Since 1976, the VSBO disciplinary board has been only a body oF unauthorized individuals with no judicial authority created by fiat by the Supreme Court of Virginia.

Current research and evidence supports that Supreme Court of Virginia and the Virginia State Bar Organization routinely commit violations of the laws of the Commonwealth of Virginia.

The interests of justice demand an impartial tribunal , but the Court refused to request that the Virginia General Assembly to preside over the appeal of the Appellant’s matters and the appeals of all other misconduct and impairment matters involving attorneys practicing law in the Commonwealth of Virginia.

On June 25, 2019, the Supreme Court of Virginia refused to ask the Virginia General Assembly appoint an impartial tribunal and dismissed all related Motions for the same.

Some of Law and Economics’ basic claims have come to be criticized as a result of empirical findings that question their viability. Particularly, the premise that agents consistently act rationally and with their self-interest in mind seems problematic. What the consequences of the criticism mean for Law and Economics’ tenability depends largely on the questions whether (1) some elements are unassailable to the alternative’s objections and (2) the alternative is a systematic whole. It is argued that Law and Economics may be salvaged, if it is minimized and its ambitions are tempered. This means focusing on the stable, a priori, elements inherent to it.

Randall Trapp, et al. v. Commissioner DuBois, et al. was filed in 1995 on behalf of a group of inmates who were part of a Native American Spiritual Awareness Council in a Massachusetts prison. The Council maintained a weekly Circle and other practices associated with American Indian spirituality. At the time of filing, the Circle had already been in existence at the prison for more than five years.

The case proceeded to trial in 1999. In 2002, the Massachusetts Appeals Court ordered the Defendants to settle the controversy by negotiations with the Plaintiffs. In 2003, the first Purification Lodges were held inside three Massachusetts prisons, where named Plaintiffs were incarcerated (several having been transferred from the original prison). By 2003, Native Circles were meeting regularly in many prisons in the state.

Sexual age-of-consent violations involving adult–adolescent relationships (AARs) are sometimes viewed with ambivalence by the media and are infrequently prosecuted. Two studies conducted in Britain (where the age of consent is 16) examined influences on disapproval of minimally presented AARs between a 14-year-old and a 30-year-old. In Study 1, AARs involving an older man were seen as more harmful and objectionable than those involving an older woman. A second study on a jury-eligible adult population replicated Study 1's gender effects, and also found a difference between legal knowledge and personal belief that the older person had committed a crime. Gender effects in both studies were mediated by perceived harm and emotions.

L’exercice de l’art infirmier répond à des règles réglementaires qui sont d’ordre public. Ceci implique qu’elles sont directement opposables à l’infirmier et ne souffrent pas d’exception. Néanmoins, en situation d’exception, ces règles répondent clairement à la problématique de l’infirmier placé en situation de catastrophe, attentat ou face à de nombreuses victimes.

The Y-specific STR loci DYS19, DYS385, DYS389I, DYS389II, DYS390, DYS391, DYS392, DYS393, DYS434, DYS437, DYS438, DYS439 and GATA A10 were studied in a northern Portuguese population. Haplotype and allele frequencies of these 14 Y-chromosome STRs were estimated. In a sample of 212 individuals it was possible to define 196 different haplotypes of which 182 were found only once, 12 were found in 2 samples and the 2 most frequent haplotypes were shared by only 3 individuals. The observed haplotype diversity value was 0.9992. The usefulness of the inclusion of each of these new markers for forensic purposes is discussed by comparing expected and observed increases in haplotype diversity. When combining the new markers (DYS434, DYS437, DYS438, DYS439 and GATA A10) with the classical set (DYS19, DYS385, DYS389I, DYS389II, DYS390, DYS391, DYS392 and DYS393) a 0.68% increase in haplotype diversity was obtained and the number of different haplotypes rose from 157 to 196. When DYS434 was not considered the haplotype diversity was not affected.

This paper aims to prove that, due to a series of systematic, political and legal reasons, the structure of the grand jury has been transformed in ways that have altered its function, the result of which gives rise to a decrease in the screening function of grand juries and their protection of the accuse vis a vis the investigatory function of this institution, further empowering the prosecution to instrumentalize the grand jury in ways unintended by its incorporation into the 5th amendment. It concludes by arguing that these transformations have not only stripped the institution of its purpose, but also allow the prosecution to abuse its power and disregard its duty.

Abstact  Forensic botany can provide significant supporting evidence during criminal investigations. Rechtlichen Anforderungen an automatisiertes Fahren basieren unter anderem auf dem Wiener Übereinkommen über den Straßenverkehr von 1968, das einen Rechtsrahmen für nationale Straßenverkehrsgesetze vorgibt. In Deutschland erfolgte mit Wirkung vom 21. Juni 2017 die Ergänzung der Paragraphen 1a und 1b in das Straßenverkehrsgesetz (StVG). Entsprechend dem § 1a Absatz 1 StVG ist der Betrieb eines Kraftfahrzeugs „mittels hoch- oder vollautomatisierter Fahrfunktion“ grundsätzlich zulässig, unter der Bedingung, dass die Funktion bestimmungsgemäß verwendet wird. Wegen der Bedeutsamkeit des Themas hatten sich 2015, 2018 und 2019 Arbeitskreise beim deutschen Verkehrsgerichtstag für Empfehlungen zum automatisierten Fahren ausgetauscht.
Hier wurde auch auf den bereits mehrfach von dem Juristen Prof. Dr. Dr. Hilgendorf zitierten „Aschaffenburger Fall“ von Januar 2012 hingewiesen. Dabei wurde davon ausgegangen, dass ein wegen Schlaganfall bewusstloser Fahrzeugführer durch einen aktivierten Lenkassistent in einen Ort eingefahren ist und im Anschluss zwei Menschen getötet hat. Das Fahrzeug entsprach dem Stand der Technik und Hilgendorf begrenzt in diesem konkreten Fall die Sorgfaltspfl icht des Herstellers durch den Grundsatz des erlaubten Risikos. Im Rahmen der Produktbeobachtungspflicht müssen jedoch seiner Meinung nach zukünftige Neuentwicklungen Konsequenzen aus diesem nun bekannten Verkehrsunfall ziehen. Als weiteres Beispiel wurde der tödliche Unfall in Tempe im US-Staat Arizona angesprochen, bei dem ein Uber-Testfahrzeug im selbstfahrenden autonomen Modus mit einer Fußgängerin und ihrem Fahrrad kollidierte. Es handelt sich dabei um den ersten aufgezeichneten tödlichen Fußgängerunfall mit einem selbstfahrenden Uber-Testfahrzeug. Auf der Basis von veröffentlichten Fotos des Deformierten Volvo XC90, der Unfallstelle mit den Endlagen konnte vom Verfasser eine Unfallrekonstruktion mit PC-Crash angefertigt werden. Unter Annahme einer Geschwindigkeit von 64 km/h (17,8 m/s) und einer sofort wirkenden Notbremsung 1,3 Sekunden vor Kollision mit einer Verzögerung von 6,8 m/s2 wäre der Unfall vermieden worden.
Als Basis für systematische Unfallanalysen mit künstlicher Intelligenz und Risikobewertungsmethoden (beispielsweise AcciMap, das Systems-Theoretical Accident and Process Model - STAMP und die Functional Resonance Analysis Method - FRAM) im Rahmen der Produktbeobachtung, dem Freigabeprozess und der Entwicklung von automatisierten empfiehlt sich eine flächendeckende Speicherung der Unfall-, Verkehrsfluss-, Wetter- und Fahrzeugbetriebsdaten.

Legal requirements for automated driving are based, amongst others, on the Vienna Convention on Road Traffic of 1968, which provides a legal framework for national road traffic laws pretends. In Germany, paragraphs 1a and 1b were added to the Road Traffic Act (StVG) with effect from 21 June 2017. According to Section 1a, Paragraph 1 of the StVG, the operation of a motor vehicle "by means of a highly or fully automated driving function" is generally permissible, provided that the function is used as intended. Due to the importance of the topic, working groups had exchanged recommendations for automated driving at the German Traffic Court Conference in 2015, 2018 and 2019.
Here reference was also made to the "Aschaffenburg case" of January 2012, which has already been quoted several times by the lawyer Prof. Dr. Dr. Hilgendorf. This case was based on the assumption that a driver who was unconscious due to a stroke had entered a town by means of an activated steering assistant and subsequently killed two people. The vehicle was state of the art and Hilgendorf limited the manufacturer's duty of care in this specific case by the principle of permissible risk. In his opinion, however, future new developments must draw consequences from this now known traffic accident within the framework of the product monitoring obligation. As a further example, the fatal accident in Tempe in the US state of Arizona was mentioned, in which an Uber test vehicle collided with a pedestrian and her bicycle in self-propelled autonomous mode. This is the first recorded fatal pedestrian accident involving a self-propelled Uber test vehicle. On the basis of published photos of the deformed Volvo XC90, the accident site with the end positions, the author was able to make an accident reconstruction with PC-Crash. Assuming a speed of 64 km/h (17.8 m/s) and an immediately effective emergency braking 1.3 seconds before collision with a deceleration of 6.8 m/s2 the accident would have been avoided.
As a basis for systematic accident analyses and risk assessment or Artificial Intelligence methods (e.g. AcciMap, the Systems-Theoretical Accident and Process Model - STAMP and the Functional Resonance Analysis Method - FRAM) in the context of product monitoring, the release process and the development of automated ones, it is recommended that accident, traffic flow, weather and vehicle operating data be stored area-wide.

Complex issues in education today require research approaches that would contribute to new understandings of how education law can contribute to the realisation of educational rights and aspirations.1 Examples of such problems include issues of gender inequality, ethnic and
religious discrimination, managing learner behaviour and making education more inclusive, to mention a few. This highlights a need to identify the kind of approaches that would take understanding of the field of education law forward. The aim of this article is to explore the essence
of education law research. In doing so it attempts to
grapple with and move beyond the apparent tension between legal and educational approaches towards collaborations and approaches that will address the current issues in education more holistically. In comparing South African with international approaches this article will contribute towards discourses about education law
epistemologies and methodologies.

Growth of e-commerce in India is posing significant legal and regulatory challenges. Deficiencies exist despite significant amendments and introduction of secondary legislation. This paper has been written with an object to highlight deficiencies in information technology legislation governing e-commerce in India. Content analysis of information technology and other relevant legislation/literature revealed that, the IT Act partially address issues like legal validity of electronic transactions, security, content regulation, intermediary liability and jurisdiction, whereas areas like junk mail and spamming, intellectual property, payment, taxation of e-commerce transactions, and consumer protection are unaddressed. This paper fulfils the identification of ten major components of e-commerce value chain vis-a-vis the Information Technology Act and signalizes key deficiencies. Information in this paper is useful for policy and decision makers in government and e-commerce businesses.
