WHEREAS,Section 12, Article II of the 1987 Philippine Constitution states thatr "The
State recognizes the sanctity of family life and shall protect and strengthen the family as a
basic autonomous social institution. It shall equally protect the life of the unborn from
conception. The natural and primary right and duty of parents in the rearing of the youth for
civic efficiency and the development of moral character shall receive the support of the
Government'",

WHEREAS,under Section 16 (Welfare Clause) of Republic Act 7160, otherwise known


as the Local Government Code of 1991, provides that local government units shall ensure
and promote the health and safety of the people;

WHEREAS, death rates, percentage of fully-immunized children (FIC), infant and


young child feeding (IYCF) are widely recognized as valuable measures of child well-being,
particularly when viewed with the context of two decades of demographic changes in the
country;

WHEREAS, the loss of a loved one is perhaps the greatest loss to the family, friends
and community and often represents untold sufferings and unfulfilled dreams and
aspirations;

WHEREAS, it is of prime importance that the Local Government Unit (LGU) be


provided with the necessary data relative to the health and general well-being of its
constituents, for them to have a conclusive basis in the formulations of its policies;

NOW THEREFORE, on motion of City Councilor RosaIita T. Nunez, duly seconded by


City Councilors Elizabeth B. Bagonoc, Alberto D. Pacquiao, Jose Orlando R. Acharon,
ShandeeTheresa O. tudo-Pestano, Ramon R. Melliza and Brix T. Tan, be it -

RESOLVED,as it is hereby resolved, to adopt the following ordinance.

ORDINANCE NO. 57
Series of 2018

AN ORDINANCEINSTITUTIONALIZINGTHE INFANT AND CHILD DEATHREVIEWPROGRAM


(ICDRP) OF GENERALSANTOS CITY, PROVIDING FUNDS THEREFORAND FOR OTHER
PURPOSES

Be it enacted by the Sangguniang Panlungsodof General Santos City that:

Section 1. Short Title. - This ordinance shall be known as the (ICDRP)"Infant and
Child Death Review Program of General Santos City."

Section 2. Objectives of the Infant and Child Death Review Program (ICDRP).- The
following are the objectives of Infant and Child Death Review Program of General Santos
City:

a) Collaborate with local agencies, non-government organizations


and prevention experts to recommend and implement effective
strategies to keep children safe.

b) Identify all infant and child related deaths.

c) Improve communication and linkages among local and other-


agencies and enhance coordination of efforts.

d) Develop a statistical description of all child deaths as an overall


indicator of the status of children.

e) Identify and advocate for needed changes in legislation, policy


and practices and expanded efforts in child health and safety to
prevent child deaths.

f) Increase public awareness and advocacy for the issues that affect
the health and safety of children.

g) Develop recommendations for preventing and responding to child


deaths based on said reviews and statistical information.

Section 3. Definitionof Terms.- As used in this Ordinance, the following terms shall
mean:

a) Child Death - refers to the death of a child, one to seventeen


years of age.

b) IMAP - refers to Integrated Midwives Association of the


Philippines

c) Infant Death - refers to the death of any child below 5 years old.

d) PMA - refers to Philippine MedicalAssociation.

Section 4. Institutionalization of the Infant and Child Death Review Program


(ICDRP).- There is hereby institutionalized the Infant and Child Death Review Program of
General Santos City.

Section 5. Creation and Compositionof Infant and Child Death Review Team
(ICDRT).- The Infant and Child Death Review Team (ICDRT) is hereby created to be
composed of the following:

Members
• SPCommittee Chairperson on Health and Sanitation;
• Chief of Hospital, Dr. Jorge P. RoyecaCity Hospital;
• CHO-HealthEducation and Promotion Officer;
• Provincial Department of Health Officer;
• President, United Private Midwives Associations of
General Santos City;
• President of Philippine Pediatric Society General Santos
City Chapter;
• President of the Private HospitalsAssociation of General
Santos City;
• President of the Members of the Barangay Council on
Health Committee.

Focal Person City Health Officer

Section 6. Functionsof the Infant and ChildDeath ReviewTeam.- The ICDRT shall
have the following functions:

a) Identify how and why infant and child die in order to facilitate the
creation and implementation of strategies to prevent future infant
and child deaths.

b) Develop a system for review and remedial follow-up actions.

c) Formulate and recommend to the Sanggunian the full
implementation of a comprehensive ICDRP plan in consultation
with other stakeholders and oversee its implementation;

d) Share comprehensive information from other hospitals, birthing


facilities and the like on the circumstances of infant and child
deaths.

e) Provide accessto available information to improve infant and child


death investigations and ensure accurate reporting.

f) Provide community education, promote awareness and/or


implement prevention strategies.

g) Make recommendations to develop or improve policies, practices


or prevention programs.

h) Make necessary reports to concerned agencies.

i) To monitor and recommend appropriate sanctions to non-


compliant institutions in the implementation of this ordinance.

Section 7. Secretariat and Focal Person. - The City Health Office shall be the
Secretariat of the Infant and Child Death Review Program and focal person.

a.) The focal person shall have the following functions:

i. Provide technical and administrative support, consolidating and


documenting proceedings, and managing overall implementation of
the ICDRPplans and complementary actions.

ii. Provide other assistanceas may be required by the Program.

iii. Submit an annual report on all activities regarding the status of the
program and its finances to the City Mayor and to the Sangguniang
Panlungsod.

b.) The Secretariat shall have the following functions:

i. To facilitate the call of Regular and Special Meetings;

ii. To prepare the Minutes of the Meeting for adoption;

iii. To monitor and follow-up business arising from the previous


minutes;

iv. To prepare periodic reports of the findings and other reports as


required for the approval of the team and subsequent submission to
the City Mayor;

v. To prepare the budget proposal for the team;

vi. To keep records of the team.

Section 8. Submission of Reports.-

1) All private and public hospitals, lying-in clinics, birthing homes, BHWs
are required to submit to the nearest RHU a monthly report every 1st
week of the preceding month.

2) All RHUs are required to submit to the focal person through the
Secretariat all reports submitted by the Iying-in-clinics/birthing homes,
hospitals within their area of responsibility seven (7) days after the end
of the preceding month.

Section 9. Sanctions. - The following penalties will be imposed on hospitals, lying-in


clinics/birthing homes and RHUs on any violation of the provision of Section 8 of this
ordinance.

a) 1st Offense - a fine of P3,000.00


b) 2nd Offense- a fine of P5,000.00
c) 3rdOffense- closure of the institution

All fines collected will accrue to the General Fund.

Section 10. Meeting. - The ICDRT shall meet at least once in every quarter or as
often as necessary at an expressed call of the chairperson or at least fifty percent plus one
(500/0 +1) members of the team. Provided, that a notice shall be sent to the members at
least three (3) days before the meeting will be held.

Section 11. Terms of Office. - The term of office of the Infant and Child Death
Review Team shall be three years or co-terminus with the appointing authority.

Section 12. Funding. - The amount necessary to carry out the provisions of this
ordinance shall be taken from the General Fund.

Section 13. Repealing Clause. - All previous ordinances and provisions inconsistent
with this ordinance are hereby repealed or modified accordingly.

Section 14. Separability aeose, - If for any reason any part or provision of this
ordinance shall be held unconstitutional or invalid, other parts or provisions hereof which are
not affected thereby shall continue to be in full force and effect.

Section lS. Effectivity. - This ordinance shall take fifteen (15) days after its
publication in a newspaper or general circulation within General Santos City.

Enacted by the 18th Sangguniang Panlungsod, City of General Santos, on its 98th
Regular Sessionheld on September 25, 2018.
