MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement, made and entered into by and between:

The Camarines Sur Polytechnic Colleges (CSPC), an educational institution duly organized and
existing under the laws of the Philippines, with postal address at San Miguel, Nabua, Camarines Sur,
represented by its College President, ________________________________ herein referred to as
“FIRST PARTY”; and _______________________________________, legal entity duly organized and
existing under and by virtue of the laws of the Philippines, with principal address at
___________________________________________, represented herein by its
___________________________________________, herein referred to as “SECOND PARTY”.

Witnesseth:

Whereas, the FIRST PARTY endeavors to establish a partnership with the SECOND PARTY an
Internship Program of its students for their practical exposure in the reputable establishments as part of
their curricular requirement for the completion of their program of study;

Whereas, the SECOND PARTY agrees to assist the FIRST PARTY in the implementation of its
internship program as part of its effort to upgrade the skills and knowledge of student interns to become
competent, effective and efficient professionals in their field of specialization; and

NOW THEREFORE, for and in consideration of the foregoing premises and the mutual
covenants herein set forth, the parties hereby agrees and stipulates the following terms and conditions

A. Roles and Responsibilities of Parties

1. The FIRST PARTY shall:


a. Select, identify, recommend and endorse student interns who will undergo the
internship which will be for a period indicated in the Internship Agreement to be
executed separately by the Student Intern with the SECOND PARTY;
b. Conduct pre-departure orientation/seminar to students and preferably with their
parents/guardians who intend to undergo the internship program with the SECOND
PARTY;
c. Provide the basic orientation on work values, behavior and discipline to properly
prepare the student interns for their internship assignments;
d. Assign/designate a Faculty Internship Coordinator who will be responsible for:
2) Monitoring the internship process of the student interns; and
3) Conduct of periodic visits to student interns to assess their needs and concerns and
advise the SECOND PARTY, if necessary.
e. Voluntarily withdraw any student intern who is found to have violated or in defiance of
the rules and regulations of the SECOND PARTY, and to impose the appropriate
sanctions;
f. Together with the student interns’ parents or guardians, waive any claim for injuries
that the student interns may suffer or sustain whether personal or pecuniary in the
performance of their functions during their internship;
g. Hold the SECOND PARTY free from any claim or suit and defend the SECOND
PARTY from any such claim or suit whatsoever in connection with this Memorandum
of Agreement.
2. The SECOND PARTY shall:
a. Accommodate for the Internship Program the student interns endorsed by the FIRST
PARTY, who have satisfactorily passed the screening procedure conducted by the
SECOND PARTY upon completion/submission of the student intern’s requirements
and the required medical examinations.
b. Conduct an orientation for the student intern detailing the student’s duties and
responsibilities during the internship program.
c. Assist the FIRST PARTY through its designated Faculty Internship Coordinator in
monitoring the active participation and attendance of student interns.
d. Issue a Certificate of Completion to student interns who have completed their
internship;
e. As may be needed, provide FIRST PARTY with relevant information of student
intern’s performance evaluation/rating, disciplinary actions and other student intern’s
records.

B. OTHER TERMS AND CONDITIONS

1. It is expressly understood that there will be no employer-employee relationship between


SECOND PARTY and the student intern of FIRST PARTY. The student interns are
deployed to the SECOND PARTY as part of its school curriculum on internship;
2. The student interns, Faculty Internship Coordinator and FIRST PARTY shall abide by
the existing rules and regulations of SECOND PARTY, and other rules which may be
introduced upon prior notice;
3. Both PARTIES shall endeavor to improve the Internship Program, through consultation
and regular dialogue;
4. Both PARTIES have the right to discontinue this Internship Program on reasonable
grounds upon written notice to the other party concerned;
5. The purpose of the internship program is not to lead further employment with the
SECOND PARTY but to complement student interns’ studies. Should an offer of
employment be envisaged, a 3-month break from the end of internship must be
respected. Interns likewise should not apply for post during the period of internship;
6. Notices under the Agreement may be delivered by hand or by registered mail (which
shall be airmailed if possible) or facsimile to the addresses or emailed to the address,
facsimile number, and email address specified;
7. If any provision of the Agreement or part thereof is rendered void, illegal or
unenforceable by any legislation to which it is the subject, it shall be rendered void,
illegal or not enforceable only to that extent and no further;
8. The Agreement, as well as its terms and conditions herein, shall be held in strict
confidence and that no portion or part hereof may be reproduced or be revealed to any
personnel or entity other than the signatories herein or their authorized representatives;
9. The Agreement constitutes the entire agreement between parties, their successors and
assignees. Any and all matters or things that the parties may have agreed, but have not
been reduced in writing herein, shall be void and ineffective; and,
10. This Agreement maybe amended, modified or altered by mutual consent of both parties.
C. Effectivity

This Agreement shall take effect upon the date of signing thereof by both parties and shall
continue to be in full force and effect until terminated. This agreement may be terminated
by either party by serving a written notice of at least 30 days to the other party.

IN WITNESS WHEREOF, the Parties have set their hands this day of
2022 , at Camarines Sur Polytechnic Colleges, Nabua, Camarines Sur, Philippines.
