The time has come! On 24 November 2023, the heads of state and government of the East African Community (EAC) approved Somalia’s accession. Thus, Somalia will become the eighth member of the Economic Community, with a population of around 300 million. Somalia’s membership was already in the offing in June of this year.[1] The EAC is now one of the largest regional alliances in Africa and the world, laying the foundations not only for a conflict-free future but also for realising Africa’s enormous economic potential for the benefit of its inhabitants.

The East African Community (EAC) is one of the fastest-growing regional economic blocs in the world. Now Somalia could become the eighth member state of the EAC soon. At the EAC Heads of State and Government meeting on 6 June 2023, Somalia's application for membership was officially approved, and the EAC Council and Secretary were mandated to conduct accession negotiations with Somalia. However, what does this step mean for both sides?

ZusammenfassungDie vorliegende Arbeit stellt ein Zwischenergebnis eines Forschungsprojektes zur Frage der Übertragbarkeit deutscher Staatsstrukturprinzipien auf clan-basierte Gesellschaften am Beispiel Somalias dar. Ziel der Forschungsnotiz ist es, anlässlich des Endes der turnusmäßigen Amtszeit des aktuellen Präsidenten im Februar 2021 zu erörtern, wie die Übertragung der Strukturprinzipien bislang vorangeschritten ist und wie die Ergebnisse zu bewerten sind. Diese Einschätzung der aktuellen Lage in Somalia erfolgt unter Einbezug historischer und gesellschaftlicher Hintergründe und Entwicklungen.

The latest news from Somalia could not be contradictory. On the one hand, the first democratic "one person, one vote" elections since 1969 took place in Puntland, the semi-autonomous state in north-eastern Somalia, on 25 October 2021; on the other hand, there was bloody fighting in central Somalia.

Somalia and Kenya do not have a tension-free relationship. Many reasons for this lie in the conflict-ridden history. On April 7, 2009, the Kenyan Foreign Minister and the Somali Minister of Planning and International Cooperation signed a Memorandum of Understanding (MOU), which had the goal of clarifying the long maritime border dispute. After years of dispute, Somalia appealed to the ICJ in 2014. The issue  became topical not only because of the current political crisis in Somalia, but also because the ICJ scheduled the first public hearing on March 15, 2021, after several postponements. Kenya cancelled its participation in the hearing at the last moment. Many Somali commentators interpreted this as Kenya’s withdrawal.

Zusammenfassung Die vorliegende Arbeit stellt ein Zwischenergebnis eines Forschungsprojektes zur Frage der Übertragbarkeit deutscher Staatsstrukturprinzipien auf clan-basierte Gesellschaften am Beispiel Somalias dar. Ziel der Forschungsnotiz ist es, anlässlich des Endes der turnusmäßigen Amtszeit des aktuellen Präsidenten im Februar 2021 zu erörtern, wie die Übertragung der Strukturprinzipien bislang vor-angeschritten ist und wie die Ergebnisse zu bewerten sind. Diese Einschätzung der aktuellen Lage in Somalia erfolgt unter Einbezug historischer und gesellschaftlicher Hintergründe und Entwicklungen. Against the backdrop of the end of the presidential term in February 2021, the research note discusses how the transfer of structural principles has progressed so far and how the results are to be assessed. This assessment of the current situation in Somalia takes into account historical and social backgrounds and developments.

Es kommt wohl nicht von ungefähr, dass das Bundesverfassungsgericht seine Entscheidung im Hauptsacheverfahren ESM/EZB am 18. März 2014, dem 166. Jahrestag der bürgerlichdemokratischen Revolution in Deutschland, verkündet hat. Vielleicht war es aber auch Ironie
der Geschichte,  dass die Karlsruher Richter ihre (Vorlage)Entscheidung an dem Tag begründeten, an dem der Geburtsstunde der Demokratie in Deutschland gedacht wird und in deren Folge die Frankfurter Paulskirchen-Verfassung die demokratisch-pluralistischen Werte
schuf, die bis zum heutigen Tag unser Grundgesetz prägen.
Die ersten Reaktionen auf die Abtrennung der Verfahren und die Vorlage zur Frage der Anleihenkäufe fielen höchst unterschiedlich aus. Das Verfassungsgericht habe „de factoabgedankt“ indem es zentrale Fragen an Luxemburg weitergebe, fanden die einen, andere wiederum sahen sich in ihrer Auffassung bestätigt, dass ein solcher Schritt längst überfällig gewesen sei. Die Karlsruher Richter haben mit der Entscheidung jedenfalls ihren Unmut deutlich gemacht und so sehr dies auch dogmatisch nachvollziehbar ist, findet man sich nunmehr in einem riskanten Spiel wieder. Zum einen stellt sich die Frage der (künftigen) Rolle der Bundesregierung und des Deutschen Bundestages bei den Hilfsmaßnahmen, zum anderen ist der Ausgang der Entscheidung in
Luxemburg alles andere als berechenbar. Aus dem vielbeschworenen institutionellen Kooperationsverhältnis der Gerichte könnte schnell ein Ober-unter-Verhältnis werden.

In many ways, dealing with Somalia is a look into the unknown. The complex social structure, violent conflicts and strong traditions have left researchers, traders, explorers, colonial powers and scientists both fascinated and perplexed. Somali society has opened itself up to only a few, but hardly to anybody fully. Therefore, Somalia is still a field of research that needs to be almost rediscovered, especially against the background of a rapidly changing society. Scientifically stripped of colonial and post-colonial administrative ethics and romanticism, one encounters a fascinating coincidence of different sources of law and a great variety of preconditions for their application. In Somalia, what is law is a matter of negotiation. The process of finding justice is therefore of particular importance.
