He was the De... moreProf. Ermanno Calzolaio is full professor of Private Comparative Law since the academic year 2006/2007. He was the Dean (Director of the Department of Law) of the University of Macerata since 4/7/2012 to 31/10/2018. In the years 2013-2019 he was visiting professor at the Faculté de Droit of the University of Orléans (France) where he gave lectures and conferences. In 2007, 2011 and 2016 he was visiting professor at the Law School of the Murdoch University (Perth-Australia) where he taught Comparative Law and Comparative Contract Law. In 2015 he was visiting professor at the Law School of the Beijing Normal University (Pekin -China) where he taught Comparative Law. In 2017 he was visiting professor at the Shanghai University of Political Sciences and Law. He is member of the Board of the Italian Association of Comparative Law (AIDC). He is Member of the International Academy of Comparative Law. His main research interests concern the comparison civil law-common law, with special regard to the role of precedent, property, contract law and succession law. The French Court of cassation will modify the style of its judgments, notably it will abandon the «unique phrase». Moreover, the Court will adopt an extended motivation in the most relevant cases. This contribution argues that, beyond the undeniable changes, this reform does not seem to upset the traditional characters of the French judicial style.

The dialogue between national judges and the Court of Justice of the European Union pivots around the preliminary reference procedure, through which the CJEU has laid down, over the past decades, the basic institutional principles of EU law. This procedure presupposes the cooperation of national courts. Any court or tribunal of a Member State may request the CJEU to solve questions of interpretation of the Treaties and of EU law in general, but the national courts against whose decisions there is no judicial remedy are obliged to bring the matter before the Court (article 267, paragraph 3 TFEU, in continuity with article 234 TEC and, before, with article 177 TEEC). Since the Cilfit1 case, the CJEU has clarified that the duty to raise a preliminary question does not arise each time that a question of interpretation needs to be solved. Una recente sentenza della Corte Suprema del Regno Unito introduce rilevanti cambiamenti alla regola sinora accolta dal diritto inglese, secondo cui la clausola penale è invalida, salvo che non costituisca una liquidazione anticipata del risarcimento del danno. Si pone quindi l’esigenza di riconsiderare l’approccio tradizionale alla comparazione civil law-common law in questa materia.

This essay aims at reflecting on the persistent relevance of the traditional distinction between ‘written’ and ‘unwritten’ law as an essential feature of the English legal tradition, in order to better understand the current discussion concerning the enactment of a written Constitution for the United Kingdom, after the wide public consultation launched in 2014 by House of Commons. Three main aspects are considered: the difference between the idea of Rule of law and the continental idea of Staatsrecht, the concept of parliamentary sovereignty, the relationship between statute law and case law. It will be argued that even if a written constitution should ever see the light in the United Kingdom, it will presumably have a very particular status. A peculiarly ‘British’ one. Ermanno Calzolaio*

Le présent article vise à donner un aperçu comparatif des règles sur la réserve, qui se trouve au centre d’un intérêt croissant dans les pays de civil law. En particulier, en Italie, un projet de loi actuellement en discussion envisage des changements importants. La comparaison avec le droit anglo-américain permet de se confronter à un système qui assure la protection de certains sujets sans leur réserver une fraction préfixée du patrimoine du défunt, ni déterminer rigoureusement les bénéficiaires, en laissant au juge le soin de décider au cas par cas.

This paper considers the phenomenon of bitcoins, the best known cryptocurrency, commonly pre-sented as a means of self regulation, because its circulation does not require the intermediation of central authorities, thanks to the use of the blockchain system. However, due to the enormous costs, concretely the circulation of bitcoins occur off chain, through platforms implemented by relatively few private companies. This means that a regulation does exist, but it is left to the private initiative. Moving from this statement, the paper briefly considers the recent EU regulatory initiative lauched in September 2020, putting in evidence its main contents and also its limits. In particular, the ‘a-territorial’ character of bitcoins questions the efficacy of the attempt to encapsulate their regulation within territorial ambits. The challenge for jurists (legislators, academics, judges) is to catch the new ‘global’ perspective of phenomena like bitcoins requiring to pass across the national legal orders in order to understand (and regulate) them.
