MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS

This Memorandum of Agreement is made and entered into by and


between:

The PAMPANGA FEDERATION TECHNICAL INSTITUTIONS


(PAFTI) INC. an educational institution duly recognized and existing
under the laws of the Philippines, with campus address at City of San
Fernando Pampanga, represented herein by its Vice President for
Student Affairs and Services, Alison Fajardo, Ed,D., referred to it as
the FIRST PARTY

and

The LA GRAND RESICENCE, a company duly organized under the


laws of the Philippines, with its office located at Clark, Pampanga,
Philippines, represented herein by its Human Resources Manager. Mr.
Hugo Agcaoili who is duly authorized to represent it in this transaction,
herein after referred to as the SECOND PARTY.

WITNESSETH

WHEREAS, the FIRST PARTY is a school which provides, time and cost
effective training program in different areas, instituted an internship
Program wherein qualified students undergo internship prior to graduation
in order to adequately familiarize with actual office and technical
operations, and management to augment their formal learning;

WHEREAS, the FIRST PARTY allowed students to undergo Internship,


whereby proposal was accepted and approved subject to terms and
conditions provided in this Memorandum of Agreement.

WHEREAS, the SECOND PARTY accept students of the FIRST PARTY as


student-intern in support of Internship Program and to complement the
existing curricula to match the needs and demands of the industry.

WHEREAS, both parties are cognizant of the need for cooperative


endeavor and fully aware of the benefits that could be mustered in this
undertaking.
NOW, THEREFORE, for and in consideration of the above premises, the
parties hereunto have jointly agreed to implement a scheme designed to
achieve their common objectives as follows;

A. The PAFTI Inc. shall:

1. Provide students enrolled, and qualified to undergo internship for


required number of hours to the SECOND PARTY, See attached list of
certified student's;

2. Serve as the company's partner in developing student-intern in their


chosen career by endorsing well-trained and disciplined apprentices;

3. Designate SiPP Coordinator to monitor attendance and follow-up the


student-inter profile and coordinate other agency/industry regarding the
various activities/requirements under this program;

4. Provide the agency/industry's relevant information pertaining to


student-intern profile and data 9endorsement documents)

5. Orient the student-intern regarding the Program of the School, policies,


rules and regulations;

6. Provide the journal where all their activities for the week will be written
in the space provided for.

B. SECOND PARTY shall:

1. Accept and accommodate student-intern with complete documentation


regarding internship who will undergo training for required number of
hours indicated in their endorsement documents;

2 Provide student-intern an orientation regarding the agency/industry


policies, rules and regulations and its operation before the training will
start;

3. Furnish the school copy of the said policies, rules and regulations to be
imposed on the student-intern;

4. Provide Supervised Applied Learning Experience for student intern and


give assignments or designate respective work station, strictly within the
company location eight (8) hours daily or what was agreed upon by the
FIRST and SECOND parties and may request student-inter to work beyond
eight hours for a maximum of two (2) hours;
5, Assign SIPP coordinator who will take charge and supervise the student-
intern while undergoing Internship or the implementation of all phases of
the Training Plan;

6. Provide first aid assistance to the student-intern when injured while in


the performance of his/her assigned task;

7 Allow the SIPP coordinator of PAFTI Inc. to visit the station at least two
(2) to three (3) days in a month to monitor the status of the student-intern
and the program;

8. Make available, free of charge, the consumable materials and basic


hand tools and equipment or documents necessary for the internship;

9. Sign the Certificate of Completion to be issued by the HT to student-


inter after serving the required number of hours.

C. FURTHER, the following terms and conditions are likewise included:

1. The First Party or the Second Party reserves the right to discontinue the
Internship of the student-intern on reasonable grounds mentioned below,

1.1 In cases of maltreatment, bullying, sexual harassment and the like;

12 Habitual absenteeism from the student-intern and related theoretical


instruction;

1.3 Willful disobedience of company rules and insubordination to lawful


order of superior;

1.4 Poor physical condition, permanent disability or prolonged illness


which incapacitates the student-Intern from working;

1.5 Theft or malicious destruction of company property and equipment;

1.6 Inefficiency of performance on the agency/industry for a prolonged


period despite warnings duly given to the student-intern;

1.7 Engaging in violence or other form of gross misconduct inside the


company s premises;

1.8 Any decision by the agency/industry regarding the performance and


attitude of the student-intern shall be forwarded to PAFTI Inc. Office of
Career Services through phone or SIPP Coordinator for the due process or
investigation.

The discontinuation shall take effect immediately upon receipt of the said
notice by either party.

C. EFFECTIVITY
This agreement shall take effect immediately upon signing hereof,
and shall continue hereafter, either party may terminate this agreement
anytime by serving written notice to the other party, giving thirty (30)
days lead time before intended date termination.
