Wrongful Birth

Il danno da procreazione costituisce una fattispecie giuridica che da qualche decennio impegna molti tribunali di Paesi occidentali. Il testo affronta la questione dal punto di vista filosofico, analizzando il concetto stesso di danno da procreazione, nel suo duplice versante di nascita sbagliata e di vita sbagliata, e le argomentazioni che sostengono
il dovere morale di non far nascere esseri umani con un problema di salute. In particolare vengono prese in esame la tesi di Harris e di Savulescu, secondo cui tale doverosità deriva dall’obbligo di non introdurre sofferenza inutile nel mondo (Harris) e dal Principio di Beneficialità Procreativa (Savulescu). L’analisi è condotta secondo due livelli: il primo rimanendo nella logica stessa della beneficialità e della non maleficienza, cercando anche di vedere se le premesse poste dai due autori portino effettivamente alla conclusione dell’esistenza di tale obbligo morale; la seconda discutendo alcune delle premesse teoriche di tali tesi.

For a few decades, many courts of western countries are facing the claims for wrongful birth and wrongful life. The paper addresses the issue from a philosophical perspective, analysing the same concept of a “damage from procreation”, in its double face of wrongful birth and wrongful life, and the arguments that support the moral duty of not giving birth to human beings with a health problem. Specifically, it examines the thesis of Harris and Savulescu, according to which such dutifulness derives from the obligation not to introduce unnecessary suffering in the world (Harris) and the Principle of Procreative Beneficence (Savulescu). The analysis is conducted on two levels: the first, remaining in the logic of beneficence and non-maleficence, trying to see if the premises laid down by the two authors lead to the conclusion of the existence of this moral obligation; in the second, discussing some of the theoretical premises of these theses.

In this article we analyze the problem of whether a person who considers his own life as damage may file a complaint against who allowed his birth (wrongful life). The dominant doctrine argues that the award of such compensation would recognize the person a “right not to be born”, defending that such right does not exist. However, in this type of claims life is not the damage itself, but living with disability. We sustain that wrongful life actions do not contend with the inalienability of human life, and that the respect for the dignity of human life enforces the award of compensation to ensure life with a minimum of conditions.

""Con la sentenza 16754/2012 la Corte di Cassazione torna ad occuparsi del risarcimento per nascita indesiderata, con particolare riferimento all'attribuzione del risarcimento direttamente al bambino nato malformato. Con un'argomentazione complessa la S.C. supera la tesi negazionista, di Cass. 14488/2004, e afferma che l'inadempimento degli obblighi informativi e diagnostici del medico rispetto alla gestante genera un diritto risarcitorio in capo a tutti i soggetti coinvolti: la madre, il padre, i fratelli e persino il nascituro, poi nato malformato. Con tale arresto il diritto italiano accoglie la c.d. "wrongful life action" (azione di risarcimento per vita indesiderata), aderendo ad un orientamento che a livello internazionale conta meno di una decina di decisioni favorevoli (tra cui il celebre caso Perruche).

Il commento si propone di ricostruire il percorso argomentativo della Cassazione. In primo luogo offre al lettore una introduzione al tema della "wrongful life", con riferimento alle problematiche emergenti e al dibattito internazionale. Individuati gli elementi problematici della questione, segue l'analisi del caso, dei precedenti e delle questioni giuridiche che la S.C. supera per giungere alla decisione. In particolare il commento si concentra sul diritto al risarcimento del nascituro e in questa chiave analizza i vari aspetti del giudizio di responsabilità: soggettività del nascituro; interesse del nascituro tutelato; violazione del consenso informato e inadempimento degli obblighi di informazione; nesso di causalità; evento di danno; onere della prova.""

The boundaries of recovery for personal injury, property damage, psychiatric damage and pure economic loss have been the subject of extensive judicial discussion.  However, the courts are constantly asked to consider whether to expand recovery for such damage to novel situations.  Wrongful conception is one such situation.  In these cases parents claim, inter alia, the costs of raising a child conceived and born as a result of a negligent medical sterilisation procedure or negligent advice on this procedure.  Decisions of the highest courts in common law jurisdictions reveal significant differences in judicial strategies deployed to consider whether to recognise recovery.  Using wrongful conception as a case study, this article compares and analyses various aspects of the judicial strategies.  Five main areas of concern are identified, including: problems with the conceptualisation of the harm claimed; insufficient attention to incrementalism and the pace and "quantum" of the development of the law; and the development of hard-edged and categorical "rules" leading to either anomalies or "injustice" in subsequent cases.  The article evaluates these problems and offers some preliminary conclusions on what kind of overall judicial strategy may be best for handling novel situations.

La autora analiza las acciones denominadas wrongful birth y wrongful life. Para ello se remonta a los orígenes de estas, desarrolla los presupuestos para su accionar, identifica los elementos de la responsabilidad civil aplicable y recurre a la jurisprudencia en la experiencia comparada. Finalmente, concluye que si bien en el Perú el aborto no se ha legalizado y, en consecuencia, estas acciones no son procedentes (al no calificar como " daños indemnizables "), lo cierto es que la legalización del aborto no es lejana a nuestro sistema jurídico, por ende, debemos estar preparados para este eventual escenario.

En el presente trabajo se examina la posibilidad, en el ordenamiento jurídico chileno, de indemnizar los perjuicios producidos en virtud de los polémicos supuestos de wrongful life, wrongful birth y wrongful conception. Una vez estudiadas las diversas posiciones que sobre el particular existen en nuestra doctrina, en forma conjunta con la jurisprudencia atingente al tema, tanto nacional como extranjera, se afirma la posibilidad de conceder indemnización de perjuicios, pero no basadas en la pérdida de una chance, sino en virtud de la culpa existente en la mala praxis médica que en estas situaciones puede observarse, aplicando una noción de daño que lo entienda como la lesión a los intereses.

This article reconsiders the House of Lords decision in Rees v. Darlington Memorial Hospital NHS Trust (2003) and the decision to award a conventional award of £15,000 in all cases of failed sterilisation resulting in the birth of an unwanted child. In so doing, it briefly recites the history of the Wrongful Conception action and the unique facts of Rees. It then goes on the consider the implications of two fundamental aspects of the judgment. Firstly, it looks at the 'conventional award' itself and considers the reasoning behind the award and the effect that it has on our understanding of (particularly women's) reproductive autonomy. Secondly, it analyses the rather 'unique' judgment of Lord Scott and his decision to evaluate these cases using the possessory analogy of an unwanted foal; particular focus is given to the notion of parental 'choice' in these cases and whether mitigation (i.e. abortion or adoption) can ever be considered "reasonable".

En este artículo se examina la aceptabilidad de las acciones "wrongful birth" (WB) a partir de la teoría discursiva del derecho de Jürgen Habermas. Inicialmente, se describe el alcance que tienen hoy diversas pruebas genéticas para informar decisiones reproductivas. En un segundo momento, se delimitan reclamaciones judiciales presentadas en ordenamientos jurídicos que admiten la interrupción voluntaria del embarazo (IVE), debido a afectaciones en el embrión y el feto que no fueron conocidas por los padres por no seguirse la lex artis ad hoc en el diagnóstico preconceptivo, preimplantatorio y prenatal. En tercer lugar,
se explican los puntos con base en los cuales Habermas, en debate con Thomas McCarthy, propone la evaluación de la legitimidad de normas y fallos judiciales en términos de discursos de fundamentación y aplicación. Finalmente, se plantean las consecuencias que surgen de estos argumentos para valorar la admisibilidad de este tipo de demandas.

Si può essere moralmente e anche giuridicamente colpevoli mettendo al mondo qualcuno? Intendo chiedere se si possa esserlo – in particolari circostanze – con questo stesso atto, senza il bisogno di aggiungervi altri atti. Ogni atto procreativo consegna l’esistenza – una certa esistenza specifica, in certe condizioni iniziali specifiche – a chi inizia ad esistere. Quel che ci stiamo domandando è se alcune “chiamate al mondo” possano essere di per sé moralmente e anche giuridicamente sanzionabili.

When the doctor recognizes a deformities of the foetus just near the birth, the mother can claim damages for violation of the right to abortion provided that there has been causation between the breach of contract and the wrongful birth. The Italian Corte di Cassazione turns one’s attention to how the judge can check that if the mother had been informed, the law condition for the abortion would have been completed and she would have chosen interrupting the pregnancy. The A. discusses the various possibility in the light of breach of contract rules into the different steps of the relationship between the doctor and the mother.

El presente artículo pretende resolver la siguiente pregunta de investigación: ¿en casos de nacimientos con enfermedades congénitas que involucran una discapacidad física o mental, inadvertidas oportunamente debido a un error de diagnóstico prenatal, es posible pregonar que respecto de los padres se configura un daño susceptible de reparación en el ordenamiento jurídico colombiano? Para dar respuesta a la cuestión, se hace una revisión de la acción denominada wrongful birth en el derecho comparado y su autonomía frente a otras wrongful actions relacionadas con el ejercicio de la libertad reproductiva y la paternidad responsable (wrongful life, wrongful conception y wrongful adoption), con base en lo cual se emprende el análisis de cada uno de los elementos de la responsabilidad civil en nuestro país en los supuestos de wrongful birth, para concluir su viabilidad en Colombia y presentar un esquema de cómo podría ser la reparación de perjuicios.

The essay focuses on the question of the compensation for damages suffered by a child before his birth. Most notably, the Author tries to demonstrate how legal action to compensate the damage caused before birth does not at all imply what some legal scholars and jurisprudence qualify as the «right not to be born». In other words, the right of the child to be compensated for the damage of wrongful birth does not mean that the child has the right to non-existence.

本論文は、｢誕生肯定｣の概念について哲学的に考察するものである。｢誕生肯定｣とは、私が２００７年の論文「生命学とは何か」において導入した概念である。発表から４年が経過したが、その間の思索において、この概念が｢生命の哲学｣の根幹をなし得ることが明瞭になってきたので、ここでその全体像を記しておくことにする。全体の見取り図を与えることを優先するので、細部においては未消化の議論が多くあるが、それらの点については次回の課題にしたいと考えている。私はいま、｢誕生肯定｣の概念を土台として、その上に｢生命の哲学｣を構築することを目指している。読者はその一端を垣間見ることができるであろう。

μελέτη που εξετάζει τα ιδιαίτερα ακανθώδη ζητήματα της ιατρικής ευθύνης του γενετιστή ή μαιευτήρα για «ζημιογόνο ζωή» και «ζημιογόνο τεκνοποίηση». Συγκεκριμένα, σε αρκετές χώρες, και ιδιαίτερα στις ΗΠΑ έχει τεθεί στην κρίση των δικαστηρίων το ερώτημα, εάν ένα παιδί που γεννιέται με γενετικές βλάβες έχει αξίωση ενάντια στο γιατρό επειδή αυτός παρέλειψε να διαγνώσει την προδιάθεση των γονέων ή τις γενετικές βλάβες στο έμβρυο και να ενημερώσει τη μητέρα, ώστε εκείνη αντίστοιχα, ή να αποφύγει τη σύλληψη ή να προβεί σε διακοπή της εγκυμοσύνης, οπότε δε θα ζούσε το παιδί και δε θα υπέφερε από τη γενετική του ασθένεια («wrongful life»). Αντίστοιχα, έχει τεθεί το θέμα της ευθύνης του ιατρού προς τους γονείς του τέκνου που έχει γεννηθεί με γενετικές ανωμαλίες στις ίδιες περιπτώσεις, όταν δηλαδή ο γιατρός από σφάλμα του απέτυχε να διαγνώσει, είτε σχετική προδιάθεση των γονέων, είτε τη γενετική βλάβη του κυοφορούμενου, ώστε να μπορέσουν οι τελευταίοι να αποτρέψουν τη γέννηση του άρρωστου τέκνου, είτε αποφεύγοντας τη σύλληψη, είτε προχωρώντας σε άμβλωση («wrongful birth»).
Οι αμφιλεγόμενες αυτές αξιώσεις παρουσιάζουν πολλά ηθικά αλλά και νομικά ζητήματα, τα οποία έχουν απασχολήσει και φαίνεται ότι θα απασχολήσουν ακόμα περισσότερο τα ελληνικά δικαστήρια στο άμεσο μέλλον. Η μελέτη παρουσιάζει συνοπτικά τα επιχειρήματα που προτείνονται υπέρ και κατά της αναγνώρισης των αξιώσεων αυτών διεθνώς, σχολιάζει τις ελληνικές δικαστικές αποφάσεις που αντιμετώπισαν έως τώρα, έστω και εμμέσως, τις εν λόγω αξιώσεις και παίρνει θέση υπέρ της αναγνώρισής τους από την ελληνική έννομη με βάση (ιδιαιτέρως) το δικαίωμα των γονέων και του τέκνου στην προσωπικότητα.
