  خلا التشريع المقارن وقصر الفقه عن إيجاد تعريف للمنتوجات المتشابهة وكذلك المسؤوليّة المدنيّة الجماعيّة الناجمة عن أضرارها، وبشكل عام يمكننا تعريف المنتوجات المتشابهة بأنها: (المحاصيل المعدة للاستخدام والاستهلاك والمتشابهة من حيث الخصائص والعمل والغاية ولكن لمنتجين مختلفين). والمنتوجات المتشابهة من حيث النوع كثيرة جداً ومتعددة، ولا يمكن حصرها في أي حالٍ من الأحوال، وأنّ هذه المنتوجات أو السلع في تطوّر وتزايد دائم مع التطور الذي تشهده البشرية؛ فضلاً عن إزدياد رغبات وحاجات الإنسان في حياته اليومية.
  أما بالنسبة للمسؤولية المدنيّة الجماعيّة، فهي عبارة عن: (التزام مجموعة من الأشخاص بجبر الضرر عند تعذر معرفة الفاعل بينهم، وذلك بسبب عدم تمكّن المتضرر من إثبات الرابطة السببيّة بالشكل المعهود بين الفعل المتسبّب بالضرر والضرر الذي أصابه). والطبيعة القانونيّة للمسؤولية المدنيّة الجماعيّة عن أضرار المنتوجات المتشابهة، هي ذات طبيعة تقصيرية، ولا يمكن في أيّ حال من الأحوال تصوّر الطابع العقدي لها، لأنه لو أمكن ذلك لتمكّنا من تعيين المتسبّب بالضرر أو المتسبّبين به، ومن ثم نخرج من نطاق المسؤوليّة المدنيّة الجماعيّة؛ وذلك لسقوط شرطها ألا وهو عدم التمكّن من تمييز الطرف المتسبّب بالضرر من بين المجموعة، وندخل في نطاق المسؤوليّة المدنيّة العقدية.
  ومن خلال بحثنا ظهر لنا، أنه لا يمكن الاعتماد على الأسس التقليدية لقيام المسؤوليّة المدنيّة كالنظرية الشخصية والنظرية الموضوعية كأسس لقيام المسؤوليّة المدنيّة الجماعيّة بشكل عام والمسؤوليّة المدنيّة الجماعيّة عن أضرار المنتوجات المتشابهة بشكل خاص، وقد ظهرت في هذا الصدد أسس حديثة للمسؤولية المدنيّة عن المنتوجات، ومن ضمنها المسؤوليّة الجماعيّة عن المنتوجات، فهي ثلاثة أنواع، وكالآتي: الإهمال (Negligence)، والمسؤوليّة الصارمة (Strict Liability)، وخرق الضمان (Breach of Warranty)، إذ بإمكاننا الاتكاء عليها كأسس للمسؤولية المدنيّة عن أضرار المنتوجات عموماً، والمسؤوليّة المدنيّة الجماعيّة عن أضرار المنتوجات المتشابهة على وجه الخصوص.
  إنّ الإدعاء في الدعوى المدنيّة الجماعيّة الناجمة عن أضرار المنتوجات المتشابهة يكون إمّا بصورة فردية، أو بصورة جماعية، وفيما يخصّ تعويض المتضرّر فلا بُدَّ للتشريع من فرض التأمين الإجباري على المسؤوليّة الناجمة عن أضرار المنتوجات، وإن لم يكفِ مبلغ التأمين فلا بُدَّ من صندوق ضمان، وذلك لضمان حصول المتضرّر على التعويض العادل.

How do activist plaintiffs experience the process of human rights litigation under the Alien Tort Statute (ATS)? Answering this question is key to understanding the impact on transnational legal mobilization of Kiobel v. Royal Dutch Petroleum Co., in which the US Supreme Court sharply limited the scope of the ATS. Yet sociolegal scholars know remarkably little about the experiences of ATS litigants, before or after Kiobel. This article describes how activist litigants in a landmark ATS class action against former Philippine President Ferdinand Marcos faced a series of strategic dilemmas, and how disagreements over how to resolve those dilemmas played into divisions between activists and organizations on the Philippine left. The article develops an analytical framework focused on litigation dilemmas to explain how and why activists who pursue ATS litigation as an opportunity for legal mobilization may also encounter strategic dilemmas that contribute to dissension within a social movement.

Sara Golru, in ‘The Challenge of Proving Toxic Tort Causation: Genetic Markers as the Solution?’, presents a comparative analysis of the role of genetic marker evidence in toxic tort cases throughout Australia and the United States. Sara identifies inconsistencies in the approach of Australian courts to genetic evidence of causation, and considers how developments in the US can inform toxic tort litigation in Australia.

O artigo explora a experiência norte-americana com os bellwether trials. Os bellwether trials consistem em uma técnica de julgamento por amostragem desenvolvida com o objetivo oferecer uma alternativa às class actions na resolução massificada de casos repetitivos. O instituto se assemelha ao Incidente de Resolução de Demandas Repetitivas, mas com procedimento e efeitos particulares, ainda inexplorados pela doutrina brasileira, que podem contribuir ao desenvolvimento da tutela coletiva e pluri-individual. Este artigo apresenta o contexto em que surgiram os bellwether trials, os conceitua, explicita seu procedimento, explora casos emblemáticos em que foram utilizados e, ao final, tece comentários críticos sobre suas características mais marcantes, demonstrando como algumas delas, se incorporadas, poderiam aperfeiçoar o sistema e a prática de resolução de litígios de massa no Brasil.

As modern research demonstrates the implausibility of the Somatic Mutation Theory in cancer causation, judges in Daubert jurisdictions will undoubtedly be called upon to decide whether SMT-based expert testimony still has a place in the courtroom. To make these determinations, judges will have to become amateur scientists, say Roberto Vela and Ford Loker of Miles & Stockbridge P.C.

Resumen:
El presente trabajo consiste en un análisis de las acciones de grupo para la tutela de consumidores y usuarios contenidas en el Código Procesal Civil hondureño, vigente desde 2006, y las posibilidades que esta figura jurídica ofrece para la tutela de los intereses ambientales. Incluye una descripción de lo que implica la tutela de intereses ambientales, y un análisis de las caracteríticas del instrumento disponible en la norma procesal. Entre las características analizadas está la legitimación, la carga de la prueba, las medidas cautelares, el efecto de la cosa juzgada y el papel del juez en procesos de este tipo.

Abstract:
This paper offer an analysis of a form of collective redress available in the Honduran Civil Procedural Law in force since 2006, of consumers and legal possibilities for the protection of environmental interests. It includes a description of what constitutes the protection of environmental interests and the characteristics of the instruments available. Among the features analyzed are standing, burden of proof, precautionary measures or injunctions, the res judicata effect, as well as the role of judges in such peculiar processes.

Statutes of limitations provide manufacturers and their insurers with certainty regarding potential product liabilities and relieve the courts and defendants of the burden and prejudice of stale claims. But what happens when your client is defending a suit and moves for summary judgment in a civil action on grounds that the plaintiff’s claims are time-barred, and “emergency” legislation is subsequently enacted that purports to extend the limitations period at issue?

This discussion of causal uncertainty in tort liability adopts a comparative approach in order to highlight the important normative, epistemological and procedural implications of the various proposed solutions. Occupying a middle ground between the legal perspective and the philosophical views that are at stake when it comes to the resolution of tort law cases in a context of causal uncertainty, the arguments will be of great interest to legal scholars, legal philosophers and advanced tort law students.
