The article examines the concept of juridical act from both a comparative and Louisiana law perspective to establish the validity of the general theory of juridical acts and to determine the useful components drawn from each system.

El autor afirma que la declaración de oficio de la nulidad negocial (ex art. 220 del Código Civil) representa el poder del juez de tutelar el ordenamiento jurídico ante una valoración negativa del programa contenido en el negocio jurídico. En ese sentido, plantea que el derecho de defensa a través del proceso civil, explicitado en el contradictorio, es necesario a fin de declarar la nulidad negocial manifiesta, ya sea cuando de por medio exista alguna impugnación del negocio jurídico o una pretensión deducida en juicio que dé por sentada la validez negocial.

This paper deals with one of the most important institutes of Albanian civil law, that of juridical action, from the viewpoint of the German law. The Albanian civil law in relation to this institute has faithfully applied the example of the Italian law, the socalled "Negozio Giuridico". Nevertheless, despite the advancement of Albanian jurisprudence and doctrine in connection to this institute, its further development is needed, and the German law is one of the best examples in this regard, due to the theoretical and practical accuracy in relation to the treatment of the "Willenserklärung", the homologue of the juridical action in the Albanian civil law. For this reason this scientific article deals with the definition of juridical action according to §79 ACC and the forms of its expression according to §80 ACC according to the doctrinal and jurisprudential meaning given by German law.

No Direito Civil brasileiro atual, as categorias jurídicas do negócio jurídico inexistente e do plano da existência são tidas como “leis naturais” e, portanto, incontestáveis. A absoluta falta de consenso na literatura estrangeira coloca, porém, essa certeza em dúvida. O presente artigo analisa a pertinência do negócio jurídico inexistente e do plano na existência, chegando à conclusão de que, embora a doutrina brasileira mereça, em geral, aplausos, os termos “negócio jurídico inexistente” e “plano da existência” devem ser abandonados.
