Das Romanfragment 'Die Lehrlinge zu Sais' von Novalis stellt ein romantisches Übungskonzept vor, das seine erzieherischen Mittel nicht wie der klassische Bildungsroman um ein einzelnes Bildungssubjekt ansiedelt, das sich innerhalb eines linearen Narrativs sukzessiv (weiter-)bildet. Vielmehr gilt es, eine Bildunsglehre performativ in Szene zu setzen, die jenseits von Herrschaftslogiken die Übung nicht als eine Kontrollform, sondern als Möglichkeitsbedingung eines Kontrollverlustes entwickelt, der das freiheitliche Ich in einen spielerischen Umgang mit sich selbst setzt. Dieser im Romanfragment verhandelte Modus der Selbstdifferenz wird dabei zugleich auf eine Leserebene gehoben, wo schließlich die poetisch organisierte Kontingenz zur Vervielfachung und Intensivierung von Lektüremöglichkeiten führt.

Pensar en las consecuencias que se siguen del contacto con las formas del arte supone redirigir la mirada sobre dominios que exceden lo estético en sentido estricto. Al menos, en lo que toca a lo estético y lo artístico. Así como es difícil pensar en un arte desligado de su materialidad, es fuerza detenerse en ciertos aspectos igualmente constitutivos de algunas obras derivados de impactos extraestéticos. En este sentido, un punto de partida interesante se halla constituido por el entrecruce del arte y ciertas prácticas que dan de lleno en el ámbito que rige nuestra moralidad y nuestra vida en comunidad. Puntualmente, el ámbito de lo político.
Conviene retener aquí lo político en su sentido más amplio. Esto es, entendido como aquel espacio de visibilización y desmarque de ciertos elementos propios de una cultura y sociedad. Así, en el enfoque de Rancière, por ejemplo, el arte deviene –junto a la política– un régimen de visibilidad específico que acompaña a lo político. Ahora bien, en algún sentido, todo arte ha sido y es político. Es decir, ha podido, de mejor o peor manera, contribuir a señalar aquellos ethos en cuyo marco fue configurado. Todo arte, podría sostenerse, espeja su tiempo, su contexto cultural y social, y así acompaña la configuración de tales espacios de
construcción comunitaria de sentidos.
Cualquier obra, siguiendo esto, es susceptible de recibir un análisis histórico que busca recuperar parte de su pasado originario en la interpretación adecuada de sí. Paralelamente, buena parte de los problemas que se suscitan en materia de interpretación y crítica de arte descansan, a menudo, en la tergiversación de dichos contextos de origen en el despliegue inconveniente de ciertos anacronismos que,
como señala Didi‑Huberman, son propios de la labor historiográfica.
La obra permanece como documento y testimonio pero de un tiempo que ya no es y cuya ligazón se halla, consecuentemente, interrumpida.
Sin embargo, existe otro modo en el que el arte acompaña y de algún modo espeja esa realidad extraartística que lo rodea. Se trata de la utilización explícita de sus estrategias en materia de señalamiento, de reclamo, de interpelación.
Según esta modalidad el arte interrumpe su tradicional tendencia a la complacencia y el disfrute de sus formas por parte de su potencial público para posicionarse como elemento de transformación. Un arte con compromiso político explícito del que, entre otros, América Latina ha sido claro ejemplo desde mediados del siglo XX.

A theatrical situation engenders and maintains a peculiar ecology of events, processes, and practices, not all of which are conducted by humans. Recent performances programmatically engage with non-human actors, such as machines and algorithms, animals, plants, and mere things, and sometimes even leave the entire stage to them.
This paper develops a cosmological understanding of performance with regard to the concept and performative effect of force. The cosmological method outlined at the beginning is influenced by Alfred North Whitehead's speculative philosophy. The discussion of force then bridges natural philosophy (Aristotle, Leibniz, Schelling, Grant) and aesthetic theory (Menke, Fischer-Lichte), while the resulting ontogenetic conception of force as infinite and organized in dynamic fields builds on Gilbert Simondon's theory of individuation. This theory is finally translated into an aesthetic approach that goes beyond performative aesthetics, conceived of as in-formative aesthetics. It allows to approach different modes of being in performances on the same ontological footing, while also accounting for the different ways and intensities with which force is organized and expressed in each case. Thus a cosmological understanding of forces leads to an aesthetic understanding of performative fields.

1 Einleitung Foucaults zweite Vorlesungsreihe am Collège de France kreist um Anfänge. Nicht nur ist es seine erste historische Studie, die sich dezidiert Praktiken des Strafens zuwendet und damit einen Themenkomplex eröffnet, der mit dem Erscheinen von Überwachen und Strafen zu einem Abschluss kommen wird. Sie ist auch eine Vorlesung der Anfänge in zwei weiteren Hinsichten. Erstens beginnt mit ihr, was Foucault 1975/76 retrospektiv als Übernahme der "Hypothese Nietzsches" (VG 33) bezeichnen wird. Die fulminante Rhetorik des Kampfes, des Krieges, der im Frieden rumort, dient dabei selbst der Erfassung von Anfängen. Mit ihr wird ein altes Unterfangen in eine neue Form gebracht: nachgezeichnet werden die historischen "Entstehungsherde" (DE II/84, 176) gegenwärtiger Evidenzen. Die Vorlesung Institutionen und Theorien der Strafe kündigt zweitens an, die "Geburt des Staates nachzuzeichnen" (TIS 17). Den Gegenstand dieser Vorlesungsreihe bildet zunächst ein Volksaufstand, der sich 1639 in Rouen ereignet hat. Den Nu-Pieds und ihrer Niederschlagung widmet Foucault die ersten sieben Vorlesungen. Dieser Essay geht von Jürgen Habermas’ Bemerkung aus, negative Dialektik sei „nurmehr“ als eine (geistige) Übung zu verstehen. Demgegenüber schlage ich eine Neulektüre von Adornos Konzeption der Kritik aus einer Perspektive vor, die vor allem durch Michel Foucaults Arbeiten zu einer Ästhetik der Existenz und zum The-ma der Selbstkultivierung eröffnet worden ist. Die ethische Bedeutung der von ihm in diesem Zusammenhang erörterten Übungspraktiken konnte Foucault jedoch nur in der ästhetischen Freiheit zur Selbstüberschreitung verorten. Auch der normative Gehalt von negativer Dialektik als Übung erwächst aus dem Bezug zur Freiheit. Die ästhe-tische Übung, die dabei in den Blick kommt, speist sich allerdings aus einem Para-digma transformativer Subjektivität, das geprägt wird durch ein aporetisches Kom-munizieren zwischen dem Subjekt der Identität und der Nichtidentität des Subjekts mit sich. Negative Dialektik als Weg der Kultivierung ist somit untrennbar verbunden mit der Erfahrung des „Mißlingens der Kultur“.

This essay takes its start from the remark by Jürgen Habermas that negative dia-lectics is nothing more than a kind of (spiritual) exercise. In contrast, I propose a re-reading of Adorno’s conception of critique from a perspective that mainly has been opened up by Michel Foucault’s work on aesthetics of existence and self-cultivation. However, Foucault could only locate the ethical significance of the ascetic practices discussed in the aesthetic freedom of self-transgression. The normative content of negative dialectics as an exercise also arises from the relation to freedom. The aes-thetic exercise emerging thereby is, however, nourished by a paradigm of transforma-tive subjectivity, which is characterized by an aporetic communication between the subject of identity and non-identity of the subject with itself. Negative Dialectics as a way of cultivation thus is inextricably linked to the experience of the “failure of cul-ture”.

Wie viele Begriffe der Freiheit soll es geben? Zwei, wie Isaiah Berlin behauptet, oder drei, wie es Axel Honneth haben will? Die zeitgenössische Diskussion hingegen scheint sieben nahezulegen (negative Freiheit, Autonomie, Authentizität, Selbstverwirklichung, Macht, Nichtbeherrschung und soziale Freiheit). Ist aber "Befreiung" noch ein weiterer Begriff der Freiheit oder weist sie vielmehr über den Wert selbst der Freiheit hinaus? Oder vielleicht sollte es sich um den einen Freiheitsbegriff handeln, um den es ständig gekämpft wird? Wie dem auch sei, wird es stets angenommen, die Freiheit stelle den höchsten und tragenden Wert der modernen Politik und Gesellschaft dar. Und so macht der Begriff immer noch Epoche als Knotenpunkt von der sonst nicht zu kartografierenden Landschaft der Sozial-und politischen Philosophie der letzten sechzig Jahre, welche uns von Berlins berühmter Oxforder Antrittsvorlesung ("Zwei Freiheitsbegriffe") trennen. In diesem Seminar werden einige der Schritte reflektiert, die der Begriff der Freiheit auf dem Weg durch diese Landschaft genommen hat. Es werden dabei nicht beliebige Aufsätze zum Thema "Freiheit" gelesen, sondern begründende Texte für Ansätze, die auf dem Wert der Freiheit fussen und ihm somit die höchste Autorität über unsere Wertungen zumessen wollen. Nach einem ersten Sitzungsblock, in dem die Begriffsanalytik der Freiheit bei Berlin diskutiert wird, soll im zweiten Schritt der Debatte über die Schwierigkeiten und Einseitigkeiten von gängigen Freiheitsvorstellungen nachgegangen werden. Schliesslich werden zwei aktuelle Versuche erläutert, den Begriff der Freiheit inhaltlich zu bestimmen.

Among the third generation of Frankfurt school Critical theory scholars, Christoph Menke stands out by a strong interest in aesthetic theory and art. This workshop will focus on one of his major books in this field: Force. A Fundamental Concept of Aesthetic Anthropology.* This book connects two perspectives of research. The first perspective is the reconstruction of the “birth” of “aesthetics” as a philosophical concept in the eighteenth century (Menke pays special attention to pre-Kantian developments among German scholars): “In aesthetics, the philosophy of the subject or of the subject’s faculties assures itself of its own possibility.” The second perspective is a genealogy of the aesthetics of force, which is guided by the distinction between Baumgarten’s understanding of aesthetics as theory of the sensible faculties of the subject and a different aesthetics – developed by scholars like Herder, Sulzer and Mendelssohn – which he calls aesthetics of force (in his discussion Menke constantly refers to contemporary problems like the aesthetics of existence, aestheticization, the situation of contemporary art, the figure of the artist, the ethical and political impact of aesthetics etc.). Menke emphasizes: “The aesthetics of force founds an anthropology of difference: between force and faculty, between human and subject.” 
This workshop focuses on one of the main problems addressed in Menke’s aesthetics of force, namely the complex relation between aesthetics, force (energy), subjectivity and practices (exercises) of cultivation. In recent years a series of workshops on the interpretation of classical Chinese texts (especially the book Zhuangzi) by contemporary European sinologists have been organized at the Institute of Chinese Literature and Philosophy. The philosophical problems, which emerged through extensive discussions, show a strong and astonishing correspondence to Christoph Menke’s interest in the aesthetics of force. The guiding question of this workshop is therefore: Is it possible to unfold this correspondence in a fruitful and critical way, thus opening up a transcultural perspective, which focuses on contemporary shared problems, which avoids the fixation on comparative clichés and which is strongly aware of the fact that philosophy is always in the making? 
Christoph Menke is Professor of Philosophy at the Goethe-University in Frankfurt/Main, Germany.

Christoph Menke asserts that “the ground of autonomy is only autonomy” itself, which means that Geist – taken here as the name for the species of self-conscious life – does not and cannot produce itself. It arises in some other way, in an “event” that cannot itself be law-governed but which is necessary to enable autonomy or to make it possible.  If autonomy is acting according to the law expressive of one’s nature, then autonomy can only be enabled, so we could put it, by something else. Let us call that “spontaneity.” To bring out this point about spontaneity, I wish to put Menke’s idea to the test by looking at Hannah Arendt’s views on the subject.

Se a atualidade da Teoria Crítica é marcada pela avaliação do pensamento adorniano feita por Jürgen Habermas e em certa medida assimilada pelos demais pensadores da sua geração (como Albrecht Wellmer, Hans Robert Jauß e Peter Bürger), interessa-nos neste ensaio chamar a atenção para um certo "retorno a Adorno" que estaria em curso no presente. Para tanto, buscaremos apresentar brevemente quatro importantes filósofos alemães em atividade, os quais integrariam uma "terceira geração" frankfurtiana: Josef Früchtl, Martin Seel, Christoph Menke e Juliane Rebentisch. A obra desses quatro professores será abordada a partir de suas reinterpretações do conceito de experiência, e sobretudo de experiência estética, na filosofia adorniana.
Abstract: If Critical Theory’s present is marked by Jürgen Habermas's evaluation of Adornian thought – somewhat assimilated by other thinkers of his generation (such as Albrecht Wellmer, Hans Robert Jauß and Peter Bürger) – our main concern in this essay is drawing attention to a certain "return to Adorno" currently underway. To do so, we will briefly present four important German philosophers at work today, part of a "third generation" of the Frankfurt School: Josef Früchtl, Martin Seel, Christoph Menke, and Juliane Rebentisch. Their work will be approached starting from their reinterpretations of the concept of (especially aesthetic) experience, in Adornian philosophy.

The challenge of developing humane migration and refugee politics in Western states is far from resolved. This ongoing failure is typically attributed to the increased influence of right-wing populism and neo-fascism in Western migration politics. In this article I discuss a more radical explanation: Christoph Menke argues that political liberalism and its framing of migration as an issue of subjective human rights is the deeper root of the problem. While the merit of Menke's approach is its criticism of subjectification through individual rights that blocks politics, I show that his Critique of Rights may lead to an anti-pluralist and paternalistic 'radical republicanism'. To react to this problem, I propose a 're-flective liberalism' that allows to criticise subjectification without abandoning the form of individual rights. This position, which I develop through a discussion of Foucault's concept of 'freedom as critique', shows that in addition to protecting minorities such as migrants, individual rights turn out to be part of a regime of critical subjectification that constitutes critical subjects. Such critical subjectification by law can help to break through the blockade of politics that prevent the development of humane migration and refugee politics.

This article aims at proposing some reflections on
law, power and violence in contemporary political
philosophy. My attention will be devoted to a critical
analysis of some relevant contribution on such
matters by eminent scholars and authors such
as Alessandro Ferrara, Christoph Menke, Walter
Benjamin, Hannah Arendt.
The first part offers a brief introduction
in which Alessandro Ferrara’s reading of
Menke’s "Law and Violence" will be presented. The
second part focuses its attention on the philosophical
backgrounds of violence, especially in its relation
to liberty, power and government. In this case,
the main focus is devoted to some of the classics
in political philosophy: Niccolò Machiavelli;
Thomas Hobbes; Hannah Arendt.
The last two sections are finally devoted
to a further reflection on law and violence. On the
one hand, giving a deeper description of Ferrara’s
remarks on Menke’s work, especially in its connection
to the Rawlsian political liberalism. The last section,
on the other hand, proposes afurther brief and final
reflections on the core issue of the whole paper.

What new insights might a new title on the criticism of rights offer to legal theory and jurisprudence? Following a long tradition in critical theory, Critique of Rights by Christoph Menke seeks to explain the genesis and necessity of the paradoxical form of modern rights. What does this paradox mean? In Leviathan, Thomas Hobbes had already highlighted the tension between ius and lex, or right and law. This description refers to the two-sided structure of modern law. On the one hand, through the form of rights the law recognises individual freedom as a pre-political and pre-legal right; on the other hand, the law as a sovereign product, at the same time, permits and enables that freedom. An analysis of this paradoxical structure is the primary purpose of Menke's book. The book is organised into four parts, each divided into shorts chapters addressing specific topics. The first three parts develop historical, ontological, and critical theses, respectively. The final part, titled 'Revolution' proposes a new way of understanding the law characterised as the 'new right' of 'counter-rights'. We will return to this. Regarding methodology, the book is notable in terms of the breadth of theoretical resources on which it draws. It expansively brings together and puts to the test insights from both the Anglo-American and the civil law traditions. Menke's discussion ranges over the theories of Dworkin, Raz, and Waldron in Anglo-American analytical jurisprudence, to Savigny, Kelsen and Teubner in continental legal theory. Supporting theoretical background is drawn from Hegel, Marx, Weber, Adorno, Foucault and Luhmann, amongst others. There are similarities to and differences from other strands of critical legal scholarship. Menke's work shares with postmodern critical jurisprudence the assumption about law's necessary relation with violence (see eg Douzinas and Geary, Critical Jurisprudence, Hart, 2005). However, Menke does not propose a deconstructive hermeneutical project. Nor does he focus on the politics of adjudication or scholar activism, in the nature of American Critical Legal Studies. Instead, Menke's critical programme falls

Due to the recent unexpected publication of 'Parallax: The Dialectics of Mind and World' anthology edited by Dominik Finkelde, Slavoj Žižek & Christoph Menke, I have decided to share a snippet of my own understanding of the origins of the key philosophical term of parallax, which I've developed about a week ago as an introduction to another paper, before the mentioned anthology publication itself appeared online on 15th July 2021.

Th e aim of my essay is to question Christoph Menke's basic assumption that there can be no law without violence. While it is certainly true that the history of occidental legal forms was a history of torture and cruelty, of discipline and punishment, of police, prisons, and border control, there are at least two normative orders within the European ethical horizon that should be called “legal orders” even though they forego the use of coercion and are thus potentially nonviolent. Th e first one is international law, as most prominently conceptualized by Kant himself (thereby contradicting his own defi nition of law): International legal norms are binding, but have no distinct coercive forces at their disposal. Th e second one is Jewish law, developed and practiced over centuries under conditions of the diaspora, thus lacking any state- based means of enforcement. Both legal orders already informed the agenda laid out by Walter Benjamin’s “Critique of Violence” (1920/ 21) which can therefore guide a critical interrogation of Menke’s hidden premises. Benjamin’s notion of deposing the law ( Entsetzung des Rechts ), I argue, should not be interpreted as a “self- refl ection of law,” as Menke suggests, but rather as the idea of a law without violence.

O ensaio busca reflexões sobre o trágico em algumas obras do filósofo alemão Christoph Menke, integrante da chamada terceira geração da Teoria Crítica frankfurtiana, com o intuito de avaliar a relevância dessa categoria para um pensamento do teatro contemporâneo e para o enfrentamento dos impasses políticos do tempo presente por parte da atividade artística. Finalmente, os limites da filosofia de Menke são apontados a partir de uma problematização de seu escasso tratamento da comédia.

Tragedy and Comedy according to Christoph Menke: Critical Theory and Contemporary Aesthetics
Abstract: The essay seeks reflections on tragedy in some works by German philosopher Christoph Menke, member of the so-called third generation of the Frankfurt School of Critical Theory, in order to evaluate the relevance of this category for contemporary theater studies and for artistic activity's ability to cope with political impasses of the present. Finally, some limits of Menke's philosophy are pointed out starting from a problematization of his scarce treatment of comedy.

El ensayo intenta reconstruir de qué modo la experiencia estética se habría convertido en una categoría central de la estética contemporánea. A partir del aporte de distintos teóricos y filósofos del arte pretendemos acercarnos a las potencialidades y límites de esta categoría, prestando atención tanto a los planteos que la defienden, como también, a aquellos que la acusan de constituirse en una nueva forma ideológica. Al parecer, el concepto de obra de arte se ha vuelto obsoleto y la necesidad de comprender los procesos del arte actual se han canalizado mediante el concepto de la experiencia estética.

Distanz und Engagement

Gehört Kritisieren zum Alltag jeder wissenschaftlichen Tätigkeit,
so lassen sich doch bei genauerem Blick auf die Tätigkeit,
die Haltung, die Geschichte und Gegenwart von Kritik
kaum allgemeine Aussagen über sie treffen oder aufrecht
erhalten. In Frankfurt als der Stadt, in der in den 1920er-Jahren
das Institut für Sozialforschung die Tradition Kritischer
Theorie begründet hat, ist es kaum möglich, über Kritik nicht
in der dort begonnenen interdisziplinären Weise (sozial- und
kulturwissenschaftlich, politisch, philosophisch wie auch an
konkreten Gegenständen einzelner Fachwissenschaften orientiert)
nachzudenken. Dabei liegt es nahe, als einander in
Spannung verbundene Haltungen der Kritik diejenigen der
Distanz und des Engagements zu identifizieren: Distanz der
Epoche im phänomenologischen Sinne, der Verfremdung im
ästhetischen Sinne, des Abstands als einer Voraussetzung
jeder Erkenntnis. Doch zugleich auch Engagement im Sinne
eines eingreifenden Denkens, einer das eigene Interesse und
mehr vertretenden Parteinahme und einer selbst die Wissenschaftlichkeit
der Wissenschaft noch in Frage stellenden
Aufgabe von Distanz. Im Verlauf des Sommer-Semesters 2016
lädt die kolloquial angelegte Ringvorlesung Geisteswissenschaftler
unterschiedlicher Disziplinen an der Goethe-Universität

This paper offers a joint reading of Jürgen Habermas’s Between Facts and Norms and Christoph Menke’s Critique of Rights. More than identifying the regimes of continuity and rupture that the latter establishes in relation to the former, the paper aims at
understanding the way Menke tries to correct the discourse theory by
introducing, at the same time, an ontology of law and modern subjective rights, and a materialist reflection on non-law. It is then necessary to elucidate two central issues. First, the difference in Habermas’ and Menke’s approaches regarding the historical reconstruction of the rights system. Second, the different conceptions of self-reflection of law with which the two authors operate. Thus, it becomes possible to answer affirmatively to the following question: is there a critical theory of political will?

In der postmarxistischen politischen Philosophie wird die Veränderung gegenüber der Verstetigung analytisch und normativ bevorzugt. Deshalb leistet die postmarxistische Theorie keine realistische Analyse und normativ-differenzierende Bewertung von politischen Institutionen, insbesondere des Rechts. Der Beitrag liefert einen Ansatz, um diese Lücke zu schließen, indem er der Abblendung von institutionellen Fragen mit einer neuen postfundamentalistischen Institutionentheorie begegnet. Diese Theorie basiert auf dem Freiheitsbegriff der Kritik, der im Anschluss an Foucault entwickelt wird und zeigt, dass kritische Subjektivität durch die Institutionalisierung von freiheitlichen Subjektivierungsregimen bedingt ist. Dieser Freiheitsbegriff korrigiert den avanciertesten Ansatz der postmarxistischen Rechtstheorie, Menkes Rechtskritik. Deren Stärke ist es, die liberal entpolitisierende Subjektivierung des Rechts zu kritisieren, doch Menkes Vorschlag einer radikalen Politisierung ist paternalistisch. Mit Foucault lässt sich hingegen ein Recht denken, das Subjektivierung kritisiert und dennoch nicht paternalistisch ist, weil es die Subjekte zur Kritik der Institutionen befähigt.

This paper will discuss various understandings of the term ‘Gewalt‘ (violence/power/sovereignty) within the context of Political Theory. I will begin by challenging the highly contradictory relation of modern democracy and ‘Gewalt’.

Presenting the concept of ‘Gewalt’ in the works of Carl Schmitt as well as Thomas Hobbes, I will stress their understanding of processes transcending and creating social and legal order. Following this, I will give an alternative interpretation of ‘Gewalt’ as an element bound by the processes of law. Using the arguments of Christoph Menke and Walter Benjamin, I will then demonstrate
why referring to ‘Gewalt’ enables us to highlight fundamental aspects of social order and in law, that seem to be most mythical. In this, the mythical is described as a phenomenon that
occurs when a social order cannot systematically establish its own preconditions. Finally, I intent to show why a rejection of ‘Gewalt’ in politics and communal conflict might not lead to the absence of violence or acts of sovereignty, but to an increase in these phenomena.
Throughout this argument, I intent to outline a concept that enables Political Theory to question the preconditions of social order in an immanent and critical form.

Der Aufsatz beschäftigt sich am Beispiel des deutschen "Kopftuchstreits" mit der rechtlich-politischen Auseinandersetzung um subjektive Rechte innerhalb des liberalen Rechtsstaats. Wie Christoph Menke in seiner Deutung der für den politischen Liberalismus wesentlichen politischen Konflikte gezeigt hat, bezieht sich diese Auseinandersetzung vorrangig auf zwei Fragen: Wer sollte Anspruch darauf genießen, ein politisches Subjekt zu sein, das heißt, als Gleiche oder Gleicher berücksichtigt zu werden? Welche Ansprüche politischer Subjekte können als schützenswerte Verwirklichung subjektiver Rechte gelten? Der vorliegende Beitrag beschäftigt sich vorwiegend mit der Frage, wie die politischen Konflikte des letztgenannten Typs auf die rechtliche Auseinandersetzung um Grundrechte abfärben. Damit wende ich mich gegen ein Verständnis der Grundrechte, das diese als Garant der ethischen Neutralität eines liberalen Gemeinwesens ansieht. Ich möchte zeigen, dass der Sinn subjektiver Rechte in der liberalen Demokratie zwar unter anderem genau darin besteht, dass sie partikulare ethische Wertvorstellungen neutralisieren und die Bürgerinnen und Bürger innerhalb eines vernünftigen Rahmens vor Unterdrückung schützen. Wie eine Analyse der Entscheidungen des Bundesverfassungsgerichts (BVerfG) zum "Kopftuchstreit" zeigt, wird diese Funktion aber stets zugleich durch die partikulare Interpretation gleicher Rechte unterminiert. Dies bezeichne ich als die Dekonstruktion der Neutralität, die sich im Recht vollzieht.

First published in 2011, Christoph Menke’s Law  and Violence (Recht und Gewalt) is one of the most significant contributions to contemporary philosophy of law. By diagnosing a sort of violence “crowned by fate” in law, Menke pledges for a critique capable of breaking through this cycle of infinite
repetition. The article analyses his main claims throughout the book and
contextualizes them with the broader landscape of Menke’s own thought.

Benjamin’s Critique of Violence (1921) has been a relevant source of legal and political philosophy about the nature of law, from Derrida to Menke. In this article, we rebuild the reading of Benjamin’s Critique proposed by Menke and consider the appropriateness of violence in the law not as a tragic tension, but as a condition for its reproduction. Finally, we will consider its paradoxical nature as a confirmation of the difference between the force of law and social-normative elements such as recognition [Anerkennung].

In „Der Exzeß des Urteils: Eine Lektüre von König Ödipus“ stellt Menke zwei Ordnungen des Urteilens vor: die Ordnung des Rechts und die Ordnung des Fluches. Ich lese Menke so, dass Ödipus‘ Geschichte eine ist vom Scheitern des subjektiven Urteilens und damit vom Scheitern der Ordnung des Rechts, denn das subjektive Urteil ist die Ordnung des Rechts.
In meinem Aufsatz rekonstruiere ich zuerst die Bewegung der Ordnungen. Leitend ist mir dabei die  Antwort auf die Frage, warum Menke schreibt, Ödipus verliere im Urteil über sich selbst als Vatermörder und Ehemann seiner Mutter sein Selbst, seinen Subjektstatus und seine Handlungsfähigkeit. Denn Ödipus‘ Verlust ist der Zusammenbruch der Ordnung des Rechts, welche  durch die Ordnung des Fluches ermöglicht wurde, nur um letztendlich in sie wieder zurückzufallen. Anschließend stelle ich Fragen, die auf das Wesen des Rechts zielen, indem sie eine Schwierigkeit im Menkeschen Denken über das Recht offenlegen.

Abstract: Moderne Gesellschaften sind plural, auch in normativer Hinsicht. Im Zentrum aktueller Debatten um normative Pluralität steht vielfach das Recht. Es ist selbst Teil einer pluralen normativen Landschaft, die es in vielfältiger Weise zu ordnen beansprucht. Um über diesen – nicht unproblematischen – Bezug in sozialethischer Hinsicht ins Ge-spräch zu kommen, sind Vorklärungen notwendig: Was ist Recht? Wie grenzt es sich von anderen sozialen Normen ab und wie setzt es sich zu diesen in Beziehung? Vor allem das staatliche Recht muss sich diesbezüglich der Frage stellen, wie es mit normativer Pluralität umgehen könne, ohne nichtrechtliche Normativitäten zu juridifizieren oder nichtstaatliches Recht zu marginalisieren.

In my comment I aim to render explicit some fundamental tensions or contradictions between legal emancipation and queerness, which are at stake in the legal frameworks for the protection of queers. It thereby reopens the question of the strategic choice between appealing to the democratic legislator (political strategy) or judicial activism (legal strategy). I will first describe the current human rights paradigm, in which the legal strategy around gender identity is framed, as based on liberal subjective rights which naturalize the individual will. Second, I show that this liberal strategy is problematic, as it is apologetic and open for right-wing criticism. Third, I examine a constructivist paradigm and its tension with the naturalist paradigm. Fourth, I argue that a legal strategy which is based on the constructivist paradigm works better than the naturalist one. However, it blurs the boundaries between law and politics.

This book uses a philosophical reflection on Greek tragedy to develop a new theory of tragic experience, for the first time turning the focus on the suffering persons. Asmus Trautsch examines the existential dimension of the ancient form and probes the pertinence of tragedy for our times which is a surprisingly apt model for understanding global phenomena of self-endangerment so characteristic of modernity.

1 Einleitung Foucaults zweite Vorlesungsreihe am Collège de France kreist um Anfänge. Nicht nur ist es seine erste historische Studie, die sich dezidiert Praktiken des Strafens zuwendet und damit einen Themenkomplex eröffnet, der mit dem Erscheinen von Überwachen und Strafen zu einem Abschluss kommen wird. Sie ist auch eine Vorlesung der Anfänge in zwei weiteren Hinsichten. Erstens beginnt mit ihr, was Foucault 1975/76 retrospektiv als Übernahme der "Hypothese Nietzsches" (VG 33) bezeichnen wird. Die fulminante Rhetorik des Kampfes, des Krieges, der im Frieden rumort, dient dabei selbst der Erfassung von Anfängen. Mit ihr wird ein altes Unterfangen in eine neue Form gebracht: nachgezeichnet werden die historischen "Entstehungsherde" (DE II/84, 176) gegenwärtiger Evidenzen. Die Vorlesung Institutionen und Theorien der Strafe kündigt zweitens an, die "Geburt des Staates nachzuzeichnen" (TIS 17). Den Gegenstand dieser Vorlesungsreihe bildet zunächst ein Volksaufstand, der sich 1639 in Rouen ereignet hat. Den Nu-Pieds und ihrer Niederschlagung widmet Foucault die ersten sieben Vorlesungen. Während die geschichtswissen-schaftliche Debatte über die Volksaufstände des 17. Jahrhunderts vor allem um ihre Bedeutung für die Herausbildung des absolutistischen Staates kreiste, führte Foucault, Claude-Olivier Doron zufolge, in ihre Analyse etwas Neues ein: die Nu-Pieds gerieten als "Ereignis" (Doron 2017, 383) in den Blick. 修養與批判：以阿多諾的「否定辯證」為工夫實踐

阿多諾(Theodor W. Adorno)《否定辯證法》的最後章節為〈關於形上學的沈思〉。自從笛卡爾《沈思錄》以來，「沈思」在現代歐洲哲學中指向古希臘、羅馬哲學的修養論遺產。因此，阿多諾所謂「否定辯證」涉及哲學理論與工夫實踐的關係。以此預設為背景，筆者將特別關注法蘭克福大學哲學系教授孟柯(Christoph Menke)對阿多諾《否定辯證法》的討論，藉此連接美學與工夫論在當今法蘭克福學派脈絡下的關係問題。哈伯瑪斯(Jürgen Habermas)在《溝通行動理論》關於《否定辯證法》的評斷認為，《否定辯證法》只能被理解為一種「修持」(Exerzitium)或「習練」(Übung)而已（在筆者看來，兩者屬於廣義的「工夫論」範圍）。當然，在哈伯瑪斯回顧阿多諾批判理論之得失的過程中，這是負面的評語。然而，孟柯關於阿多諾的研究提供修正哈伯瑪斯負面評斷的理論契機，進則有助於反思批判理論與修養哲學的關係。同時，此一研究角度也可促進批判理論與當代漢語哲學的跨文化溝通。

Wer sich in den letzten Jahrzehnten für Ästhetik interessierte oder für politische Philosophie, vielleicht auch für die Tradierungen kritischer Theorie, der verbindet gewiss mit Christoph Menke ein Werk. Das Aufregende an Menkes Schreiben ist nicht nur, dass es systematisch am Verhältnis von Ästhetischem und Politischem arbeitet – an einem stets zu Irritationen oder Streit neigendem Verhältnis. Wir könnten sogar sagen, dass Menke dort einsetzt, wo diese Irritationen Schulen oder Theorietraditionen entzweiten.
