Any organization should seek the efficiency maximization, namely the achievement of an effect/effort ratio as high as possible. In order to apply this economic ground rule, some companies use strategies based on gaining a competitive advantage over competitors. In contrast, other companies choose lighter options to increase profitability. They apply strategies focused on agreements with competitors that aim to maintain prices at a certain level regardless of economic factors governing the market mechanism. The purpose of this paper is to highlight the positive and negative effects of cartels as a management strategy. In this regard, the first part of the article summarizes the most important theories about cartels and their characteristics, while the second part presents some European and Romanian cartels, based on data provided by the European Commission and the Competition Council. El presente artículo trata de explicar y delimitar las características y funciones del cartelista en España durante el siglo XX. El contexto publicitario desde el que se aborda el estudio presenta cambios fundamentales que afectan a la concepción del cartelista y generan nuevos perfiles profesionales con denominaciones igualmente novedosas. En el estudio del cartelista se parte de las raíces artísticas de los profesionales de la publicidad y se observan los cambios hacia la especialización de los cartelistas en las técnicas y teorías publicitarias. Desde las Bellas Artes, concretamente las Artes Decorativas, se incorporan los artistas al arte comercial, un arte aplicado entre otras actividades, a la publicidad. Así encontramos referencias a los ilustradores, artistas y dibujantes que se dedican a la denominada publicidad artística, expresión que deja explícito el afán por aunar y separar al mismo tiempo el arte y la publicidad, el arte y la técnica. Para completar el estudio se delimita el concepto de cartelista del de diseñador gráfico, director de arte y creativo para llegar a las postrimerías del uso del vocablo en las últimas décadas del siglo XX. Entrado el siglo XXI las disciplinas diseño y publicidad están perfectamente diferenciadas y estas, a su vez de la pintura y el dibujo artístico.

Malaysia is a known for its high level of sensitivity in the halal and haram aspects. Its status as an international halal hub reflects the sustainable halal ecosystem in the country, supported by the sensitivities of the government, industry and consumers. Unfortunately, there are irresponsible parties who make halal food a medium of crime. Thus, various food crime issues rise such as food crime, food fraud, food adulteration, food terrorism and cases that cover it. Accordingly, the objective of this article is to target the analysis of food crime issues in Malaysia, focusing on the issue of illegal meat cartels. In addition, various causative factors have been put forward, as well as modern technological alternatives as practical solutions. Data were analysed in a qualitative approach, in which data were collected through document analysis from various primary and secondary sources. As a result, the issue of illegal cartel meat has betrayed all consumers in Malaysia. The government needs to empower halal control in the country, including making practical use of the Industrial Revolution 4.0 era technology.

Either on or immediately before Tuesday 12 April 2022, Guardia Nacional (GN) forces in Jamay, Jalisco seized an improvised armor fighting vehicle (IAFV), a narco tank (narco tanque), belonging to the Cártel Jalisco Nueva Generación (CJNG). These vehicles have been utilized by the Mexican cartels for over a decade, increasingly integrated into their operational units (commandos), and have proliferated over time. The circumstances of this IAVF seizure, related to its being discovered in the back of a semi-tractor-trailer, are of great interest because they provide a glimpse into the mechanisms behind the logistical supply of CJNG operational units.

El diseño gráfico es una disciplina que se encarga de elaborar discursos
visuales con la finalidad de emitir una idea concreta. Esto es bastante
complejo, lo cual ha llevado a diversos investigadores del diseño gráfico
a buscar sostén en otras áreas del conocimiento como la semiótica, la
tradición retórica o las ciencias cognitivas. Todas estas disciplinas
abordan un marco teórico aleaborado y muy diverso, aunque tienen un punto en donde se llegan a ligar: la metáfora.

En la semiótica tiene lugar en la semántica al ser el proceso de metaforización un mecanismo mental del ser humano para asignarle significaciones distintas a los objetos, haciéndolos signos.

Comunicación Visual La comunicación es el proceso al que el emisor recurre cuando tiene el objetivo de compartir algún mensaje con un receptor. Cabe recordar el circuito básico de la comunicación: Es necesario que el emisor y el receptor conozcan los códigos utilizados. El lenguaje visual es un tipo de código en la comunicación visual, que nos permite emitir y recibir mensajes por medio del sentido de la vista. En el diseño gráfico, al tratarse de una disciplina plenamente visual, se utiliza un proceso de comunicación en el que interviene por un lado, la realidad, y por otro, la imagen. Donde el emisor es responsable de la información gráfica que construye para el espectador que la recibe. La realidad abarca todo aquello que es y que existe verdaderamente, mientras que una imagen es una apariencia realizada mediante el lenguaje visual, basada en la imitación de algunos elementos de la realidad. En ambos casos, el diseñador interviene dichos recursos dependiendo de los objetivos que hayan sido establecidos previamente, buscando propuestas y soluciones de diseño (identidad corporativa: isotipos, logotipos o imagotipos, programas y papelería de marca; ilustraciones; composiciones; etc.) con el fin de cumplir su función. De esta manera, para comunicarse, el emisor crea una imagen que sustituye a la realidad, transformándola con el fin de darle un significado

A licitação compreende uma relação econômica pautada
em normas regulatórias do Estado que se fundamentam na
busca de eficiência alocativa. Sendo o desenho do regime jurídico
licitatório forma de regulação estatal em atividade econômica
de extrema relevância, está sujeito a eventuais falhas de mercado
– como são os casos dos comportamentos anticompetitivos
adotados pelos particulares – e também a falhas de regulação,
como a produção de consequências não previstas. No presente
estudo pretende-se analisar, ainda que brevemente, como uma
melhor regulação licitatória pode contribuir para uma mais hábil
prevenção à cartelização nas licitações públicas.

La estrategia de los países desarrollados en el aprovechamiento de los recursos genéticos de la biodiversidad se ha centrado, por lo general, en cuatro grandes ejes: 1) la sistemática colección, caracterización y almacenamiento de los recursos genéticos existentes; 2) el registro y patentamiento de estos recursos mediante derechos exclusivos de propiedad intelectual1; 3) la ejecución de grandes inversiones públicas en investigación y desarrollo, en equipos científicos y de laboratorio y en habilidades técnico-científicas; y 4) la transferencia de estos activos al sector privado para su aprovechamiento económico y comercial (Stein, Kutner & Adams, 2000).

A possibilidade de indevido cerceamento da concorrência em contratações públicas não é um problema apenas de países em desenvolvimento. Trata-se de questão que ocupa juristas e economistas ao redor do mundo. No presente artigo apontam-se três formas típicas de manifestação do fenômeno, quais sejam: a corrupção, as restrições competitivas provocadas pelo próprio Estado e as condutas anticoncor-renciais perpetradas pelos particulares. Pretende-se mostrar que o Direito Administrativo moderno pode e deve desempenhar importante papel no trato das restrições à competitividade. Para tanto, é imprescindível permear o Direito da Contratação Pública com preocupações que, hoje, são típicas tão somente do Direito Concorrencial.

Since 1958 the European Commission has been in charge of monitoring a progressive reduction of national aid to shipbuilding. However, a large gap existed between theory and practice, especially during the severe crisis that hit Western European shipbuilding from the late 1970s onwards. This article gauges the real influence of state-aid control on companies' restructuring by examining both the Commission's papers and the archives of the French shipyard of Dunkirk, which was the second French shipbuilding company in the early 1980s before collapsing in 1986. It argues that the closure of the yard was due to a progressive assertion of European Economic Community (EEC) state-aid control, but also to the company's internal weakness as well as changes in the French state's industrial policy.

A legislação concorrencial brasileira caracteriza toda e qualquer forma de abuso do poder econômico como uma infração à ordem econômica. A principal conduta delitiva é a formação de cartel. A maior dificuldade na implementação de uma política pública contrária à cartelização dos mercados é a caracterização jurídica de um acordo entre concorrentes, principalmente, no contexto oligopolístico. Nossa hipótese é a seguinte: se a lei brasileira não exige a presença de um acordo para a caracterização do delito administrativo, deveria ser juridicamente possível condenar a coordenação indevida de ações entre concorrentes mesmo na ausência de acordo. Não obstante, como a colusão tácita é fruto exclusivo da convergência de interesses (cooperação espontânea), não haveria como impor um remédio comportamental adequado, caso fosse condenada. Nossa Teoria Unificada da Colusão é proposta como um meio de superar parcialmente a referida limitação prática ao oferecer a possibilidade de tratamento uniforme, ainda que limitadamente. Ao final, um algoritmo heurístico de como lidar com casos de cartel e colusão tácita é oferecido.

Resumen. No existe un consenso claro en cuanto al método más apropiado para el estudio de carteles, por lo que se han ido utilizando unas y otras alternativas al hilo de las necesidades puntuales de cada investigación. El objetivo del presente artículo es plantear una propuesta metodológica para análisis del diseño gráfico de cartelería, y la elección de dicha temática viene dada por la ausencia de una metodología clara a este respecto y se justifica por la escasez de modelos previos que versen sobre el análisis del cartel. La presente propuesta tiene como fin abordar y plantear un diseño de fichas de variables con el que poder extraer posteriormente en un trabajo de campo, no solo elementos descriptivos cualitativos de los carteles, si no datos cuantitativos del objeto de estudio en cuestión. En un primer momento se hace necesario plantear una ficha más genérica, para posteriormente abordar la carga textual y del contenido icónico del cartel en sus correspondientes plantillas, para en una última examinar la propuesta cromática, tanto de los elementos tipográficos como de los gráficos. Para el diseño de dichas tablas de análisis se tendrán en cuenta, en primer lugar, los datos informativos básicos de cada cartel, para una vez definidos los criterios compositivos elementales pasar a examinar pormenorizadamente las distintas creaciones artísticas, definidas por los citados contenidos textual, gráfico y cromático. Abstract. There is no clear consensus as to the most appropriate method for the study of posters, so alternatives have been used according to the specific needs of each investigation. The objective of this article is to propose a methodological proposal for the analysis of graphic design of cartels. The choice of this subject is given by the absence of a clear methodology in this respect and is justified by the scarcity of previous models that deal with the analysis of cartels. The present proposal aims to address and propose a design of variables sheets with which to later extract in a field work, not only qualitative descriptive elements of the posters, but also quantitative data of the object of study in question. At first it is necessary to propose a more generic card, to later deal with the textual load and the iconic content of the poster in its corresponding templates, for a last one to examine the chromatic proposal, both of the typographic elements and of the graphics. For the design of these tables of analysis, the basic informative data of each poster will be taken into account first, so that once the elementary compositional criteria have been defined, the different artistic creations, defined by the aforementioned textual, graphic and chromatic contents, can be examined in detail.

Resumen de diez páginas que realiza la autora sobre la investigación que llevó a cabo donde analiza la relación que mantiene la legislación de competencia y la agricultura. Analiza las excepciones agrarias y se detiene en el Reglamento nº 1308/2013. Asimismo, conecta la Ley 12/2013 de la cadena alimentaria con la legislación de competencia.
Estudia los cárteles agroalimentarios que ha habido en Europa y en España, y se detiene en el cártel de la leche.
Dentro de la aplicación pública y privada del Derecho de la competencia, contextualiza la Directiva 2014/104 de daños y perjuicios y el RD-Ley 9/2017. Un apartado especial ocupan las acciones colectivas.
A toda la investigación, le otorga un alcance internacional privatista, para concretar qué juez es competente y qué ley será aplicable cuando los cárteles tengan un alcance transfronterizo. O presente artigo, através de metodologia dedutiva, por meio de pesquisa bibliográfica atinente ao tema, especialmente doutrinária e documental, objetiva realizar uma análise crítica sobre o critério de dosimetria das multas aplicadas aos cartéis conforme a Lei 12.529/11, tendo como caso de debate o Termo de Compromisso de Cessação (TCC) firmado no âmbito de investigação de cartel no mercado de Gas Insulated Switchgear. Para tanto, primeiramente analisa-se a Resolução 3/2012 do Conselho Administrativo de Defesa Econômica, e, em seguida, aborda-se a decisão do conselheiro João Paulo de Resende sobre a definição da contribuição pecuniária no TCC firmado no cartel no mercado de Gas Insulated Switchgear, e, no mesmo caso, a posição diversa da Superintendência Geral. Posteriormente, analisa-se mais detidamente as divergências entre tais posições, e, então, adentra-se no debate realizado sobre essa temática no Congresso brasileiro. Ademais, discute-se o Projeto de Lei do Senado 283/2016 e a base de cálculo da multa. Por fim, conclui-se pela necessidade de um maior debate sobre o tema na sociedade em face da indeterminação normativa existente.

A proposta deste trabalho é abordar o limite de escala lógica do cartel. Esse dispositivo de transmissão é proposto por Jacques Lacan e chamado de " órgão de base " do funcionamento de sua Escola. O cartel pode ser entendido como uma forma coletiva que emerge de diversas tentativas – inclusive fracassadas – de constituição que se estrutura para-além dos efeitos de 'grupo' descritos por Freud em Psicologia das massas e análise do eu. Portanto, objetiva-se que o cartel escape às tradicionais estruturas hierárquicas e verticalizadas, além de tentar esvaziar o sentido das identificações entre os pares e do 'Um ideal'. Para tanto, a proposta é de um arranjo lógico limitado a 4+1, em que os membros do cartel se reúnam em torno de um tema (que funcionaria como elo entre o pequeno grupo), apresentando um argumento de trabalho que simultaneamente faz o grupo – uma vez que os membros estão articulados por uma produção de saber, uma tarefa – e particulariza a questão. Pensando com base na teoria dos discursos (que se utiliza de matemas para demonstrar os engendramentos dos laços sociais) proposta por Lacan em 1969-70, a estrutura de um cartel pode ser associada a uma inscrição no discurso do analista. Os outros discursos – do mestre, do universitário e da histérica – de certo modo mapeiam o aparelhamento de gozo de maneira indiferente às escalas sociais. A qualificação 'numérica' do cartel é pouco estudada na psicanálise e, em nosso entender, diz de um compromisso implícito da teoria lacaniana com certas teses da filosofia política e da sociologia a respeito da origem dos fenômenos de massa. Partindo-se dessas idéias é que nos perguntamos o que seria um 'laço pelo discurso analítico' que não corroborasse com esse corolário restritivo, que, ao contrário dos outros discursos, incide sobre a escala do laço social. Tentamos nos servir da psicanálise – sobretudo da proposta lacaniana do cartel – para pensarmos na estrutura grupal como também potencialmente emancipatória. Acreditamos que isso está posto no fundamento do 'órgão basal' da Escola, ao sugerir pensar para-além da alienação grupal.

Abstract
The purpose of this paper is to address the logical scale limit of the cartel. This transmission device proposed by Jacques Lacan and called the " basic organ " of the functioning of his School can be understood as a collective form that emerges from a number of attempts-including failures-of the constitution that structures itself beyond the group effects described by Freud in Mass Psychology and Self-Analysis. Therefore, it is intended that the cartel escape from traditional hierarchical and vertical structures, as well as try to empty the sense of identifications between peers and the " One ideal ". To do so, the proposal is a logical arrangement limited to 4 + 1, in which the cartel members gather around a theme (which would act as a link between the small group), presenting a working argument that simultaneously makes the group-since the members are articulated by a production of knowledge, a task-and particularizes the question. Thinking on the theory of speeches (using maths to demonstrate the engendering of social ties) proposed by Lacan in 1969-70, the structure of a cartel can be associated with an inscription in the analyst’s speech. The other speech from the master, the university, and the hysteric-somehow map the apparatus of enjoyment indifferently to social scales. The “numerical” qualification of the cartel is little studied in psychoanalysis and, in our opinion, it says of an implicit commitment of the Lacanian theory with certain theses of the political philosophy and the sociology with respect to the origin of the mass phenomena. Starting from these ideas, we ask ourselves what would be a “tie by analytic discourse” that does not corroborate this restrictive corollary, which, unlike the other speeches, focuses on the scale of the social bond. We try to use psychoanalysis - especially the Lacanian proposal of the cartel - to think of the group structure as also potentially emancipatory. We believe that this is on the foundation of the ‘basal organ’ of the School, by suggesting thinking beyond group alienation.

Recently, however, we witness a transformation of the classical concept of the intellectual that can be analyzed only by using hybridization methods. Expert intellectuals, who typically work for universities or think tanks, possess specialized knowledge and envision their social role to be charged with political responsibility. They strive to fashion public opinion in their statements, which is unusual for pure experts. In order to empirically examine whether expert intellectuals fulfill some of the classical functions of the intellectual, I conduct a content analysis of op-eds written by the most prominent contributors for the world’s largest newspaper syndicate (»Project Syndicate«). his introduction to the special issue on business responses to European competition policy considers the development of research in the field of European competition policy. It is argued that existing analyses have concentrated on the development of policy over time and that we know surprisingly little about the response of business to the demands of competition policy. This is important because it is apparent that ever stricter legal provision has not removed the problem and where there appears to be a considerable degree of recidivism. The aim of the special issue is to begin to address these issues by examining the response of different companies and sectors to the existence of EEC/EU competition policy.

Efforts that come close to discovering a cartel but stop short of a positive identification may in fact reinforce a cartel rather than break it. Once discovered, cartels must be punished with utmost severity. Half-hearted punishments and “mere talk” against cartel activity may also end up strengthening a cartel. When a cartel member is unable to verify with certainty whether the other members are colluding, it may employ a decision rule that depends on its prior belief that the other firms are cheating. Briefly stated, prior mistrust raises the likelihood of a cartel breakdown. When the competition agency
initiates investigation about cartel activity, it will increase the firms’ level of certainty that there is little or no cheating. This effect can only be counterbalanced with sufficiently high fines. A positive identification of cartel activity not followed by a
sufficiently large punishment will only act as an external reinforcement mechanism for the cartel. In fact, the cartel itself would find it difficult to create an equally efficient
reinforcement mechanism. This kind of a competition policy reduces the competition authority into an agency whose only function is to ensure cartel formation and sustainability, as well as effective, efficient and costless maintenance of collusion. The
Turkish cement cartel is discussed as a real-life example of these theoretical points. It is argued that enabling and encouraging harmed purchasers or sellers to collect damages
from the cartel participants through private legal action can strengthen the deterrent effect of the Competition Authority’s anti-cartel enforcement actions.
