RESUMO: A presente investigação visa a compreender, empiricamente, se o sucessivo e repetitivo patenteamento de processos e produtos farmacêuticos, pelos mesmos depositantes, pode ser considerado justificativa suficiente para o expressivo número de arquivamentos de pedidos de patente relacionados à doença de Chagas, no âmbito do INPI. Metodologicamente, este estudo compõe um diagnóstico empírico mais amplo, sustentado por inferências descritivas e guiado pelas regras de inferência de Epstein e King. O substrato teórico utilizado é composto pela interação entre a moralidade da aspiração e a moralidade do dever, de acordo com a perspectiva teórica de Bankowski. Ao final, foi possível concluir que, apesar da hipótese inicial levantada, a razão pelo expressivo número de arquivamentos detectado, no caso da doença de Chagas, não é o múltiplo patenteamento de processos e produtos farmacêuticos pelo mesmo depositante, uma vez que, a partir dos dados analisados, este fenômeno não pôde ser constatado.

RESUMO: A presente pesquisa se propõe a investigar se o cumprimento dos deveres impostos pelo sistema jurídico de patentes está em consonância com sua aspiração de incentivar a inovação no que concerne à pesquisa e ao desenvolvimento (P&D) de produtos destinados ao combate das doenças negligenciadas. Essa investigação configura-se como um diagnóstico empírico preliminar sustentado por inferências descritivas, formuladas a partir da coleta indireta de dados e guiadas pelas regras de inferência de Epstein e King. O substrato teórico utilizado é composto pela interação entre a moralidade da aspiração e a moralidade do dever, de acordo com a perspectiva teórica de Bankowski. Desse modo, em primeiro lugar, é possível inferir que o cumprimento dos deveres impostos pelo atual modelo de exclusividade tem se mostrado insuficiente para incentivar a inovação no caso específico das doenças negligenciadas. Em segundo lugar, verifica-se que, mesmo dentro do grupo dessas enfermidades, algumas delas podem ser consideradas mais negligenciadas do que outras, podendo demandar tratamentos diferenciados, no que diz respeito à operacionalização do sistema jurídico de patentes e à elaboração de políticas públicas. Non-communicable diseases dominate the public health arena in China, yet neglected tropical diseases (NTDs) are still widespread and create a substantial burden. We review the geographical distribution, prevalence, and epidemic characteristics of NTDs identified in China caused by helminths, protozoa, bacteria, and viruses. Lymphatic filariasis was eliminated in 2007, but schistosomiasis still affects up to 5% of local village residents in some endemic counties with around 300 000 people infected. China harbours more than 90% of the world's burden of alveolar echinococcosis and food-borne zoonoses are emerging. In 2010, the overall prevalence of soil-transmitted helminth infections caused by Ascaris lumbricoides, Trichuris trichiura, and hookworm was 11·4%, with 6·8% of these infections caused by A lumbricoides. Managing lymphatic filariasis (LF) morbidity and reducing disability is one of the two primary goals of the Global Programme to Eliminate Lymphatic Filariasis. However, in order to achieve this, the geographical distribution of LF morbidity needs to be better estimated. All cases of lymphoedema within a single health centre catchment area (pop. 42 000) in the southern region of Malawi were examined. Maps of lymphoedema burden were produced and trends in patient demographics, severity of lymphoedema (Dreyer staging) and health-seeking behaviour were explored. The number of lymphoedema cases was compared with records maintained by the Ministry of Health, Malawi. A total of 69 lymphoedema cases were identified (32 per 10 000 population), of which 48 (70%) were female and 21 (30%) male. The majority of cases (51/69) had Dreyer stage 2-3, and almost all (65/69) had experienced acute attacks as a result of their lymphoedema. Human African trypanosomiasis (HAT) has been neglected for a long time. The most recent drug to treat this disease, eflornithine, was approved by the US FDA in 2000. Current treatments exhibit numerous problematic side effects and are often ineffective against the debilitating CNS resident stage of the disease. Fortunately, several partnerships and initiatives have been formed over the last 20 years in an effort to eradicate HAT, along with a number of other neglected diseases. This has led to an increasing number of foundations and research institutions that are currently working on the development of new drugs for HAT and tools with which to diagnose and treat patients. New biochemical pathways as therapeutic targets are emerging, accompanied by increasing numbers of new antitrypanosomal compound classes. The future looks promising that this collaborative approach will facilitate eagerly awaited breakthroughs in the treatment of HAT.

The study sought to analyze the magnitude of occurrence and the sociodemographic, economic and clinical profiles of leprosy associated with household social networks (HSN), with disease overlap in cities from the states of Bahia, Piauí and Rondônia, Brazil, from 2001 to 2014. This is a cross-sectional study using primary and secondary data regarding new cases of leprosy notified to the Brazilian Information System for Notifiable Diseases (SINAN, in Portuguese) residing in the cities. We applied a standardized instrument to the new cases and reviewed data from charts and from SINAN. Of a total of 1,032 (29.6%) assessed cases, 538 (52.1%) had more than one case in their HSN. There were larger frequencies of female sex (292; 54.3%), age between 41 and 60 years (240; 44.6%), primary education (272; 50.6%), income lower than the minimum wage (265; 49.3%) and living with 5 or more people (265; 49.3%). The overlap of cases in the HSN was associated in the multivariate analysis with residing in cities in the state of Rondônia (PR = 1.23; 95%CI: 1.07-1.43; p = 0.003), as well as living with 3 to 4 people in the same household (PR = 1.66; 95%CI: 1.11-2.49; p = 0.014) and having leprosy reaction (PR = 1.31; 95%CI: 0.99-1.70; p = 0.050). Case repetition within the same HSN is a frequent event in the situations we studied. Its occurrence must be considered as a sentinel indicator of greater epidemiological severity in primary health care surveillance. We highlight the vulnerability of affected families.

Lymphatic filariasis (LF) is a disfiguring parasitic disease and one of the leading causes of disability in the world. This study aimed to assess the severity of lymphoedema, the physical restrictions and socio-economic impact on affected individuals living in an endemic community in Malawi. In a single health centre catchment area, a follow-up survey was conducted to assess 69 lymphoedema cases, and the impact of their condition in eight different areas of their lives. Differences were examined by sex, age and severity of disease. The overall level of disability was quantified and the impact of acute dermatolymphangioadenitis (ADLA) attacks was examined. O presente estudo exploratório visa a investigar empiricamente os efeitos gerados pela aplicação legalista do sistema jurídico de patentes no âmbito do judiciário brasileiro, especificamente, no que se refere às demandas por medicamentos experimentais para doenças negligenciadas. A partir da coleta direta de dados empíricos, disponíveis nas bases do STF, o trabalho parte da realização de uma inferência descritiva, de acordo com as regras de inferência de Lee Epstein e Gary King, para testar a hipótese inicial levantada. Ademais, o substrato teórico do trabalho é composto pela ideia de legalismo, elaborada na perspectiva de Zenon Bankowski, em que se enfatiza a moralidade do dever em detrimento da moralidade da aspiração. A falha de pesquisa e desenvolvimento (P&D) de medicamentos destinados às doenças negligenciadas parece ser a causa para que o poder judiciário permaneça uma instância alheia aos problemas da população afetada por esse tipo de enfermidade, sobretudo, em casos de inexistência ou ineficácia dos medicamentos disponíveis no mercado. Por fim, destaca-se que essa investigação está inserida no contexto de um diagnóstico mais amplo sobre os impactos da atual conformação do sistema patentário na realidade dos países em desenvolvimento.
