CSOs in governance

This research focuses on the role of civil society as a tool for democratic consolidation in Nigeria. The role of the civil society remains invaluable and cannot be overemphasized as civil society remain one of the veritable tools through which Nigeria's democratic sojourn can gain a formidable consolidation. Many have categorized the Civil society as an essential 'third' sector, as its activities have the propensity of exerting very positive influence on government policies and decisions. The paper concluded and recommended amongst others that, the resource base of CSOs within the country must be expanded to avoid situations where CSOs continue to depend on foreign donors because such situations leave them vulnerable and restricted to implementing the agenda established by their donors, there should be an increase and focus networking among civil society groups to aid training of cadres in grassroots mobilization and advocacy.

Opracowanie to powstało w ramach projektu INPRIS, jednak w dużej mierze bazuje na dorobku programu „Obywatelski monitoring kandydatów na sędziów”. W ramach programu koalicja organizacji przeprowadziła w roku 2006 monitoring wyborów sędziów do Trybunału Konstytucyjnego. Program podsumowała publikacja Obywatelski monitoring kandydatów na sędziów, wydana na początku 2007 r. Koalicja organizacji kontynuowała jednak działania przy okazji kolejnych wyborów do TK w latach 2007–2008 (w roku 2009 wyborów nie było). Jednocześnie jednak osobiste doświadczenia z obserwacji wyborów w latach 2006–2008 zostały wzbogacone badaniami sytuacji sprzed rozpoczęcia działania programu OMKS, poczynając od 1985 r. i pierwszych wyborów sędziów TK. Na podstawie analizy dokumentów źródłowych prześledzono wybory sędziów od początku istnienia Trybunału, co pozwoliło na dokonanie porównań zarówno procedury wyborów określonej prawem, jak i praktyki wyborów.
Punktem wyjścia niniejszego opracowania jest przekonanie, że wybory sędziów TK powinny być transparentne, że zainteresowane środowiska powinny mieć możliwość oceny kwalifikacji kandydatów przed wyborem, że wybór wreszcie powinien bazować na rzetelnej ocenie kompetencji kandydatów.
Przedmiotem niniejszej analizy były następujące aspekty wyborów: regulacje prawne jako podstawa procesu wyborczego (od Konstytucji po regulamin Sejmu) oraz praktyka sejmowa, która w ramach tego samego „oprzyrządowania prawnego” bywa zupełnie różna. Szukano odpowiedzi na nasuwające się pytania. Czy wybory są w wystarczającym stopniu transparentne? Czy stwarzają możliwość dla debaty publicznej nad kandydaturami (zarówno w ramach parlamentu, jak i poza nim)? Czy gromadzi się wystarczająco dużo informacji o kandydatach, by móc dokonać rzetelnego wyboru? Czy nad kandydaturami odbywa się dyskusja? Czy na wybór mają wpływ gremia pozapolityczne, czy jest on czysto polityczny?
Główne wnioski i postulaty zmian prawa, praktyki i zwyczaju parlamentarnego umieszczono na początku opracowania. W treści znajdują się kolejne, bardziej szczegółowe, propozycje.

[This study was developed as part of the INPRIS project, but is largely based on the achievements of the Citizens' Monitoring of Candidates for Judges program. In 2006, a coalition of organizations conducted a monitoring of Constitutional Tribunal (CT) elections. The program was summarized in a publication Civic Monitoring of Candidates for Judges, issued in early 2007. However, the coalition continued with the 2007-2008 elections to the Constitutional Tribunal (there were no elections in 2009). Personal experience from observation of 2006-2008 elections was enriched by examination of the situation before the OMKS program started, beginning from 1985 and the first elections of the judges of the Constitutional Tribunal. Based on the analysis of source documents, the election of judges was traced from the beginning, which allowed to make comparisons in relation to both the legal framework of the procedure of elections, as well as the practice of elections.
The starting point for the research is the conviction that the election of CT candidates can be transparent, that the candidates can be evaluated prior to the election and elections can be based on a fair assessment of the candidates.
The subject of analysis were the aspects of elections: legal regulations as the basis of the electoral process and parliamentary practice, which within the same "legal instrumentation" can be quite different.
Answers were sought to the following questions. Are elections sufficiently transparent? Do they provide opportunities for public debate on candidates (both within and outside parliament)? Is enough information gathered about candidates to make a sound choice? Is there discussion on candidates? Is the selection influenced by non-political bodies or is it purely political?
The main conclusions and postulates for changes in the law, practice and parliamentary customs are placed at the beginning. There are other, more detailed propositions, in the body of the text.
