This article interrogates the rationale and promise of the judgment by the
Court of Appeal in the Maina Kiai judgment. It is argued that by the Maina
Kiai court affirming the finality of results at the polling station, the Maina
Kiai judgment has the impact of imbuing a positive perception on fairness of elections and the legitimacy of electoral outcomes. This has been
achieved by doing away with the historic perception that electoral officials
tamper with electoral results at the National Tallying Centre.

Jelen tanulmány legfőbb célja rávilágítani a választójog mint alapjog, egyik aspektusa, a választójog egyenlősége szerepére a jogállamiság koncepciójában, felvázolva a tudomány jeles képviselőinek erre vonatkozó álláspontját. A magyar alkotmánybíróság választójog egyenlőségéhez kapcsolódó legfontosabb határozatai és a Velencei Bizottság kapcsolódó ajánlásai is felvillantásra kerülnek. A kérdés kapcsán kiemelésre kerül a magyarországi nemzetiségek országgyűlési képviseletének kérdése is, amelynek megoldására a rendszer-váltás óta igény jelentkezett, amely igény csupán 2010-et követően került kielégítésre. Megvizsgáljuk, hogy több mint két évtizedes mulasztásos alkotmánysértés állt-e fent a nemzetiségek országgyűlési képviseletére vonatkozóan. Fényt derítünk arra is, hogy sikerült-e kedvezményes országgyűlési képviseletet biztosítani a Magyarországon élő nemzetiségeknek, vagy éppen hátrányosabb helyzetbe kerültek a nemzetiségi választópolgárként nem regisztrált választóknál?

Este proyecto de investigación para concluir la licenciatura en Derecho trata las principales figuras que dificultan la transparencia en el sistema de financiamiento político dominicano, así como los mecanismos directos e indirectos de control que se utilizan en la actualidad tanto en la República Dominicana como en distintos países latinoamericanos y anglófonos para hacer del sistema de financiamiento uno que aporte a la institucionalidad, la equidad partidista, y que, grosso modo, mejore la calidad democrática de los procesos que él comprende.

Este artículo reexamina la idea de Lijphart (1997) de que el voto obligatorio sea un instrumento efectivo para reducir la desigualdad del ingreso con un diseño de investigación cuasi experimental basado en la técnica de matching. Los resultados muestran que el voto obligatorio no tiene un impacto significativo sobre las políticas redistributivas. En base a la experiencia de América Latina, donde predomina el voto obligatorio junto a alta desigualdad de ingresos, el artículo sostiene que el problema empírico del argumento lijphartiano se encuentra en el supuesto implícito de la existencia de un vínculo programático entre políticos y electores. Se sugiere como hipótesis alternativa que la combinación de alta participación electoral y alta desigualdad puede deberse a la prevalencia de un vínculo clientelar, frecuente en democracias con instituciones débiles.

Magyarország 2012. január 1-jén hatályba lévő Alaptörvénye a választójog területén számos változást hozott. Átrendeződött a választójogosultak köre, részben a választójog egyes pozitív feltételei meghatározásának törvényi szintre utalásával, részben pedig a kizáró okoknak az Emberi Jogok Európai Bírósága döntéseinek megfelelő átalakításának köszönhetően. De az Alkotmányhoz képest más módon közelít az Alaptörvény a választójog gyakorlásának, a választási rendszernek és a nemzetiségek parlamenti képviseletének kérdéseihez, ráadásul egy új választási alapelvet is intézményesít. E változások áttekintésére és elemzésére vállalkozik ez  a tanulmány, de foglalkozik a választójog jogalkotás formai szempontjaival, valamint az Alaptörvényből végül kimaradt, de a 21. század legizgalmasabb választójog problémájának ígérkező ún. családi választójog problémakörével is.

El derecho a la libre determinación en materia política de los pueblos originarios de México, aun cuando se encuentra reconocido en el artículo 2 de la Constitución Política de los Estados Unidos Mexicanos (2020), debe judicializarse para su ejercicio. En el Derecho constitucional de las entidades federativas de México, si bien es cierto se les reconocen derechos colectivos, no existen leyes de desarrollo constitucional que refieran a los procedimientos a seguir, en caso de que la Asamblea comunitaria de un municipio de mayoría indígena decida elegir a  sus autoridades municipales conforme a sus sistemas normativos propios. Ese vacío procesal del sistema electoral mexicano impacta en el ejercicio del derecho colectivo que tienen los pueblos originarios de decidir su destino en materia electoral municipal respetando las reglas constitucionales. Para demostrar lo anterior se hace un análisis del contexto político y jurídico del municipio indígena de Oxchuc-Chiapas, que impulsó la judicialización de ese derecho colectivo y culminó con la celebración de elecciones bajo sistemas normativos propios el 21 de abril del 2019.

Equal suffrage is a basic principle of democratic elections which is included in most constitutions and international human rights documents. It applies to the design of the boundaries of the political community, electoral system and electoral procedure. However, there are special cases where the effectiveness of this principle is questionable. This paper deals with two different aspects of the Hungarian regulation concerning the voting rights of Hungarian citizens living abroad. The paper gives an overview of the regulation and presents the recent constitutional disputes and relevant case law of Hungarian and European fundamental rights protection mechanisms. Finally, it opens the debate by posing some key questions on the future of the Hungarian situation and more generally, on the level of protection of voting rights before the national and international institutions. Court, right to vote. Generally, it is the constitutional power that decides on the boundaries of the political community and the scope of the voters who can participate in the elections of the most important democratically elected constitutional organs. The constitution usually determines these boundaries based on a combination of three criteria: age, nationality or other status, and residence.' The state can decide whether it gives voting rights to those who are residing outside the territory of the country or who are just abroad on the elections day. If they choose the inclusive solution, there is a large scale of regulation on the electoral system (how their votes can be transformed into mandates) and on electoral procedures (how they can cast their vote). There are quite few international human rights standards in this field because international documents and protection mechanisms usually give states a wide margin of appreciation concerning their electoral system and procedures. However, one of the most important electoral principles, namely, equal suffrage, is also applicable in this domain and can influence the range of possible solutions. This paper aims to present the current situation in Hungary concerning the right to vote of Hungarian citizens abroad, noting that the system was entirely amended before the 2014 parliamentary elections.

The background to the High Court case of Doherty v Ireland  was as follows. In the 2007 General Election the constituents of Donegal South West elected Mary Coughlan, Pat Gallagher, and Dinny McGinley to the 30th Dáil Éireann. Mr Gallagher’s seat became vacant on 6 June 2009 when he was elected to the European Parliament. The vacancy Mr Gallagher left in the Dáil would become the longest lasting in the history of the State. The Fianna Fáil led Government was deeply unpopular during the 2009-2010 period  as the true extent of the public cost of the 2008 banking crisis became increasingly apparent. The Government parties suffered two by-election defeats at the same time Mr Gallagher, a Fianna Fáil TD, vacated his seat.  As a result, the Government held a very narrow majority in Dáil Éireann,  which would almost certainly reduce further with another by-election. Accordingly, the Government had strong incentive to avoid holding a by-election in Donegal South West and in two other constituencies where seats had become vacant.
In the summer of 2010 Pearse Doherty, then a member of Seanad Éireann, sought a declaration from the High Court that the Government was under a constitutional obligation “at least not to oppose a motion” in Dáil Éireann to move a writ to hold a by-election to fill the vacancy. The applicant also sought an order compelling the Government not to oppose or otherwise obstruct a motion to hold the by-election.  At the substantive hearing of the case, by consent of the parties, a new relief  was added, that of a declaration simply that there had been excessive delay in filling the Dáil vacancy. It was this relief – formulated as: “there has been unreasonable delay in moving the writ for the by-election in Donegal South West” – that Kearns P granted on 3 November 2010.  The Government promptly reacted to Kearns P’s judgment; within three weeks the Donegal South West by-election had been held and won by the applicant himself.
In the context of identifying the applicant’s case as justiciable Kearns P made clear his understanding of the Constitution’s requirements for filling vacancies arising in the Dáil. He cited Article 5’s description of the state as democratic and the provisions in Article 16 on the right to vote in Dáil elections and the permissible parameters for the ratio of Dáil members to population, which much be equal around the country. He remarked that these provisions were not merely aspirational, but “set out the citizens’ rights in clear and unambiguous terms.” The judge emphasised that Article 16.7 envisaged “the filling of casual vacancies.” 
On the statutory interpretation question, Kearns P read section 39(2) of the Electoral Act 1992 Act (the 1992 Act) to include a requirement that the process for holding a by-election to fill a Dáil vacancy must take place within a reasonable time of a vacancy occurring. This subsection omits reference to an overall temporal requirement, distinct from the Chairman of the Dáil having to act “as soon as he is directed by the Dáil,” and the respondents argued the correct interpretation was that the provision leaves it entirely at the discretion of the Dáil when to hold a by-election. For Kearns P, however, the subsection, on the respondents’ reading, would be unconstitutional. He outlined how the presumption of constitutionality requires that “a statute must, where possible, be construed in a fashion which best protects constitutional rights” and stated:

To read section 39(2) of the Electoral Act, 1992 as being subject to the requirement that the writ be moved within a reasonable time does no violence to the express wording of the sub-section. Rather it gives effect to the sub-section in a manner which honours the Constitutional provisions in question.

The judge also stated that on ordinary statutory interpretation principles he could arrive at this reading of the subsection since it would otherwise fail to rule out a casual Dáil vacancy going unfilled for anything up to five years (that is, the entire life of a Dáil, if the vacancy arose shortly after a general election). Statutes are not to be interpreted such that they could produce, in Kearns P’s view, an absurd result such as this.
Additionally on the statutory interpretation question, Kearns P made reference to the court’s obligation under section 2 of the European Convention on Human Rights Act 2003 (the 2003 Act) to interpret and apply rules so far as is possible in a manner compatible with the State’s obligations under the European Convention on Human Rights (the Convention). He identified the obligation on states under Article 3 of the Protocol 1 of the Convention to hold free elections by secret ballot at “reasonable intervals.” Kearns P acknowledged the absence of authority on this substantive requirement for elections other than general elections. The judge did, however, conclude that the principles at issue – democratic representation and the ascertainment of public opinion – are the same and that it would be “absurd to apply a requirement of reasonable time to the holding of a general election and then to flout or altogether ignore the same principle at the micro level of a by-election.” Thus, Kearns P concluded that section 2 of the 2003 Act requires the reading of section 39(2) of the 1992 Act to include an expedition requirement for the by-election to be held in order to fill the Dáil vacancy to be held within a reasonable time. It is clear that for Kearns P any one of these three routes – the constitutional double construction rule, ordinary principles of statutory interpretation, and the obligation to read statutory rules in a Convention compliant manner –  would lead to the conclusion that section 39(2) is to be read as imposing an expedition requirement on the Dáil in moving to have its vacancies filled.
Kearns P’s conclusion of excessive delay in this instance was easily arrived at. At the time of the hearing, over 17 months had passed since the vacancy in Donegal South West arose and still there had been no writ issued for the by-election to be held, though there was evidence admitted that the Government intended for the by-election to be held in the first quarter of 2011. In concluding that this constituted inordinate delay, Kearns P made reference to the Constitution Review Group’s recommendation in 1996 that the Constitution’s text should be amended to include a specific requirement for a by-election to be held within 90 days of a vacancy occurring.  Kearns P also noted equivalent procedures in other jurisdictions specifying parliamentary vacancies to be filled in much shorter time periods than the length of time the Donegal South West seat had been left unfilled.

Cette pratique générale – s’exprimer à échéance régulière pourl ’élection de ses représentants – recouvre un grand nombre de diversités. Diversité dans la nature des régimes : régimes parlementaire, semi-présidentiel ou présidentiel. Diversité dans les espaces-temps qui séparent les scrutins. Diversité surtout dans les modalités de l’élection.Le mode de scrutin est une des contraintes juridico-politiques qui entourent l’expression du suffrage. Depuis plusieurs années, la nature et les modalités des systèmes électoraux sont au centre de débats politiques et scientifiques. Certains Etats ont changé leur législation électorale récemment (Italie, Japon, Nouvelle-Zélande). En Belgique, la problématique d’un éventuel passage au scrutin majoritaire a été évoquée à plusieurs reprises. L’ouvrage fait le point sur l’état des principaux modes de scrutin à l’ceuvre en Europe. Une question centrale traverse le livre: dans quelle mesure le mode de scrutin « fait-il » l’élection ? Cette problématique est au cceur des différentes contributions à travers l’évocation de situations en Europe occidentale et centrale ou dans une dimension internationale – les élections pour le Parlement européen.Dans la deuxième partie du livre, la controverse est centrée sur la Belgique, à travers des interrogations clés : quelles raisons ont justifié le passage d’un mode de scrutin majoritaire au scrutin proportionnel en 1899 ? Quelles sont les modalités juridiques d’un éventuel changement de mode de scrutin ? Quels pourraient, enfin, être les effets d’un passage du mode de scrutin proportionnel à un scrutin majoritaire ?

The paper examines the main approaches to the definition of legal responsibility in the modern electoral process in Russia, and its types.

Voter registration is the tool for enforcing universal suffrage by ensuring that every individual who is eligible to vote is able to exercise his or her right to vote. It serves also the principle of equal suffrage as it guarantees that every voter will cast his or her ballot only once. In our essay we made an attempt at offering a brief survey of legislation and practice in connection with voter registration. We examined almost 40 participating
states of Organization for Security and Cooperation in Europe (OSCE) for exploring similarity and difference between the ways in which they regulate voter registration and between the ways in which voter registration effectively operates.

This comparative study was made in the framework of project ‘Developing accurate voters’ list in transitional democracies’ realized by Association of European Election Officials (ACEEEO) financed by the United Nations Democracy Fund.

Dans un contexte de rénovation de la vie politique française-impulsé par l'actuel chef de l'État-, le renouvellement de la composition de l'Assemblée nationale vers plus de représentativité était attendu. L'ampleur du changement du personnel politique, tel qu'il a découlé des dernières élections législatives, est une première étape, inédite sous la V e République. Reste alors à envisager la possibilité d'introduire « une dose de proportionnelle », conformément à la proposition de campagne du président de la République. Cette réforme électorale, tentée à son époque par le président Mitterrand, peut paraître séduisante mais comporte aussi un certain nombre de risques et de limites que ce débat souhaite mettre en lumière à travers les regards croisés de Thomas Ehrhard (Paris II) ; Pierre Martin (CNRS) et Romain Rambaud(université Grenoble-Alpes).


Summary In a context of renewal of French political life-driven by the current head of state-the renewal of the composition of the National Assembly to move towards more representativeness was to be expected. The extent of the change in the political personnel, as it emerged during the last legislative elections, is a first step, unprecedented under the Fifth Republic. It remains to be considered as to the possibility of introducing «a dose of proportionality», in accordance with the campaign proposal of the President of the Republic. This electoral reform, attempted in his time by President Mitterrand, may seem attractive, but also includes a number of risks and limitations that this debate wishes to highlight through the analytical eyes of Thomas Ehrhard,  Pierre Martin, and Romain Rambaud.

Les électeurs choisissent-ils le parti qui leur correspond le mieux ? Disposer de plus d'informations entraîne-t-il plus d'hésitations avant de voter ? Comment les électeurs belges perçoivent-ils la démocratie ? Resumen: El Consejo Nacional Electoral y la Sala Electoral del Tribunal Supremo invalidaron fraudulentamente la elección de Gobernador del estado Barinas que favorecía al candidato de la oposición democrática. Este fraude electoral demostró la falta de condiciones de integridad electoral de Venezuela y la ilegitimidad de las elecciones regionales y locales celebradas el 21 de noviembre de 2021.

Abstract: The National Electoral Council and the Electoral Chamber of the Supreme Tribunal fraudulently invalidated the Barinas Governor election that favored the candidate of the democratic opposition. This electoral fraud demonstrated Venezuela's lack of electoral integrity conditions and the rigged nature of the regional and local elections held on November 21, 2021.

The new political narrative promoted a ‘mixed’ system for ‘democratisation’ of the composition of the National Electoral Commission. In the article, I verify the most essential arguments and introduce the results of the legal and constitutional analysis, which were previously unprecedented. All to answer one crucial question: has ‘the myth of the good electoral system’ – a judicial model of the central electoral commission unique on a European scale – really fallen?

[PL] Sejm VIII kadencji ustanowił niespotykane wcześniej w polskim systemie prawnym procedury dla wyłonienia organów państwowych. W szczególności — jako analizy przypadków — zostaną przedstawione postępowania i faktyczne czynności wyborcze dla Rady Mediów Narodowych, Krajowej Rady Sądownictwa oraz Państwowej Komisji Wyborczej. Służyć będą nadrzędnemu zadaniu referatu — próbie ukazania, że w przyszłości omawiane organy zagrożone są przez krótkowzroczność ustawodawcy oceniającego funkcjonalność założeń w ramach ówczesnej sytuacji politycznej.

Kiedy spojrzy się ponad obecną arytmetykę sejmową, odpowiedź na tytułowe pytania wskaże nie tylko postulaty de lege ferenda, ale również — co prawdopodobnie najciekawsze — stałą zależność, tendencję projektodawców. Dla doktryny zaś — przestrogę na przyszłość, jak nie tworzyć procedur wyboru dla poszczególnych organów oraz jak walczyć z podobnymi pomysłami w perspektywie następnych kadencji parlamentu.

This research study gives an in-depth examination of the legal underpinnings, institutional framework of the electoral laws and the jurisprudence developed by the Supreme Court of Kenya in resolving electoral disputes from its inception to-date. The purpose of the study was to investigate whether the dispute resolution mechanisms in our electoral system are rigid, costly and inefficient and serve to hinder justice by placing emphasis on technicalities at the expense of substantive justice.  Thus it measured the modalities of resolution of disputes in Kenya against the Constitutional and statutory principles in place as well as the aspired democratic values.

The study has established that our electoral law regime is very progressive as measured with international standards in place and the fundamental problem bedeviling the electoral dispute resolution system thereof emanates from the failure to observe and implement the laws in force due to the prevailing attitude that laws are an impediment to exercise of unlimited freedoms instead of means to achieve rule of law, peace and justice to all. It is noted that a few sections of the law need to be fine-tuned to align with the democratic aspirations enshrined in the Constitution of Kenya.

The research paper concludes by calling for a review of some areas of the law to enhance efficiency and increase the effectiveness of the law, creating public awareness on the need to observe the laws as well as shifting focus from making of more laws to enforcement and implementation of the laws in force. This will ensure that there is certainty, impartiality, equity and sense of justice by all players in the electoral arena which is integral in instilling the much needed faith in the electoral system thereby expanding our democratic space

Trust in political parties has never been lower, but we have more and more of them, to the point where voters need magnifying sheets to read ballot papers. What is the relationship between party regulation and the nature of our democracy? How is it that parties have been able to gather so many public resources yet with so little scrutiny of their affairs? This is the first book on party regulation in Australia. It covers a wide range of issues, from party donations to candidate selection, from expectations of parties in a representative democracy to the reluctance to regulate and the role of the courts where legislators fear to tread.

El Estado Dominicano para lograr el mantenimiento y consolidación de su sistema democrático, vigila, fiscaliza y controla los recursos públicos y privados a los que acceden los partidos, agrupaciones y movimientos políticos para desempeñar su actividad política.

La República Dominicana promulgó la Ley 33-18 de Partidos, Agrupaciones y Movimientos Políticos, y la Ley Orgánica de Régimen Electoral No. 15-19, destacándose dentro de las mismas, disposiciones legales vinculantes a la fiscalización del financiamiento de las organizaciones políticas y las campañas electorales, lo cual, confiere importancia a la temática que desarrollaremos; pues la previa exploración de fuentes indica que en el país, luego de la promulgación de las indicadas leyes, no se han realizado indagaciones relacionadas a la transparencia dentro del sistema financiero de las organizaciones políticas y su impacto en los índices de corrupción, lo que justifica la presente investigación y la hace pionera en República Dominicana en este tema particular.

Este estudio aportará resultados útiles respecto al nivel de eficacia y aplicabilidad de las leyes números 33-18 de Partidos, Agrupaciones y Movimientos Políticos y 15-19 sobre el Régimen Electoral. Asimismo, revelará la incidencia de la transparencia en el financiamiento político sobre el índice de corrupción del país y además ofrecerá información comparada sobre lo que se ha establecido al respecto en distintos sistemas políticos-electorales de la región Latinoamericana.

В данной работе рассматриваются основные проблемы внедрения электронного голосования в общемировой практике. Особое внимание уделяется проблеме соотношения теоретических наработок и их практической реализации.

This paper examines the main problems of the implementation of electronic voting in the world practice. Special attention is paid to the problem of correlation of theoretical developments and their practical implementation.

O trabalho analisa a questão da participação feminina na política brasileira, valendo-se, para tanto, de uma análise comparada a partir das legislações eleitorais do México e da Argentina. Antes, entretanto, de analisar a temática por este viés comparado, percorre brevemente o cenário de lutas e reinvindicações que culminaram com a conquista do direito ao sufrágio feminino no Brasil, fazendo deste o marco inicial do estudo sobre a participação feminina na política do país. Investiga, a partir deste momento histórico, quais foram as principais alterações legislativas que cercaram a questão da atuação política das mulheres brasileiras e debate, nesta senda, a legislação de cotas eleitorais de gênero em vigor. Neste diapasão, a partir da constatação numérica de que ainda prevalece o estigma de que a mulher não é própria do espaço público e que, por isso, não deve “fazer política”, apura, com suporte no direito comparado, as possíveis razões para este atraso ocupando-se essencialmente de analisar as leis de cotas argentina, mexicana e brasileira em cotejo. Seu foco é, portanto, a lei que estabelece as cotas e os mecanismos legais que lhe faltam para a sua eficácia. Nesse sentido, elabora uma crítica à legislação em vigor no Brasil e aponta uma possível reconfiguração de seus mecanismos, sempre se pautando no ideal da paridade de gênero que é garantido, mas também se limita pelos ditames constitucionais. Analisa, nesta toada, algumas decisões dos tribunais eleitorais do país, projetos de lei e propostas de emenda à Constituição que, guiados pela preocupação com a igualdade de gênero na política, já indicam os novos rumos da questão de gênero no Brasil. A conclusão final a que chegou a pesquisa resume-se na constatação de que a legislação de cotas brasileira não cumpriu as suas metas, uma vez que não logrou atingir a paridade de gênero na política e que, por isso, deve ser revista a partir das diretrizes que despontam das experiências estrangeiras de sucesso, pois esse é o caminho mais curto para alcançar a igualdade entre mulheres e homens.

"Women’s political presence in Brazil: a comparative case study in the light of the Argentine and Mexican experiences"
This thesis focuses on the political participation of women in Brazil. With support on comparative law, it examines the reasons for our precarious handling of this pressing matter as well as viable solutions via à vis the Brazilian constitutional and electoral systems. Are electoral gender quotas a viable solution to the lack of women in power? To asses this issue, a comparative law investigation based on Mexico’s and Argentina’s electoral legislation was set out. Prior to that, however, a brief introduction summarizes the series of struggles and political claims which culminated with women’s right to vote in Brazil – tracing legislative shifts and political debates since the end of the 18th century and explaining the electoral gender quotas in force nowadays. Women in Brazil are still stigmatized as not being able to “act politically” and are, therefore, kept away from the public sphere – this thesis demonstrated how and why even the electoral quotas active today have not been enough to homogenize the Brazilian parliament in terms of gender. Electoral gender quotas must be reinvented in Brazil. This work lays out the points of fragility of our electoral gender quotas and suggests alternatives inspired in the success achieved in Argentina and Mexico. Despite the evident inefficacy of the measures adopted to this day to promote women’s presence in places of power, there is an incipient movement of change in the country: judicial rulings from Brazilian electoral courts, projected laws, and amendments to the Constitution indicate new paths to gender biased elections in Brazil. Our final conclusion is the Brazilian legal quotas system did not achieve its goals and that, because of that, it should be revisited and reinvented according to the guidelines that emerge from positive foreign experiences as this is the shortest way to accomplish the equality between genders.

Properly conducted media coverage of an election campaign is a condition and a safeguard of free and equal suffrage. Apart from legal regulations, it is also highly affected by journalistic professionalism and ethos. In the article, I contain an analysis of the relations between ethics and law binding the journalists during election campaigns. Next, I compile the ethical principles applicable to journalists during election campaigns. The emphasis is put on the deontology of the Polish national television.

Afirma que a Constituição estabelece o Estado de Direito como fundamento da cidadania contemporânea, uma noção de democracia, uma concepção de representação política, indicando os contornos dessa relação, e um ideal republicano, a partir de uma forte noção de liberdade e de igualdade, com a assunção de direitos e deveres de cidadania. Apresenta cinco princípios constitucionais como base para a construção do alicerce do Direito Eleitoral brasileiro: a autenticidade eleitoral; a liberdade para o exercício do mandato; a necessária participação das minorias no debate público e nas instituições políticas; a máxima igualdade da disputa eleitoral; e a legalidade específica em matéria eleitoral. Enfatiza que, a partir desses princípios, é possível construir os alicerces do Direito Eleitoral brasileiro, para permitir sua concretização como um sistema internamente coeso, racional, inteligível e conforme aos comandos constitucionais. Conclui que as regras do jogo democrático devem estar em consonância com os valores constitucionais e como tais devem ser aplicadas.

La literatura sobre gobernanza electoral ha venido destacando la relevancia de los organismos electorales, cuyo rol es central en la asignación técnicamente garantizada de la legitimidad democrática. Por un lado, se han señalado algunas tipologías que buscan clasificar las instituciones existentes en diversos sistemas políticos. No obstante, particularmente para algunos países, se ha advertido que corresponde más bien referir la presencia de modelos híbridos de organismos que intervienen en los procesos y procedimientos administrativos y contenciosos relacionados con las elecciones. Esto además tiene serias implicancias en Estados multinivel. Por otro lado, también se ha resaltado la relación endógena que las reglas y los árbitros electorales tienen respecto a los procesos de reforma política. 
De acuerdo a tales señalamientos, esta investigación aborda las características específicas que tuvo el proceso político de reforma del entramado institucional mixto o híbrido de la gobernanza electoral en Argentina, en el período 1983-2013. Dentro de este país, se analiza el nivel nacional y el subnacional, tomando las provincias de Córdoba, Entre Ríos y Santa Fe. 
Si bien se asume que en ese período se dio una secuencia de reformas de tal arquitectura institucional mixta, se destaca que la dinámica de los cambios fue de fronteras móviles. Así, se busca ilustrar el corrimiento, por un lado, entre las atribuciones de las agencias estatales respecto a la organización de los comicios. Por el otro lado, entre las competencias electorales del nivel federal y del subnacional. El registro empírico analizado permite señalar que entre 1983 y 2013, las reformas predominantemente fueron o a favor del modelo judicial o en beneficio del modelo clásico de gobernanza electoral. Las fronteras móviles también alternaron entre la centralización y descentralización de las atribuciones electorales en el Estado multinivel.

RESUMO O presente artigo objetiva averiguar, de forma crítica, como a legislação brasileira estabeleceu a competência criminal da Justiça Eleitoral, especificamente no que toca ao conflito com a Justiça Comum, dada a competência daquela Justiça Especializada para processar e julgar os crimes eleitorais e os comuns conexos a eles. A análise partirá da legislação vigente, bem como dos posicionamentos jurisprudenciais atualizados. Procurar-se-á demonstrar que a competência da Justiça Eleitoral já vem prevista na própria Constituição Federal, ainda que de forma indireta, de modo a não haver conflito com a competência da Justiça Comum, esta atuando subsidiariamente. ABSTRACT The present article intends to critically examining how Brazilian law established the criminal jurisdiction of the Electoral Justice, specifically in relation to the conflict with the Common Justice, given the jurisdiction of that Specialized Justice to process and adjudicate electoral crimes and the common crimes related to them. The analysis will be based on the current legislation and on the up-to-date jurisprudential positions. It will be tried to demonstrate that the jurisdiction of the Electoral Justice is already foreseen in the Federal Constitution, although indirectly, so there is no conflict with the jurisdiction of the Common Justice, with this one acting subsidiarily.

Apelar a principios para la solución de casos electorales es una forma de “hacer
Derecho” (o más bien, de hacer política) que daña el imperio de la ley. Este ideal cobra
mayor fuerza cuando se ancla al principio de autonomía personal, base de los derechos
humanos y del ideal democrático. El imperio de la ley cumple un papel relevante en el
ámbito electoral ante la necesidad de hacer frente a problemas de coordinación y a
situaciones de interacción estratégica de carácter político. Para cumplir con las
exigencias de ese principio, el mejor remedio es exigir restricción judicial, pues la
regulación de la política no puede realizarse exitosamente si los jueces electorales
elaboran juicios morales para identificar, en cada caso, lo que el Derecho prescribe. El
activismo judicial se ejemplifica con dos decisiones del Tribunal Electoral Federal de
México que contrastan con dos sentencias de actitud interpretativa contraria dictadas por la Suprema Corte de Justicia,. Posteriormente, se destaca la relación entre el
imperio de la ley y el principio de presunción de constitucionalidad de las leyes los
cuales, en su conjunto, nos acercan a un modelo de constitucionalismo más bien débil.
A continuación, se subrayan las dificultades para derrotar esa presunción cuando se
parte de argumentos basados en principios abstractos provenientes de un ejercicio de
ponderación. Finalmente, se recomienda a los jueces abrazar el positivismo jurídico en
su sentido ético o normativo, por tratarse de una teoría coherente con el imperio de la
ley y sus consecuencias institucionales, al menos en el ámbito electoral.

Throughout the first part of the 20th century suffrage was an important issue in Hungary; several electoral reforms and reform proposals came to light paving the way to universal, equal and secret suffrage. However, the idea of plural suffrage also came up for debate twice in this period. Plural suffrage means that some people's votes weigh more than others' or some electors are eligible to vote multiple times. This practice is a clear deviation from equal suffrage and unimaginable in a contemporary democratic rule of law, except for the plural right to vote of the Italian and Hungarian minorities in Slovenia. It is worth examining these two cases, the underlying motives and the opinion of contemporary constitutional law experts. I will overview the key events of the extension of suffrage in Hungary since 1847 and provide an international outlook on the appearance of plural suffrage in public law and scientific works.

Az Európa Tanács Velencei Bizottsága aktív szerepet játszik Európa választási standardjainak kialakításában. E tevékenysége során általános ajánlásként fogadta el Code of Good Practice in Electoral Matters című dokumentumot, és az egyes országok választási törvényeit egyedi véleményekben méri az ebben megfogalmazott elvárásokhoz. E soft law követelmények kötelező jogi erővel nem, de jelentős politikai autoritással bírnak, és mivel a bíróságok (mind nemzeti, mind nemzetközi szinten) egyre inkább felhasználják a dokumentumot a választási alapelvek értelmezéséhez, közvetetten kikényszeríthetővé is válnak. Magyarországnak az Európa Tanács és a Velencei Bizottság tagjaként figyelemmel kell lennie ezekre az elvárásokra a választási szabályozás és gyakorlat kialakításakor.

A global comparison of the laws governing political parties reveals a significant degree of diversity—in the sources from which these laws derive, the specific functions they target, and the extent to which they regulate parties as political organizations and electoral actors. Previous studies have provided accounts of this diversity as the product of institutional arrangements, historical circumstances, and partisan politics, but little research has been done to establish whether international norms and standards play any role. Is there a set of universally accepted principles that govern the regulation of political parties? If not, what are the opposing principles and competing rights that are at play? Although international conventions and other instruments establish a set of basic principles that recognize the qualified right of parties to exist and to contest elections, significant normative disagreements exist surrounding the desirability of parties as electoral actors, qualifications upon freedoms of association, the extent to which parties should be supported by the state, the nature of party competition, and the extent to which equality interferes with the freedoms of political expression and association (and vice versa). Determining and defining the parameters of the debate, rather than advocating for a universal policy solution, may provide a workable way forward in determining a series of internationally acceptable normative standards.

[PL] Wyrok Europejskiego Trybunału Praw Człowieka z 8.11.2021 r., Dolińska-Ficek i Ozimek przeciwko Polsce, jest wynikiem batalii sądowych rozgrywających się na tle działalności wadliwie powołanych sędziów do Izby Kontroli Nadzwyczajnej i Spraw Publicznych Sądu Najwyższego (IKNiSP SN) na wniosek zreformowanej Krajowej Rady Sądownictwa. W precedensowej sprawie Trybunał rozstrzygnął z całą stanowczością o naruszeniu art. 6 ust. 1 Konwencji o ochronie praw człowieka i podstawowych wolności (EKPC). Orzeczenie Trybunału w Strasburgu dla polskiego systemu wyborczego sensu largo oznacza, że nie mamy obecnie sądu — korzystając z pojęć konwencyjnych — „ustanowionego ustawą” do spraw wyborczych.

Proponowany referat rozważa mniej oczywiste konsekwencje wyroku Dolińska-Ficek i Ozimek oraz będzie starał się odpowiedzieć na pytania nawiązujące do tytułu: czy brak reakcji ustawodawcy na omawiany wyrok może doprowadzić do naruszenia art. 3 Protokołu Nr 1 do EKPC przy stwierdzaniu ważności wyborów przez IKNiSP SN? Czy wskazane naruszenie jest równoznaczne z wadliwością samych wyborów? Czy wadliwość wyborów zawsze oznacza ich nieważność? Aby w pełni ocenić zakres wpływu rozpatrywanego orzeczenia, należy także rozważyć, czy standardy dotyczące wolnych, rzetelnych wyborów mogą zostać wprowadzone (i ewentualnie na kanwie jakich spraw) również przez wyrok Trybunału Sprawiedliwości Unii Europejskiej w ramach strategicznej litygacji.

Analiza przypadku dwóch sędziów-kandydatów na wyższe stanowiska oraz dalsze rozważania podjęte zostały z wykorzystaniem metody formalno-dogmatycznej oraz podejścia kontekstowego. Całość pozwoli udzielić odpowiedzi na (zmodyfikowane) trzecie pytanie testu Ástráðsson: czy stwierdzone naruszenia prawa do „sądu ustanowionego ustawą” zostały stwierdzone i — co ważne — mogą zostać poddane naprawie przez sądy krajowe?

Publikacja prezentuje krytyczne spojrzenie na różne instytucje prawa wyborczego i praktykę ich funkcjonowania zarówno w kontekście doświadczeń wyborczych lat 2018-2020 i towarzyszących im zmian prawa, jak i sytuacji związanej ze stanem pandemii i problemów wynikających z konieczności organizacji wolnych wyborów w warunkach nadzwyczajnych. Analizie poddawane są w tym kontekście klasyczne zagadnienia z zakresu prawa wyborczego, takie jak zasady prawa wyborczego (w szczególności zasada wolnych wyborów), prawa wyborcze obywateli, organy wyborcze, proces wyborczy, kampania wyborcza, kontrola wyborów czy też cisza legislacyjna.

W wielu tekstach, których autorami są młodzi badacze prawa konstytucyjnego z różnych ośrodków akademickich, zamieszczono również ocenę obowiązujących w Polsce regulacji prawnych w świetle standardów międzynarodowych, w tym zwłaszcza standardów Rady Europy, a także postulaty de lege ferenda, ukierunkowane na usprawnienie istniejących już procedur wyborczych oraz zapewnienie wyborom do organów przedstawicielskich w najwyższym stopniu demokratycznego charakteru.

Książka adresowana jest nie tylko do studentów wydziałów prawa i administracji, ale również do wszystkich tych, którzy na co dzień zajmują się prawem wyborczym, zarówno w ujęciu praktycznym, jak i teoretycznym. Z pewnością będzie też ciekawą lekturą dla wszystkich zainteresowanych prawem wyborczym i szeroko rozumianym prawem ustrojowym.

The Current Challenges of Electoral Law

The publication presents a critical view on various institutions of electoral law and their functioning in the context of the 2018-2020 elections and the accompanying changes to the law, as well as the situation caused by the pandemic and the problems resulting from the organization of the free elections in extraordinary conditions. The authors analyse classic electoral law issues such as the principles of electoral law (the principle of free elections in particular), citizens’ electoral rights, electoral bodies, the election process, the election campaign, election control, or legislative silence.

Many texts, whose authors are young researchers in constitutional law from different academic centres, contain the assessment of legal regulations in force in Poland in accordance with international standards, especially those set by the Council of Europe, as well as the de lege ferenda demands, which aim at improving existing electoral procedures and ensuring that the elections to representative bodies are fully democratic.
