Poligamy

Starting from the concept of “cuckold” and having placed the substantial differences with the “troilism”, despite the terminological error committed by almost all the researchers who consider these two terms of synonyms, we proceeded to analyze the clinical, neurobiological and relational profiles, to then investigate the borderline forms of troilism: Open couples, polygamy and polyamory. By analyzing the possible etiological causes, which are the basis of these manifestations, it was concluded that probably the multifactorial is the most suitable answer, with a clear orientation towards the psychological causes deriving from a post-traumatic stress adaptation (substantially in the field of paraphilias or narcissism with adaptive forms, therefore self-destructive).

ÖZET İslam, hayatımızdaki zorluklara karşı bizlere ibadet ve muamelat konularında kolaylıklar sağlamış ve esneklikler getirmiştir. Dolayısıyla bir erkeğin ikinci bir kadın ile evlenmesine bazı sebepler neticesinde İslam hukuku müsaade etmiştir. Çok evliliğin ruhsata bağlı olarak gerçekleştirebileceğinden bahsettikten sonra evliliğin ne olduğundan ve kişinin niçin ikinci bir eş ihtiyacı duyacağından bahsetmek daha isabetli olacaktır.

La entrada en vigor de la Mudawana 2004 ha supuesto para el ordenamiento marroquí un paso adelante en la regulación de las relaciones familiares desde una perspectiva más acorde con los principios de igualdad y libertad propios de las sociedades democráticas. Se han vertido muchas opiniones sobre la trascendencia del texto desde perspectivas políticas, sociológicas y jurídicas, dentro y fuera de Marruecos. Con esta obra se pretende ofrecer al lector una visión completa de la reforma operada por la nueva Mudawana en Derecho de familia, analizando sus instituciones más significativas desde el Derecho español y los principios que lo informan, reflexionando sobre aquellas normas, su génesis y su aplicación en una sociedad estructurada sobre principios tradicionales islámicos, que mira al futuro con un espíritu abierto al cambio. Esta reflexión no es ajena a los operadores jurídicos españoles, ante los que se plantean conflictos protagonizados por inmigrantes marroquíes residentes en España, invocándose la aplicación de la Mudawana como ley personal del litigante

Neste ensaio analisa-se o funcionamento de famílias poligâmicas como redes ego-centradas em três romances africanos de diferentes momentos históricos: o grande clássico da literatura nigeriana, Things Fall Apart (1958), de Chinua Achebe, Xala (1973), do autor senegalês Ousmane Sembène, e Niketche (2002), um também já clássico contemporâneo da escritora moçambicana Paulina Chiziane.

Kasus Poligami menjadi menarik saat ini karena datang dari figur yang selama ini seringkali menyodorkan indahnya berumah tangga, nah..mengingat sebagaian umat ada yang terlalu berharap banyak pada tokoh panutannya, dan secara kebetulan tokoh tersebut seringkali membahas (menghindari kata memamerkan) indahnya kerukunan rumah tangganya, maka munculah 2 kelompok di masyarakat. Hal ini terlihat dari adanya komentar dari yang pro pada tokoh tersebut,  ada kelompok yang menganggap poligami itu sunat sebagai pembelaan pada tokoh panutannya, dan yang kontra beranggapan poligami itu tidak boleh. Argumentasi yang disampaikan oleh 2 kelompok ini seringkali menggunakan bahasa agama sebagai sebuah pembenaran atas pendapatnya.


Mengingat argumentasi yang ada seringkali menggunakan bahasa agama, maka menjadi sangat penting dipahami tujuan dari syari'at (maqoshidu asy-asyar'i) itu sendiri, yaitu:

1. Memelihara Agama (hifdzu ad-diin),
2. Memelihara harta (hifzdu al-maal),
3. Memelihara jiwa (hifdzu an-nafsi),
4. Memlihara kehormatan (hifdzu al-'irdl),
5. Memelihara keturunan (hifdzu an-nasl)

Sebagain besar ulama mujtahid berpendapat bahwa sumber hukum islam ada 4 yaitu Al-Qur'an, Hadits (Sunnah Nabi), Ijma' (Konsensus ulama), dan Qiyas (analogi hukum).

Kembali kepada masalah poligami, dalam menyikapi Poligami, perlu didahului dengan pemahaman yang jelas tentang makna SUNNAH Nabi. Betul bahwa Poligami memang SUNNAH Nabi, tapi tidak serta merta poligami itu hukumnya sunat, karena definisi dari Sunnah Nabi adalah perkataan, perbuatan dan taqrir (ketetapan) Nabi. Dari Sunnah nabi itulah akan melahirkan 5 hukum bagi ummatnya yaitu wajib, sunat, makruh, haram, dan mubah (boleh).

Jika hukum poligami dianggap sunat, maka akan berakibat pada pemahaman bahwa yang berpoligami mendapat pahala karena poligaminya an sich, sebaliknya jika hukum poligami dianggap haram (terlarang), maka yang melakukan poligami akan dianggap berdosa.  Dari kedua pemahaman ini melahirkan anggapan miring pada nilai-nilai keislaman sebagai sebuah Agama.

Lain halnya jika hukum poligami dianggap sebagai sebuah perbuatan yang MUBAH (boleh) saja, maka keterkaitan pahala atau dosanya bukan pada perbuatan poligaminya itu sendiri, melainkan dilihat dari apa penyebab yang mendorong seseorang melakukan poligami dan akibat yang ditimbulkannya.

Berdasarkan faktor penyebab dan akibat inilah akan berdampak pada hukumnya. Wallahu 'alam

Yüzyıllardır süren çok eşlilik tartışmaları günümüzde halen sıcaklığını koruyor. Osmanlı döneminde serbeset olan çok eşli evlilik Cumhuriyet döneminde yasaklanmıştır. Devam eden yasağa rağmen günümüzde çok eşli evlilik halen bir gelenek algısı ile yapılmaktadır. Genelde İslam toplumlarına mal edilen çok eşli evlenme biçimi elinizdeki kitapta da görüldüğü gibi insanlığın ilk dönemlerinden günümüze kadar birçok din ve kültür tarafından öngörülmüş ve farklı toplum tabakaları tarafından uygulanmıştır.

Dünya toplumları örneğinde kadın ve erkeğin çok eşliliği olarak görülen evlilik türlerine yer verilen bu kitapta ana tema Türkiye toplumunun tarihsel köklerindeki bir erkeğin birden fazla kadınla evliliğidir. Bunun yanı sıra çok eşliliğin özgün kültür kalıpları içerisinde en yaygın yapıldığı şehir olan Şanlıurfa da projeksiyona alınmıştır. Bölgede bu tür evliliği yapan 200 paydaş kişi ile yapılan görüşmeden elde edilen bilgilerle çok eşliliğin günümüz koşullarındaki nedenleri ve sonuçları hakkında okuyucuya bir perspektif sunulmuştur. Sosyolojik bir bakış açısı ile hazırlanan elinizdeki çalışma çok eşliliğin ülkemizdeki görünümü hakkında okuyucuya doyurucu akademik ve güncel bilgiler vermektedir.

A three-part closed questionnaire was distributed to a convenience sampling of 202 men and women, high school students, and older respondents in a Bedouin-Arab town if the Negev, Israel. Those in monogamous families had more positive attitudes towards polygamy than those from polygamous families. The same was true of men versus women, and youth versus older respondents. Perceived reasons for polygamous family structures likewise varied by age and gender. Previous exposure to or experience with the practice may be significant to perceived altitudes and reasons.

Critical discourse analysis (CDA) has become a very influential interdisciplinary approach, which views a discourse as a form of social practice. Antipoligamy discourse, as a social practice persisted for a long time ago in Indonesia, offers chalenging discussions in the perspective of CDA. Teun van Dijk, as one of the pioneers of CDA, articulates ideology as the basis of the social representations of groups. Furthermore, he advocates a sociocognitive interface between social structures and discourse structures. Within these views, whenever social groups, including the producers of antipoligamy texts, voice their ideas and feelings, their ideology come up apparently or, otherwise, lies behind language. This paper is an attempt to explain how women formulate their beliefs into a joint statement: by using what ideological discourse production strategies they share their ideology to public. A Joint Statement issued in December 2006, which contains a broad definition of poligamy in negative sense, in fact represents negative other-representation strategy used by its producer.

That children should be conceived naturally, born to and raised by their two young, heterosexual, married to each other, genetic parents; that this relationship between parents is also the ideal relationship between romantic or sexual partners; and that romance and sexual intimacy ought to be at the core of our closest personal relationships -- all these elements converge towards the ideal of the nuclear family.

The authors consider a range of relationship and family structures that depart from this ideal: polyamory and polygamy, single and polyparenting, parenting by gay and lesbian couples, as well as families created through current and prospective modes of assisted human reproduction such as surrogate motherhood, donor insemination, and reproductive cloning."

Maslahah actions that encourage human goodness or anything beneficial to human beings. This article is in the decision of the Religious Court of Madiun City number 0020/Pdt.G/2017/PA.Mn. The judge only granted the application for permission to have polygamy and rejected the application for separation of joint property; the decision was not granted on the verdict. The method used in this research is a qualitative research method that produces descriptive data analysis. Primary data in the form of the judge's decision of the Religious Court of Madiun City Number 0020/Pdt.G/2017/PA.Mn The secondary source of library materials in the form of books and interviews with judges. The results of this study there are three conclusions, namely 1). That is the decision with case number 0020/Pdt.G/2017/PA.Mn is by the rules of Maslahah Dzaruriyyah because in this matter, to preserve religion, soul, intellect, lineage, and property have been fulfilled. Only one thing has not been fulfilled about the property, so the more significant problem must come first. 2). The maslahah of formal and material written evidence has been met, but in the evidence of common property is not by the law, the judge rejected it, and it is by the maslahah mu'tabaroh supported by syara '. 3). The maslahah in the witness evidence, including the maslahah hajjiyah, is less than maximum, or it is still doubtful that the witness only knows it. Not by the material requirements (Article 171 HIR/308 RBg) to see, hear, and experience for himself. So the judge gave relief to the parties to support the fulfilment of the maintenance of religion, soul, intellect, lineage and property.
