In this essay we discuss the philosophy of law of Moses Ben Maimon, dedicating special attention to two issues: the function of the law and the golden middle way of the classic ethical tradition. We argue that the intersection among these two issues lies in the concept of the law as an instrument to temper human excess in order to achieve an ordered society, an ethical life, and a sufficient knowledge of God. Drawing on the philosophical, ethical, and medical writings of the Jewish thinker, we argue that the achievements of good habits and an educated inclination do not make laws irrelevant and superfluous. On the contrary, human beings are required to comply with both intelligible and less intelligible rules, to the extent these rules come directly or indirectly (via interpretation) from God. The revealed law (Torah) as paradigm of limit and moderation emerges as well in Maimonides conception of legal hermeneutics. In this way, we argue that the high moral value represented by the action’s attributes of God in Jewish thought is matched by the awareness of the limits of human intellect: it is according to these limits that the Jewish law (Halakha) outlines its rules.

Roman law since the archaic period took care of the furiosus, a citizen who was mentally impaired, protecting his person and his patrimony during the time in which he was incompetent. Latin has a great number of words to indicate mental illness, often too quickly considered interchangeable. Therefore, trying to ascertain the specific nuances of each term and trying to understand the selection made by jurists is a preliminary step to understand the legal regulation for the mentally impaired. In light of ancient classifications, I propose to divide the Latin lexicon of madness in two groups: one pertaining to exceptional and somewhat positive states of divine possession and another connected to insanity and mental impairment that extends to insipientia. In my opinion the legal jargon is oriented toward the first group.

La recente giurisprudenza della Corte europea dei diritti dell’uomo ha stimolato presso la dottrina penalistica una rimeditazione del principio di prevedibilità della decisione giudiziale, assunto da quella giurisprudenza quale contenuto fondamentale della stessa garanzia del nullum crimen. Questo contributo analizza fisionomia e corollari del principio, soffermandosi poi sui suoi fondamenti normativi, anche a livello costituzionale; e si chiede quindi quale sia il ruolo rispettivo del legislatore, del giudice comune e della Corte costituzionale nella concreta attuazione del principio nell’ordinamento penale, sottolineando in particolare come anche in un ordinamento di civil law come quello italiano gravi su ogni giudice comune – di legittimità, ma anche di merito – il dovere non solo di rendere giustizia nel caso concreto, ma anche di rafforzare e comunque di non frustrare, attraverso le proprie decisioni, la prevedibilità delle future decisioni di casi simili da parte di altri giudici. E ciò, da un lato, attraverso l’enunciazione in forma chiara e precisa – e per ciò stesso generalizzabile – della ratio decidendi che sostiene la soluzione di questioni nuove; dall’altro, attraverso il tendenziale vincolo del giudice alle soluzioni offerte dalla giurisprudenza consolidata, laddove esistente, a meno che non sussistano cogenti ragioni che militino in senso contrario.
