VISION
The Sole Authority competent to expound upon any matter touching the interpretation and
application of the Industrial Relations Act Ch. 88:01 relating to the functions and
responsibilities with which the Board is charged by the Act or any other written Law.

BRIEF HISTORY AND PROFILE OF
THE REGISTRATION RECOGNITION AND CERTIFICATION BOARD
1. The Registration Recognition and Certification Board (RRCB) was established under
Part II, Section 21 (1) of the Industrial Relations Act Chap 88:01 (“the Act”). The
purpose of the Act is “to make better provision for the stabilization, improvement and
promotion of industrial relations” throughout the Republic of Trinidad and Tobago.
2. The Board consists of a Chairman and eight (8) other Members. The Chairman is a fit
and proper person selected by the President of the Republic of Trinidad and Tobago
after consultation with such organizations or other bodies of persons as in her opinion
are “the most representative of workers and employers” and is appointed by the Minister of
Labour and Small Enterprise Development (the Minister”). The other Members are
also appointed by the Minister as follows:
For each member other than the Chairman, there is an alternate member selected in
the same manner as the related substantive member.
3. The duties of the Board are set out in Section 23(1) of the Act which charges the Board
with responsibility for:

The determination of the appropriate bargaining unit is central to the mandate of the
Board. The purpose behind the concept of the “appropriate bargaining unit” is to give
full benefit to the right to organize and the right to collective bargaining.
The Board’s determination is of immense practical importance, not only for the
immediate parties, but for the structure and performance of the collective bargaining
system as a whole.
4. The Act constitutes the Board as the sole authority for the determination of bargaining
units and granting Certificates of Recognition to Trade Unions. It is also the sole
authority capable of determining whether or not a person is a worker within the
meaning of the Act and whether or not a person is a member in good standing of a
Trade Union.
5. The determination/decisions of the Board are final and not generally open to challenge
except in specific circumstances where they deal with matters outside of its functions
and responsibilities as detailed in the Act, or if they violate the rules of natural justice,
or if any member of the Board had a real interest in the matter before it.
6. By virtue of the execution of its powers, functions and responsibilities under the Act,
the Board plays a critical role in Industrial Relations in Trinidad and Tobago.
7. All members of the Board were in office until 24th February, 2018.
There was no Board in office from 24th February, 2018 to 31st December, 2018.
8. The Board is assisted in the execution of its work by a Secretary appointed under
Section 22(2) of the Act and other staff all of whom are Public Officers. This is called
‘The Secretariat’ and is comprised of the Secretary, Examiners who are the technical
officers as well as Secretarial, Administrative, Clerical and Manipulative staff as
shown in Table 2 below.
The Secretary assists the Chairman at Board Meetings and prepares the Minutes of
Board Meetings. Examiners under the supervision of the Secretary initiate and conduct
the processing and procedures required to deal with the matters assigned to them and
produce a Report thereon. Specialized Transcription Staff assist with verbatim
recording of the proceedings of Hearings.
9. The Board holds Meetings and Hearings in pursuance of matters brought before it.
The composition of all committees or panels set up by the Board reflects each of the
tripartite categories of membership of the Board.
10. Notwithstanding the provisions of Section 23(6) of the Act that: “No decision, order,
direction, declaration, ruling or other determination of the Board shall be challenged, appealed
against, reviewed, quashed or called in question in any court on any account whatever; and no
order shall be made or process entered or proceeding taken by or in any court, whether by way of

injunction, declaratory judgment, certiorari, mandamus, prohibition, quo warranto or otherwise
to question, review, prohibit, restrain or otherwise interfere with the Board or any proceedings
before it” there have been over the years legal challenges on the ground of natural
justice by way of judicial review proceedings against the decisions of the Board.
Challenges, though fewer in number, have been made on the issue of jurisdiction.

CHAIRMAN’S REPORT
1. INTRODUCTION
The Annual Report for the year ending December 31, 2018 is prepared in accordance
with Section 83 of the Act.
2. BOARD’S PRODUCTIVITY
The life of the Board expired on 24th February, 2018 and no new Board was appointed
for the remainder of the year.
Nevertheless, the Board determined ten (10) matters before the expiration of its term
of office. See Appendix I.
3. OPERATIONAL EFFECTIVENESS
Notwithstanding, the Secretariat continued with its functions. The Secretary and
Examiners continued processing Applications for Certification of Recognition,
Petitions and Referrals by gathering the necessary information which would be
required for the composition of their respective reports. However, no determination
could have been made in the absence of an appointed Board. See Appendix II
The Board maintained its policy of being approached through the established channels

The role of the Secretariat is to provide consistently accurate, timely and useful
information to the Board. The Secretariat must support the Board in carrying out its
mandate. As a result, the Secretary attempted to shorten the time taken for the

processing of Applications for Certification of Recognition by reducing extensions of
time to parties as well as the issuance of Summons to parties pursuant to Section 24.
6. CORE PRINCIPLES OF THE SECRETARIAT
The Core Principles of the Secretariat, derived from the responsibilities of the
organization enshrined in the Act, may be summarized as follows:
Due respect for the privacy and confidentiality of matters brought to the
attention of staff, or disclosed or discovered during official investigations and
clarifications in accordance with the provisions of the Act;
Promoting the balance between workplace demands and Family needs of the
Staff;
The Secretary is the Head of the Department – The Secretariat. The position of
Secretary was created by Section 22(2) of the Act and is filled in accordance with the
norms of the Public Service. The Secretary is a member of the Public Service
establishment. The Secretary records Minutes at Board Meetings and is responsible
for dissemination of the Minutes and preparation of the Agenda for Meetings. The
Secretary is responsible for the effective and efficient performance of the Secretariat
and is also its Chief Technical/Administrative, Accounting and Financial Officer. All
the Reports to the Board for determinations/decisions are finalized by the Secretary.
The Secretary is appointed by the Ministry of Finance as the Accounting Officer and
the Secretary approves all financial transactions of the Department in accordance with
the approved Budget. Matters for Board decisions are presented by the Secretary in
the form of “Board Documents” which are discussed at meetings and decided upon.
The Secretary exercises administrative leadership but does not take part in the
determinations made by the Board. The functions carried out by the Secretary bear
many similarities to those of a Company Secretary in private enterprise as well as that
of a Registrar.
The Secretary must exercise all deliberate care and diligence in the performance of
daily routines. The Secretary must act in good faith, and use the powers of the office
under the Act for a proper purpose. As an employee, the Secretary owes the RRCB all

common law duties of competence, care, service, loyalty and good faith.
As indicated earlier in this Report the Examiners under the ultimate supervision of the
Secretary initiate and conduct the process and procedure required to deal with the
matters assigned to them and ultimately produce a report with or without a
recommendation upon which the Board then makes a decision or determination.
Although the Secretary has the final responsibility for the quality of the Reports that
reach the Board for determination the efficiency and professional approach of the
Examiners to their work are critical and pivotal to the Board’s achievement of its
mission, objectives and responsibilities.
9. BUDGET
Funding for the proper functioning and effective operation of the Board is provided
annually in the National Budget.
The accounts of the Registration Recognition and Certification Board is audited by the
Auditor II, Ministry of Labour and Small Enterprise Development.
