Tear Gas

The chronic stresses of air pollutants in Athens are believed to derive mostly from vehicles and from the heating of buildings. However, there are also incidents of acute shocks which have not been widely investigated. This paper explores, through monitoring particulate matter in various areas of the city, the effect of teargas used by the police during riots in the air quality of the city, the effect of the fire of recycling factories in the periphery of the metropolis and also the effect of lock-down restrictions and the decrease of transportation on air quality. Conclusions are drawn on what is more dangerous for the population of the city and to which policies the city should focus so as to improve air quality in the city centre.

Özet Biber gazı, özellikle son on yılda kolluk görevlileri tarafından toplumsal olay-lara müdahalede sıklıkla başvurulan bir araç haline gelmiştir. Biber gazı kul-lanımındaki artış çok sayıda ülkenin yanı sıra Türkiye'de de gözlemlenmekte-dir. Özellikle polis tarafından toplantı ve gösteri yürüyüşlerine müdahalede yoğun bir şekilde kullanılmaktadır. Bu çalışmada kolluk görevlilerinin güç kullanma araçlarından biri olarak biber gazı kullanımı, ulusalüstü insan hakları hukukunun normatif ve içtihadi standartları çerçevesinde ele alın-maktadır. Kolluğun bu standartlara aykırı şekilde biber gazı kullanması iş-kence ve kötü muamele yasağı ihlalini sonuçlama potansiyeli taşımaktadır. Bu bağlamda kolluğun biber gazına başvurması; gereklilik, orantılılık, üçüncü kişilerin zarar görmesinin önlenmesi, ortaya çıkabilecek sağlık sorunlarına karşı tıbbi müdahale imkanı sağlanması gibi ilkelere tabidir. Під час Революції Гідності масовими були випадки застосування гранат зі сльозогінним газом органами правопорядку проти учасників протестів. При цьому, вплив сльозогінного газу зазнавали як протестувальники, так і працівники ЗМІ, спостерігачі та інші особи, які не брали участі в зібранні.

Законодавче регулювання застосування сльозогінного газу в Україні в подальшому було частково переведене з підзаконного рівня на рівень закону, водночас, підзаконні нормативно-правові акти не містять детальних інструкцій.

Актуальність теми курсової роботи полягає в тому, що в ній проаналізовано застосування сльозогінного газу на мирних зібраннях в контексті дотримання прав людини, яке може спричиняти порушення прав людини працівниками органів правопорядку.

Дослідницьке питання: Чи забезпечує законодавство України дотримання прав людини при застосуванні сльозогінного газу під час мирних зібрань?

Об’єктом дослідження є дотримання прав людини у разі застосування спеціальних засобів органами правопорядку. Предметом дослідження є дотримання прав людини у разі застосування сльозогінного газу під час мирних зібрань.

Мета дослідження – на основі аналізу міжнародних стандартів та принципів права встановити, чи забезпечує законодавче регулювання в Україні дотримання прав людини при застосуванні сльозогінного газу під час здійснення громадянами свободи зібрань.

Завданнями дослідження є:
- перевірка міжнародних стандартів прав людини на предмет захисту людської гідності у випадках застосування сльозогінного газу;
- з’ясування відмінностей в міжнародних стандартах гуманітарного права та права прав людини щодо застосування сльозогінного газу;
- аналіз національного законодавства, що регламентує використання сльозогінного газу.

During the 2013 Gezi protests in Turkey, volunteering health professionals provided on-site medical assistance to protesters faced with police violence characterized by the extensive use of riot control agents. This led to a government crackdown on the medical community and the criminalization of “unauthorized” first aid amidst international criticisms over violations of medical neutrality. Drawing from ethnographic observations, in-depth interviews with health care professionals, and archival research, this article ethnographically analyzes the polarized encounter between the Turkish government and medical professionals aligned with social protest. I demonstrate how the context of “atmospheric violence” –the extensive use of riot control agents like tear gas– brings about new politico-ethical spaces and dilemmas for healthcare professionals. I then analyze how Turkish health professionals framed their provision of health services to protestors in the language of medical humanitarianism, and how the state dismissed their claims to humanitarian neutrality by criminalizing emergency care. Exploring the vexed role that health workers and medical organizations played in the Gezi protests and the consequent political contestations over doctors’ ethical, professional, and political responsibilities, this article examines challenges to medical humanitarianism and neutrality at times of social protest in and beyond the Middle East.

Recurriendo a ciertos conceptos propios del análisis económico del derecho administrativo, este trabajo sostiene que el uso de gases lacrimógenos como reacción a la protesta social es un mecanismo que no solo es potencialmente lesivo de derechos fundamentales sino que además es sumamente problemático a la hora de satisfacer la finalidad a la que supuestamente sirve, develándose la necesidad de una regulación que pueda dar cuenta de la totalidad de factores y costos sociales involucrados. Sumado a esto, el análisis propuesto sugiere que el uso de gases lacrimógenos debiese ser restringido a casos excepcionalísimos.
