Il diritto italiano non può più evitare di affrontare il tema della genitorialità in relazione all'orientamento sessuale e all'identità di genere. Questo volume vuole affrontarlo nella sua complessità e presentare per la prima volta una compiuta analisi dei suoi profili giuridici. Muovendo dalla riflessione già maturata in altri ambiti scientifici, gli autori s'interrogano sulla tutela che l'ordinamento italiano offre alle famiglie in cui almeno uno dei genitori è una persona omosessuale o trans. Giudici, accademici e amministratori sono infatti chiamati sempre più frequentemente a risolvere le questioni che le famiglie omogenitoriali pongono. La dimensione europea e le esperienze di altri Stati offrono spunti per riflettere, capire e decidere. Questo volume non si ferma davanti al dato positivo e allo status quo, ma guarda oltre, nella prospettiva di un sistema giuridico che coglie le sfide di modelli di famiglia che mutano nella costanza del valore che rappresentano.

This book represents the effort by jurists from all walks of life – legal practitioners, scholars, judges, legal advisers to NGOs, and equality bodies – to reflect on the challenges that sexual orientation and gender identity pose to contemporary law. It originates from the international conference Equality and Justice - LGBTI (Lesbian, Gay, Bisexual, Trans and Intersex) Rights in the XXI Century organized within the framework of the Equal-Jus.eu Project in Florence on May 12 and 13, 2011.
It discusses the state of legal studies in the field of sexual orientation and gender identity and deals more specifically with the notions and usage of sex and gender in the Western legal tradition, with constitutional and comparative law approaches, EU and migration law, and issues common to LGBTI couples such as freedom of movement, mutual recognition, parenthood, and inheritance. Significant attention it devoted to gender identity issues and to the role of the judiciary and of equality bodies in dealing with LGBTI cases. Essays are written in English, Italian and French.

Questo lavoro preliminare indaga la prassi applicativa dopo le due importanti sentenze del 2015 della Corte di Cassazione e della Corte costituzionale sulla riattribuzione del genere anagrafico, le quali hanno statuito che l'intervento chirurgico non è una condizione necessaria. Tramite l'analisi di diversi provvedimenti emessi, l'Autore mostra come l'interpretazione della legge n. 164/1982 sia ancora pesantemente influenzata da un approccio patologico e, nella migliore delle ipotesi, medico all'identità di genere. Nonostante spesso si affermi di muovere dalla prospettiva dei diritti fondamentali, i giudici si rifanno quasi esclusivamente alle consulenze mediche e all'aspetto fisico. Così facendo, rifiutano di adottare un approccio rispettoso dell'autodeterminazione e dell'identità personale di ognuno. Lo scritto offre alcuni suggerimenti su come i giudici dovrebbero ricollocare il diritto in gioco in un quadro più ampio e conseguentemente ridefinire gli elementi di prova utili ad accertare l'identità delle persone.
