Prenuptial agreements

The article contains a legal analysis of the property relations resulting from the marriage of Jan Klemens Branicki to Katarzyna Barbara Radziwiłł. The events here depicted reveal that the economic success of an aristocratic family to a large extent consisted in a skilful construction of the prenuptial agreement and later in enforcing its fulfilment.

A discussion of the High Court of Australia's recent decision in Thorne v Kennedy with reference to the three vitiating factors discussed by the High Court: duress, undue influence and unconscionable conduct. It is suggested that the High Court left unclear the status of lawful act duress, and the overlap between duress and actual undue influence remains unclear. Moreover, it is also unclear how equitable principles interact with the provisions of the Family Law Act. The significance of independent legal advice and a post-nuptial binding financial agreement in this case is also discussed.

Este trabajo aborda la validez y la eficacia de los acuerdos que los cónyuges o futuros cónyuges toman, para el caso de ruptura, que afectan a los hijos menores habidos o que habrá en el matrimonio. Para ello se deberá conjugar el interés del menor y la autonomía de los cónyuges o futuros cónyuges. Como referente se contará con la solución que tanto en Derecho norteamericano como el catalán ofrecen a estas cuestiones, que se analizan desde el prisma de nuestro ordenamiento jurídico.

A pre-nuptial or ante-nuptial agreement is an agreement between man and woman prior to their marriage that seeks to set out their financial liabilities and responsibilities to one another in the event of their divorce.

From the starting point authority of Hyman v Hyman that considered the enforceability of agreements between husband and wife to the Supreme Court decision in Radmacher v Granatino, this area of law has undergone significant development in recent years.

The aim of this paper is to carry out a review of United States regulations and cases law from 1972 to the Uniform Premarital and Marital Agreement Act (2012). During these four decades United States legal system has evolved from contractualist positions to those more sensitive to the family interests present in these pacts, as well as to a unification in the treatment of matrimonial and premarital agreements.

En este trabajo se realiza un recorrido por la normativa y la jurisprudencia de los EE.UU desde 1972 hasta llegar a la propuesta de ley uniforme de 2012 (The Uniform Premarital and Marital Agreement Act). Durante estas cuatro décadas el ordenamiento jurídico de los EE.UU. ha evolucionado desde posiciones contractualistas a otras más sensibles a los intereses familiares presentes en estos pactos, así como a una unificación en el tratamiento de los acuerdos matrimoniales y prematrimoniales.

After the Court of Appeal decision in Radmacher v Granatino, the question whether English law should introduce enforceable pre-nuptial or marital property agreements came into focus again. Taking the decision as a starting point, the article argues in favour of introducing such agreements. Adopting a comparative approach, the article explains how such agreements are used in Germany and demonstrates that the idea of private autonomy, which has been regarded as the basis of pre-nuptial property agreements in Germany since the 19 th century, can explain why couples should be allowed to make their own decisions with respect to the financial consequences of the breakdown of their relationship. Analysis of the different notions of contract in German and English law as well as comparing marriage with partnerships and other long-term contractual relationships illustrates not only the historical reasons why such agreements have not been allowed so far, but also helps to understand what safeguards the legislator and the judiciary could apply to ensure that parties do not abuse their freedom.

Los acuerdos prematrimoniales con previsiones para el caso de ruptura, hasta hace algunos años desconocidos e ignorados para el Derecho europeo, están tomando una gran relevancia e irrumpen en nuestro panorama jurídico con una fuerza inusitada. El legislador (excepto el catalán) no ha reaccionado aún, pero sí la doctrina y la jurisprudencia, que buscan argumentos para su admisibilidad, mirando los modelos normativos ya en vigor fuera del viejo continente. Entre estos modelos el Derecho estadounidense se erige como "el modelo", no en vano, el único texto en vigor en Europa, el Código de familia catalán, bebe de sus fuentes, como, también, lo hace la doctrina y la jurisprudencia incipiente. En este trabajo, con un especial y detallado detenimiento en la jurisprudencia norteamericana, la autora expone y agrupa los modelos normativos de los países en los que, actualmente, estos acuerdos se encuentran regulados. Quizás para enseñarnos que entre todos tampoco hay grandes diferencias, lo que demuestra que, en definitiva, los acuerdos prematrimoniales con previsiones para el caso de ruptura son un instrumento mucho más usual y "normal" de lo que los juristas más conservadores pudieran pensar.

The Catalan new regulation on premarital agreement is inspired by the American doctrine built on case law. To test this hypothesis, this paper contains the result of a synthesis work that aims to extract the significant features of each of both legal regimes to compare them. The comparison reveals great parallels that can only be due to the influence of American law in Catalan law.

La novedosa regulación catalana sobre los acuerdos matrimoniales con previsiones de ruptura está inspirada en la doctrina norteamericana construida a partir de los cases law. Para contrastar esta hipótesis, en el trabajo se contiene el resultado de una labor de síntesis que tiene la finalidad de extraer los rasgos significativos de cada uno de los dos regímenes jurídicos para poder, así, compararlos. La comparación pone de manifiestos grandes paralelismos que sólo pueden deberse a la influencia del Derecho norteamericano en el catalán.

Como consecuencia del mundo globalizado en el que estamos inmersos la sociedad tiende a unificarse, y con ella, el Derecho. Las nuevas tecnologías, el mercado voraz que rompe las fronteras y cruza los océanos, no son más que puentes entre los países donde cada vez, con más fluidez, circulan ideas y se uniforman planteamientos de vida. Prueba de ello es la reciente regulación de los acuerdos prematrimoniales con previsión de ruptura en el Código de familia catalán inspirada, directamente, en el Derecho norteamericano, donde constituyen una institución conocida y desarrollada tanto a nivel doctrinal como jurisprudencial. En ambos cuerpos normativos se parte de la premisa de que, también en Derecho de familia, un mal acuerdo es preferible a la mejor de las sentencias o a las leyes. Guiados el legislador y los operadores jurídicos, seguramente, por un principio de operatividad: el acuerdo que nace de la voluntad, de la libertad, se cumple con más facilidad. Porque, en definitiva, en las cuestiones íntimas los afectados son más capaces que un extraño de resolver sus desavenencias; quedando el Derecho relegado a velar por que los pactos no perjudiquen a los más débiles de la relación familiar.

This submission focuses on the legal principles in relation to parenting and property, specifically the area of binding financial agreements (BFAs).
This submission responds to question 19 in the Issues Paper (IP 48):
‘What changes could be made to the provisions in the Family Law Act governing binding financial agreements to improve the clarity and comprehensibility of the law for parties and to promote fair outcomes?’

Les accords prénuptiaux en prévision de la rupture sont une notion juridique connue en droit américain, avec un régime juridique consolidé construit sur la jurisprudence. Cependant, c’est une notion étrangère à la tradition juridique de droit continental  méfiante de ce genre d’arrangement. Cette situation est en train de changer, et, maintenant, il y a une tendance dans les arguments de la doctrine et de la jurisprudence qui cherchent à valider ces accords. Même le législateur catalan les a expressément réglementées dans le Code de la famille, le premier texte européen qui prévoit ces accords, et c’est fait sur le statut juridique de ces conventions dans le droit américain.

Dans cet article, nous exposons les obstacles trouvés pour leur admission (certains sur la base d'être considéré comme contraires à la morale) et comment peuvent être surmontés en interprétant nos règles de droit à la lumière d'autres principes, pour répondre à la demande sociale et à la réalité du moment particulier d’application. Nous analysons aussi le statut juridique des accords prénuptiaux en  droit américain et comment les intégrer dans le droit européen (à la manière qui a été fait par le législateur catalan).

This paper presents dowries as a source for estimiting the levels of wealth and economic inequality among the Barcelona artisans of modern times. To do this, starting from the analysis of almost 160 prenuptial agreements (1501–1777), with the participation of different trades, a proposal is made for the categorization of unions. The main analysis looks at the potters’ guild, taking it as an example to explain the evolution of dowry amounts and their social categorization. Internal inequalities in terms of wealth and purchasing power can be shown through the different crafts of this guild.

This book provides an alternative perspective on an issue fraught with difficulty – the enforcement of prenuptial agreements. Such agreements are enforced because the law acknowledges the rights of spouses to make autonomous decisions about the division of their property on divorce. Yet this book demonstrates that, in the attempt to promote autonomy, other issues, such as imbalance of power between the parties, become obscured.

This book offers an academic and practical analysis of the real impact of prenuptial agreements on the relationships of those involved. Using a feminist and contractual theoretical framework, it attempts to produce a more nuanced understanding of the autonomy exercised by parties entering into prenuptial agreements. This book also draws on an empirical study of the experiences and views of practitioners skilled in the formation and litigation of prenuptial agreements in New York. Lastly, it explores how the court might address concerns regarding power and autonomy during the drafting and enforcement processes of prenuptial agreements, which in turn may enhance the role that 'prenups' can play in the judicial allocation of spousal property on the breakdown of marriage.

Family law is succumbing to pluralism. Scholars have celebrated this trend as a desirable outcome of the struggle for marriage equality. And a pluralistic family law seems to offer distinct benefits: more regimes than just marriage, and greater room for choice within each regime (manifest by more types of legally enforceable intrafamilial contracts). This Article exposes counterintuitive facts that lead to a surprising conclusion: the legal changes that scholars tout as increasing pluralism eviscerate the substance of the choices families are permitted to make. The policies that appear to extend choice within each regime, in fact, mask what I call a " neoclassical " approach to intrafamilial contracts— that is, an approach that adopts formalist, binary, and proceduralist principles for the creation of legal obligations. As this Article's scrutiny of prenuptial and cohabitation agreements reveals, neoclassical contract theory is slowly taking over family law. The neoclassical approach vindicates a thin notion of autonomy over other values and favors the status quo. The Article further contends that the roots of family law pluralism in market logic render it fundamentally flawed: as long as the menu of relationship options is predicated on basic contract law, then, regardless of how many options the menu includes, the system will necessarily privilege the more economically powerful partner. Is it possible to avoid this perverse result while preserving freedom of choice? The Article develops a more robust vision of pluralism by identifying the goals and methods of pluralism in family law as they have developed over time. In doing so, the Article offers foundations of a new theory of pluralism that advances true substantive equality and autonomy.
