Audiovisual Media Services Directive

The present dissertation paper explores some of the challenges presented by the protection measures that Video-Sharing Platforms (VSPs) such as YouTube will have to put in place in order to protect minors and European citizens from Hate Speech and Harmful Content, as it is required by the newly revised Audiovisual Media Services Directive (AVMSD). Consequently, VSPs -and potentially Social Media Platforms (eg Facebook)- are expected to filter, block and remove user-generated content that does not comply with the laws of the European Union and even Member States' policies. Therefore, it is submitted that this represents a departure from the former "light-touch" regulatory approach towards the establishment of public-private partnerships created with the purpose of influencing online platforms' behaviour. In order to preserve the freedom of expression of VSPs' users, human rights law will play a key role in determining the lawfulness of speech, this being a quasi-judicial labour formerly exclusive to the National Courts and the European Court of Human Rights.

Resumen:
La televisión pública en Europa pierde peso e influencia en las políticas de comunicación de esta segunda década del siglo XXI, en sus propios medios de financiación, en la lucha por las audiencias  y en los sistemas tecnológicos de difusión  frente a los nuevos modelos  híbridos y convergentes abanderados por los operadores de cable, de satélite y de la distribución por Internet (IPTV). Frente a la fragmentación de audiencias y al debilitamiento de los modelos de financiación tradicionales (publicidad, canon, subvención), las televisiones concentran sus estrategias de difusión en las economías de escala y de club a través de duopolios o plataformas integradas de mercado.

Abstract:
Europe’s public service television is losing strength and influence in the communication policies of the second decade of the 21st century, in its own financing means, in the fight for audiences and in the broadcasting technologies against the new hybrid and convergent TV models led by the operators of cable, satellite and internet TV. To cope with the fragmentation of the audiences and the weakening of the traditional financing models (advertising, fees, subsidies), television companies concentrate their dissemination strategies in the scale and club economies through duopolies and integrated market platforms.

Case-law of the Court of Justice of the European Union, as well as procedures taking place before the Commission aiming to clarify certain aspects regarding freedom of services – in this case, the principle of free transmission and retransmission of audiovisual media services – have always been regarded as particularly important in offering guidance in interpreting and applying European legal norms. The adoption in December 2018 of the revised text of the Audiovisual Media Services Directive (Directive 2018/1808) marks the transition to a new, amended legal framework. It also enables the critical review of the last case decided in front of the Court of Justice of the European Union, still instrumented according to the provisions of Directive 2010/13/EU: Case C‑622/17 (Baltic Media Alliance v. El 17 de noviembre de 2009 se puso en marcha el primer Código de corregulación audiovisual en España: �Código de Corregulación para la Calidad de los Contenidos Audiovisuales en Navarra 2010�. Dicho Código resulta pionero en este ámbito y, teniendo en cuenta el contenido de la recién aprobada Ley General Audiovisual, se presenta como un ejemplo del trabajo a realizar por el futuro Consejo Estatal de Medios Audiovisuales (CEMA) o la autoridad reguladora correspondiente. Recent challenges in the EU business sector also comprise the revision of the Audiovisual Media Services Directive (the new text in force since December 2018), the main media policy tool of the EU which establishes the legal framework for a convergent media landscape that comprises linear, non-linear audiovisual media services and, recently, also video-sharing platforms (VSPs) and user-generated content. One of the novelties in the revised text of the AVMSD is the new set of legal provisions enshrined in Art. 4 referring to the anti-circumvention procedure, a phenomenon the European media landscape has long been familiar with (i.e. broadcasters from another Member State circumventing the stricter rules of the target Member State).
