Resumo: Os estudos sobre o diálogo da inteligência artificial com o direito parecem geralmente as... more Resumo: Os estudos sobre o diálogo da inteligência artificial com o direito parecem geralmente assumir caráter futurista, focando em situações que ainda não ocorreram. Abordamos aqui um tema mais palpável: a possibilidade de aplicar essas tecnologias na análise e na produção de documentos jurídicos, como petições, contratos ou despachos judiciais/administrativos. Para tanto, inicialmente, serão expostos alguns conceitos técnicos e o desenvolvimento histórico da informática jurídica. Em seguida, aborda-se o diálogo entre a linguagem computacional e a linguagem jurídica, em especial a formalização e modelização desta última. Para tornar a explicação mais compreensível, expõe-se como essas ferramentas estão sendo implementadas no Brasil e no resto do mundo, fazendo ainda comentários críticos sobre suas limitações em nível prático.
Abstract: Studies on the dialogue between artificial intelligence and law generally seem to assume a futuristic character, focusing on situations that have not yet occurred. This article seeks to address a more palpable theme: the possibility of applying these technologies in the analysis and production of legal documents, such as petitions, contracts, or judicial/administrative orders. To this end, initially some technical concepts and the historical development of legal informatics will be exposed. Then, the dialogue between computational language and legal language is addressed, especially the formalization and modeling of the latter. In order to make the explanation more understandable, it explains how these tools are being implemented in Brazil and in the rest of the world, making critical comments about their limitations on a practical level.

A coleta de dados disponibilizados em sites públicos, em especial através de técnicas de web craw... more A coleta de dados disponibilizados em sites públicos, em especial através de técnicas de web crawling e web scraping, possibilita alimentar bases de dados para diversas finalidades. A partir do cruzamento desses dados entre si ou com outras bases de dados, é possível inferir informações adicionais sobre pessoas, órgãos públicos ou empresas, por exemplo. Com a crescente informatização do processo judicial no Brasil, estas técnicas vêm sendo aplicadas para a extração de informações do texto de decisões judiciais e documentos processuais. Neste contexto, o presente artigo busca avaliar o aparente conflito entre o direito à proteção de dados e o princípio da publicidade dos atos processuais, demonstrando experiências positivas na União Europeia e apontando para futuros desafios no cenário brasileiro.
A aceleração tecnológica do capitalismo digital tem como um de seus elementos a ênfase na coleta ... more A aceleração tecnológica do capitalismo digital tem como um de seus elementos a ênfase na coleta de dados-em especial, dados pessoais-como matéria-prima para a operação de algoritmos computacionais. Em meio a tal fenômeno, percebe-se uma crescente coleta de informações referentes a características corporais humanas por meio de tecnologias biométricas como o reconhecimento facial. Neste contexto, o presente artigo busca analisar o fenômeno da digitalização do corpo humano, pelo referencial teórico dos estudos de vigilância e da biopolítica. Observa-se uma objetificação do corpo pelas tecnologias biométricas, fenômeno este que serve aos interesses de Estado, como a segurança pública, bem como à lógica do mercado de comodificação de informações pessoais. Com este percurso teórico, passa-se a uma breve análise de dois casos judiciais que envolvem o metrô de São Paulo, que consistiram no uso intrusivo de reconhecimento facial de seus usuários para fins publicitários e de segurança pública. O exame dos casos possibilita a demonstração da necessidade de instrumentos jurídicos de proteção aos dados pessoais, bem como os limites de uma tutela puramente jurídica fundada na privacidade.
[en] Questioning the right to privacy and data protection in light of biometric surveillance Abstract. One of the elements of technological acceleration in digital capitalism is the emphasis on data collection-in particular, personal data-as raw material for the operation of computational algorithms. In the midst of this phenomenon, there is a growing collection of information regarding human body characteristics, gathered by biometric technologies such as facial recognition. In this context, this article seeks to analyze the phenomenon of digitalization of the human body, using the theoretical framework of surveillance studies and biopolitics. There is a noticeable objectification of the body by biometric technologies, a phenomenon that serves the interests of the State, such as public security, as well as the logic of the market for the commodification of personal information. With this theoretical path, a brief analysis of two judicial cases involving the São Paulo subway is carried out, which consisted of the intrusive use of facial recognition of its users for advertising and public security purposes. The examination of these cases makes it possible to demonstrate the need for legal instruments to protect personal data, as well as the limits of a purely legal protection based on privacy.

O presente trabalho tem como objetivo delinear possíveis impactos da Lei Geral de Proteção de Dados Pessoais (Lei 13.709/2018) na atividade dos arquivos públicos, visando demonstrar a conflitiva relação entre privacidade e direito à informação. Toma-se como objeto de discussão, outrossim, a sensibilidade dos documentos produzidos por órgãos repressivos da ditadura civil-militar, o que ilustra de forma ímpar o atrito entre os dois direitos. Para tanto, é empreendido um estudo teórico por meio da produção bibliográfica sobre história e arquivística, bem como comentários em bases jurídicas e doutrinárias. A nova Lei permite o tratamento de dados para a realização de estudos por órgãos de pesquisa, de modo que outras modalidades de atividades arquivísticas devem observar as normas gerais para o tratamento pelo poder público. Constata-se que, estando em jogo o interesse público, o conflito entre proteção de dados e direito à informação põe em risco a construção da memória coletiva e até mesmo a qualidade da pesquisa histórica.
[en] This paper aims to outline possible impacts of the General Law on Personal Data Protection (Law 13.709 / 2018) on the activity of public archives, in order to demonstrate the conflicting relationship between privacy and the right to information. As an object of discussion, we also focus on the sensitivity of the documents produced by repressive agencie s of the civic-military dictatorship, which illustrates in a unique way the friction between these two rights. To this end, a theoretical study is undertaken through bibliographical production on history and archival, as well as comments on legal and doctrinal bases. The new law allows the processing of data for studies by research agencies, and therefore other modalities of archival activities must comply with the general rules for processing by public authorities. As the public interest is at stake, the conflict between data protection and the right to information endangers the construction of collective memory and even the quality of historical research.

Com a proximidade da aprovação da Diretiva do Parlamento Europeu e do Conselho relativa aos Direi... more Com a proximidade da aprovação da Diretiva do Parlamento Europeu e do Conselho relativa aos Direitos de Autor no Mercado Único Digital e da sua implementação nos Estados-membros da União Europeia, é essencial uma análise do seu artigo 13, que inicialmente implementaria a obrigatoriedade de filtros de conteúdo que automaticamente impedissem o upload de conteúdo que desrespeitasse direitos autorais. O objetivo do presente artigo é o de fazer uma análise técnica dos diferentes modelos de filtragem de conteúdo, compreendendo quais tipos de conteúdo se encaixam e como dentro destas tecnologias, observando suas limitações tanto técnicas quanto às limitações da sua utilização pelo direito, aproximando os conhecimentos práticos e o estado da arte desses algoritmos às discussões do direito. Para além da análise dos próprios filtros e do artigo proposto, busca-se diagnosticar o impacto que a aprovação da dita Diretiva terá nos ambientes online europeus e na sociedade da informação como um todo, focando na clara incompatibilidade da proposta com a liberdade de expressão, utilizando o impacto da aprovação da proposta nos memes e na liberdade artística como exemplos. De maneira geral, o artigo afirma que, por diversas incompatibilidades, sejam elas materiais, nas altas margens de erro encontradas nos filtros, sejam elas relacionadas à subjetividade inerente à análise dos direitos autorais, nem em 2018 e nem em nenhum futuro próximo previsível será possível uma automação da análise dos direitos autorais sem enormes danos tanto para a própria matéria quanto para os direitos fundamentais e a sociedade como um todo.
