“Tekstüre” bir tekstil terimi olup; Türk Gümrük Tarife Cetveli’nde “Sentetik ve Suni Filamentler, Şeritler ve Benzeri Sentetik ve Suni Dokumaya Elverişli Maddeler” başlığını taşıyan 54. Faslın bazı açılımlarda “Tekstürize iplik”, “tekstürize edilmemiş”, “tekstürize”, “tekstüre edilmemiş” gibi ifadelerle karşılaşılmaktadır.
Bu yazımızın konusunu, tekstürenin gümrük uygulamalarındaki yeri ve önemi; tekstürenin anlamı, amacı ve son olarak da özellikle taşrada görevli gümrük muayene memurlarımızı ve gümrük kimyagerlerimizi yakından ilgilendiren, bir sentetik veya suni filamentin tekstüre olup olmadığının nasıl tespit edilebileceği hususları teşkil etmektedir.

İlk baskısını yapan elinizdeki bu kitap gümrük ve gümrük vergileri konusunda mevcut kaynak boşluğunu doldurabilmek amacıyla hazırlanmıştır.

Uluslararası ticaretin akışını sağlayan kapılar olan gümrük idareleri, bir
ülkenin rekabet düzeyini belirleyen kritik kurumlar olarak öne çıkmaktadır. Bir ülkede gümrük idarelerinin sunacağı hizmetin hızı, kalitesi, etkinliği ve verimliliği ile ülke refahı arasında doğrudan bir ilişkiden bahsedilebilir. Gümrükler bu önemli görevlerinin yanında, ülkemizdeki vergilerin yaklaşık beşte birini toplayan vergi idareleridir. Evet… gümrük vergilerinin toplanan vergiler içerisindeki payı bu denli büyüktür.

Gümrük vergileri dâhilde alınan vergilerden farklı bir yapıya sahiptir
ve her biri özel uzmanlık gerektiren tarife, kıymet ve menşe gibi teknik konular içermektedir. Bu yapı sebebiyle gümrük ve maliye alanları arasında genel bir kopukluk olduğunu ve akademik alanda gümrük vergilerinin neredeyse göz ardı edildiğini söylemek mümkündür. Bu kopukluk üniversitelerde vergi ile ilgili bölümlerdeki ders programları, ders kitapları ve ilgili literatür incelendiğinde de açıkça görülmektedir. Maalesef Maliye bölümlerinde gümrük vergileri ile ilgili derslere yer verilmemektedir. Gümrük vergileri Türk vergi sistemi gibi genel dersler içerisinde bir iki sayfada ”böyle de bir şey var” kabilinden kısaca bahsedilen bir alan durumundadır. Bizi bu kitabı hazırlamaya sevk eden saik de, Hacettepe Üniversitesi’nde Maliye yüksek lisansı yaparken farkına vardığımız kaynak eksikliği olmuştur. Kitap “Gümrük Vergilerinde Vergi Uyumunun Artırılması” başlıklı yüksek lisans tezimizdeki bilgileri de genel olarak içermektedir.

Sonuç olarak, gümrük vergileri ile ilgili mevcut kaynaklar yetersizdir.
Bu kaynaklar genellikle vergi tekniğini, sistematiğini dikkate almayan yalnızca mevzuat bilgisini aktaran kitaplardır ve çok sayıda “eksik ve hatalı bilgi” içermektedir. Diğer taraftan gümrük mevzuatının çok dinamik, sürekli değişen yapısı eserlerin güncelliğinin ve geçerliliğinin çok kısa sürede ortadan kalkmasına sebep olmaktadır. Bu kitapta ise bütüncül bir anlayış, kavramsal bir bakış açısı öne çıkarılmış, “işin temel mantığı” aktarılmaya çalışılmıştır. Yalnızca mevzuatın aktarılması yerine öze ilişkin bilgilere yer verilmiştir. Bu sebeple da kitabı isimlendirirken “Her gümrükçünün bilmesi gerekenler…” şeklinde bir isimlendirme yapmayı uygun gördük. Ayrıca bu kitapta başka kaynaklarda göremeyeceğiniz pek çok yeni ve değerli bilgiye ulaşacağınızı umuyorum.

Bu kitap dış ticaret ve gümrük işlemleri ile ilgilenen herkes için temel
başvuru kaynağı niteliğinde olması amacıyla hazırlanmıştır. Üniversitelerin dış ticaret ve maliye ile ilgili bölümlerinde yardımcı kaynak olarak kullanılabilir. Dış ticarete ve dış ticaret eğitimlerine olan ilginin giderek arttığı günümüzde bu eğitimler için de kitaptan faydalanılabilir. Diğer taraftan kitabın uzmanlık sınavına hazırlanan ticaret uzman yardımcıları ve görevde yükselme sınavlarına, gümrük müşavirlik ve müşavir yardımcılığı sınavlarına hazırlanan meslektaşlarım için de faydalı olacağını düşünüyorum.

Private Public Partnerships (PPP) are today considered an integral avenue for the pursuit of Kenya’s development agenda. They are seen as a vehicle through which the government encourages and involves the private sector through commercial investments in facilities and services; give better value for money and transfer significant risk and management to the private sector. The adoption of this mechanism has widely been herald, however there is need to ascertain and evaluate the performance of these projects in detail. The principal objective of this study is to determine if implemented Public Private Partnerships in Kenya measure performance. Specifically, the study sought to identify the approaches/criteria used and the factors that influence performance measures employed. The research adopted a descriptive survey with the target population comprising seven implemented and concluded PPP projects. The study was a census survey, a complete enumeration of the objects to be studied. The study collected primary data through the use of a questionnaire which contained both open ended and closed ended questions. The study established that indeed implemented PPPs measured their performance using various criteria which included appropriate risk allocation, compliance with technical specifications of time, quality and functionality, project social benefit, financial performance indicators and environmental factors. Further, the study identified multi stakeholder expectations, difficulty in defining performance output, inability to measure total cost-benefit of projects, political influence and communication challenges as the major factors that influenced performance measurement. The study recommends that further partnerships should be encouraged using PPP models and that performance measurement should be a key consideration. It further recommends the need to undertake a comparative study on the determinants of a partnership and its relationship with the performance of relevant groups as well as the impact of government legislation on PPP success.

Özet Gümrük vergileri toplam vergi gelirleri içerisinde büyük bir yer tutan, devletin önemli gelir kaynaklarından bir tanesidir. Dolayısıyla gümrük vergileri tahsilatının daha etkin ve verimli hale getirilmesi kamu gelirlerinin korunması ve arttırılması açısından büyük önem taşımaktadır. Gümrük vergisi, gümrük vergileri tanım içinde yer alan vergilerden yalnızca bir tanesidir. KKDF ve Kültür Fonu da Gümrük Kanunu'nda yer alan tanım itibariyle gümrük vergileri olduklarından, bu mali yüklerin de gümrük idarelerince tahsil edilmesi gerekmektedir. Mükelleflerin BİLGE sisteminin tespit ettiği vergi ve belge bilgilerinden tamamen bağımsız şekilde beyanda bulunabilmeleri de uygulamada sorunlara sebep olabilmektedir. Mükelleflerin beyan sırasında yapabilecekleri değişikliklere sınırlamalar getirilmesi bu sorunların hafifletilmesine yardımcı olabilir. Diğer taraftan gümrük idarelerinde e-haciz sisteminin olmaması takipteki alacakların tahsilini güçleştirmektedir. e-Haciz sisteminin gümrük kaynaklı kamu alacakları için de uygulanabilir olması sağlanmalıdır. Ek tahakkuk ve geri vermelerin BİLGE sistemi üzerinde yapılamaması gümrük vergileri uygulamalarında karşılaşılan bir diğer sorun olarak karşımıza çıkmaktadır. Ek tahakkuk ve geri verme işlemlerinin sağlıklı yürütülebilmesi için BİLGE sistemi ile tam entegre çalışan yeni bir programa ihtiyaç vardır.

Customs Duties and Some Problems in the Collection of Customs Duties
Abstract
Customs duties, having a great place among tax revenues, are one of the most important sources of public revenue. Thus increasing the effectiveness and the efficiency of the collection of customs duties looms large in terms of protecting and increasing the public revenue. Customs duty is only one of the duties that is included in the definition of customs duties. Resource Utilization Support Fund and Culture Stoppage are also customs duties and they have to be collected by the customs administrations. Taxpayers have the opportunity to change the duty and document information that are determined by BİLGE system and to make declarations independently. This causes problems in implementation. Restricting the changeable areas can help reducing these problems. Besides the customs administrations not having an e-lien system makes the collection of non-performing loans more difficult. An e-lien system should be provided for the customs originated public receivables. Another problem appearing in the collection of customs duties is that the recoveries and repayments are not included in BİLGE system. A new program integrated with BİLGE system is needed for the proper implementation of recoveries and repayments.

This article examines the functioning of the European Union’s (EU’s) consumer protection law in an incident in which the EU banned Asian shrimps in order to protect its consumers and aims to answer the following questions: 1. Are the EU’s actions in compliance with its own law and the law of the World Trade Organization (WTO)? 2. What is the impact of these actions on international trade and on the EU’s trading partners especially if they are developing countries? The most important consequence of this incident is its restrictive impact on international trade and/or the use of consumer protection as a tool for protectionism. In this particular incident, it does appear that the EU’s actions could have been held to have violated WTO law had the Asian developing countries brought a case against the EU. The article will conclude by examining the impact of the EU’s actions on its relations with Asia.

This article attempts to answer the question ‘What could be the role for trade in achieving the goals laid down in the Paris Climate Agreement?’ This article explores the interactions between the trade and climate change regimes, their specific interactions, and innovative ways forward in the context of global governance. Sections 1 and 2 of this report first assess the numerous linkages between trade and climate change including at the policy level. Chapter 3 then systematically assesses the main policy options for making trade more supportive of climate action. ÖZET Gönüllü beyan, yükümlülerin hatalı veya eksik beyan edilmiş veya daha önce hiç beyan edilmemiş bilgileri, kendi istekleri ile vergi idaresine beyan etmesini ifade etmektedir. Bu çalışmada Türkiye'nin toplam vergi gelirleri içerisinde yaklaşık %20'lik paya sahip olan gümrük vergileri için, 4458 sayılı Gümrük Kanununun 234/3 üncü maddesi ile yürürlükte olan gönüllü beyan uygulaması ele alınmıştır. Sonuç olarak bu uygulamanın yükümlüler açısından yeterince cazip olmadığı ortaya konulmuş olup, eksik tahsil edilen gümrük vergileri için enflasyon oranında vade farkı uygulanması ve eksik alınan verginin %5'i gibi düşük bir oranda ceza uygulanması uygulamasına geçilmesi önerilmektedir.

ABSTRACT The term " voluntary disclosure " is used to express the chance given to the taxpayers to voluntarily correct inaccurate or incomplete information or to disclose information that they have not declared to the tax administration before. In this study, the voluntary disclosure program, that is in force by the Customs Code No:4458 Art.234/3 is examined. This program applies to the customs duties, which constitute 20% of total tax revenue in Turkey. As a result, this study manifests that this program is not attractive enough when considered from the taxpayers' perspective. To achieve a higher voluntary compliance level, we suggest that an interest for delay should be applied for the duties that have been undeclared before in accordance with the inflation rate and the penalty rate should be as low as 5%.

İdarenin işlemlerinin geçerli olması ve hüküm ifade edebilmesi için tebliğ edilmesi, yani muhatabına usulüne uygun şekilde, tebligat hukuku çerçevesinde bildirilmesi yasal bir gerekliliktir. Tebligat işlemlerinin ayrı bir kanunla düzenlenmiş olması da mevzuatımızda tebligata verilen önemin bir göstergesidir. Ancak gümrük işlemlerinin ve vergilerinin tebliğinde yaşanan bazı sorunlar tebligatın öneminin gümrükte tam olarak anlaşılmamış olabileceğini göstermektedir. Bu sorunların çözüme kavuşturulması ve elektronik tebligata geçilmesi ile tebligat işlemlerinin daha düzenli ve hızlı gerçekleştirilmesi sağlanabilir.

Bu çalışmada vergi idaresi ile yükümlüler arasında ortaya çıkan uyuşmazlıkların karşılıklı görüşmelerle barışçıl bir şekilde çözülmesini öngören uzlaşma müessesesi ele alınmış, gümrük vergileri ve cezalarında uzlaşma müessesesinin nasıl uygulandığına dair genel bilgiler verilmiş ve uzlaşma müessesesinin öne çıkan sakıncalı yönleri değerlendirilmiştir. Uzlaşma müessesesi Anayasamıza ve temel vergileme ilkelerine aykırı yönler barındırmakta, cezaların caydırıcılığını azaltmakta ve adalet anlayışını zedelemektedir. Uyuşmazlıkları gerçek anlamda çözmeyen uzlaşma aynı zamanda memurların ücretlendirilmesinde de adaletsizliklere sebep olmaktadır. Belirtilen sakıncalı yönler sebebiyle beklenen olumlu etkilerinden çok olumsuz etkileri olduğu anlaşılan uzlaşma müessesesinin vergi hukukunda kaldırılması gerektiği sonucuna ulaşılmıştır.

Trafficking of biodiversity materials is a major threat to the earth’s ecological balance and Sri Lanka is no exception. This article describes the protocol under the Convention on Biodiversity in the context of illicit trade in biodiversity and wildlife materials trade products across Sri Lanka during the period of 1992–2009. It highlights the methods that can be effective to counter-attack and prevent illegal transnational trading and discusses how the region can approach a coordinated implementation of those key provisions. Details of the current illegal biodiversity during the above period are highlighted and the great effort made by Sri Lankan Customs in protecting the country’s conservation of biodiversity and combatting the weak points of illegal transactions is pointed out clearly with remedies.

Israeli manufactured export performance has been on a growth path for the past two decades. This growth is partly due to the continuing shift in Israeli export specialization patterns from traditional products towards technology-intensified exports. However, Israel’s strong export competitiveness also derives from proliferating free trade agreements (FTAs) with its trading partners, especially the European Union (EU). This paper analyzes export statistics to provide data validating the positive impact of recent FTAs on Israel’s export comparative advantages across all sectors between 1995 and 2015. It employs an econometric framework to examine stability and specialization trends, as well as convergence. İsmini “BİLgisayarlı Gümrük Etkinlikleri” ifadesinden alan BİLGE sistemi, Fransız Gümrük İdaresi ile Gümrük Müsteşarlığı arasında 1995 yılında imzalanan, “Fransızların BİLGE’si” Sofix Otomasyon Sisteminin adaptasyonunu da içeren mutabakat protokolünün gereği olarak Türk gümrük idarelerine adapte edilmiş ve 1998 yılında başlayan ilk pilot uygulamalar sonrasında 2000’li yıllarla birlikte adım adım gümrüklerimizde yaygınlaşmaya başlamıştır.
e-gümrük yolunda atılan en önemli adım olarak kabul edebileceğimiz BİLGE, eşyanın gümrük idaresine sunulmasından, gümrük işlemlerinin tamamlanarak ilgilisine teslimine kadar gerçekleşen her aşamadaki işlemleri kapsayan gerçek zamanlı bir otomasyon sistemidir.

Özet Bu çalışmada kısaca haciz sürecinin nasıl işlediğine dair giriş niteliğinde bir bilgilendirme yapıldıktan sonra e-Hacizin dayanakları, mevcut e-Haciz uygulamaları ve gümrükteki mevcut durum değerlendirilerek konuyla ilgili önerilere yer verilmiştir.
