The Author argues that the social security discipline provided for employees by statutory employm... more The Author argues that the social security discipline provided for employees by statutory employment law is fully applicable to the so-called “hetero-organized work” (article 2, decree no. 81/2015). After a brief introduction regarding the relevance, within the scope of labour law, of the social security dimension, the Author analyses the different positions expressed by Italian legal literature. The Author then points out how the most recent developments of Italian case law offer more arguments to support the full applicability of the social security discipline to hetero-organised workers and concludes by highlighting some practical effects of such extension.

Le indennità destinati ai lavoratori autonomi dal decreto “Cura Italia”, subito ribattezzate “Bon... more Le indennità destinati ai lavoratori autonomi dal decreto “Cura Italia”, subito ribattezzate “Bonus 600 €” e riproposte dal decreto “Rilancio”, costituiscono una novità assoluta nel diritto previdenziale italiano. È infatti la prima volta che il legislatore istituisce misure di integrazione reddituale a favore dei lavoratori autonomi colpiti da situazioni di sospensione o riduzione delle attività. Il contributo, svolte alcune riflessioni preliminari sulla tradizionale scopertura previdenziale del lavoro autonomo, si sofferma sul fondamento costituzionale delle nuove misure di sostegno, da rinvenirsi nell'art. 38, comma 2, Cost., rilevando come però le misure si inseriscano in un quadro articolato, segnato dal pluralismo degli statuti previdenziali delle diverse categorie di lavoratori autonomi. Dato conto di alcuni dati statistici, vengono poi analiticamente passate in rassegna le misure predisposte per le diverse categorie, dandosi conto della sorprendente diversità di disciplina che le caratterizza e delle connesse problematiche teoriche e applicative. Vengono quindi esaminate le novità apportate dal decreto Rilancio e svolte alcune considerazioni di carattere non conclusivo, critiche rispetto all'irragionevolezza delle numerose differenze di disciplina ma speranzose rispetto al fatto che le misure emergenziali possano costituire un primo tassello di un nuovo statuto previdenziale per il lavoro autonomo.

To this end, the paper analises in the first place the contractual terms and conditions regulating the relationship between the riders and the platforms and therefore it describes the effective modalities of execution of the performance, in order to ascertain whether there is room for the reclassification of the labour relationship and, if not, what protective schemes could still find application in favour of platform workers.

Dopo avere esaminato le particolarità della prescrizione previdenziale rispetto a quella ordinaria, vengono analizzate le diverse azioni esperibili da parte del lavoratore danneggiato (azione di condanna al versamento dei contributi non prescritti, azione risarcitoria ex art. 2116 c.c., anche in forma di condanna generica, costituzione della rendita vitalizia ex art. 13, L. n. 1338/1963), delle quali vengono esaminati i rispettivi presupposti ed effetti.
