This publication (formally an article, de facto a book) is a wide inquiry on legal clinical education in Europe. It was sponsored by and presented in European Parliament (ARDI intergroup). In the first chapter over a hundred clinical legal programs, spread in all the Union territories, are fully monitored and examined. The second chapter presents a qualitative analysis through the interviews with some protagonists of the \u201cmovement\u201d of legal clinical education. In fact, since the comprehensive vision of this phenomenon, we can conclude that it is a \u201cmovement\u201d because we are not simply in the presence of a proliferation of isolated experience. There is an emergence of a new trend in academia characterized by different way of teaching the law, an alternative view of the law itself and a different role of academia in the relationship with society. In a dusty square of an ancient neighborhood of Palermo there is a miserable second-hand market, called \u201cmercato dell\u2019Albergheria. Merchandise sold is mainly stuff collected from garbage. Those who sell and buy are some of the poorest and most marginalized among urban population, so none of the sellers has a permission or pays any tax. Nevertheless, Albergheria market had existed undisturbed for about twenty years. It therefore seems to be an actualization of the free market ideal. The State is not there: neither to give, nor to require. In the main square, where the market is, a peculiar coincidence occurs: one of the buildings, an ex-cinema, is now a lecture-hall of the Law Department of the University of Palermo. So, where everything is illegal, youth is trained in the legal professions. A lively debate has arisen in the last twenty years inside the countries which experienced colonialism. The main point of the discussion is that decolonization did not end with the achievement of political independence. A subtler, but not less intruding colonization persists and it’s growing. So many solutions have been elaborated in order to manage the cultural marginalization of the ex-colonies. The author discusses the well-known Indian contribution to the debate on universal values. This contribution eludes some of the most interesting parts of the Indian history, it neglects the dissonant voices, and it excuses aged believes and institutions despite their obvious dangerousness for the safety of the fundamental human rights.

Philip Zimbardo, ideatore del celebre esperimento carcerario di Stanford e perito della difesa nel processo sugli abusi di Abu Grahib, approfondisce il concetto di responsabilità di sistema. Egli accusa il diritto penale di anacronismo rispetto alle scoperte delle scienze sociali, trascurando la conclamata e poderosa influenza dell'ambiente sull'individuo. La responsabilità di sistema sembrerebbe sollevare gli individui dalla responsabilità personale, configurandosi come alibi per la coscienza, scusante per atti atroci, negazione della stessa libertà umana, decretando un determinismo assolutorio e rassegnato ai mali del mondo. Tale concetto, smascherando il paradigma delle " mele marce " , serve invece a responsabiliz-zare maggiormente i vertici delle organizzazioni, i cosiddetti architetti di sistema. Philip Zimbardo, author of the well-known Stanford prison experiment and defense expert in the Abu Grahib abuse trial, elaborates on the concept of Systemic Responsibility. In his work, he points his finger at the anachronism of the criminal law system especially when compared with the insights of Social Sciences, and remarks the unquestionable influence of environment on individuals. Systemic Responsibility seems to remove man from individual responsibility, while casting itself as an alibi for consciences, an excuse for atrocious acts, a negation of human freedom itself and deriving all that is ill in the world to an irreconcilable determinism. Instead, the notion of Systemic Responsibility, unmasking the 'rotten apples' paradigm, helps the assumption of responsibility of those who at the top of the power hierarchy in organizations: the system's architects.

Il saggio – pubblicato nel volume curato da Giuseppe Burgio "Oltre la nazione" – indaga il sottile confine tra le fattispecie "terrorismo" e "lotta di liberazione" attraverso le norme di diritto internazionale umanitario, il concetto di "diritto penale del nemico" e analizzando il caso di un processo per terrorismo a carico di un gruppo di tamil residenti in Italia.

The adult education in Italy is undergoing a profound change, due to the coming into effect of a new legislation (Presidential Decree no. 263/2012) that rethinks deeply this topic, and due as well to the social changes caused by recent migrations. Especially in Sicily, the Provincial Centers for Adult Instruction (CPIA) provide in actual fact the first educational intervention to many migrants, mostly teenagers and young adults, who arrived after crossing the Mediterranean Sea.
Therefore CPIAs are well suited to become a great educational workshop and the results could be shared with other school sectors. In this text we will deal with three questions common to many educational settings, but that arise with particular patency in a Sicilian CPIA: how to work with a group of very diverse students? How to overcome ethnocentrism? How to raise the quotient of citizenship?
In order to tell this area of the public education system, still little known, the theoretical part will alternate with some short stories of daily life in a school for adults, located at the South border of Europe.

Il primo interrogativo riguarda la legalità, il secondo l'efficacia, il terzo la convenienza economica, il quarto la morale. Già chiamarli clandestini è un'ingiustizia. Vengono rigettati in potere di un dittatore che sconosce il diritto e la pietà. " Li mandano al massacro, dicono alcune donne, gli italiani non dovrebbero permetterlo, meglio finire in fondo al mare, morire nel deserto ". I respingi-menti non destano indignazione perché il razzismo istituzionale, mentre nega il diritto delle sue vittime, inaridisce la facoltà di compatire e immedesimarsi della sventura di uomini poveri e deboli. Emigrare è diritto umano primario.

This research on clinical legal education moves from its historical and philosophical roots, in particular presenting the theoretical basis established by Jerome Frank. The second chapter reports the results of an inquiry over a hundred of clinical legal programs, spread in all the Union territories, fully examined by quantitative and qualitative survey instruments. Chapter III investigates the contribution of law clinics to achieve some important goals set by European legislation. In particular I will analysis the potential remarkable impact of clinical legal programs on: Bologna Process, access to justice, human rights and egalitarian policies.

It might be surprising to discover that among the 196 States officially recognized by the United Nations there is already one without territory. It is the Sovereign Military Order of Malta and of Rhodes, known with the acronym of SMOM. At the time of crusades, the order of the Hospitaller Knights conquered some Mediterranean islands where they established a new State. After many defeats, they lost all their territory, nevertheless they continued to be a State, taking part in the international diplomacy and delivering passport. While we cannot consider the SMOM a model, it is surely a precedent that demonstrates how a State with a people, but without a strip of land on which to exercise dominion and jurisdiction is possible.
The nation-state closed into defined borders, as any human institution, has a history: a genesis, an evolution and will probably have an end. At the present, this political creation is in a deep crisis despite its supporters, the “sovranists”, are growing. The territory, intended as a barred and excluding space, represents itself the "limit" of the State because it is not only a powerful detonator for conflicts and discriminations, but also a claustrophobic dimension to solve the main global challenges. It will be never possible to face climate change, human mobility, governance of the digital revolution, etc. via a territorial and national approach.
But the effort to develop a new geopolitical paradigm encounters a serious obstacle. Thought and language are shaped by the material and immaterial environment in which we live. So we need a methodology.
To shape both a creative and rigorous heresy of the State I propose “The Otherwise Method”: a workshop of political and legal imagination. This practice aspires to enlarge the sphere of possibilities by imagining how reality could be otherwise.
