Sexual freedom

This thesis aims to analyze the structure of Grey’s Anatomy (Shonda Rhimes, ABC, 2005 –) and examine how the television series portrays themes associated with female subjects, such as the myth of romantic love, sexual freedom, motherhood, abortion, and gender inequalities in the work environment. Drawing from the feminist and the melodramatic theories as well as American television studies, this thesis scrutinizes how a series that targets mass culture incorporates ambiguities while portraying these themes. It also analyzes the impact these narrative fissures might have on female empowerment.

Genero ikuspegitik Zuzenbidearen neutraltasuna eta honen izaera objektiboa zalantzan jartzen hasita, genero estereotipo eta aurreiritzi sexistek Zuzenbidean eta eremu judizial osoan zenbaterainoko eragina
duten aztertzen du lan honek. Horretarako, Espainiako Zigor Kodeko 179. artikuluan jasotzen den bortxaketa delituaren azterketa egiten da, tipo penalak jasotzen duen “haragizko sarketa” edo penetrazioaren baldintza sexu-askatasunaren babesarekin loturan jarriz. Bortxaketa burututzat ulertzeko ekintza tipikotzat ezartzen den penetrazioaren edo “haragizko sarketa” kontzeptuaren azterketa egiten da, honakoak Zuzenbidearen izaera maskulinoarekin duen lotura aztertuz. Horretaz gain, bortxaketa
delituaren kasuan saiakera graduaren existentziak babesten den ondasun juridikoarekiko (sexu-askatasuna) suposatzen duen kontraesana aztertzen da. Penetrazioaren zentralitateak sexu-askatasunaren babeserako muga argi bat suposatzen duela ikusiko da, genero estereotipo eta aurreiritzi sexisten existentzia bermatuz, eta beraz, emakumea diskriminatuz. Praktika judizialeko profesional orok dugun
erantzukizunean ere jarriko da arreta, eta egoera hau iraultzeko dauden proposamen desberdinak jasoko dira.

RESUMEN:
Partiendo de poner en cuestión la neutralidad y la objetividad del Derecho desde la perspectiva de género, este trabajo analiza en qué medida afectan los estereotipo de género y prejuicios sexistas en el Derecho y en toda la esfera judicial. Para ello, se analiza el delito de violación que se recoge en el artículo 179 del Código Penal Español, y se relacionarán la condición del “acceso carnal” o penetración, y la protección de la libertad sexual. Se analiza el concepto de “acceso carnal” o penetración que el tipo penal impone como acción típica, analizando la relación que guarda esta condición con la naturaleza masculina del Derecho. Además, se atenderá la contradicción que supone la existencia del grado de tentativa en el delito de violación, en cuanto al bien jurídico que se protege mediante este delito (la libertad sexual). Se verá que la centralidad de la penetración supone un gran límite para la protección de la libertad sexual, garantizando la existencia de estereotipos de género y prejuicios sexistas, y por lo tanto, discriminando a la mujer. Se atenderá la responsabilidad que tenemos todos los profesonales del ámbito de la práctica judicial, y se darán a conocer diferentes propuestas para volcar la situación.

ABSTRACT:
Starting from questioning the neutrality and objectivity of Law from a gender perspective, this paper analyzes in what measure gender stereotypes and sexist prejudices affect the law and the entire judicial sphere. For this purpose, the crime of rape is analyzed, which is set forth in the article 179 of the Spanish Penal Code, and is related to the condition of "carnal access" or penetration, and the protection of sexual freedom. It analyzes the concept of "carnal access" or penetration that the criminal type imposes as a typical action, analyzing the relationship that this condition has with the masculine nature of the Law. In addition, it will address the contradiction of the existence of the degree of intentionality in the crime of rape, in terms of the legally protected good by this crime (sexual freedom). The centrality of the penetration will be seen, which supposes a great limit for the protection of sexual freedom, guaranteeing the existence of gender stereotypes and sexist prejudices, and therefore, discriminating women. We will take care of the responsibility that all of us professionals have in the field of judicial practice, and will unfold different proposals to overturn these situations.

Cinsel suçlar, ceza kanunlarının toplumsal temeli hakkında en önemli göstergelerden biridir. Bu bağlamda 2004-2005 yılında hayata geçirilen Türk Ceza Hukuku Reformu kapsamında cinsel suçlarla ilgili, eskiye nazaran keskin anlayış farklılıkları içeren önemli değişiklikler yapılmıştır. Yeni düzenlemeler nispeten daha belirgin ve sistematik olmakla birlikte esas alınan düşüncenin toplumsal karşılığı bağlamında doktrinde ve uygulamada birtakım tartışmalı noktaların bulunduğu da bir gerçektir. Makalede cinsel suçlara dair yeni düzen hakkında, sorunlu noktalara da işaret edilerek genel bir çerçeve çizilmektedir. Makalede bu suçlarla bağlantılı kısa bir tarihi gelişime değinildikten (I.) ve suçlar hakkında genel bir bilgi verildikten (II.) sonra ortak bazı noktalardan hareketle daha detaylı açıklamalar (III.) yapılmakta, cinsel suçlarla ilgili bazı istatistiki bilgilere (IV.) değinilmektedir. Nihayet kısa bir sonuç kısmına ve tablolara yer verilmektedir.

Abstract: The sexual crimes are one o f the most important reforms o f Turkish Penal Law Reform of 2004-2005. In this study a general frame is drawn for the regulations on the sexual crimes and some controversial issues related to this topic are mentioned.

This article peruses the 1,850 year tradition of Western laws against polygamy and the recent developments in the field. It shows how the traditional Western cases against polygamy and same-sex unions used strikingly different arguments drawn from the Bible, nature, rights, harm, and symbolism. Because these arguments are so different, Western nations can re- sponsibly hold the line against polygamy, even if they choose to accept same-sex marriage and its accompanying norms of sexual liberty, domestic autonomy, equality, and nondis- crimination.

Resumo: O artigo é uma análise do senso comum teórico dos juristas sobre a liberdade sexual no Brasil. O objetivo é compreender a ideologia e as relações de poder no discurso dominante sobre a liberdade sexual. O percurso da cartografia foi: a sistematização dos elementos da análise do discurso na obra de Luis Alberto Warat; a identificação do discurso dominante sobre a liberdade sexual no senso comum teórico dos juristas; e a descrição da ideologia, das relações de poder e seus efeitos. Percebeu-se que a liberdade sexual é vista prioritariamente em sua dimensão negativa e tem pouca proteção jurídica em comparação à liberdade religiosa, que tem situações de discriminação e violências equiparáveis no cotidiano, mas que são tratadas distintamente na cultura jurídica. A dogmática não alcança as contingências sociais sobre a liberdade sexual, como as da liberdade religiosa, pois não há: imunidade tributária para entidades de defesa de direitos LGBT, obrigatoriedade de educação contra violência de gênero e tipificação de crimes por discriminação de gênero e sexualidade. O discurso dominante é, portanto, o da ideologia de gênero heteronormativa, que tem os seguintes efeitos de poder: adesão, naturalização, neutralização, invisibilização, identificação, exclusão e dominação. Dessa forma, propõe-se: uma releitura ontológica, epistemológica e política para maior garantia de liberdade e alteridade no sistema de justiça brasileiro frente às diversas violências de gênero desamparadas legalmente. Palavras-chave: Liberdade sexual, ideologia, senso comum, heteronormatividade. Introdução Que sentidos são compartilhados sobre a liberdade sexual no Direito? Proponho responder essa pergunta nesse trabalho, de forma ainda restrita e limitada, mas com a intenção de abrir horizontes para uma discussão sobre relações de poder e epistemologia do Direito quanto às questões de gênero e sexualidade. O Direito tem, cada vez mais, dialogado com estudos sobre gênero e sexualidade, afinal, muitos conflitos jurídicos têm como conteúdo principal a violência de gênero, por exemplo. Outras questões simbólicas e estruturais também são importantes, tais como as desigualdades de gênero, a marginalização de minorias sexuais e o machismo no campo jurídico. Partindo dessas problemáticas, foi selecionado o direito à liberdade sexual para ser mais bem avaliado, já que a ideia de liberdade perpassa o sistema jurídico e a performatividade dos corpos.

This article aimed to clarify the opinion of the Jordanian legislator regarding the criminalization of sexual acts in comparison to the position of the monotheistic religions and contemporary laws, in addition to knowing the Jordanian society's view of criminalizing sexual acts. By looking at the Jordanian legal texts related to the subject, it became apparent to researchers that the Jordanian legislator adopts the principle of sexual freedom like other legislators in other countries, despite this violation of Islamic law, which is the official religion of the state according to the Jordanian constitution. In order to achieve the objectives of the study, the researchers adopted the descriptive and analytical approach that reads the opinion of the Jordanian legislator, the monotheistic religions, and contemporary laws in criminalizing sexual acts. Using the results of a questionnaire designed for the purpose of knowing the views of the Jordanian society on the principle of sexual freedom. This questionnaire was distributed to a random sample of 1000 people. The article reached a number of conclusions, including that (84)% of Jordanian society do not accept sexual freedom for religious, moral and social reasons. In light of the results of the article, the authors recommended abolishing the principle of sexual freedom from Jordanian law and calling on the Jordanian legislator to reconsider texts related to the criminalization of sexual acts in line with the culture of society.
