The paper addresses the role of the International Labour Organization (ILO) in the consideration of cases and in the interpretation of international human rights instruments by the Committee on Economic, Social and Cultural Rights and the European Court of Human Rights. As labour rights form part of internationally recognized human rights the author attempts to evaluate the penetration of ILO standards and legal reasoning into the adjudication of human rights cases and interpretation of human rights instruments by other international bodies. The analysis of the jurisprudence of the CESCR and the ECtHR demonstrates that the ILO standards and the legal reasoning are always referred to in the cases related to labour rights and serve as a source of "substantial filling" of both the International Covenant on Economic, Social and Cultural Rights and the European Convention on Human Rights.

Purpose. The research was undertaken to estimate the perspectives of wage claims under the ECHR and investigate whether the provisions of the Convention might be referred to in the claim for decent wage. Design/methodology/approach. The paper investigated the approach of the European Court of Human Rights to wage claims (non-payment, reduction or deductions from wages), considering relevant case law under the article 1 of Protocol 1(property rights) and article 3 (degrading treatment) of the ECHR. Findings. The Court perceives salary as a payment which is protected under Article 1 of the Protocol 1. Such approach entitles employees to bring claims on the lack of payment before the ECtHR, as well as claims on the reduction of wages or excessive deductions. Digitalization progresses represent huge challenges to employee’s privacy at work, in particular taking into account the e-monitoring issues. Even though a number of European and International instruments provide legal framework for employee’s privacy protection at work, information and communication technologies (ICTs) used for monitoring in the workplace require the elaboration of a deeper understanding of what privacy at work is and what are the boundaries of employer’s managerial power. Work-related stress is also one of the consequences of e-monitoring. Hence, the legal challenge will be to develop a concept of the employee’s right to control the e-monitoring practises. The history of the development of the European Convention on Human Rights represents a unique experience of widening the scope of protection of an international instrument from classical political and civil rights to certain social and economic rights. With a particular focus upon the protection of labour rights under the European Convention, the author researches the roots of expansion of the Convention, analyzing the process of drafting and the capabilities theory of A. Sen, and the application of Convention as a “living instrument”. The paper traces how the judgments of the European Court in social matters contribute to the development of the relevant legislation of the states and establish enforceable standards of human rights protection.

In the diversity of national approaches to the problem of protection of employees’ privacy at work, the jurisprudence of the European Court of Human Rights provides a priceless framework for the consideration of cases concerning employee’s privacy. Even though the term “privacy” was not used by the Strasbourg Court, its broad interpretation of the right to respect for private life significantly contributed to the protection of personal data, elaborating positive obligations of the states. In the field of regulatory instruments in the social field, the European Convention on Human Rights (ECHR) and the related jurisprudence of the Court of European Court of Human Rights (ECtHR) deserves renewed focus. In recent years considerable debate has developed over the relationship between social rights and human rights, and the jurisprudence of the ECtHR has clearly demonstrated the growing value of human rights in the workplace. This paper argues the possibility of establishing common principles of protection from psychosocial risks (PSR) on the basis of the legal positions of the European Court of Human Rights (the Court) expressed in recent cases on degrading treatment and occupational health. The author focuses on the positive obligations of the States to ensure the protection of the right for life and of the right to respect for private life. The prohibition of degrading treatment in relations between private persons is also considered as relevant to the issue of the protection from PSR. Analyzing the Court's case law (judgments of the Court) we substantiate the possibility of claiming protection from PSR under the European Convention on Human Rights, namely, articles 2, 3 and 6, 8.

The paper investigates the implementation of two new norms in post-Soviet labor law: the right to strike and the prohibition of discrimination. The paper consists of three parts: the first presents general reflections about Russian legal culture as it is the key to understanding the background of labor law developments; the second is dedicated to an analysis of the right to strike in Russia as a prerequisite of the right to collective bargaining and as an indicator of the efficiency of the social dialogue system; and the final section explores the implementation of the prohibition of discrimination in Russia.

The article is devoted to the problems of realization of the right to strike in Belarus and Russia. The article considers the conception of strike in Russia and Belarus. The strike procedure is analyzed in detail. The authors have revealed a number of problems in the organization of the strike: in holding the strike in a structural division of the organization, in making a decision on holding the strike, in notifying the employer of the planned strike, in suspending the strike, etc. It is rather difficult for employees to exercise the right to strike and after the collapse of the USSR, there has been no legitimate strikes in the independent Republic of Belarus. The article provides statistical data. The article analyzes the compliance of the national legislation of Belarus and Russia with international standards. The authors estimate the influence of international organizations on the change of labour legislation in Russia and Belarus. The judicial practice on cases of recognition of strikes as illegal is considered. The practice of the European Court of Human Rights is analyzed. The authors consider if the right to strike can indeed be protected in Russia and Belarus through bringing claims to international human rights bodies and through the help of ILO.

В статье исследуется понятие подходящей работы, закрепленное в ч. 3 ст. 4 ФЗ РФ «О занятости населения в РФ» в свете конвенций МОТ, Европейской социальной хартии, Европейской конвенции по правам человека, а также Пакта ООН об экономических, культурных и социальных правах. Этот анализ приводит нас к выводу о том, что определение работы как подходящей вне зависимости от соответствия работы профессиональной квалификации гражданина, в некоторых случаях свидетельствует о дискриминации этих категорий граждан. Кроме того, такой подход является нарушением права человека на свободный выбор профессии. We consider this concept in light of the Constitution of the Russian Federation and of the international instruments. This analysis leads us to conclusion that the regulations of suitable employment do not provide a reasonable and fair consensus between the individual characteristics of the citizen, his aspirations in the field of work and the interests of society, while special rules established for particular groups of people are discriminatory and in some cases might amount to the violation of the prohibition of forced labour and to infringing the right of the worker to free choice of the occupation. Понятие «подходящей работы» является одним из ключевых в российском законодательстве о занятости, оно необходимо для определения того, действительно ли человек ищет работу и готов к ней приступить. Статья 4 ФЗ «О занятости населения в РФ» (далее Закон о занятости) содержит два определения: согласно общему определению, данному в ч. 1 ст. 4, подходящей считается такая работа, в том числе временная, которая соответствует профессиональной пригодности работника с учетом уровня его квалификации, условиям последнего места работы (за исключением оплачиваемых общественных работ), состоянию здоровья, транспортной доступности рабочего места. В статье рассматриваются наиболее важные решения Европейского суда по правам человека (ЕСПЧ), имеющие отношение к защите трудовых прав граждан. Автором проанализированы дела, которые были рассмотрены данным органом судебной власти в течение последних лет по ст. 3, 4, 8 и 11 Европейской конвенции о защите прав человека и основных свобод 1950 г. (ЕКПЧ), в частности, о расследовании несчастных случаев на производстве, запрете принудительного труда, защите частной жизни работников и обеспечения их права на свободу выражения мнения и объединения. Исследование позволило сделать вывод, что Европейская конвенция является важным инструментом в области защиты права на уважение частной жизни сотрудника на работе. Европейский суд по правам человека разработал систему оценки действий работодателя по контролю за выполнением работников своей трудовой функции (видеозапись, просмотр электронных сообщений, прослушивание телефона) в свете ст. 8 Европейской конвенции. Эта система должна использоваться и национальными судами при рассмотрении дел, связанных с неправомерной, по мнению работника, формой контроля. Расширенное толкование понятия принудительного труда и торговли людьми, данное Европейским судом в решении по делу Chowdury and оthers v. Greece, как включающее в себя также невыплату задолженности по заработной плате, что ставит работников в уязвимое положение, также чрезвычайно важно для российской практики. Прочтение понятия «торговли людьми» как преступления, предусмотренного ст. 127.1 Уголовного Кодекса Российской Федерации, позволило бы обеспечить более эффективную защиту самым незащищенным группам населения (например, внутренним и внешним мигрантам, инвалидам). Автор подчеркивает важность выводов ЕСПЧ в решении по делу «Огневенко против России», свидетельствующих о том, что общий запрет забастовок сотрудников железной дороги, предусмотренный ст. 26 Федерального закона «О железнодорожном транспорте в Российской Федерации» от 10.01.2003 № 17-ФЗ, несовместим со стандартами в области прав человека, а именно с положениями ст. 11 Европейской конвенции.

Абстракт В статье исследуется понятие подходящей работы, закрепленное в ч. 3 ст. 4 ФЗ РФ «О занятости населения в РФ» в свете конвенций МОТ, Европейской социальной хартии, Европейской конвенции по правам человека, а также Пакта ООН об экономических, культурных и социальных правах. Этот анализ приводит нас к выводу о том, что определение работы как подходящей вне зависимости от соответствия работы профессиональной квалификации гражданина, в некоторых случаях свидетельствует о дискриминации этих категорий граждан. Кроме того, такой подход является нарушением права человека на свободный выбор профессии. The main objective of this paper is to provide a critical overview of the new Russian and Kazakh legislation by comparing it with the norms of the European Framework Agreement and exploring the possible ways of protecting teleworkers' rights in Belorussia and Ukraine in the lack of special provisions. The article will comprise of three parts: the first one will trace Russian experience, the second will analyze the Kazakh approach to distant work, and the third part will be dedicated to the relevant policies in Ukraine and Belorussia. In the concluding part the perspectives of further development in this sphere will be evaluated. The Peculiarities of Telework in Post-Soviet Space: Russia, Kazakhstan, Belorussia, and Ukraine The spread of telework has become a strong trend in a contemporary world since 1990s labor law scholars and national (as well supranational) governments and social partners sought to establish a due legal framework for the regulation of such a type of employment contract. Much work has been done in this direction on the European level; the European Framework Agreement established the unique understanding of telework and fixed the minimum guarantees of distant workers' rights. The adoption of this agreement lead to gradual changes of national approaches to this type of work and contributed significantly to the enhancement of national labor provisions that are fixed in the legislation or in the collective agreements. In the countries chosen for the present research, the situation is completely different. Trade unions do not play any important role in the elaboration of labor law provisions, and national legislation either has recently adopted certain norms on telework (as in Russia or Kazakhstan) or does not deal with this matter (as in Belorussia and Ukraine). The main objective of this paper is to provide a critical overview of the new Russian and Kazakh legislation by comparing it with the norms of the European Framework Agreement and exploring the possible ways of protecting teleworkers' rights in Belorussia and Ukraine in the lack of special provisions. The article will comprise of three parts: the first one will trace Russian experience, the second will analyze the Kazakh approach to distant work, and the third part will be dedicated to the relevant policies in Ukraine and Belorussia. In the concluding part I will evaluate the perspectives of further development in this sphere and estimate whether national legislation is likely to provide adequate and equal protection to teleworkers in future.

This chapter explores the employee’s protection from the psychosocial risk of harassment in France and Italy. France has adopted legal provisions on this matter and explicitly acknowledged psychological risk as an occupational risk, while in Italy protection was developed through judicial interpretation of the employer’s obligation to protect the employee’s physical integrity and moral personality. Having identified the differences in the two national approaches to the risk of harassment, this chapter investigates which of these approaches could serve as vector for the development of protection from harassment in Russia, where psychological risk is not yet acknowledged.

The paper establishes the ways the European Court of Human Rights applies international labour standards and refers to comparative research of national labour legislations when adjudicates cases related to labour rights. In the first part the author researches the meaning of the “living” character of the European Convention on Human Rights (ECHR) and the outcomes of Convention evolutionary interpretation in cases related to labour law. The second part investigates the references to the international instruments other than the ECHR in the ECtHR’s case law and traces the contributions of the ILO standards to the development of labour rights protection. The third part follows the use of comparative research of national labour legislations by the ECtHR and argues its particular impact on anti-discrimination protection and on the protection of the freedom of association.

Автор рассматривает вызванные экономическим кризисом изменения в коллективном трудовом праве Италии и Испании, направленные на децентрализацию коллективно-договорного регулирования.Изученный опыт Испании и Италии является лишь одной из иллюстраций общего процесса децентрализации коллективного регулирования трудовых отношений. Автор утверждает, что этот процесс будет иметь глубокие последствия для трудового права в целом. Он приведет к еще большему снижению количества работников, на которых распространяется действие коллективных соглашений (в Испании, например, эта цифра с 85 процентов до кризиса снизилась до 57,8 процентов в 2011 году ) и, как полагают некоторые исследователи, к разрушению коллективного трудового права.  Децентрализация приведет к еще большему ослаблению правового положения и без того слабой стороны трудового договора – работника,  к усилению неравенства в обществе и подрыву социальной стабильности.

Настоящая статья посвящена изучению вклада Европейского суда
по правам человека в защиту права на заработную плату. В первой части рассмотрены особенности подхода Европейского суда по правам человека (ЕСПЧ, Суд) к данной категории дел и проанализированы немногочисленные решения ЕСПЧ, которые позволяют сделать вывод о правовых позициях Суда в отношении вычетов из заработной платы и чрезмерного налогообложения, о правах работников на дополнительные выплаты, о возможных границах применения мер строгой экономии в виде урезания
заработной платы государственных служащих.
Во второй части автор рассмотрит теоретическую возможность применения норм Европейской конвенции по правам человека (ЕКПЧ) к защите права работников на достойную заработную плату посредством широкого токования запрета, унижающего достоинство обращения, предусмотренного статьей 3 ЕКПЧ.

Globalization, increase in competitiveness, progressing economic integration and the “austerity”
measures due to the European Union (EU) actions during the last economic crisis, especially
in so-called GIPSI countries, have strongly deteriorated the relationship between social rights and
economic freedoms. This made international instruments for protection of social rights more relevant
than ever for resisting this re-balance. The aim of this article is to research the contributions of the International
bodies to this prosess and reveal their actual role in the sphere of protection of social rights.

При разработке Европейской Конвенции о защите прав человека и основных свобод была очевидна её направленность на защиту
прежде всего гражданских и политических прав граждан. Признание Европейским Судом по правам человека отсутствия чёткой гра-
ницы между гражданскими/политическими и социальными/экономическими правами было значительным достижением, которое
позволило предоставлять защиту и некоторым социально-экономическим правам, которые не были прямо предусмотрены в Конвен-
ции. В настоящей статье рассмотрены возможные философские предпосылки включения социально-экономических прав в защитную
сферу Конвенции, приведены примеры расширенного толкования права на свободу объединения (статья 11) и права на уважение
собственности (статья  1 Протокола № 1 к Конвенции). В настоящей работе анализируется включение в защитную сферу Конвенции
новых социально-экономических прав в результате эволюционного подхода («расширяющегося со временем» или просто «широкого
подхода к толкованию») к запрету пыток и унижающего человека обращения (статья 3), а также к нормам статьи 8 о праве на уваже-
ние частной жизни. Автор утверждает, что, несмотря на интегрирование многих социальных прав в результате признания неделимо-
сти прав человека, уровень защиты новых социально-экономических прав значительно уступает уровню защиты традиционных для
Конвенции гражданских и политических прав, что обусловлено, в первую очередь, более широкой степенью усмотрения государств
в принятии и реализации социальной политики.

This paper argues the possibility of establishing common principles of protection from psychosocial risks (PSR) on the basis
of the legal positions of the European Court of Human Rights (the Court) expressed in recent cases on degrading treatment
and occupational health. The author focuses on the positive obligations of the States to ensure the protection of the right for
life and of the right to respect for private life. The prohibition of degrading treatment in relations between private persons is
also considered as relevant to the issue of the protection from PSR. Analyzing the Court’s case law (judgments of the Court)
we substantiate the possibility of claiming protection from PSR under the European Convention on Human Rights, namely,
articles 2, 3 and 6, 8.

Конвенции по правам человека, применяемого Европейским судом по правам человека при
рассмотрении дел о защите трудовых прав и прав в области социального обеспечения. Нами
выделено два основных метода установления содержания статей Конвенции – обращение к
актам МОТ и Европейской социальной хартии, а также к сравнительному опыту других стран,
для определения общих тенденций в области защиты социальных прав граждан.

В работе последовательно рассмотрена история формирования эволюционного подхода к толкованию Конвенции, а
также примеры пересмотра и создания новых правовых позиций Европейским судом.

of the Court’s most recent case law – cases considered in
the period from 1963 to 2016 – on fundamental
employment rights such as the right to wages, protection
from discrimination and unfair dismissal, the right to
occupational safety at work, and civil liberties such as the
freedom of association, the freedom of religion and
expression, and the right to privacy.
Drawing on close scrutiny of 347 cases since 1963, the
author traces the evolutionary development of the Court’s
positions on labour rights as human rights through case
analyses, commentary, and general conclusions in each of
several categorical groupings.
