In the interest of the service and to fully adopt a systematized process that
will enhance safeguarding of the integrity of the assessment and certification
system, the following guidelines in the institutionalization of issuance of E-
Certificate in all regions is hereby issued;

I. Background

In August 2021, an enhancement in the agency’s system was introduced. This


system primarily aims to strengthen the integrity of assessment and
certification particularly on the TESDA-issued National Certificate (NC) and
Certificate of Competency (CoC) to individuals who are found to be competent
in a particular qualification.

The implementation of the issuance of E-Certificate in the National Capital


Region (NCR) and Certification Office (CO) enabled the system to full-proof
the approach towards eventual nationwide deployment. The gradual adoption
of the system in NCR encountered operational issues associated with various
conditions on assessment and certification and provided an opportunity to
address the issues before the full institutionalization across all regions.

From its pilot implementation starting August 01, 2021 up to the


institutionalization in all Accredited Assessment Centers (ACs) in NCR on July
18, 2022, the system report on Process Cycle Time (PCT) generated in the
TESDA Training Management Information System (T2MIS) on December 31,
2022 reflects a total of 73,135 E-Certificates issued to competent individuals.
With an adoption rate of 80% among all the District Offices (DOs) in TESDA
NCR, where about 20% of the total Accredited Assessment Centers are,
TESDA is now ready to implement the system in the remaining regions.

II. Objectives

The issuance of E-Certificate aims to:

1. Reduce the Process Cycle Time (PCT) in the issuance of TESDA NC and
CoC;

2. Cease the issuance of paper-NC/CoC and adopt digital transformation in


TESDA processes

3. Prevent erroneous information in the issued TESDA NC/CoC; and

4. Mitigate proliferation of fake TESDA NC/CoC.

III. Scope and Coverage

These guidelines shall cover the following;

1. Procedure of validation of the candidate’s information on the day of the


competency assessment to the issuance of E-Certificate (NC/CoC) to
successful candidates, including the monitoring of PCT on the issuance
of E-NC/CoC;

2. All of the qualifications in all TESDA-accredited ACs including those


conducted through Onsite Assessment and Competency Assessment
conducted for Special Clients (PRLEC, Indigenous Peoples, Rebel
Returnees, etc.);

3. Competency Assessment conducted by the CO namely Capability


Building Program (CBP) for Regional Lead Assessors (RLAs), Portfolio
Assessment, and Overseas Assessment Program (OAP);

4. Renewal and/or conversion of TESDA-issued NCs/CoCs;

5. Process of Issuance of Certification Authentication and Verification (CAV).

IV. Implementation Arrangements

1. All TESDA Provincial/District Offices (PO/DOs) shall assign CAC Lead


Operations Officers (LOOs) for the implementation of the issuance of E-
Certificate. The TESDA Provincial/District Directors (P/DD) shall assign
LOOs strictly complying to the qualifications stated in Item No. 5.1,
Section V of these guidelines.

2. Filing of application for Competency Assessment and the conduct of


competency assessment of candidates shall be in accordance and adhere
to the existing guidelines on Assessment and Certification.

3. The TESDA Regional and Provincial/District Offices (ROPO/DOs), and


accredited ACs shall require a valid email address from the assessment
applicants during the filing for application for competency assessment.
The email address shall be valid and personal to the applicant. Use
of the employer’s or company’s email address is strictly prohibited.

4. All TESDA PO/DOs shall also comply to the technical requirements in
these guidelines for the issuance of E-Certificate for the purpose of
conversion and renewal of NC/CoC.

5. Automatic Numbering System shall also be adopted in the conversion and


renewal of NC/CoC.

6. For the purpose of validation of birth date and full name of assessment
candidates, they shall be advised to bring any of the following and shall
be presented on the day of the assessment;

6.1. Valid Passport;


6.2. PSA Copy of Birth Certificate;
6.3. Any Government-Issued Identification Card with photo and date of
birth;
6.4. Any of the following for married women;
6.4.1 PSA copy of Marriage Contract;
6.4.2 Certification from the Local Civil Registry; or
6.4.3 Certification from Barangay.

7. Conduct of Assessment

7.1. The following steps shall be undertaken by the AC on the day of the
conduct of the assessment;

7.1.1 Step 1: Validation of Application

(a) The AC Processing Officer shall validate the application


documents of the candidates forwarded by the TESDA
PO/DOs and request the candidates to accomplish the
TESDA Consent Agreement Form (TESDA-DPA-Form
2). The AC Processing Officer shall ensure that all
required information in the application form are complete
and correct e.g., spelling of name, birth date, registered
email address. The arrangement of candidates shall be
according to the sequence of the names in the
assessment schedule.

(b) The Processing Officer shall require all candidates to


have a valid and personal e-mail address. The
Employer, Agency, or Company e-mail address shall
not be accepted.

(c) For onsite assessment and competency assessment of
special clients (PRLEC, Indigenous People, and Rebel
Returnees), the TESDA PO/DOs shall extend their
assistance to ensure that the candidates for assessment
have valid email address prior to the conduct of
competency assessment.

(d) The screen/monitor of the computer should be facing the


candidate while showing the actual information of the
candidate registered in the T2MIS for immediate
correction/updating, to make sure entry in the system are
all correct and accurate.

7.1.2SteD 2: Caoture of Photo and Diaital Sionature

(a) The candidate shall proceed to the window/desk for


capturing of the photo, digital signature, and confirmation
or updating of e-mail address. Candidates shall be in bare
face (with no eyeglasses, colored contact lens, or any
accessories that may cover the facial features, showing
the left and right ears, with neutral face expression and
both eyes open). Wearing of head scarf/veil for religious
or health reasons shall be allowed.

(b) Prior to the day of the assessment, candidates shall be


informed to wear a shirt/top garment with collar.
Candidates shall wear the required PPEs, as necessary,
after the capture of photos.

(c) Capturing of photo and digital signature shall be


strictly done within the day of assessment and in
every assessment that the individual will take.

(d) For onsite assessment and competency assessment of


special clients where faces of candidates are withheld
due to lawful order, the TESDA P/DDs shall submit a
Certification (attached as ANNEX A). This Certification
shall be endorsed by the TESDA Regional Director to the
Executive Director of the TESDA CO for inclusion in the
report on PCT.

7.1.3Step 3: Competency Assessment

(a) For easy identification during the actual assessment, the


candidate shall be provided with a number. The
candidate shall proceed to the designated area/room for
orientation. Conduct of competency assessment shall
adhere to the existing procedures and guidelines.

7.2. Competency Assessment conducted by the CO:

7.2.1 CBP for RLAs and OAP;

(a) For CO assessment, the processing of applications shall


follow the corresponding issued policies and guidelines.
(b) The steps listed above shall be followed by the CO
Processing Officer.

7.2.2 Conduct of Portfolio Assessment;

(a) The CO Processing Officer shall inform the candidates to


submit the following:

(i) JPG file format of colored high-resolution passport


size photo, white background, and wearing a
corporate suit/attire or a shirt with a collar;
(ii) JPG file format in a high-resolution photo of three (3)
specimen signatures, using black ink, white
background; and
(iii) Scanned copy of two (2) Government Identification
Cards with photo and signature.

(b) The CO Processing Officer shall verify by e-meeting the


candidate through any video conferencing application, or
social application e.g. facebook messenger, etc.

7.3. All competent candidates shall receive their E-Certificate individually


through their respective registered email addresses.

7.4. The issuance of E-Certificate shall be the basis of the report on the
GAA Indicator on the PCT in the Preparation and Issuance of
Certificate. Once the E-Certificate has been transmitted to the email
of the certified worker, it shall be automatically recorded in the report
on PCT in the T2MIS report module._________________________

7.5. The CAC Focal who is a permanent employee from the TESDA
ROPO/DOs shall be given exclusive access to the report on PCT in
the T2MIS.

V. Responsibilities

1. TESDA Central Office

1.1. Information Communication and Technology Office (ICTO)


shall:

1.1.1 Perform timely system maintenance and recommend system


enhancement:

1.1.2 Facilitate training and orientation on the issuance of E-


Certificate to the CAC LOOs in coordination with the
Certification Office; and

1.1.3 Provide technical assistance on the institutionalization of the E-


Certificate system.

1.2. CO shall:

1.2.1 Facilitate training and orientation on the issuance of E-


Certificate to the CAC LOOs in coordination with the
Information Communication and Technology Office; and

1.2.2 Provide technical assistance on the institutionalization of the


E-Certificate system.

2. TESDA Regional Offices (ROs) shall:

2.1. Oversee the implementation of the assessment and certification


activities in the region;

2.2. Receive and accept assessment application requirements and


endorse to the TESDA PO/DOs for processing. Applicant’s
information i.e. Full Name, Birth Date and Email Address shall
be strictly validated prior to the endorsement to the TESDA
Provincial/District Office;

2.3. Verify the readiness of the candidate through the accomplished Self-
Assessment Guide (SAG) and any other document in support of
Recognition of Prior Learning (RPL) such as Certificate of
Employment (COE) or other evidence;

2.4. Monitor compliance of ACs on the requirements for the issuance of


E-Certificate;

2.5. Accredit ACs compliant with the requirements on the Accreditation


of ACs and the requirements for the issuance of E-Certificate;

2.6. Provide technical assistance to the candidates, TESDA PO/DOs,


and accredited ACs on the issuance of E-Certificate; and

2.7. Conduct training and orientation together with the TESDA PO/DOs
to the TESDA accredited ACs on the system of issuance of E-
Certificate.

3. TESDA PO/DOs shall:

3.1. Manage the implementation of assessment and certification


activities in the province/district, to wit:

3.1.1 Receive and accept assessment application requirements.


Applicant’s information i.e. Full Name, Birth Date and
Email Address shall be strictly validated prior to the
endorsement to the TESDA accredited Assessment
Center;

3.1.2 Verify the readiness of the candidate through the accomplished


Self-Assessment Guide (SAG) and any other document in
support of Recognition of Prior Learning (RPL) such as
Certificate of Employment (COE) or other evidence;

3.1.3 Pool all qualified applicants according to the needed basic


information, i.e., location, qualification etc., in the application
requirements;

3.1.4 The P/DDs shall officially endorse the applicants to the ACs;

3.1.5 The PODO CAC Focal shall create the assessment schedule
according to the number of applicant-candidates endorsed by
the TESDA RO and TESDA AC;

3.1.6 The P/DDs shall assign the Competency Assessor (CA)


ensuring that all Accredited CAs in the Province are given
the assignment to conduct an assessment on a rotation
basis.

3.1.7 The P/DD and PODO CAC Focal reviews and validates the
assessment results in assessment documents;

3.1.8 The CAC LOO shall encode the validated results in the T2MIS
on the day after the conduct of assessment;

3.1.9 Issue the E-Certificate to competent individuals through email;


and

3.1.10 Facilitate conversion, renewal and issuance of


Certification, Authentication and Verification (CAV) to certified
individuals.

3.2. Conduct training and orientation together with the TESDA RO to the
TESDA accredited ACs on the system of issuance of E-Certificate.

3.3. The P/DDs shall assign CAC LOOs for the implementation of the
issuance of E-Certificate.

3.4. Provide technical assistance to the candidates and TESDA


Accredited ACs on the issuance of E-Certificate.

3.5. The P/DDs and CAC Focal hold accountability in ensuring security
and confidentiality of the information in the system.

4. TESDA Accredited ACs shall:

4.1. Receive processed assessment application requirements from the


TESDA PO/DOs for encoding. Applicant’s information i.e. Full
Name, Birth Date and Email Address shall be strictly validated
prior encoding;

4.2. Verify the readiness of the candidate through the accomplished Self-
Assessment Guide (SAG) and any other document in support of
Recognition of Prior Learning (RPL) such as Certificate of
Employment (COE) or other evidence;

4.3. Establish a facility with complete tools and equipment for the
issuance of E-Certificate;

4.4. Conduct competency assessment according to the existing


procedures and guidelines; and

4.5. Ensure the correctness of all information of the assessment


candidates.

CAC LOOs shall:

5.1. Have the following qualifications:

5.1.1 Knowledge on data user interface and query software, object­


or component-oriented software;

5.1.2 Excellent data entry skills for accurately maintaining


processing logs;

5.1.3 Keen attention to detail, critical thinking and analytical skills;

5.1.4 Problem-solving skills to effectively resolve database and


system issues and user concerns; and

5.1.5 Verbal communication to explain complex technical information


to users with little technical knowledge

5.2. Attend the training and orientation to be conducted by the CO and


ICTO;

5.3. Conduct training of representatives from the accredited Assessment


Centers in their respective PO/DOs;

5.4. Serve as the Contact Person of the Central Office and ACs in the
PO/DO relative to the concerns on the E-Certificate;

5.5. Encode the validated assessment results by the P/DD and CAC
Focal, in the T2MIS; generate the certificate number; generate the

E-Certificate of competent candidates; after which the system
automatically transmits the E-Certificate to the registered email
address of the competent candidate in a password-protected
Portable Document Format (PDF).

5.6. Hold accountability in ensuring the security and confidentiality of the


information in the system; and

5.7. Monitor the encoding of candidates in the T2MIS by the Assessment


Centers.

VI. Technical Requirements

1. The ACs and PO/DOs shall have a complete Computer set or Laptop with
stable internet connectivity. A backup electronic device for internet
connection is required.

2. Photo Capturing

2.1. The ACs and PO/DOs shall set up a designated area with a white
backdrop.

2.2. A full high definition 1080P web camera is shall be set up to capture
photos of candidates. Other types of cameras may be used as long
as the photo is in high-resolution mode.

2.3. The camera shall be attached or have a direct connection to a


computer where the T2MIS shall be accessed.

3. Digital Signature

3.1. A signature pad (Wacom, EPad, etc.), graphic tablet, or any devices
that can capture digital signature may be used as long as these will
deliver accurate result. The device shall be attached or have a direct
connection to a computer where the T2MIS shall be accessed.

3.2. To ensure full functionality of the device in the system, appropriate


software and driver for the device must be installed in the computer.

4.__ For competency assessment that will be conducted in designated

internet connection is mandatory for the purpose of accessibility in the
T2MIS.

Vil. Procedure Details

1. Pre-assessment

1.1. The TESDA PO/DO CAC Focal shall validate the information of the
candidate.

1.2. The TESDA PO/DO shall create the schedule in the T2MIS and
assign Competency Assessor on a rotation basis.

1.3. The TESDA PO/DO shall endorse the validated list of candidates
together with the application documents to the AC.

1.4. The TESDA PO/DO shall ensure that the assessment schedules
are equitably distributed among ALL Accredited ACs in the
province/district and that ALL CAs are assigned to conduct
assessment, unless they are non-compliant/or have pending
case.

1.5. Upon receipt of the list of candidates from the TESDA PO/DO, the
AC Processing Officer shall register the candidates in the schedule
created by the TESDA PO/DO.

1.6. The AC Processing Officer shall inform the candidates on the details
of the assessment including the required attire (shirt/top garment
with collar) and other documents for validation purposes.

1.7. For the competency assessment that will be conducted by the


TESDA CO, the Processing Officer shall:

1.7.1 Register the candidates in the T2MIS to generate the Unique


Learners Identification (ULI);

1.7.2 Create the assessment schedule;

1.7.3 Register the candidates in the created schedule;

1.7.4 Ensure the quality of the submitted photo and specimen

1.7.5 Validate the email address of the candidates; and

1.7.6 Convert the photo and specimen signature to PNG file format
and upload in the T2MIS.

2. Assessment Day

2.1. The AC Processing Officer shall validate the application documents


of the candidates, capture individual photos and digital signatures,
and confirm or update the email address and birth date of the
candidates.

2.2. The screen/monitor of the computer should be facing the candidate


while showing the actual information of the candidate registered in
the T2MIS for immediate correction/updating, to make sure entry in
the system are all correct and accurate

2.3. The AC Processing Officer shall ensure that the photo of the
candidate shall be from shoulder level up with the head and face
occupying at least 80% of the picture.

2.4. The AC Processing Officer shall upload the photo and digital
signature of each candidate in the T2MIS.

3. Post-assessment

3.1. The AC Manager, upon issuance of CARS shall inform the


competent candidates on the issuance of the E-Certificate. During
the transitory period, AC Manager may still confirm if the competent
individual will avail the paper-based certificate.

3.2. For competent individuals who confirms to receive the paper-based


certificate during the transitory period, the Assessment Center
Manager shall inform the successful candidates on the schedule for
claiming the paper-based certificates and the amount of Php50.00
to be paid at the TESDA Provincial/District Office.

3.3. The CAC LOO shall review and validate the assessment results in
the assessment documents and encode the assessment results in
the T2MIS; generate the certificate number; generate the E-
Certificate of competent candidates; and automatically transmit the
________E-Certificate to the registered email address of the competent

candidate in a password-protected Portable Document Format
(PDF).

3.4. For the conduct of Portfolio Assessments, the TESDA CO


Processing Officer shall:

3.4.1 Inform the competent candidates on the issuance of the E-


Certificate and confirm if they will avail of the paper-based
certificate: and

3.4.2 Encode the assessment results in the T2MIS; generate the


certificate number; generate the E-Certificate of competent
candidate: and automatically transmit the E-Certificate to the
registered email address of the competent candidate in a
password-protected Portable Document Format (PDF).

3.5. The certified individual shall receive the E-Certificate and can print
the E-Certificate in any A4 size, clean white paper.

3.6. For companies/employers that require paper NC, the certified


individual must print his/her NC/CoC in a clean A4 size, white
paper and bring to the nearest TESDA Provincial/District Office
for Dry Seal.

3.7. The TESDA PO/DOCAC Focal shall verify the NC/CoC before
stamping the dry seal In the NC/CoC, which is free of charge.

3.8. The TESDA PO/DO CAC Focal shall generate the report on the
transmittal of E-Certificate which shall serve as the basis for the PCT
in the preparation and issuance of E-Certificate. The PCT report
shall be attached to the Registry of Workers Assessed and Certified
(RWAC).

3.9. The CO shall generate the PCT Report from the T2MIS on a monthly
basis, or as often as necessary.

4. Renewal of TESDA NC and CoC:

4.1. All TESDA PO/DOs shall accept application for the renewal of
TESDA issued NC and CoC.

4.2. The TESDA PO/DO shall access the Renewal Module. The Steps 1
and 2 in Section IV of these guidelines shall be followed by the
TESDA PO/DO.

4.3. For applicants that are outside of the Philippines, the TESDA PO/DO
CAC Focal shall request for the following:

4.3.1 JPG file format of colored high-resolution passport size photo,


white background, and wearing a corporate suit/attire or a shirt
with a collar;

4.3.2 JPG file format in a high-resolution photo of three (3) specimen


signatures, using black ink, white background; and

4.3.3 Scanned copy of two (2) Government Identification Cards with


photo and signature

4.4. In addition, existing procedure on the renewal of NC and CoC shall


be complied.

5. Conversion of Skills Certification to NC:

5.1. Existing guidelines and procedure on the conversion of certification


to an NC shall be followed.

5.2. The TESDA PO/DO shall access the Renewal Module. Steps 1 and
2 in Section IV of these guidelines shall be followed by the TESDA
PO/DO

6. Issuance of Certification, Authentication and Verification (CAV)

6.1. The applicant shall submit a printed copy of the E-Certificate to any
TESDA PO/DO and pay the processing fee of Php50.00.

6.2. The TESDA PO/DO CAC Focal shall validate the assessment
records in the T2MIS. If found correct and complete, the TESDA
PO/DO CAC Focal shall issue the CAV according to the prescribed
template (ANNEX B).

VIII. Data Privacy and Accountability

1. Data privacy rights of the data subjects (Assessment Candidates) shall be


upheld at all times in accordance with the Data Privacy Act, relevant
issuances of the National Privacy Commission and other rules and
regulations connected thereto.

2. All clients for assessment and certification shall be issued with the Data

3. The competent individual shall be responsible for any actions that will
affect the integrity of the National Certificate and related system/s or the
rights of the subject data.

IX. Transitory Period

1. The TESDA CO in coordination with the ICTO shall conduct training and
orientation to the P/DDs, CAC Focals, and CAC LOOs within ten (10)
working days after the publication of these guidelines in the TESDA
Intranet.

2. All ACs shall be given a maximum of one (1) month to comply with the
requirements after the conduct of training and orientation by the TESDA
CO and ICTO.

3. The TESDA ICTO shall activate the added features in the T2MIS for the
issuance of E-Certificate one (1) month after the conduct of training
and orientation. Likewise, the implementation by ALL ACs shall be on
the same day of activation.

4. All TESDA POs shall implement in parallel the issuance of paper NC/CoC
and E-Certificate six (6) months after the effectivity of these guidelines.
Requests for blank NCs shall no longer be granted by the CO after the six
months transition period.

5. Likewise, immediately after effectivity of these guidelines TESDA DOs in


NCR shall no longer purchase blank NCs/CoCs from the National Printing
Office (NPO) and shall only utilize the remaining stock of paper
NCs/CoCs.

6. All TESDA ROPODOs shall utilize all of their remaining blank NCs and
CoCs within the transitory period of six (6) months. Transition period shall
start the day after the activation in the system.

7. After the six (6) months transition period, the issuance of E-Certificate
shall be institutionalized in all regions. The CO shall no longer purchase
and issue paper-based blank NCs/CoCs.

8. TESDA shall notify the NPO through the Administrative Service (AS) that
there shall be no paper NCs/CoCs to be purchased/printed six (6) months
prior to the institutionalization of the E-Certificate.

9. TESDA shall notify all agencies, employers through which the job
applicants will need to submit the National Certificates on the new system
and format of issued certificates.

X. Activity Management and Monitoring

1. The TESDA RD shall be responsible and accountable in the


institutionalization of the issuance of the E-Certificate within region.

2. The TESDA P/DDs shall be responsible and accountable in the


implementation within their respective Provinces/Districts.

3. The LOOs who are in charge of monitoring and management of the


system shall serve as the Contact Person of the Central Office and ACs
in the Province/District relative to E-Certificate concerns.

4. The Executive Director of the TESDA CO shall manage the


implementation of all CO conducted competency assessments.

5. The TESDA CO shall initiate the orientation of all concerned officers.

6. The TESDA CO shall monitor the overall implementation of the issuance


of E-Certificate.

7. The TESDA ICTO shall provide technical assistance on the


institutionalization of the E-Certificate system.

8. The TESDA CO shall only accept submission of Tracking Sheet in the


Preparation and Issuance of Certificate (TESDA-OP-CO-05-F42) from the
TESDA ROPODOs until two (2) months after the transition period.

After which, the issuance of E-Certificate shall be the basis of the
report on the GAA Indicator on the PCT in the Preparation and
Issuance of Certificate.

XI. Risk Management

The following are the identified risks in the implementation of the issuance of
E-Certificate:

1. Attempt to maliciously break into the network or system that may


compromise the integrity of information of the Certified Workers;

2. Candidates have no email address or forget after creating one;

3. Employers’ requirement for TESDA paper-based NC;

4. Unauthorized access into the system creating false/fraudulent information


and/or creating candidates profile.

To mitigate the risks, the following measures shall be undertaken:

1. Establish a security strategy of deploying security controls in the T2MIS


and applications by:

1.1. Designating a point person in the implementation of the system who


will have exclusive access such as the CAC LOOs, and the
Provincial Director who shall be held accountable for any breach in
the system;
1.2. Deployment of forms related to data protection; and
1.3. Imposition of relevant sanctions and penalties (Section XII, page 18
of this guidelines).

2. Assistance to the candidates in creating email addresses. Should the


candidates forget and could not access, the E-Certificates can be
accessed from the TESDA Provincial Office. (Section V, page 8 of this
guidelines)

3. All agencies shall be informed of the new system and format of the
National Certificate. (Section IX, page 16 of this guidelines)

4. Only the LOOs and P/DDs shall have access to the system on the

XII. Sanctions and Penalties

1. Sanctions shall be imposed for violation of these guidelines in accordance


with the provision of the Philippine TVET Competency Assessment and
Certification System (PTCACS) as amended, including future amendment
thereto.

2. TESDA personnel who will be proven to have taken part in violating these
guidelines shall be subject to proper disciplinary action in accordance with
the 2017 Rules on Administrative Cases in the Civil Service (RACCs) and
other related issuances.

XIII. Separability Clause

If for any reason, any part or provision of these guidelines is declared invalid
or unconstitutional, any part or provision not affected thereby shall remain in
full force and effect.

XIV. Repealing Clause

All issuances inconsistent herewith are declared superseded or modified


accordingly.

XV. Effectivity

This Circular takes effect as indicated in various sections of this guidelines.

ANNEX C

DATA PRIVACY AGREEMENT

This Data Privacy Agreement is made between TESDA and Competency Assessment
Candidate/Certified Individual for the purpose of adhering to the Data Privacy Act of
2012's protection of data subjects' rights.

Whereas, TESDA as a government agency which collects, processed and store


personal information, including those form clients in various projects and programs,
adheres to Republic Act No. 10173 known as Data Privacy Act of 2012;

Whereas, the TESDA Training Management Information System (T2MIS) as a


resource network and platform for TESDA's assessment and certification and related
activities contain and manages various personal information and all other data;

Whereas, Assessment Candidate and Certified Individual are limited to their access
rights and that in no way compromising the data subject's privacy rights by
unauthorized collection, use, downloading, disclosing and any other acts that will result
to violation of confidentiality, availability and integrity of the personal information and
data and the T2MIS as a whole;

Whereas, TESDA and Assessment Candidate/Certified Individual shall be bound to


the general and specific terms and condition of this agreement.

E-Ceitificate and T2MIS Access

1. The password need to remain secret and secure and strictly no sharing with the
exception for those who need to surrender his/her password if requested to do so
in the presence of his/her supervisor, as part of a work/assignment turnover;

2. That if the User is a TESDA employee. Job Order, with Contract of Services or
similar engagements, TESDA reserves the right to hold the employee liable for
damages caused by the employee's failure to protect the confidentiality of his/her
password in accordance with terms of this agreement;

3. There shall be no unauthorized file sharing and networking of whatever type;

4. There shall be no reconfiguration of any TESDA-approved VPN technology by any


users, other than the system administrators performing official duties to ensure that
mandated security requirements are not inadvertently disabled or modified;

5. T2MIS and related network resources shall not be utilized in support of unlawful
activities defined by law and any other acts that shall result to damage of the
system;

6. T2MIS and related network resources shall not be utilized for activities that violate
Data Privacy Law, Cyber Security Law and any other applicable laws.
Corresponding sanctions and penalties shall be imposed;

7. In addition to the preceding paragraph, any other acts that violates the code of
conduct policies established by the Human Resource Management Division
(HRMD) or the Agency/Company where the user is employed or under contract.

TESDA Waiver

1. Users recognize that systems and networks are imperfect and waive any claim for
lost work or time that may arise from the use of the T2MIS. TESDA shall not be
liable for degradation or loss of personal data, software, or hardware as a result of
their use of the IT System.

2. Users recognize that TESDA provides access to the T2MIS only as a privilege and
not a right; that they have no right to use it for any purpose other than those directly
connected with the work of TESDA; and that TESDA may take whatever measures
it deems necessary to enforce this. Users therefore waive any action they may
have against TESDA under any law or administrative rule or regulation for any act
the TESDA undertakes under this agreement.

Non-Disclosure

1. T2MIS Users acknowledge and adhere to the non-disclosure of the personal


information without the voluntary consent of the data subject/s and any or all other
data from T2MIS without the authority of an Authorized Officer.
