As psychological research advances, psychologists and neuroscientists are able not only to debate one another in increasingly precise ways, or address mental illness with increasingly sophisticated interventions. They also become better equipped to suggest concepts that individuals may apply in everyday contexts in order to improve their personal lives—or their professional ones. The legal profession represents a complex field that makes substantial demands on both brain and body. Five psychological concepts, grounded in research, stand out as being of potential benefit to practitioners of this demanding art: meditation; observational learning; retrieval cues; memory preservation through new learning; and multiple intelligence's.

Although a commentary on the UNCITRAL draft sales convention had been prepared by the Secretariat and circulated to Governments, the diplomatic conference which met in Vienna did not decide to sanction the publication of an official or semi-official commentary on the final text of the international sales convention.' There was no formal debate on the question of a commentary as there had been at the 1978 Hamburg Conference on Carriage of Goods by Sea, where a decision was taken not to publish a commentary. In 2013 verwierf het Studie- en Documentatiecentrum Oorlog en Hedendaagse Maatschappij (CegeSoma) het archief van mr. Frédéric Eickhoff. Tijdens de Tweede Wereldoorlog verdedigde hij ongeveer 2500 verzetslieden die moesten verschijnen voor de Duitse militaire rechtbanken in bezet België. Tijdens de verwerving van dit archief doken heel wat vragen op omtrent de ontsluiting en raadpleging ervan. Een advocaat is tijdens de uitoefening van zijn beroep immers gebonden aan het beroepsgeheim. Welke beperkingen legt dit beroepsgeheim nog op met betrekking tot het archief van een advocaat na diens overlijden? Vanuit deze vraag werden dit onderzoek en de bijhorende stage uitgevoerd.
Aangezien advocatenarchieven een zeer uiteenlopende inhoud hebben en zeker niet allemaal archiefbescheiden bevatten die onder het beroepsgeheim vallen, is het in de eerste plaats nodig het type archief waarrond dit onderzoek draait goed te definiëren. Daarna wordt gekeken naar de eigenlijke inhoud van de advocatenarchieven die relevant waren voor dit onderzoek. Aan de hand hiervan werd een niet-exhaustieve typologie van archiefstukken, aanwezig in zaak- en cliëntdossiers binnen een advocatenarchief, opgesteld.
Het beroepsgeheim van de advocaat en privacybescherming zijn de twee belangrijkste aspecten van een advocatenarchief waarmee een archiefinstelling rekening dient te houden. Het beroepsgeheim van de advocaat heeft binnen de Belgische context een absoluut karakter. Dit houdt in dat het onbeperkt in de tijd blijft gelden, zelfs na overlijden van zowel de cliënt als zijn raadsman. Bovendien is het een wettelijke en contractuele verplichting die de advocaat ten opzichte van zijn cliënt en bij uitbreiding, ten opzichte van de democratische rechtsstaat, dient na te komen. In theorie mogen archiefstukken die gebonden zijn aan het beroepsgeheim dus nooit vrijgegeven worden. Binnen de rechtsleer gaan er echter stemmen op voor een versoepeling van het beroepsgeheim en bijgevolg af te stappen van dit absolute karakter. Het beroepsgeheim heeft ook niet in alle landen ter wereld een dergelijke absolute invulling. In verschillende (Europese) landen is het voor cliënten mogelijk hun advocaat te ontheffen van zijn beroepsgeheim, waarna de advocaat vrijuit mag spreken. Een dergelijke invulling van het beroepsgeheim is voor een land als België dus zeker niet onmogelijk.

Sociolegal studies have identified a collectivity of legal actors-the legal complex-and its association with political liberalism in varying power settings. However, little attention has been paid to how such collectivity evolves with regime change; or if, and when, such collectivity may dissolve. Studying the case of Taiwan, this article demonstrates how legal professions-lawyers, judges and prosecutors-unite and divide during and after state transition. Democratization has the unsettling effect that brings out the internal dynamics of the legal profession, who initially aligned to defend judicial autonomy from authoritarian control, but confronted one another in judicial policy-making in democratic times. Each legal profession bases its policy orientations on a normative commitment, which leads to three lines of confrontations: the ways in which the judiciary is held accountable, the extent to which the procuracy enjoys investigative power, and the institutional division between the judiciary and procuracy.

The adversarial legal system is traditionally praised for its normative appeal: it protects individual rights; ensures an equal, impartial, and consistent application of the law; and, most importantly, its competitive structure facilitates the discovery of truth – both in terms of the facts, and in terms of the correct interpretation of the law. At the same time, legal representation is allocated as a commodity, bought and sold in the market: the more one pays, the better legal representation one gets. In this article, I argue that the integration of a market in legal representation with the adversarial system undercuts the very normative justifications on which the system is based. Furthermore, I argue that there are two implicit conditions, which are currently unmet, but are required for the standard justifications to hold: that there is (equal opportunity for) equality of legal representation between parties, and that each party has (equal opportunity for) a sufficient level of legal representation. I, therefore, outline an ideal proposal for reform that would satisfy these conditions.

IV. THE TRIAL COURT, JUDGE LON E. FARRIS, ERRED IN RULING THAT THE CIRCUIT COURT LACKED SUBJECT MATTER JURISDICTION TO HOLD A JURY TRIAL TO DETERMINE WHETHER THE DEFENDANTS HAD ENGAGED IN MISCONDUCT UNDER THE VIRGINIA SUPREME COURT RULES OF PROFESSIONAL CONDUCT CITED IN THE UNDERLYING CASE ON APPEAL.

Przedstawiam drugą edycję raportu poświęconego tematyce stanu wykorzystywania technologii informatycznych i zmian zachodzących na rynku usług prawnych w Polsce. Pierwsza edycja badań została przeprowadzona tuż przed wybuchem pandemii SARS-CoV-2 (COVID-19) w Europie (od 25 września do 25 grudnia 2019 r.), a jej wyniki są dostępne dla Państwa na stronie internetowej: www.legaltechnology.pl. Nowa rzeczywistość w jakiej wszyscy się znaleźliśmy, skłoniła mnie do powtórzenia przedmiotowych badań w tożsamej formie. Druga edycja jest zatem wynikiem przeprowadzonych badań sondażowych zrealizowanych w dniach 11 maja do 11 lipca 2020 roku na bazie ogólnodostępnej ankiety online. Polskojęzyczny kwestionariusz 14 pytań ponownie został zaadresowany do prawników w całym kraju, dzięki pomocy i wsparciu izb adwokackich i radców prawnych (badania ilościowe CAWI na bazie ankiety elektronicznej). Niezmiennie w pierwszych pytaniach (Q1 – Q3) badałam poziom wykorzystywania i zainteresowania wybranymi technologiami informatycznymi (IT) i ocenę ich przydatności przez respondentów. W drugiej części kwestionariusza (Q4 – Q7) skupiłam się na analizie zmian zachodzących na rynku usług prawnych w Polsce, pytając o istniejące i nowe zjawiska (trendy) oraz stosowane modele biznesowe. Chcąc uzyskać aktualny obraz rynku usług prawnych w Polsce w dobie trwania pandemii SARS-CoV-2 (COVID-19) do badania zaprosiłam adwokatów i radców prawnych, co pozwoliło uzyskać łącznie 128 wypełnionych ankiet, stanowiących podstawę przedmiotowego raportu. The above quotation was made by the Late Father of Our Nation, Mwalimu Julius Kambarage Nyerere (from his Stability and Change in Africa speech given to the University of Toronto, Canada, 2 October 1969), which in one way or another it entails the importance of opening up the doors (political and socio-economic) in Africa particularly in East African Countries by any possible means so as to develop the social, political and economic strength of the region. In order for the East Africa Community to exist effectively these doors must be completely opened in order to allow those obstacles which prohibit other from developing such as trade barriers and other to vanish.
The paper covers the historical background of the Community on the aspect of its legal institutions and various challenges and opportunities which the lawyers are facing in the Community.

El presente texto tiene como objetivo apuntar algunos aspectos sencillos y muchas veces llamativos respecto a la supuesta "obligación" de los abogados e incluso los magistrados de vestir alguna tenida determinada para ejercer su función. El análisis tiene su centro en el análisis histórico de la costumbre para, de esta forma, llegar a Chile y sus textos positivos que rompen con la costumbre hecha ley por los reyes de España y Castilla. Finalmente el texto termina con un somero análisis de los principios generales del derecho, especialmente el "decoro judicial" y la "dignidad", los cuales son esgrimidos constantemente por el Poder Judicial chileno y la comunidad leguleya para mantener esta extraña costumbre de vestir en una cierta moda externa.

The standard of proof beyond a reasonable doubt is commonly thought to be an important benefit to the accused. The history of the standard is much more complex and demonstrates lesser commitments to the truth and to the defendant.
This article develops the history of the reasonable doubt instruction in the United States and its English antecedents. Examining the development of the instruction in the seventeenth and eighteenth centuries and its evolution through the nineteenth and twentieth, this history reveals the dual nature of the instruction. It both encapsulated a theory of knowledge and articulated a level of confidence in the evidence. Further, the history describes twentieth-century changes in the meaning of the legal standard, particularly the divorce of the jury instruction from a broader theory of knowledge and the failure of the legal language to reflect changing definitions of reason in public discourse. The most significant of these changes in the jury instruction is to define reasonableness as the assignment of reasons. The result of these changes has been both to lower standards of criminal proof and to diminish the autonomy of the juror as the finder of fact. This outcome is the opposite of that believed by the majority of the Supreme Court that made proof beyond a reasonable doubt a constitutional requirement in In re Winship. In particular, these changes in the standard may have altered the operation of the presumption of innocence, so that the defense now has the burden of proving the reasons for innocence. This result has all but escaped scholarly notice, although it is felt keenly by some judges, and it is worthy of both further study and reform.

The legal services market in Poland and throughout the European Union is changing rapidly in the 21st century. Cross-border and international legal services, cooperation with foreign lawyers and collaboration with foreign clients are now increasingly common. Simultaneously, the conditions for lawyers to work internationally, the goals of legal services and the methods and forms of legal work are changing. Finally, lawyers evolve and become more and more international.

The study indicates that Polish lawyers are very reluctant to integrate into the European legal services market: they rarely work with foreign clients, do not establish relationships with foreign lawyers, do not work in other European countries and are distanced from the global development of legal services. Furthermore, the international legal services market rarely finds in Poland clients and associate lawyers. Polish lawyers and the entire domestic legal services market appear to be strongly isolated from the increasingly internationalised European legal services market. However, a small number of Polish lawyers practising abroad or with foreign nationals are reluctant to establish business links in the country.

Reasons for this are mainly: defective education of lawyers in the international field, absence of internships abroad, ossification of structures of national bar associations, no international networking, poor integration of the Polish services market with the market of other European Union countries and cultural lack of need for transnational legal services.

The research was conducted between 2017 and 2021 by semi-structured interviews (SSI) among representatives of the boards of Polish regional bar associations as well as by questionnaire surveys performed on a representative sample of Polish advocates and legal advisers. The study is supported by a content analysis of Polish lawyers' websites and desk research. The study is part of the canon of sociology of law. Based on the research outcomes, changes and reforms are proposed in Polish legislation, corporate law, education, and in day-to-day legal practice.

Par d’autres textes, souvent totalement inédits, ce volume invite également à découvrir le collégien Robespierre dans ses relations avec l’administration de Louis-le-Grand, l’académicien d’Arras et sa correspondance avec son ami Dubois de Fosseux, où encore l’avocat, ses ardentes défenses et sa dénonciation des « préjugés ». Le volume rassemble encore trois adresses rédigées par Robespierre pour les Jacobins (1791), un projet de discours contre « la faction de l’étranger » (sept.-oct. 1793), des notes sur les « chefs de la coalition » (juin-juillet 1794), etc.
Longtemps oubliés, ces textes majeurs, divers par leur moment de production, leur nature ou leurs objets, permettent d’approcher Robespierre au travail et de renouveler le regard sur certains moments-clés de son existence.

RESUMO: A análise crítica da função social do advogado na justiça brasileira, confeccionado com base em estudo bibliográfico e documental pautada em autores que se valem de uma concepção jusfilosófica, sob uma perspectiva marxista, acerca do direito e da função social do advogado para a administração da justiça, surge do interesse em descobrir quais devem ser as orientações balizadoras da referida função jurisdicional desses profissionais, considerando-se como pressuposto que a função social da advocacia deva ser de tal entendimento que elucide como os advogados, mais que operadores do direito, têm atuado e devam atuar, para a constituição de uma sociedade justa e equânime, questionando de maneira jusfilosófica a essencialidade de suas atividades, já que laborar profissionalmente sem um viés filosófico pode comprometer o desempenho e o propósito do ofício dos advogados em sua função social previamente estabelecida.

ABSTRACT: The critical analysis of the social function of the lawyer in Brazilian justice,
based on a bibliographic and documentary study based on authors who use a jusphilosophical
conception, from a Marxist perspective, about the law and the social function of the lawyer for
the administration of justice , arises from the interest in discovering what should be the guiding
guidelines for the aforementioned jurisdictional function of these professionals, considering as
an assumption that the social function of law must be of such understanding that it elucidates
how lawyers, more than operators of law, have acted and should act, for the constitution of a
fair and equitable society, questioning in a jusphilosophical way the essentiality of their
activities, since working professionally without a philosophical bias can compromise the
performance and the purpose of the legal profession in their previously established social
function.

by the collectors or processors for the purpose of processing. Consent has been viewed as an expression of a person‘s
autonomy or control, which has the consequence of allowing another person to legally disclaim liability for acts, which have
been consented to. Consent has many connotations in various privacy laws, somewhere it tows the line of prevailing
international laws and in some laws it gets localized, but largely consent remains individuals’ will to share his / her data. This
paper analysis the established privacy laws i.e. EU’s GDPR and ECPA of USA with long awaited India’s proposed Personal
Data Protection Bill. The author has been involved in various government consultations on PDPB since 2006.

Chapter I of this report documents the death penalty verdicts that were issued in 2017 and which the research team managed to gather from the court documents, whether issued by the court of first instance or by the court of Cassation, or whether by a civil or military court according to the chronological order of issuance. This chapter contains details of some of these cases, including 5 cases in which the Court of Cassation has upheld death sentences, eight cases in which the death penalty were issued in civil courts, and two cases where the Supreme Military Court of Appeals has upheld death sentences against civilians.

Chapter II monitors the patterns of violations inflicted upon some of the defendants sentenced to death during the proceedings. At least 32 defendants in 8 cases were forcibly disappeared, while the prosecution began investigations with at least 50 defendants, despite the absence of their lawyers during these initial interrogation periods. At least 42 of the defendants sentenced to death retracted their previous confessions as having been the result of torture, the courts documented the presence of physical marks on the bodies of at least 13 defendants during trial, and at least 22 of them asked to be examined by forensic medicine. Moreover, the Ministry of Interior filmed and published videos of 11 defendants confessing during the interrogations. Finally, documented are the complaints of poor prison conditions made by at least 22 defendants who were eventually sentenced to death.

This document is the product of a brainstorming exercise conducted on the subject of the ethical dimension of the law, and whose main objective is to relate the rules or laws are values oriented towards the greatness of man as a person, sentient intelligence and healthy collective relationship between humans and their environment. Refer to the ethical dimension of law is nothing to indicate the ability or moral content they contain and the scope or extent that suchcover. Reflection outlined here the word refers to ethics as the anthology of legal order and theguarantee of its permanence in the radical purity of all values, because if a legal structure lacksethical dimension then, does not meet its primary value, read and justice. Thus, we concludethat the main way legal and moral standards to preserve its primary function should be structured using the tool that is ethics.

The rapid development of contemporary Polish-Ukrainian relations and the emigration of Ukrainians to Poland and EU countries require more and more lawyers to provide cross-border legal services. However, the emerging barriers between the countries effectively limit the possibilities for cooperation. It is particularly important to determine the extent of involvement of Polish lawyers in Ukraine and Ukrainians in Poland and to explain the reasons for their lack of involvement. It is also important to determine the consequences of the observed problem and the development strategy for the future.

The present research is part of a larger study on the internationalisation of the Polish justice system and the provision of cross-border legal services. Methodologically, the study has been performed through structured interviews among representatives of Polish lawyers and questionnaires among all Polish lawyers. It was supplemented by non-reactive methods: an analysis of statistical data, an anthropomastic analysis, a content analysis of websites, and a functional analysis of legal acts.

The results of the study show that Polish lawyers do not practice in Ukraine at all, and no more than 20 Ukrainian jurists work in Poland. The reasons are the border barriers and the lack of demand for mutual legal services, as well as cultural differences. The low level of involvement of the Polish and Ukrainian Bar Associations also contributes to the low level of provision of cross-border legal services. Nevertheless, Ukrainian immigrants to Poland are increasingly becoming Polish lawyers. Currently, the involvement of Ukrainian lawyers in the Polish legal services market is slowly increasing. This confused situation will likely change later this decade.

Imaginez ce que cela donne quand ces bambins et bambines deviennent presque adultes vers 15 ans, grand max. Du gibier de supermarché et de smartphone. C'est tout dire et ne hjamais en finir avec la délinquance car ils sont des proies faciles pour les roublards interlopes qui errent dans les ruelles sde nos villes acharnées à oublier le mal pour simplement s'en donner à coeur joie sur un ballon rond - parfois ovale.
