Documents d’Étienne le Grand. Observations en marge de quelques mentions anciennes
Ces dernières années, le répertoire des documents émis par la chancellerie princière au temps d’Étienne le Grand (1457–1504) s’est enrichi de quelques pièces originales; on a ajouté aussi plusieurs mentions (surtout non-datés) de documents perdus, puisées dans des actes ultérieurs au règne de ce prince. Les
observations de l’auteur portent sur six mentions de documents du temps d’Étienne le Grand, qui peuvent corriger ou compléter certaines informations concernant
l’histoire de quelques villages moldaves et de leurs anciens propriétaires.

In questo studio si riconsidera nel suo complesso il tema della documentazione del comune di Roma nel medioevo alla luce dei traguardi storiografici raggiunti nel corso dell’ultimo quarantennio in tema di documentazione comunale e dei rinnovati metodi di indagine e di analisi ai quali essa viene sottoposta. Attraverso l’esame critico della documentazione conservata e usando la griglia interpretativa della storia politico-sociale del comune, l’autrice ricostruisce l’apparato di scritture del comune capitolino e in generale il suo sistema documentario, ossia le tipologie, le forme e i modelli documentari, il rapporto tra il notariato locale e le istituzioni comunali, il livello di adeguamento alle conquiste documentarie degli altri comuni cittadini dell’Italia centro-settentrionale, le pratiche di conservazione dei documenti, il rapporto tra sviluppo delle strutture politiche, crescita dell’apparato amministrativo ed evoluzione delle strutture documentarie. Inoltre, grazie a un’analisi comparativa con la documentazione dei comuni cittadini dell’Italia centro-settentrionale, evidenzia, da una parte, quali furono le convergenze del sistema documentario capitolino con quelli degli altri comuni e, dall’altra, quali furono al contrario le eccezionalità, nella scelta dei modelli, nell’adozione di peculiari tipologie di documenti e in alcune pratiche documentarie messe in atto. Il periodo considerato è quello compreso tra la Renovatio senatus del 1143/1144 e il 1268, anno in cui i romani conferirono per la seconda volta la dignità senatoria a Carlo d’Angiò, che da quel momento fu contemporaneamente re di Sicilia e senatore e signore di Roma, con tutto quello che ciò significò in termini di crescita dell’apparato documentario del comune capitolino. In uno dei primi documenti prodotti dal Senato, infine, l’autrice individua il testo (parziale) del giuramento che i senatori pronunciavano al momento dell’elezione, che costuirebbe uno dei più antichi testi dei cosiddetti “brevi dei consoli” di cui si ha notizia.

... Das umfangreichste Kapitel des Buches enthält die ausführlichen, ungarischsprachigen Rege-sten der mittelalterlichen, vor 1542 entstandenen Urkunden (S. 211–420). Von den 35–40.000 mittelalterlichen Urkunden, die sich auf das historische Territorium Siebenbürgens beziehen, blieben dank der besonderen Sorgfalt, mit der die Familie Wass ihr Archiv aufbewahrt hat, etwa 700 erhalten. Die Regesten wurden – gemäß der schon verallgemeinerten Methode – für die einzelnen Urkunden erarbeitet, d. h. die im Text einer anderen Urkunde eingegliederten (vollständig oder inhaltlich transkribierten) Urkunden wurden aus der Rahmenurkunde herausgehoben, chro-nologisch geordnet und an jenem Platz veröffentlicht, an dem sie gemäß dieses Kriteriums hätten stehen sollen. Gleichzeitig wurden in den Regesten der Rahmenurkunden auf sie hingewiesen. Die Regesten enthalten neben dem rechtlichen Inhalt oder Ereignis alle Eigennamen (von Personen, Ort¬schaf¬ten oder geographischen Namen) sowie die im lateinischen Text auftauchenden nicht lateinischen Wörter, den Titel oder den Rang der erwähnten Personen und alle Einzelheiten, Ausdrücke oder Anmerkungen, die für die historische Forschung eine gewisse Bedeutung spielen könnten. ...

In un certo numero di città italiane, tra Duecento e Trecento il potere politico è assunto da un signore, al quale i consigli comunali conferiscono l’arbitrium (e ai quali più tardi, ai primi del Trecento, il potere imperiale o papale offre un riconoscimento attraverso il vicariato). Sia dal punto di vista del personale, sia dal punto di vista dell’organizzazione degli uffici, sia infine dal punto di vista della tipologia della documentazione prodotta, i signori cittadini adottano pratiche nuove, ed elaborano modelli documentari nuovi, con molta prudenza. Il sistema documentario comunale, e i notai che ne erano gli artefici e i protagonisti, poté infatti adattarsi, almeno per un certo lasso di tempo, alla nuova situazione politica. Il saggio esamina queste problematiche per Mantova bonacolsiana, riprendendo le ricerche di Pietro Torelli. Sono dunque approfonditi (con particolare attenzione agli anni tra il 1290 e il 1310) i rapporti tra i signori e uno scelto gruppo di notai: fedeli alla loro funzione di officiali comunali, ma anche attenti alle esigenze documentarie della famiglia al potere.

L'intensa attività professionale del notaio Matteo di Biliotto da Fiesole, che visse ed operò a Firenze tra XIII e XIV secolo, resta attestata da due soli registri superstiti, dei quali il primo (anni 1294-1296) è stato pubblicato nel 2002 in questa stessa collana a cura di Manila Soffici e Franek Sznura. Si pubblica adesso il secondo registro di imbreviature, contenente rogiti accolti principalmente a Firenze tra gli ultimi mesi del 1300 e la metà del 1314, periodo conclusivo del percorso professionale (e della vita) del notaio. La varietà dei testi e la ricchezza delle tipologie negoziali contenute in questa fonte offrono alla storiografia sulla Firenze medievale dell'età di Dante materiali interessanti, che dobbiamo alla penna e al lavoro di un notaio dalla personalità poliedrica e complessa, il quale sperimentò ruoli e responsabilità politiche ed istituzionali di primo piano nel contesto cittadino e non solo. Il volume è chiuso da una serie di indici analitici dettagliati.

At the beginning of the 11th century, the newly conquered territories had to be organized and included into the Hungarian Kingdom. The first step into incorporating this new land was the challenge of defeating the king’s rivalsin Banat and Transylvania. During the same century, the conquered regions began being organized into administrative units. The political climate and the internal instabilities led to a series of changes by the end of the century, increasing the efficiency of the Arpadian kings and empowering them with a better administrative, economic and judiciary control. By means of researching the primary sources – various collections of documents –, our paper aims to analyze these particular changes in the development of the administrative-territorial borders within the eastern parts of the realm, namely in the Banate, in Crișana, Maramureș and Transylvania.

The purpose of the study is focused on the location, identification, and
assessment of documentary collections of the medieval era, which are preserved in the General Archive of the Administration (AGA) and inventoried in the documents included in the files from the state confiscations of the nineteenth century. The selection of documents has been carried out taking into account the type of document. A database has been created that allows quantitative analysis by document types, chronology and politico-administrative scope. It has been found that most of the documents are sales taxes and property rights declarations. In addition, documents from the time of the Catholic Monarchs and Henry IV are predominant. Finally, the documents have been found to refer, to a great extent, to records cities with their own jurisdiction, followed by noble and ecclesial holdings.

Das 12. Jahrhundert galt für das ungarische Königreich als eine Zeitspanne der territorialen Expansion, einschließlich nach Siebenbürgen. Das siebenbürgische Gebiet wurde etappenweise übernommen und dem Königreich in Richtung Nord-Westen, Süd-Osten eingegliedert. Kurz danach erfolgte die Notwendigkeit der Territorialverwaltung. Zur gleichen Zeit, europaweit verbreitete sich die Schriftpraxis innerhalb der administrativ-territorialen Laienbehörden. Das ungarische Königtum verstand in vollen Ausmaß die Umsetzung dieser Praxis. Die vorliegende Arbeit nimmt die Analyse der mittelalterlichen, aus den 12. Jahrhundert stammenden Urkunden vor, welche siebenbürgische, administrativ-territoriale Laienbehörden erwähnen. Weiterhin streben wir nach der Hervorhebung der Inhaber dieser Stellen im ungarischen Apparat.

Nel saggio si studiano e si pubblicano in edizione critica sette documenti degli anni Venti del XIII secolo, inediti e sconosciuti alla storiografia romana, dove si concentrano gli unici riferimenti all’associazione dei salinari romani come gruppo organizzato e come soggetto giuridico colletivo. Attraverso l’esegesi storico-giuridica di tali documenti e grazie all’analisi diplomatica delle loro forme esterne e interne, si ricostruiscono le vicende di questa organizzazione e se ne chiarisce la competenza giurisdizionale nel più ampio contesto dell’apparato giudiziario della Roma del primo Duecento, ma soprattutto si mettono a fuoco le caratteristiche di struttura e di forma delle scritture che essa produceva nello svolgimento della propria attività e le si inquadrano nell’ambito del sistema documentario romano e dei meccanismi di produzione e di conservazione di scritture documentarie della Roma di quel periodo, rilevando tra l’altro analogie di modelli documentari e di formulari, oltre che di atteggiamenti procedurali (nei confronti del diritto, dell’argomentazione e delle prove), con quelli impiegati dalla curia capitolina.

The 13th century has proved to have been a dynamic period in the history of the Hungarian realm, namely of Transylvania. The beginning of the century was marked by a territorial expansion towards the inner-Carpathian region through the annexation of the Burzenland. When analyzing the events developed over the span of the century, we are able to separate it into two stages divided by the Mongol invasion of 1241-1242. The realm’s territorial progress, as well as an attempt to cross over the Carpathian borders, were thus stopped by the catastrophic event that was the Mongol invasion not only for the Hungarian realm but also for Europe. This was to become the central point during the 13th century. The administrative-territorial situation of the Hungarian authority within Transylvania is to be depicted through the documents issued between 1201 and 1241, the year of the invasion. The administrative-territorial changes were emphasized by the development of new counties. On the one hand, counties such as Solnoc, Alba, Cluj and Dăbâca were developed during the 12th century and on the other hand, the first half of the following century had brought upon other counties, thus an administrative-territorial development.

The institution of the provost (praepositus) in Sibiu/Hermannstadt developed as a fundamental characteristic in the history of the Transylvanian Saxons’ settlement during the Middle Ages. As an ecclesiastical administrative structure, the provostship (praepositura) helped the Transylvanian Saxons’ community maintain its features and identity. It was brought into existence as an institutional power serving the German settlers who were living in Transylvania within the confines of the territories offered by King Geza II. The other settlers had come to be subordinated to the bishopric in Alba Iulia. The 13th century was a dynamic and important one in the history of the provostship (praepositura). The problem that arose derived from the provostship’s (praepositurae) subordination and its jurisdiction. This being the case, the pope’s intervention couldn’t have been avoided. His interest was to use this ecclesiastical structure in order to subordinate this respective area to the Western Church. The present paper aims therefore to analyze the conflict ignited among the archbishopric in Esztergom, the one in Kalocsa and the bishopric in Alba Iulia/Weißenburg. All of these ecclesiastical institutions struggled and fought against one other in order to subordinate the provostship (praepositura) in Sibiu/Hermannstadt. Thus, by presenting the provostship’s (praepositurae) characteristics and role, as well as the personalities who influenced all these ecclesiastical medieval institutions, we attempt to analyze the political, religious and social landscape that led to the materialization of this institutional conflict.

The history of institutionalized writing in the Hungarian Kingdom is closely linked to the process of enforcing
the royal authority within the provinces. The need to implement an administrative system became a must once the
kingdom’s expansion turned into an accomplished phase. This was the context which led to the emergence of documents
within the Hungarian Kingdom. One is able to state, that the medieval document, even through its primary form,
represented the solution to various problems, economic, social and religious ones. The present paper aims to portray the
history of institutionalized writing in the Hungarian Kingdom, emphasizing the administrative writing, its context of
development, the causes that led to it emerging as such, the evolution of the practice of writing and its characteristics.

The last decades of the 13th century have brought upon a significant moment  in the development of the Inner Carpathian  area and its administrative  teritorial units. The conflicts between the ever growing autonomous  tendencies of the  nobility  towards  a week royal authority  have led to the emergence of an ambitious dynasty of noblemen, eager to fill up the power void. The present paper aims to analyze the local institutions  during  the second half of the 13thcentury  in a time of weakening authority  of the last Arpadian kings: theTransylvanian duchy, banate and voivodeship, the counties of Dăbâca, Cluj, Sibiu and Hunedoara.
