not deny the int... more In Although populism remains as a marginal concept in political studies, one can not deny the interest that it has awakened on several scholars all around the world, through all the 20th century and currently. Even when a definition has been elusive and approaches differ greatly on their judgment we believe the discussion has been far from idle. On the one hand through this polemic a peculiar field has come to be; with its historical debates, its attempts to forge categories or to discredit them, the studies about populism have risen a horizon of their own. On the other hand discussing populism, a term as conflicting as it is, keeps bringing us the opportunity to reflect on other notions as crucial to politics as democracy, republic, emancipation, authoritarianism, representation and others.
This paper aims to show that the Law and Economics movement from Chicago (Becker, Posner) has att... more This paper aims to show that the Law and Economics movement from Chicago (Becker, Posner) has attempted to solve the problem of in-terpersonal comparison of utilities by means of a fallacy. This fallacy is made of the aggregation of individual preferences as if they were cardinal magnitudes, not ordinal ones. By doing so, the discussions of the public reason about welfare and justice are misled provided that the guidelines founded in the Theory of Moral Sentiments by Adam Smith (one of the authors to whom Posner assigns the philosophical foundation of Law and Economics) are true. According to the moral philosophy of Adam Smith, not utilitarian calculus, but simpathy-the capacity of putting himself in the situation of the others by means of imagination-was to develop the central role in the discussions of public reason (the " impartial spectator ") about welfare and justice.

They argued that the subjective theory of value advanced by the first generation of Austrian economists was rooted in Aristotle. We claim here, although, for a biased reception of the Aristotelian conception of value among Austrian revisionists, and we suggest some clues in order to recover the genuine dimension of the Aristotelian conception of economic value
El propósito del presente trabajo es analizar la teoría de la justicia elaborada por el juez esta... more El propósito del presente trabajo es analizar la teoría de la justicia elaborada por el juez estadounidense Richard Posner, uno de los máximos exponentes de la escuela del Análisis Económico del Derecho. Dicha teoría es presentada en contraposición a la teoría moral conocida como utilitarismo-cuya formulación canónica corresponde a Jeremy Bentham y John Stuart Mill-, ante todo para mostrar por qué el Análisis Económico del Derecho no puede considerar la igualdad o equidad como una nota fundamental y propia de la justicia. El trabajo está compuesto de tres partes. Primera: el análisis del tratamiento que la justicia recibe en la teoría económica a través de la distribución del ingreso, y los límites y dificultades que las políticas redistributivas deben enfrentar. Segunda: el estudio de las bases filosóficas de las que parte Richard Posner para desalentar cualquier política " redistributiva ". En esta segunda parte se analizan las líneas fundamentales de su " teoría de la justicia " , su contenido y formalización, teniendo en cuenta los elementos que, según el autor, una auténtica teoría moral debe poseer. Tercera: un balance crítico de la teoría a la luz de las conclusiones a las que arriba Posner. En el presente trabajo se discute la pretensión del jurista norteamericano Richard Posner de redu... more En el presente trabajo se discute la pretensión del jurista norteamericano Richard Posner de reducir el Derecho y la Ciencia Jurídica a la Economía y al Análisis Económico.
Al tal efecto se intenta responder primero la pregunta de si es posible abordar la complejidad del fenómeno jurídico mediante el método específico de la economía neoclásica, transformando las diversas disciplinas que estudian dicho fenómeno (Teorías de la Argumentación Jurídica, Teoría General del Derecho, Hermenéutica Jurídica, entre otras) en otras tantas aplicaciones del Análisis Económico del Derecho. En segundo lugar, y tras haber mostrado que lo primero es sólo posible en las estrechas márgenes de un reductivismo epistemológico que despoja de su contenido específico al Derecho, se analiza la cuestión más compleja de si es posible, con todo, incluir el análisis económico como un elemento más de la argumentación jurídica. En otras palabras, se estudia la posibilidad de asentar el razonamiento jurídico sobre argumentos del tipo “pareto-eficientes” o “Kaldor-Hicks-eficientes”. Por último, se especifican las condiciones excepcionales bajo las cuales sería posible un empleo limitado de tales argumentos en el razonamiento jurídico general.

Ahondar en los supuestos filosóficos en los que se funda una determinada teoría económica formula... more Ahondar en los supuestos filosóficos en los que se funda una determinada teoría económica formulada por un determinado autor implica tres importantes tareas: 1) analizar su biografía intelectual en busca de algunas claves que permitan entender por qué dicho autor se focalizó en determinados problemas y no en otros; 2) analizar el "zeitgeist" o "tono vital de la época" para comprender cómo se relacionó ese autor con los problemas centrales de su tiempo; 3) tratar de esclarecer la imagen de hombre, de sociedad y de estado que laten detrás de la teoría en cuestión. Dichos cometidos explican el sentido parcial del presente trabajo.

un nuevo enfoque de la educación superior
qu... more La Educación Basada en Competencias (EBC) constituye un nuevo enfoque de la educación superior que ha gozado de gran predicamento en Europa desde su aprobación en el “Proceso de Bolonia”. Sin embargo, la EBC arrastra una serie de dificultades importantes que en este trabajo se ponen de manifiesto. Su sentido técnico-utilititarista constituye un obstáculo para el desarrollo del pensamiento crítico-moral, dada la reducción virtual de toda razón práctica a razón instrumental. Pero, además, las objeciones contra la enseñanza universitaria tradicional basada en contenidos teóricos se apoyan, en el caso de algunos proponentes de la EBC, en argumentaciones sofísticas que se analizan en la segunda parte de este trabajo. Por último, la recuperación de algunas destrezas y habilidades olvidadas de la ética aristotélica señala la necesidad del conocimiento teórico en el desarrollo del espíritu emprendedor e innovador que debería alentar la educación superior.

Although, beyond the empty core of its scientific rhetoric, the liberal advocates of efficiency uncover the strategy of overwhelming the moral and political issues in a swamp of data susceptible of no proof.

La presente obra de autoría colectiva ofrece atractivos e innovadores análisis sobre las diversas... more La presente obra de autoría colectiva ofrece atractivos e innovadores análisis sobre las diversas perspectivas de la legitimidad democrática que se debaten en la actualidad, tales como las que se prescriben para el Estado de Derecho desde el liberalismo, el comunitarismo, el populismo, la democracia deliberativa y el republicanismo. Cada trabajo que integra este libro puede ser leído de forma autónoma e independiente. Sin embargo, entre estos capítulos también existen importantes conexiones de sentido. A dichos trabajos los reúnen ciertas preocupaciones sobre problemas y desafíos que nos son comunes. Desde dicha perspectiva, en esta obra colectiva, diversas autoras y autores se proponen como objetivo común examinar los bordes de legitimidad democrática en el Estado de Derecho contemporáneo. Esos estudios se centran no solo en diversas experiencias teóricas y normativas, sino también en diversas experiencias institucionales que han tenido lugar en contextos situados. ¿Acaso no existen profundos y persistentes desacuerdos acerca de lo que debe entenderse por legítimo en el Estado de Derecho del siglo XXI? Sobre esta cuestión ha de reflexionar cada integrante de este prestigioso grupo académico, que participa de la presente obra con la esperanza de contribuir a tornar más robusta la legitimidad democrática del Estado de Derecho contemporáneo. Las lectoras y lectores, entonces, tienen ahora en sus manos algunas herramientas conceptuales necesarias, aunque no suficientes, para continuar la reflexión sobre este interrogante.

Cada trabajo que integra este libro puede ser leído de forma autónoma e independiente. Sin embargo, hay una importante conexión de sentido: examinar los bordes de la legitimidad democrática en el Estado de Derecho contemporáneo. Esos estudios, entonces, se centran tanto en problemas de investigación teórica y normativa, como en problemas de diseño institucional y casos empíricos, produciendo un diálogo de saberes entre la filosofía jurídica y política, la sociología, las ciencias políticas y la historia. ¿Acaso no existen profundos y persistentes desacuerdos acerca de lo que debe entenderse por legítimo en el Estado de Derecho del siglo XXI? ¿Cómo conviven la potencia transformadora de la democracia, en tanto soberanía popular, con las instituciones contrademocráticas del derecho? Jorge Mario Bergoglio, S.J., y sus estrechos colaboradores.

not deny the interest that it has awakened on several scholars all around the world,
through all the 20th century and currently. Even when a definition has been elusive
and approaches differ greatly on their judgment we believe the discussion has been far
from idle. On the one hand through this polemic a peculiar field has come to be; with
its historical debates, its attempts to forge categories or to discredit them, the studies
about populism have risen a horizon of their own. On the other hand discussing populism,
a term as conflicting as it is, keeps bringing us the opportunity to reflect on other
notions as crucial to politics as democracy, republic, emancipation, authoritarianism,
representation and others.
This work is a partial outcome of a Postdoctoral Scholarship granted by the National Council for Scientific and Technological Development of Chile (FONDECYT Postdoctorado 3120252: " Insuficiencias del análisis económico del Derecho frente a los casos difíciles. here, although, for a biased reception of the Aristotelian conception of value among Austrian
revisionists, and we suggest some clues in order to recover the genuine dimension of the

Al tal efecto se intenta responder primero la pregunta de si es posible abordar la complejidad del fenómeno jurídico mediante el método específico de la economía neoclásica, transformando las diversas disciplinas que estudian dicho fenómeno (Teorías de la Argumentación Jurídica, Teoría General del Derecho, Hermenéutica Jurídica, entre otras) en otras tantas aplicaciones del Análisis Económico del Derecho. En segundo lugar, y tras haber mostrado que lo primero es sólo posible en las estrechas márgenes de un reductivismo epistemológico que despoja de su contenido específico al Derecho, se analiza la cuestión más compleja de si es posible, con todo, incluir el análisis económico como un elemento más de la argumentación jurídica. En otras palabras, se estudia la posibilidad de asentar el razonamiento jurídico sobre argumentos del tipo “pareto-eficientes” o “Kaldor-Hicks-eficientes”. Por último, se especifican las condiciones excepcionales bajo las cuales sería posible un empleo limitado de tales argumentos en el razonamiento jurídico general.

desde su aprobación en el “Proceso de Bolonia”.
Sin embargo, la EBC arrastra una serie de dificultades
importantes que en este trabajo se ponen de
manifiesto. Su sentido técnico-utilititarista constituye
un obstáculo para el desarrollo del pensamiento
crítico-moral, dada la reducción virtual de
toda razón práctica a razón instrumental.
Pero, además, las objeciones contra la enseñanza
universitaria tradicional basada en contenidos
teóricos se apoyan, en el caso de algunos
proponentes de la EBC, en argumentaciones sofísticas
que se analizan en la segunda parte de
este trabajo.
Por último, la recuperación de algunas destrezas
y habilidades olvidadas de la ética aristotélica
señala la necesidad del conocimiento teórico en
el desarrollo del espíritu emprendedor e innovador
que debería alentar la educación superior.

Cada trabajo que integra este libro puede ser leído de forma autónoma e independiente. Sin embargo, entre estos capítulos también existen importantes conexiones de sentido. A dichos trabajos los reúnen ciertas preocupaciones sobre problemas y desafíos que nos son comunes. Desde dicha perspectiva, en esta obra colectiva, diversas autoras y autores se proponen como objetivo común examinar los bordes de legitimidad democrática en el Estado de Derecho contemporáneo. Esos estudios se centran no solo en diversas experiencias teóricas y normativas, sino también en diversas experiencias institucionales que han tenido lugar en contextos situados.
¿Acaso no existen profundos y persistentes desacuerdos acerca de lo que debe entenderse por legítimo en el Estado de Derecho del siglo XXI? Sobre esta cuestión ha de reflexionar cada integrante de este prestigioso grupo académico, que participa de la presente obra con la esperanza de contribuir a tornar más robusta la legitimidad democrática del Estado de Derecho contemporáneo. Las lectoras y lectores, entonces, tienen ahora en sus manos algunas herramientas conceptuales necesarias, aunque no suficientes, para continuar la reflexión sobre este interrogante.
Cada trabajo que integra este libro puede ser leído de forma autónoma e independiente. Sin embargo, hay una importante conexión de sentido: examinar los bordes de la legitimidad democrática en el Estado de Derecho contemporáneo. Esos estudios, entonces, se centran tanto en problemas de investigación teórica y normativa, como en problemas de diseño institucional y casos empíricos, produciendo un diálogo de saberes entre la filosofía jurídica y política, la sociología, las ciencias políticas y la historia.
¿Acaso no existen profundos y persistentes desacuerdos acerca de lo que debe entenderse por legítimo en el Estado de Derecho del siglo XXI? ¿Cómo conviven la potencia transformadora de la democracia, en tanto soberanía popular, con las instituciones contrademocráticas del derecho? Sobre esta cuestión giran las reflexiones de la presente obra, con la esperanza de contribuir a la discusión pública y al fortalecimiento de nuestras democracias.
