ICT Law

Il rapporto tra scienza giuridica e tecnologie informatiche rappresenta una questione ormai ineludibile per chiunque intenda misurarsi con le istanze della società digitale. I due autori si confrontano su temi attuali e decisivi relativi all’informatica giuridica e al diritto dell’informatica, esaminando l’impatto della tecnologia sulla società nel suo complesso, sulla persona e i suoi diritti, sugli istituti e sugli strumenti del diritto. Le tematiche spaziano dalla problematica tutela dei dati personali e del right to be forgotten al riconoscimento dei diritti digitali, dal governo di dati e algoritmi alle questioni poste dall’intelligenza artificiale e dalla blockchain, dall’affermarsi pervasivo di documenti informatici, firme elettroniche e contratti telematici alla complessa protezione di opere digitali e beni informatici, dalla necessità di un’amministrazione digitale e aperta all’emersione di nuove geometrie di potere, dagli inediti bilanciamenti tra interessi ai difficili equilibri in tema di responsabilità, dalla diffusione endemica della criminalità informatica ai nuovi e cupi scenari della guerra cibernetica. L’obiettivo del volume è quello di proporre al lettore alcuni punti di osservazione privilegiati per riflettere sul destino della scienza giuridica nell’era tecnologica, avvalendosi anche dell’analisi di significativi casi di studio: regolare la dimensione digitale della vita umana costituisce una sfida impegnativa ma inevitabile, cui il diritto è chiamato a rispondere.

The paper aims to examine the evolution of the intellectual property protection in the light of the changed context of reference derived from the impact of the digital dimension and, in parallel, the changes in the legal framework, recently innovated by the European Directive 2019/790 and its transposition into national law with Legislative Decree 177/2021. The analysis aims to highlight the critical aspects of the interaction between copyright and information technologies, in particular the difficult balance in the digital context between different interests in which take shape the opposing instances of closure and control, on the one hand, and openness and sharing, on the other hand, of which the protagonists (authors, users and providers) that characterize contemporary society are bearers. In the conclusions, the paper assesses the legal framework of reference and suggests useful directions for future legal regulation in this area.

Il contributo intende esaminare l’evoluzione della tutela relativa alla proprietà intellettuale alla luce del mutato contesto di riferimento derivato dall’impatto della dimensione digitale e, parallelamente, dai cambiamenti intervenuti nel quadro giuridico, costellato di recente dalla direttiva europea 2019/790 e dal suo recepimento nell’ordinamento nazionale con il d.lgs. 177/2021. L’analisi intende evidenziare gli aspetti critici dell’interazione tra diritto d’autore e tecnologie informatiche, in particolare il difficile equilibrio nel contesto digitale tra interessi diversi in cui prendono forma le contrapposte istanze di chiusura e controllo, da una parte, e apertura e condivisione, dall’altra, di cui sono latori gli attori protagonisti (autori, utenti e provider), che caratterizzano la società contemporanea. Nelle conclusioni il lavoro valuta il mutato framework giuridico di riferimento e ipotizza direzioni utili ai fini della regolazione giuridica futura in materia.

L’opera affronta, con l’apporto pratico-operativo dei numerosi contributi che la compongono, il tema del diritto di internet muovendo dai principi costituzionali della materia fino a quelli di matrice finanziaria e tributaria. Il tutto senza omettere di trattare i profili di proprietà intellettuale, privacy e web reputation, la contrattualistica, gli aspetti di diritto penale e quelli di diritto amministrativo. Si tratta quindi di un testo del quale l’operatore del diritto – indipendentemente dalla sua branca di specializzazione – non può fare a meno offrendo soluzioni ai temi giuridici che si pongono in diretta conseguenza del nascere e dello svilupparsi delle nuove tecnologie legate al mondo di internet. Filo conduttore del lavoro di studio e ricerca di ogni singolo contributo autorale è l’analisi delle questioni maggiormente dibattute alla luce dei risultati cui è pervenuta la più recente giurisprudenza senza dimenticare l’apporto, insostituibile, della dottrina. Il volume è aggiornato alle misure adottate per contrastare l’emergenza sanitaria legata al COVID-19 avuto particolare riguardo a quelle disposizioni del d.l. 8 aprile 2020, n. 23 (cd. Decreto Liquidità) che modificano il dettato di alcuni articoli del Perimetro di Sicurezza Nazionale Cibernetica; affronta specificamente il tema delle fake-news sul web e quello dei canali social quali strumenti privilegiati su cui veicolare aggiornamenti in tempo reale da parte delle istituzioni declinandoli, entrambi, alla luce dell’eccezionalità del contesto della pandemia.

Este artigo expõe, comparativamente, os regimes jurídicos relativos às medidas de segurança no tratamento de dados pessoais em Portugal e no Brasil, depois do Regulamento Geral de Proteção de Dados da União Europeia e da Lei Geral de Proteção de Dados do Brasil. O que é feito tanto em termos gerais, quanto a propósito das especificidades legislativas aplicáveis à Justiça Criminal.

"Cloud Computing. In Search of Lost Law in the Web 3.0" is one of the most complete essays on the cloud, giving informations on a bunch of aspects related to the considered technology, such as privacy, cybersecurity, disaster recovery, copyright, e-Government, e-School, e-Health, servitization, consumer protection, SMEs protection, right to access the Internet, green cloud and contracts, with some considerations of philosophy of law and general legal theory on the evolution of the property paradigm and on third enclosure movement. Il presente saggio intende mettere a fuoco il fenomeno del
cloud computing, tentando di setacciare i frammenti normativi dispersi in un fiume di norme difficilmente componibili a sistema, al fine di ricostruire il quadro giuridico vigente in materia. La certezza e la conoscibilità del diritto sono esigenze che si fanno viepiù pressanti in un terreno, come quello in esame, ancora tutto da dissodare e l’ignoranza del quale può a ragione far temere, con la prozia Léonie nella Recherche, che « la journée ne se passera pas sans pluie ». Ed è alla luce dell’attuale incertezza che si spiega il singolare fenomeno per cui, secondo una ricerca del 2014, gran parte delle imprese italiane ha familiarità con la nuvola informatica, laddove solo una sparuta minoranza ha già iscritto in bilancio una posta per la transizione verso il nuovo paradigma. Non ci si limiterà a porre nel buratto il diritto positivo tradizionalmente inteso (sovrastatale, nazionale e regionale), ma, altresì, strumenti di soft law interni ed europei, nonché i contributi di autorità amministrative indipendenti e le riflessioni della più attenta
dottrina anche extra-giuridica. Ciò nella convinzione che l’interdisciplinarità in questo campo non sia una scelta rimessa alla discrezionalità del singolo, ma un imperativo epistemologico. Chiudendo quante alle premesse metodologiche, si precisa che, dopo aver descritto il funzionamento della nuvola informatica e aver dato conto di alcuni documenti normativi a carattere generale, si procederà a una ricostruzione di tipo tematico, in modo tale da fornire, tanto al teorico, quanto al pratico, un agile strumento di lavoro, che allevî dalla faticosa lettura della congerie di atti riguardanti il cloud, potendosi concentrare anche solo sugli aspetti di contingente interesse.

Can  I  consent  to  an  infringement  of  my  Trademark? Yes.  In  a  case,  a  party  sued  the  defendants  for  infringement  of  trademark,  the defendants  defended  themselves  by  saying  the  party  had  acquiesced  to  the  use  of  the infringing  trademark.  The  Court  decided  that  since  the  defendants  had  used  the infringing  trademark  since  1958  and  since  they  had  done  good  business  without opposition;  their  use  of  the  trademark  was  honest  and  concurrent.  The  Court  further stated  that  the  party  openly  acquiesced  in  the  concurrent  use  of  the  trademark  similar  or indeed  identical  with  their  own  for  a  considerable  length  of  time  and  it  would  be  unjust at  this  time  (about  14  years  later)  to  ask  the  defendants  to  stop  using the  mark.  The  Court thus  refused to  remove  the  infringing  trademark  from  the  Register.

I should not choose a particular legal model or management structure and then try to shoehorn my members into a model that does not fit their interests or investment orientation. I will let my members’ interests and comfort levels guide my ultimate decisions.
Four (4) Factors to Consider When Choosing a Legal Entity
The four issues to consider when choosing a legal entity are liability, governance, taxation, and membership.

When one discusses about the meaning of copyright, they mostly referred to the right to copy the work by the owner of such artistic and literally work, but not for any other user of such work. And some they mostly regarded it as the exclusive economic rights of the owner of the work.
The purpose of this paper is to try to look at the various legal definitions of what copyright means through looking at the different authors of various books, to see whether these definitions have encompasses all aspects as to what is real amount to copyright. The aspect of Copyright is widely and extensively discussed in most of Intellectual Property and Information, communication and Technology Law texts.

Digital democracy has been cutting the edge in fields connected to legal, political and social theory over the last two decades but cross- fertilization and transdisciplinary approaches are still scarce. The impact of ICTs on political and governance processes seem elusive to traditional theoretical settings and mainstream conceptualizations. This is a selection of peer-reviewed conference papers originally presented at the workshop Legitimacy 2.0: E-democracy and Public Opinion in the Digital Age, at the IVR World Congress held in Frankfurt, August 18th 2011. They are also being published in the Law, Technology and Society - Proceedings XXV World Congress of IVR Special Workshop on "Legitimacy 2.0: E-democracy and Public Opinion in the Digital Age", Paper series B, ed. by Ulfrid Neumann, Goethe University, Frankfurt am Main 2012. These papers offer different approaches to findings in the field, the purpose being to go beyond the polarization between the apologists that hold the web to overcome the one-to-many architecture of opinion-building in traditional democratic legitimacy, and the critics that warn cyberoptimism entails authoritarian technocracy.

The report is based on Dar es Salaam and Iringa Regions, which is one among the region in Tanzania that develop and still developing the aspect of information and communication technology.
At the end of this report a person may be able to assess the impact of ICT evolution in Tanzania, to measure whether the society is aware that their conducts using ICT facilities hamper copyright protection, to assess if the society understands the concept of copyrights and copyright infringement, to assess the extent of copyright infringement facilitated by ICT evolution, and lastly to measure whether the legal regime present in Tanzania suffices to deal with copyright scenarios observed in the exercise.

The advancement in technology has gained universal acceptance which has made the use of computer system almost unavoidable in today's world. Most of the facets of all sectors which includes but not limited to commercial, media, education and entertainment etc. are now internet based. However, this progressive and welcoming advantage of the internet has also come with its disadvantages caused by the growing rate of internet-related crimes called "Cybercrimes." The increasing rate of cybercrimes in Nigeria has been linked with lack of sufficient laws and failure of the relevant law enforcement agencies to implement the existing laws which is aimed at preventing and punishing these crimes in Nigeria. This paper will examine the impact and causes of Cybercrime in Nigeria. The paper will also appraise the legal framework vis-à-vis the various challenges that inhibit the successful prosecution of cybercrime in Nigeria.

On the 27 of January 2017 human rights activist Dr Stella Nyanzi wrote a post on Facebook in which she dubbed the Ugandan president “a pair of buttocks.” Since then she has been subjected to various forms of harassment by the state culminating in her arrest on 7 April 2017 when she was charged with cyber harassment and offensive communication contrary to sections 24 and 25 of the Computer Misuse Act (CMA) respectively. Her case is emblematic of the shrinking space for free expression in the Ugandan cyberspace. While the Internet is frequently hailed as a tool for individual free expression this is not the case in Uganda where the state is using the Computer Misuse Act, specifically sections 24 and 25 to limit online freedom. This article analyses the case of Dr Nyanzi arguing that sections 24 and 25 of the CMA are unconstitutional as they limit online freedom.

Alla luce del quadro giuridico europeo e italiano di riferimento, il contributo intende esaminare la blockchain sotto la lente giuridica, attraverso l’analisi di alcuni profili particolarmente significativi relativi all’impiego di tale tecnologia. Nel complesso rapporto tra blockchain e diritto, infatti, emergono problematiche giuridiche in merito al coordinamento con la normativa in materia di documenti informatici e validazione temporale, in relazione alla rilevante applicazione costituita dagli smart contracts, e, altresì, riguardo l’interazione con norme a tutela di diritti, in specifico la disciplina in materia di protezione dei dati personali. Nelle conclusioni, il contributo delinea alcune possibili direzioni per affrontare le problematiche oggetto di analisi.

In the light of the European and Italian legal framework of reference, the contribution intends to examine the blockchain under the legal lens, through the analysis of some particularly significant profiles related to the application of this technology. In the complex relationship between blockchain and law, legal problems emerge regarding coordination with the legislation on electronic documents and timestamp, in relation to the relevant application constituted by smart contracts, and, also, regarding the interaction with protection of other rights, specifically the regulation on data protection. In the conclusions, the contribution outlines some possible directions for dealing with the problems analyzed.

There is absolutely no doubt that the emergence of Computers and its consequential scientific and technological improvements have increased drastically the complex nature of information in today's world. These improvements have become a subject of diverse study, discussions and polemics. One of such discussions concerns Cybersquatting. Cybersquatting has become a major issue in Information and Communication Technology today and its resulting legal implications have come under consideration for both scholars and legislators around the World. In the light of these, Nigerian Law should adequately cater for this ever growing problem, and Nigeria's policies and laws should adequately reflect the dynamic nature of the virtual world. Introduction The application of Computers 1 in virtually every facet of human life has contributed immensely in both positive and negative ways. Computers as tools introduce new aspects of complexity and current technological developments have made computers widely available as a result of increased competition and the reduction in prices of electronic devices. This in turn has resulted in an increasing rate of problems associated with the advancement in information and communications technology. One of such problems is Cybersquatting 2 .

The object of the present work is to provide a legal analysis of the formation of legally binding agreements through blockchain-based smart contracts. Smart contracts are computer codes that are capable of running automatically upon the occurrence of specific conditions and according to pre-specified functions. These codes can be stored and processed on a blockchain and any change is recorded in the blockchain. The expression "smart legal contract" refers to the use of smart contracts in the contractual domain to perform already existing contracts or to express legally binding agreements in the form of lines of computer code. Regarding the latter, researchers question whether blockchain-based smart contracts can be considered legally binding contracts. The study aims at putting in correlation contract requirements with blockchain-based smart contracts. The scope of the analysis is to verify how to interpret the rules on contract formation to make blockchain-based smart contracts fit into contract law.

Alla luce del quadro sovranazionale e nazionale di riferimento, l’intervento intende esaminare la blockchain sotto la lente giuridica, attraverso l’analisi di un profilo particolarmente significativo quale la tutela dei dati personali. Nel complesso rapporto tra blockchain e diritto, infatti, emergono criticità e problematiche in merito all’interazione di tale tecnologia con la disciplina in materia di protezione dei dati personali. Tali aspetti assumono connotazione peculiare nell’ambito della salute in considerazione delle categorie particolari di dati personali e delle condizioni di liceità del trattamento. Alla luce dei diversi aspetti oggetto di osservazione, nelle conclusioni l’intervento intende delineare alcune possibili direzioni per affrontare e superare le problematiche oggetto di analisi.

The contribution aims to analyze the European and national legal framework concerning electronic documents and electronic signatures. In particular, the paper examines the different legal and evidentiary value of electronic documents in relation to the different types of electronic signatures that characterize the legal system, also in the light of the principles that govern the matter, such as technological neutrality and non-discrimination. The analysis deals with the critical aspects that arise from the concrete application of the provisions to specific tools and technologies, developing some reflections in this regard.

Il contributo intende analizzare la disciplina normativa europea e nazionale in materia di documenti informatici e firme elettroniche. In particolare, il saggio esamina il diverso valore giuridico e probatorio dei documenti informatici in relazione alle differenti tipologie di firma elettronica che caratterizzano l’ordinamento, anche alla luce dei principi che governano la materia, quali neutralità tecnologica e non discriminazione. L’analisi è tesa ad affrontare gli aspetti critici che scaturiscono dall’applicazione concreta delle disposizioni a strumenti specifici e tecnologie determinate, sviluppando alcune riflessioni al riguardo.

Encrypting communications enhances privacy and the security of information services. This, in turn, incentivises innovation in the ICT sector and contributes significantly to the growth of the internet economy. India’s (now withdrawn) Draft National Encryption Policy was single-minded in its approach. It sought only to prescribe standards that would enable law enforcement agencies to access encrypted data. There are, however, multifarious concerns of users, internet companies and the intelligence community that need to be addressed. The second iteration of the encryption policy should incentivise the adoption of strong encryption standards by both the government as well as the private sector. It must explore technologically sophisticated solutions to protect information flows in the digital economy. This paper highlights some of these solutions that can help ensure that the policy remains relevant over the next few decades.

I dati formano il nostro 'io' digitale e costituiscono il fondamento di ogni attività umana. Il governo della data society passa dal governo dei dati e il diritto, ontologicamente deputato a regolare la vita, è chiamato a disciplinare i volti assunti dai dati, dalle informazioni e dalla conoscenza nella contemporaneità e a tutelare i diritti che ne sono coinvolti. In una realtà caratterizzata da amministrazioni aperte e cittadinanza digitale, il volume mira ad esaminare sotto la lente giuridica gli strumenti di conoscenza relativi alle diverse configurazioni dei dati, identificate nei closed data e nei relativi volti della trasparenza (proattiva e reattiva), negli open data e nei big data. L'analisi degli strumenti di conoscenza permette di comprendere le questioni che si pongono al diritto: le connessioni intricate di dati rivelano connessioni intricate di diritti, da bilanciare con accuratezza al fine di tutelare la persona e, insieme a lei, la società democratica presente e futura. Il lavoro esamina la disciplina e le problematiche peculiari dei diritti maggiormente coinvolti nella data governance, in specifico right to know, identità, oblio, diritto d'autore e protezione dei dati personali, alla ricerca del bilanciamento tra gli stessi nelle diverse configurazioni assunte dai dati. In conclusione il volume arriva a suggerire un bilanciamento tra diritti nel governo dei dati basato sulla centralità della persona, in particolare sulla dignità e sullo sviluppo della stessa, fondamenti sui quali convergono i diversi diritti oggetto di analisi. La tutela dei diritti può basarsi su un approccio preventivo e tecnologico by default e by design e sull¿accountability dei soggetti, immaginando soluzioni capaci di innovare i paradigmi tradizionali e minimizzare i rischi di asimmetria, controllo e sorveglianza, come gli open big data e forme di tutela collettiva. Un governo dei dati fondato su questa logica necessita del rinnovamento del diritto che passa da una costruzione di matrice globale e multistakeholder ed è guidato da un approccio etico, orientato verso la tutela dei diritti e lo sviluppo democratico. Il ruolo del diritto e la forza dei diritti sono necessari al governo della data society e alla tutela della persona nell'era digitale: ubi data society, ibi ius.

Information is power but communication is empowerment! Communication has become the major means of facilitating interaction and relationship amongst people and institutions in any society. The modern society communicate through telecommunication. The development of this technology poses a challenge to the Nigerian Legal System. The primary purpose of this paper therefore, is to examine the legal schemes for the telecommunications industry in Nigeria. The paper is divided into five chapters. In those chapters, the author identified lacunas, drawbacks and limitations existing in the legal schemes and concluded by recommending reform in the laws to deal with them.
