The aim of this paper is to discuss the relation between the notion of equality of opportunity and the Fairness System of Priority of Access to Education designed and carried out by the University of Chile. I try to identify the moral bases of such proposal and their implications. My approach is highly Rawlsian in nature.

This article addresses Rawls´s critique of utilitarianism in the framework of the discussion on the moral foundation of the principles of justice. It is shown the principle of utility lacks the necessary moral constraints that ensure both effective recognition among people and a fair distribution of the social bases of self-respect. Rawls's arguments against classical utilitarianism fall into two groups: first those who are independent of the contractual dimension of his theory, then those that are the result of the original position and the veil of ignorance. It is concluded that, given the relevance of the mutual recognition and self-respect for the establishment of a just society, the principle of utility cannot be a moral alternative for the organisation of the main social institutions.

Cuando los miembros de una sociedad se preguntan acerca de cómo deben ser distribuidos equitativamente los beneficios, oportunidades y cargas que resultan de la cooperación social se hacen una pregunta normativa sobre cómo debe ser establecida tal distribución. Cuando esta pregunta normativa apunta a identificar los criterios que deben guiar a las personas, grupos y comunidades hablamos en consecuencia de una ética de la distribución. Cuando esta pregunta normativa lleva esos criterios éticos a la evaluación de las prácticas e instituciones sociales y políticas respecto de beneficios, oportunidades y cargas socialmente escasos, hablamos de teorías de justicia distributiva. Y cuando nos preguntamos qué criterios distributivos deben diseñar y organizar el conjunto de instituciones sociales, políticas y económicas que conforman un Estado nacional o un conglomerado de naciones, estamos en presencia de una reflexión que la filosofía política contemporánea denomina justicia social. Contribuir con una reflexión en torno a algunos problemas que la justicia social suscita es el objetivo del presente número especial. Para lograrlo hemos reunido una muestra significativa de trabajos de investigadores de América Latina que elaboran una reflexión en torno a problemas asociados con la desigualdad, la estabilidad social, el trabajo, la inmigración, la interculturalidad, la carga tributaria, la discriminación y la discapacidad.

Resumen: En este artículo discuto la importancia que tiene para la teoría de la justicia de Rawls el desarrollo del sentido de la justicia como condición para la estabilidad social. Para cumplir con dicho objetivo analizo la interpretación que Rawls ofrece de nuestra psicología moral con la finalidad de evaluar su rol en la aceptación de los principios de justicia, así como las razones para fundar dicha estabilidad en determinados sentimientos morales. El análisis anterior me permitirá concluir que la búsqueda de bases naturales para fundar los sentimientos morales constituye para Rawls una vía alternativa tanto al deductivismo moral, así como a cualquier forma de fundamentación metafísica de los principios que guían nuestras prácticas sociales
Abstract: Since one of the major aim of A Theory of Justice was to argue for the stability of a well-ordered society, In this paper I discuss the importance of the sense of justice to achieve that stability. I analyse the interpretation of our moral psychology in order to show its importance in the justification of the principles of justice that would promote social stability. Such analysis allows me to conclude that the search for natural bases to found moral feelings constitutes for Rawls an alternative to any deductive and metaphysical justification of our social practices

Resumen: En este artículo discuto la relevancia que tiene el autorrespeto en la teoría de la justicia de Rawls. Para alcanzar dicho objetivo, en primer lugar examino las nociones de valor moral y mérito y su vinculación con el autorrespeto como forma de autovaloración. En segundo lugar, especifico las bases que sustentan el autorrespeto al interior de su teoría. Finalmente, discuto la función que tiene el autorrespeto en la justificación de los principios de la justicia como equidad.

Para quienes tengan interés en la filosofía moral y política contemporánea la obra de John Rawls es sin discusión una parada necesaria. De hecho, la tesis de Robert Nozick según la cual resulta imposible hacer filosofía moral y política sin considerar el marco ofrecido por Rawls, aunque parezca extrema, resulta bastante acertada. En gran medida el impacto de la obra de Rawls radica en su interés por ofrecer una teoría sustantiva de la justicia, teoría que hundiendo sus raíces en la tradición de la filosofía sea capaz de orientarnos al momento de abordar las discusiones contemporáneas sobre justicia social.
En los trabajos que componen este libro el lector podrá encontrar una discusión actualizada sobre aquellos elementos que definen la base moral y política que Rawls presentó como fundamento de su teoría de la justicia. Al mismo tiempo, estos ensayos intentan construir un puente entre la justicia como equidad y otras tradiciones de la filosofía moral y política contemporánea. Para lograr este último fin, varios de los trabajos que aquí se presentan consideran las ideas de reconocimiento y autorrespeto como claves de interpretación de la obra de Rawls

In this paper, I discuss the relevance of the sense of justice for Rawls's theory of justice. In the first part, I analyse the interpretation that Rawls offered of moral psychology for evaluating its role in the generation of the sense of justice and the acceptance of the principles of Justice. In the second part, I discuss the difficulties of accepting Rawls's proposal. Finally, I conclude that the research on moral psychology developed by Rawls allows him to recognise a way of supporting his principles of justice that is different from the traditional forms of deductive justification.

In this paper, I argue that in the context of the redistribution-recognition debate, Rawls developed a theory of justice that exceeds the margins of allocative justice and has good arguments to deal with demands of social change and recognition. I propose that some criticism of the Rawlsian conception of social justice confuses allocative justice with distributive justice. In doing this, they not only understand Rawls's conception of primary goods as measuring staff, but they also reject their moral dimension. Finally, I examine the concepts of reciprocal recognition and self-respect to improve and expand the discussion about Rawlsian distributive justice.
