Same Sex Marriage

This chapter provides the book's overall social background, research gap, objectives, sociological approach, methodology, theoretical foundation, and general arguments. Applying sociologicaltheological perspectives and utilizing the qualitative secondary research method, it contends that resolving the hot-button moral issues such as homosexuality, same-sex union, and the inclusivity of the lesbian, gay, bisexual, transgender, queer, and intersexual (LGBTQI) community in the Catholic Church, which frequently mentioned in Pope Francis's new ecclesial project called Synod on Synodality, requires an inductive theological approach and in-depth sociological study of the moral situation before moral judgment and social action to resolve them.

This study investigates the intersection of mental health disparities and interpersonal relationships among young adult LGBT individuals in five districts of West Bengal, India. 50 respondents, ranging in age from 19 to 30, from lower-middle to upper-middle socioeconomic levels, took part in qualitative interviews through the use of purposive sampling. Legal restrictions and heteronormativity remain major social obstacles that sexual and gender minorities must overcome in spite of recent legal changes. The study looks at how internalized problems like homophobia, anxiety, depression, and low self-esteem. Results highlight the importance of inclusion of legal frameworks to improve mental health and create supportive networks among the LGBT population. The study emphasizes the intricate interactions that exist between public acceptance, legislative rights, and mental health. It also stresses the necessity of complete legal reforms and social acceptance programs. This research adds to the expanding body of evidence on LGBT health disparities by illuminating these processes and emphasizes the value of social support networks and inclusive policies in fostering mental health among sexual and gender minorities. The results call for a more complex understanding of the difficulties LGBT people encounter while navigating their identities and relationships in a society that frequently marginalizes them.

After a long drawn legal battle against the criminalization of homosexual relations, the Supreme Court declared the same as unconstitutional as far as it was concerned with consenting adults in private. However, it has now opened the doors for several other topics to be discussed including marriage equality in pursuance of which several petitions are currently pending in several High Courts as well as the Supreme Court. What makes this a need of the hour is the inherent heteronormativity of Indian marriage laws although the same do not contain an express prohibition on homosexual marriages. The Mizo Marriage, Divorce and Inheritance of Property Act, 2014 however marks a departure from the usual marriage laws in India in that it specifically terms same sex marriages as void. Given the special constitutional status enjoyed by Mizoram, there is a possibility that marriage equality may not be realized there even if there is a statute made by the Indian Parliament to that effect. This paper shall specifically analyze the right to marry as an internationally recognized human right as well as its constitutional status as a fundamental right, roadblocks to achieving marriage equality in India in the light of the Mizo customary laws, and the tussle between fundamental rights and the constitutional protection accorded to personal and customary laws vis-à-vis the same.

mutaḥawwil al-jins e mutaḥawwilat al-jins – termos a serem traduzidos e
explicados mais adiante. Em um estágio posterior, os termos ʿābir al-jandar
e ʿābirat al-jandar substituíram o uso de mutaḥawwil al-jins e mutaḥawwilat
al-jins. Esta foi uma mudança implementada pelos próprios ʿābirī (plural
de ʿābir) al-jandar e ʿābirāt (plural de ʿābirat) al-jandar, ambos termos
que podem ser traduzidos como pessoas trans. Desta maneira, os antigos
termos mutaḥawwil al-jins e mutaḥawwilat al-jins foram abandonados
em benefício dos novos, mais representativos da comunidade na visão
de seus próprios integrantes.

In the late eighties of the 20th century, the methodological reflection of lesbian identity arose within the framework of feminist jurisprudence. Although the original intention was to include lesbian identity in a woman's identity, in a relatively short period there was a sudden break. Lesbian identity became a distinct identity considered to be the central position of lesbian jurisprudence. This study presents the peculiar features of lesbian legal theory. It tries to point out the historical and ideological determinants that led lesbianism to enter (legal) feminism. Lesbian separatism also took part in this development. It turned out to be the main reason for the separation of lesbian legal scholars from the feminist jurisprudence. The study presents the core ideological assumptions that constitute the theoretical nature of the lesbian theory of law, which is based on lesbian (legal) experiences.

This article explores ‘bad’ sex in an age of same-sex marriage, through an analysis of the ‘homoradical’ as a rejection of both hetero and homo-normativities. Drawing on qualitative data from 29 LGBTQ interviewees, the article considers resistance to the discursive privileging of same-sex marriage in the context of Gayle Rubin’s theories of respectability and sexual hierarchies. These hierarchies constitute a ‘charmed circle’ of accepted sexual practices which are traditionally justified by marriage, procreation and/or love. It examines non-normative sexuality through the example of the lived experiences of non-normative, anti-assimilationist identities, particularly non-monogamy, public sex, and kink sex, showing how the ‘homoradical’ deviates from the normative practices that same-sex marriage reinforces.

This study critically examines the policy landscape surrounding LGBTQ+ rights, focusing on their human rights and the promotion of diversity and equity irrespective of sexual orientation or gender identity. Using Nigeria as a case study, it delves into the intricate interplay of political, social, and economic factors that contribute to the oppression and discrimination faced by LGBTQ+ individuals.

Highlighting the background of LGBTQ+ issues in Nigeria, including societal perceptions, isolation, and the legal framework such as the enactment of the Same-Sex Marriage Bill in 2014, which criminalizes LGBTQ+ relationships, the assignment sheds light on the vulnerability of sexual minorities due to the absence of explicit policies safeguarding their rights.

By exploring the impact of this lack of legal protection, the study reveals how LGBTQ+ individuals in Nigeria endure various forms of discrimination, harassment, and violence, hindering their access to fundamental human rights and essential services like education, healthcare, and employment.

Ultimately, the article aims to deepen our understanding of the contextual factors contributing to discrimination and oppression while offering insights into potential strategies for change that can uplift highly marginalized communities. In addition, it critically evaluates existing policies and provisions and their efficacy in combating marginalization and oppression. It argues that the same-sex marriage act should be decriminalized based on the harm theory (Arimoro, 2021) and the absence of a comprehensive non-discrimination clause that explicitly encompasses sexual orientation and gender identity constitutes a significant gap in the legal framework of the Country (Izugbara et  al. 2020).

Harms that result from state-sanctioned refugee imprisonment or detention, an integral part of the global border security regime, are exemplified by direct and structural harms. Research is often particularly attentive to experiences clearly defined as detention and imprisonment such as those that take place in spaces that are gated, locked, fenced or have guards where one cannot leave due to physical barriers.
However, the insidious nature of detention for refugees means that it spreads beyond those physical barriers of the border or the fence around refugee camps and instead spreads throughout the daily lives of individuals. In this article, we work together to intertwine lived experience and academic work to truly reflect the nuanced experience of imprisonment for trans and intersex refugees. We will examine extraordinary detention and everyday detention and conclude with an argument for abolishing detention but also adding some recommendations for “improving” refugee detention for trans and intersex refugees as the state’s obsession with detaining marginalised citizens and non-citizens means that abolition is out of immediate reach.

This article presents the political debate on the legal recognition of same-sex couples and same-sex parenthood in Italy. It focuses on written sources such as documents and historiography of the LGBT movement (so called since the time of the World Pride 2000 event in Rome), and a press review covering the years 2013-2016. The aim of this reconstruction is to show if and how sexual difference, rather important in matters of procreation, has been talked about within this context. The overwhelming majority of same-sex parents in couples are lesbians, but, as will be shown, lesbians have been seldom mentioned in the debate (main source: a press survey).
