First Agenda (Kapatagan Apprehension)

: As I check the attendance majority of multi-sectoral members are

presents and being presiding officer I declared forum. To start with
may request each and every one of us to rise for the prayers. We
conducted this administrative adjudication since this is our job being
a member of multi-sectoral forest protection committee. If any
anyone wants to talk or give comments just raise your right hand
and the presiding officer will grant and then you can talk to observe
silence. I presumed that you have received a notice of hearing that’s
why you are present here.
In this deliberation we do not decide but only give recommendation
of the subject matter. To avoid biased we will solicit the majority
opinions of the member. The decision of the majority member will be
written in the resolution. Every agenda has different resolution. We
will be the one who will make the resolution, everybody has the right
to sign and refuse the resolution. If you have comments to the
resolution just tell us and we will remake the resolution.
Per our notice of hearing there are 6 agenda but since we are
running out of time since we started past 10:00 o’ clock and we
cannot tackle all of these. Considering that the others was last year
apprehension we will prioritize this year 2021 apprehension, the
number 3 and 4 agenda.
The number 3 agenda is apprehension of 1unit vehicle bearing a
temporary plate number 090101 loaded with 1,010 pieces of
undocumented forest products belong to Lauan species with an
aggregate volume of 2,059.9 board feet, effected by PNP of

Is there any representative from PNP Kapatagan? None?
Okay, Forester Hasoba have we send notice of hearing at PNP
Kapatagan?
For. Sood : Yes sir.
They must be here, actually this apprehended forest products, we
have already filed criminal complained at Provincial Prosecutor’s
Office at Tubod, LDN and it was already received. We send notice
to alleged claimant to be present in this deliberation to say
something about the items we apprehended. To know whatever
For. Gauntel : legal documents, they have to present to us for us to evaluate and
made our recommendation but unfortunately there is no
representative even in the PNP of Kapatagan. Anyway the member
of the multi sectoral present here, we will be the one to do the
conclusion, I am requesting For. Hasoba to informed us regarding
this apprehended 1 vehicle and illegal forest products.
On or about 7:00 o’ clock in the evening of February 12, 2021, the
PNP-Kapatagan responded to vehicular accident at P-4, Brgy.
Poblacion, Kapatagan, Lanao del Norte. Upon arrival at the area,
one of the vehicles involve in the accident is loaded with
undocumented forest products. The PNP-Kapatagan then informed
the DENR, CENRO-Kolambugan that they apprehended a vehicle
loaded with undocumented forest products. The DENR, CENRO-
Kolambugan representative then went to Kapatagan Police Station
in the morning of February 13, 2021 to scale the volume of the
forest products and to know who is the owner or driver of the

apprehended vehicle. According to the PNP-Kapatagan the driver of
the apprehended vehicle escaped after the incident. The DENR-
Kolambugan representative then checked the vehicle with plate
number 090101, Engine No. SL 174555, Chassis No. WGLAT
104291 and found a photocopy of the Official Receipt and Certificate
of Registration (OR/CR) named to a certain ALVIN M. SAMER of
Babak, Lapu-lapu City. The undocumented forest products are
Lauan species with a volume of 2059 board feet (bd. Ft.) The
vehicle and forest products are now in the temporary custody of
PNP-Kapatagan.

Only the name of OR/CR Official Receipt and Certificate of

registration (OR/CR)
I would have wish the presence of PNP-Kapatagan perhaps next
time when we conduct deliberation, from the CENRO perhaps we
could ensure proper receipt of the Notice of Hearing to ensure their
Atty. Bete attendance since their presence is important, I would have asked
short question from any the representative of Kapatagan ,if they
already filed as you said earlier criminal case to know if there might
be a certain development and to identify the liable person.
Any comment from the member about the apprehension in

To compel the attendance of PNP-Kapatagan, next time when
giving notice of hearing, I suggest you also copy furnished the
PLT. Tabaquero
Provincial Director so he can monitor whether personnel of
Kapatagan attended this meeting.
In order the PNP-Kapatagan cannot refuse to attend special

invite him we will also copy furnished the Provincial Director.

regarding topic number 3, I move the favorable issuance of
Bassit Acmad: confiscation order by the Regional Executive Director on the
apprehended items of the forest product and subsequently filing of
appropriate action for charges against the offender.

Second Agenda (Nunungan Apprehension)

Any queries or clarification regarding this apprehension, None?

Okay. Shall we proceed to another agenda, what’s your opinion,
since we cannot interrogate the alleged owner because he’s not
here and also the apprehending official since PNP-Kapatagan is not
around. Actually what happened is that they called us, they
intercepted that there is an incident happened and then we
immediately responded to conduct the inventory and to look for legal
documents but there is none, attorney is right that DENR testimony
is insufficient that we need the PNP- Kapatagan since they are the
one who conducted initial investigation as to the ownership of the
vehicle and forest product. We will proceed to the second agenda,
as I was saying we will prioritize this year apprehension. For the
For. Gauntel
information of the everybody last Monday we were invited by the
Sanguniang Panglalawigan of Lanao del Norte for special meeting,
a special session of ESP on the delay of the filing of appropriate
criminal charges in courts, I personally attended and discussed it to
them. The second agenda is the apprehension of 124 pcs of
undocumented forest products belong to Lauan species with and
aggregate volume of 1,240 board feet, effected by PENRO and
CENRO field personnel in coordination with the Anti-Illegal Logging
Task force at Brgy. Notongan, Nunungan, Lanao del Norte on
February 12, 2021. Actually these forest products were in the
custody of Philippine Army of Salvador. Forester Hasoba kindly
orient and give the detailed of the apprehended forest products.
On or about 8:00 o’clock in the morning of February 12, 2021, the
Joint-Operation Team conducted a briefing at the Poblacion,
Kapatagan, Lanao del Norte before going to the area where the
alleged illegal forest product is abandoned. Thereafter, the Joint-
For. Hasoba Operation Team proceeded to the Brgy. Notongan, Nunungan,
Lanao del Norte. Upon arrival at the area, the Joint Operation Team
found the abandoned 124 spices Lauan with a volume of 1,240
board feet. The forest product is now in the custody of Camp Allere
for temporary proceeding.

For. Hasoba No one claimed in the Barangay, at the PNP and in the office.

Actually we conducted investigation on that incident and we found
out that those abandoned logs where confiscated between the
boundaries of Notongan and Baning but some of the logs where
confiscated at the Brgy. Baning so I suggest to DENR if we could
take action on the Brgy. Captain of Brgy. Baning why he did not
notify the nearest Police station regarding to the logs that were
PLT. Tabaquero taken by DENR because in Brgy Notungan, the Brgy. Chairman
informed the Municipal Mayor and the Municipal Mayor informed me
regarding to the illegal logs that where happening in the area, so I
talked to the Officer In Charge of Sapad Municipal Station, he
confirmed to me that no information received from the Brgy Officials
of Baning so we can ask our legal Officer on what action we take on
our Brgy. local officials for tolerating that illegal activities
As an advance information, there was a one special meeting uphold
by Hon. Congressman Abdullah Dimaporo. They told the chainsaw
operator of Nunungan and the Brgy. Chairmen. As said by
For. Gauntel
Congressman the Brgy. Executives who is responsible must give
feed back to the military, the PNP and the DENR regarding to those
illegal loggings.
Perhaps we can send them notices why they did notice it and if they
notice it why they did not report it because it falls as nonfeasance on
the part of the public officers for not doing their responsibility in
Atty. Bete
informing authority, as based on the pictures it’s impossible not to
notice the illegal logs.

Actually Attorney that area is near in the Basketball court area so it’s

It’s quite far Sir, but the logs are 10 meters near to the basketball

We will send communication to the Brgy. Official to explain their side
why they
did report the logs to the Police station and to our office. In the
Atty. Bete situation of Kapatagan we found some Official receipt because of
the vehicle but in this case since it is abandoned we do not know
who should we prosecute criminally and administratively. We are
asking assistance from the PNP about this case.
For. Gauntel I want put that on the manifestation the Brgy. Baning
Additional information to the PNP, the apprehended forest product
Bassit Acmad was in the boundary of Nunungan and Baning, the logs were located
where adjacent to NGP project.
For. Gauntel Considering that this forest product has no claimant and no vehicle
involve, according to our lawyer we will export effort, we will find way
if possible to determine the owner so that we can filed the
appropriate charges. So we will send notice to the Brgy. Chairman
of Baning for possible feedback from him about the claimant of the
forest products.
Is there any motion for recommending that these forest products will
be issued with corresponding forfeiture order to be issued by our
Regional Executive Director that these forest products be donated in
the Philippine Army since they need it.

The recommendation of multi-sectoral is very important since it is

the bases of our Regional Director in the proper disposition of the
apprehended forest products

The second agenda is done, let’s move to Agenda No. 5 the
strengthening of Multi-sectoral Forest Protection Committee(MFPC).
For. Gauntel This include activation since before it is part of the agenda
considering there are changes of the members. We will make
Memorandum of Agreement (MOA) regarding to the member of the
Multi-sectoral Forest Protection Committee(MFPC).
