Theft

This study examined whether a cognitive interview (CI) can counteract the effects of suggestive interviews involving forced fabrication. College students witnessed a filmed event and were later forced to fabricate answers to misleading questions about the event. All witnesses were interviewed with a non-leading CI or free recall (FR) either before or after the forced fabrication phase. A week later participants completed a recognition and source monitoring (SM) test of video content. Relative to FR, the CI administered before the forced fabrication interview increased reports of correct details and reduced false assents to fabricated items. A CI after resulted in false memory rates comparable to the FR group. Early interviews using CI techniques may protect against memory loss and misinformation effects.

Homicidio Doloso
• La variación interanual de las tasas de homicidio, muestran un leve descenso en la provincia de Córdoba, pasando de 3,3 homicidios cada 100.000 hab. en 2019 a 3 cada 100.000 hab. en 2020.
• Durante el año 2020 hubo un total de 113 homicidios dolosos de los cuales 63 casos ocurrieron en la ciudad de Córdoba (55,7%) y 50 hechos en el interior (44,3%).
• Durante el primer semestre de 2020 se produjo una importante disminución de los homicidios de mujeres en manos de sus parejas o ex parejas pasando del 46,1% en el 2019 al 12,5% en el 2020.
• A diferencia de 2019, durante 2020 no hubo menores de 15 años imputados por homicidio.

Muerte en Accidentes Viales
• La tasa de muertes en accidentes viales, a nivel provincial, disminuyó de 9,1 muertes cada 100.000 hab. en 2019 a 8,5 muertes cada 100.000 hab. en 2020.
• Se produjo un total de 320 muertes por accidentes viales, de las cuales 69 ocurrieron en la ciudad de Córdoba (21,6%) y 251 en el interior provincial (78,4%).
• En la capital la tasa de muertes viales aumentó un 35% respecto al 2019, mientras que en el interior disminuyó un 14,2%.
• Disminuyó la muerte de niños menores de 12 años en accidentes viales.
• El 85% de las víctimas de muertes viales fueron hombres.

Hurto
• La tasa de hurtos tuvo una importante disminución pasando de 1038,4 hurtos cada 100.000 hab. a nivel provincial, en 2019, a 701,7 hurtos cada 100.000 hab. en 2020. Lo que representa una disminución del 31%.
• En Capital la caída interanual de hurtos fue del 34% en tanto que en el interior fue del 26%.
• Durante el segundo trimestre de 2020, hubo una reducción interanual del 54% de los hurtos con respecto a igual trimestre de 2019.
• El hurto de automotores tuvo un descenso interanual del 21% respecto al año anterior a escala provincial.

Robo
• La tasa de robo tuvo una importante disminución pasando de 1685,9 hurtos cada 100.000 hab. a nivel provincial, en 2019, a 1092,3 hurtos cada 100.000 hab. en 2020. Lo que representa una disminución del 34%.
• En Capital la reducción fue del 34% en tanto que en el interior del 33% interanual.
• Durante el segundo trimestre de 2020, hubo una reducción interanual del 55% de los robos con respecto a igual trimestre de 2019.
• El robo de automotores tuvo una reducción interanual del 32% con una reducción del 31% en Capital y del 46% en el interior.

Günümüz insan hakları telakkileri çerçevesinde İslam hukukunun hırsıza öngördüğü ceza, bazı çevrelerce ağır bulunmuş ve ilgili ayetteki “el kesme” lafzı farklı şekillerde te‟vîl edilmiştir. Ancak bu te‟vîllere veya bu te‟vîllere kaynak teşkil edebilecek yorumlara literatürde yer verilmediği görülmüştür. Bu çerçevede bu çalışmada Semerkant meşâyıhının önde gelen müfessir ve hukukçularından İmam Mâturîdî ve Irak meşâyıhının öne çıkan isimlerinden Cessâs‟ın konuya yaklaşımları ele alınmıştır. Her iki müellifin mensup oldukları hukuk gelenekleri arasında usûl ve fürûda kısmî farklılıklar bulunmaktadır. İmam Mâturîdî, sahip olduğuusûl düşüncesi çerçevesinde hırsızlık haddine bakışını ortaya koymuştur. O, âm lafzın manaya delâletinde şüphe barındırması sebebiyle umûm veya husûsa delâlet ettiğini gösteren bir delile ihtiyaç duyduğunu savunur. Bununla birlikte hırsızlık suçunu düzenleyen Mâide sûresinin 38. ayetinde “hırsız” isminin âm olduğu, buna karşın hırsızlık fiilinin bu nitelikte olmayıp hâs olduğunu savunur. Buna göre her hırsızın had cezası ile cezalandırılması gerekir. Ancak her hırsızlık fiilinin bu şekilde cezalandırılması mümkün değildir. Nitekim ayette -hırsızlık fiiline had cezası uygulanabilmesinin şartları- çalınan malın değeri, hırz, kimden çalındığı gibi hususlar açıklanmamıştır. Bunların belirlenmesi müçtehitlere bırakılmıştır. İmam Mâturîdî; sahâbe ve tâbiînin, çalınan malın asgarî miktarı/değeri konusunda ihtilafa düşüp kendilerinin tespitte bulunmalarına binaen hırsızlıkta nisabın farklı zaman ve coğrafyalarda değişkenlik arz edebileceğini îmâ eder. Cessâs da ayetin umûma delâlet ettiğini belirtmekle birlikte hırsızlık suçunun rukûn ve şartlarında mücmellik olduğu görüşündedir. İmam Mâturîdî ve Cessâs‟ın hırsızlığın hükümleri konusundaki içtihat ve tercihlerinde kurucu imamların görüşlerinin dışına çıkmadıkları görülmektedir. Bununla birlikte her iki müellif de ihtilaf edilen meselelerde kendi tercihlerini ortaya koymuşlardır. Ayrıca her iki müfessir, konuları ele alırken sahâbe ve tâbiûn görüşlerine yer vermiştir. Cessâs, Irak meşahının görüşleri üzerinden hareket ederek zaman zaman İmam Şâfiî gibi geleneğin dışındaki hukukçuların görüşlerini de vermiştir. İmam Mâturîdî ise genel olarak ahkam ayetlerinin tefsirinde kurucu imamların görüşlerine yer verirken hırsızlık konusunda onların görüşlerini zikretmemiştir.

Within the framework of today‟s human rights conceptions, the punishment envisaged by Islamic law for the thief has been found severe and the word “cut off hand” (hadd) in the relevant verse has been interpreted in different ways. However, it has been observed that these ta‟wīls (interpretations) that may constitute a source for these ta‟wīls are not included in the literature. In this context, in this study, the approaches of Imam al-Māturīdī, one of the leading commentators and jurists of the Samarkand shyakhs, and alJassās, one of the prominent names of the Iraqi shyakhs, are discussed. There are partial differences in usūl and furū between the legal traditions to which both authors belong. Imam al-Māturīdī has expressed his view on the hadd of theft within the framework of his methodical thought. He argues that since there is doubt about the meaning of ām words, there needs to be an evidence showing that they refer to a general or a particular meaning. However, he argues that the name "thief" in the 38th verse of the chapter of al-Mā‟idah, which regulates the crime of theft, is ām, on the other hand, the act of stealing is not of this nature and is hās (particular). Accordingly, every thief should be punished with hadd. However, not every act of theft can be punished in this way. As a matter of fact, in the verse, the value of the stolen property required for the punishment of theft to be applied, the hirz (protected area), from whom it was stolen, etc. terms are not disclosed. The determination of these is left to the mujtahids. Imam al-Māturīdī implies that the nisāb (quorum) in theft may vary in different times and geographies, based on the fact that the Sahābī and Tābi‟ūn disagreed on the value of the stolen property and made their own determinations. Al-Jassās also states that the verse refers to the general, but he is on the opinion that the crime of stealing is closed in the rukn (its conditions). It is seen that Imam al-Māturīdī and al-Jassās did not go beyond the opinions of the founding imams in their ijtihad and preferences on the provisions of theft. However, both authors put forward their own preferences on the disputed issues. In addition, both commentators gave place to the views of the Sahābī and Tābi‟ūn while dealing with the subjects. al-Jassās, acting on the views of Iraqi jurists, sometimes gave the views of jurists outside the Hanafī tradition, such as Imam Shāfī. Imam alMāturīdī, on the other hand, while giving place to the opinions of the founding imams in the commentary of the verses containing judgment in general, did not mention their views on theft.

In this article we re-examine an enquiry to the oracle of Dodona on a lead lamella found in 1959. The enquiry, which concerns the theft of some wool, has been repeatedly published, but surprisingly without a reliable text, a proper translation and a detailed commentary. These are now provided in this paper.
