Abstrakt: W refleksji nad politycznością prawa i prawoznawstwa wydaje się dominować pogląd, że polityczność poprzedza (chronologicznie lub strukturalnie) prawo. W konsekwencji to anta-gonizmy sfery polityki współkształtują prawo i jego zjawiska (praktykę prawniczą i prawoznaw-stwo). Teza o prymarności polityczności może być jednak poddana weryfikacji w drodze analizy zainicjowanej przez przewrotne pytanie o jurydyczne warunki, bez których nie jest możliwa po-lityczność par excellence. Refleksja nad ikoną Zoon Politikon odsłania warunek polityczności w postaci podmiotowości uczestników sfery politycznej, z kolei sięgnięcie po psychoanalityczną teorię J. Lacana pozwala uchwycić psychodynamikę upodmiotowienia "zwierzęcia mówiącego" (Zoon Logon Echon). Wprowadzenie zakazu (Symbolicznego zakodowanego w prawie) okazu-je się warunkiem sine qua non ludzkiej podmiotowości. Wedle Pierre'a Legendre'a we współ-czesnym społeczeństwie to dogmatyka prawnicza reprodukuje podmiototwórczy Zakaz, a zatem "montuje" człowieka: Homo Iuridius, i "ustanawia jego życie". Tym sposobem prawo i dogmaty-ka prawnicza ukazują się jako warunki powstania podmiotu (politycznego), a tym samym samej polityczności.

Leviathan by Andrey Zvyagintsev is a movie that depicts the world in a state
of nature, with no prospects for creating a Hobbesian social contract. Set in the Russian peripheries, the film depicts a respected and caring family man who is gradually deprived of everything because of lack of political order with enforceable law and justice. The movie is a depiction of a contemporary “failed state”, equalized with the state of nature, where there
is no legitimate power and violence remains the only tool to achieve goals both in private and public spheres. Religion consists of empty rituals that serve corrupt officials to maintain power. This world cannot last without innocent victims, scapegoats of the society, one of whom is the protagonist of the movie. This paper offers a legal and philosophical inquiry into the film, as it draws especially on the theory of the social contract proposed by Hobbes. It depicts
a Russian town as a symbol of the state of nature as envisioned by Hobbes and describes the reasons why the social contract has not been made. According to Hobbes’s theory, in the state of nature concepts like justice and injustice do not convey any meaning; therefore, this paper investigates other: theological and anthropological concepts, to explore the meaning of Zvyagintsev’s Leviathan.

Based on a hitherto marginalized source, this paper criticizes and deconstructs Pierre Legendre's account of the case of the Canadian caporal Denis Lortie, who in May 1984 attacked the National Assembly in the city of Quebec, killing three people. In opposition to Legendre's view, Denis Lortie's violent act must be seen as a genuinely political reaction against a society perverted by political theology.

The doctoral dissertation “Viva vox iuris” is aimed at extending the research on law and literature by developping a new perspective, based on Pierre Legendre’s “dogmatic anthropology”.
Starting with an overview of the current state of research in this field, and based on a detailed presentation of Legendre’s theory, the dissertation develops the hypothesis that the deep entanglement of law and literature confers upon literature the capacity of either reinforcing the effectivity of cultural normativity, or of influencing it in the sense of a modificatory force. The plausibility of this hypothesis is then assessed by a thorough analysis of Kafka’s The Trial and Hoffmann’s The Sandman.
The Trial is presented as being a novel that stages the failure of interpretation on the diegetic, hermeneutic as well as the production level, i.e. with regard to the author (– interpretation being, from Legendre’s perspective, the fundamental cultural technique assuring a non-delusional human existence). Being confronted with this failure and the consequent lack of a regime of sense, the reader gains insight, ex negativo, into the necessity of being inscribed, by way of interpretation, into an order of Reference that needs to be mediated by literature and law.
With regard to The Sandman, the dissertation undertakes to show, through a combination of the concept of testimony with the dogmatic-anthropological core concepts of alterity and representation, how the fantastical blurring of the limits between reality and fiction, as staged in the novel, provides insights into the contingency of the fundamental structure of the normative order of cultural and subjective identity.

Pierre Legendre : Leçons X. Dogma. Instituer l'animal humain / Le Visage de la main (Partie I) | 1 Nous rendons compte conjointement de deux ouvrages dont le lien est moins la quasi concomitance que la complémentarité éditoriale. L'un, en effet, clôt un cycle-celui des Leçons-, et pourrait-on dire une oeuvre, de près de quarante ans 1. L'autre, Le visage de la main 2 , accompagne une ouverture : celle du site officiel consacré à Pierre Legendre, conçu éponymement par l'association Ars Dogmatica sous sa supervision, et destiné à incarner, du moins être le lieu central de la survie d'une pensée à son auteur : les textes réunis dans Le Visage de la Main sont en fait exactement ceux que l'on trouve, évidemment mis en scène d'une manière non linéaire, sur le site. Pour être tout à fait complet, il aurait fallu, ce qui n'aurait été sans risque de redondances, y ajouter au moins le dernier ouvrage de format conférence (L'Animal humain et les suites de sa blessure. Conférence à Montpellier 3), voire le recueil de conférence Argumenta Dogmatica 4. Tous ces textes se recoupent pour une large partie, proposant surtout des variations dans la méthode, le format et l'ordre d'exposition des idées. Pour cette raison, l'exhaustivité n'est pas tant ce qui compte ici, que la saisie d'un moment de la trajectoire intellectuelle, personnelle et extra personnelle de Pierre Legendre : moment que l'auteur a souhaité finalement mettre lui-même en scène, selon sa propre mesure, et en partie comme mise en abîme de sa propre réflexion sur la sensualité et la théâtralité de la pensée. De deux façons, au moins : si le volume a priori ultime des Leçons arbore comme un emblème le concept-somme de la pensée legendrienne, celui qui accompagne la mise en ligne d'Ars Dogmatica.com semble, par son titre, renvoyer à une dimension particulière du problème de la spécularité, à savoir le lien entre le charnel et le symbolique dans la vie de la représentation, au travers du regard porté par l'auteur sur lui-même-ou, pour manier un cliché littéraire, vu au miroir de son oeuvre. C'est pourquoi ces deux livres sont à la fois si ressemblants et dissemblables. L'un tente de synthétiser ce qui, aux yeux de Legendre, serait l'enjeu dernier d'une pensée (et d'une vie, ce qui tend à se confondre) vouée à rendre raison de la raison d'être de l'humanité. L'autre met en scène la manière dont cette vie a construit cette pensée, mais ne se résume pas à cet aspect personnel et rétrospectif, puisqu'il contient quelques notations fraîches, et d'une importance certaine. Leurs parutions rapprochées permet un autre exercice que celui du compte rendu cursif, et invitent plutôt à la mise en perspective d'une oeuvre de cinquante ans. La clôture du cycle des leçons, ou plutôt son ramassement : qu'est-ce, finalement, que l'anthropologie dogmatique ?

Pierre Legendre zufolge sind Logos und Nomos unlösbar miteinander verbunden: In jedem Sprechakt schwingt die Rede des Rechts, bzw. die Rede einer das Recht garantierenden Instanz mit. Diese diskursiv-emblematisch zu errichtende Referenz der Kultur ist der Garant, der—im Sinne des Lacanschen Spiegelparadigmas—die subjektive wie kulturelle Identitätskonstruktion authentifiziert, zudem als normativ-legitimatorische Matrix jenen Repräsentationsmechanismus ins Werk setzt, der die Sinn- und Bildordnung der Sprache und des Rechts auf kulturspezifische Weise inauguriert. Der Artikel widmet sich der Frage, inwieweit das Recht nicht nur als anthropologische, sondern zudem als linguistische Kategorie zu begreifen sein könnte. Mit Blick auf die Diskussionen um die (Un-)Übersetzbarkeit von Literatur wird die Anbindung des Subjekts, und seiner Sprache, an die Kultur und damit das Recht der Kultur in den Fokus gerückt und die Hypothese einer—im Recht begründet liegenden—a priori zu denkenden Mehrsprachigkeit der Einsprachigkeit aufgestellt.

Tema di questo studio è il ruolo che il corpo svolge nella rappresentazione e nell’esercizio del potere. Riferendosi alla ricerca filosofico-politica, storica, antropologica e sociologica del Novecento (da Carl Schmitt a Michel Foucault e Claude Lefort, da Marc Bloch a Ernst Kantorowicz, da Arnold Gehlen e Helmuth Plessner a Jean Baudrillard e Pierre Legendre), esso evidenzia diverse figure del corpo e del suo rapporto con la dimensione politica e rappresentativa. Ne emerge una duplice accezione del “corpo politico”: come metafora che, nella storia del pensiero politico e delle rappresentazioni del potere, è servita a caratterizzare la società, lo Stato e la sovranità, e come corpo dei singoli individui e della popolazione, che costituisce l’oggetto degli interventi normalizzatori della biopolitica contemporanea. In questo orizzonte si pone la questione del senso della norma, dell’istituzione e del loro rapporto con la vita, ovvero il problema delle condizioni di possibilità dell’ordine e dei suoi limiti.

Lacanian psychoanalysis cannot disregard its debts to philosophy, especially continental philosophy. Lacan's conception of language is derived from multiple philosophical sources (i.e. Plato, Aristotle, Kant, Hegel, Kierkegaard) including Heidegger's philosophy of language and pride of place. Heidegger's view of language prepares the ground for reversing the relationship between language and human beings, overcoming common sense about language and the communicative model of language. Language is much more than a set of labels; it shapes the human world and structures social relations themselves. In addition, language acts as a social link. The function of language as a social link allows us to think of it in relation to the Law and the very function of this human subjectivity. In reference to the Other of the Law and language, the subject finds her recognition, and this implies that the language is not reducible to communication. The process of technical-scientific domination of Western institutions leads to a reduction of their functions to the formal aspects, which may lead to a reification of the human as well as a state of alienation.

Based on the logic of the Lacanian mirror paradigm, Pierre Legendre claims that every culture needs to create a metaphysical entity of Reference, for the sake of the legitimacy and validity of its normative system. This entity disguises the abyss at the core of culture and legitimates it by staging itself as its origin. As such, the Reference not only authenticates individual and cultural subjectivity, but also becomes the foundation of law. Given that Legendre attributes a fundamental role to aesthetics in the creation of this entity, my essay will identify the role of literature in this respect, arguing that, on the one hand, literary texts help confirming the readers’ attachment to a specific order of Reference, i.e. of normativity and imagery. On the other hand, my essay claims that literature also has the capacity to reflect on the basis of cultural normativity and to unveil the contingency of normative truths. This results from what I call the cultural structures of testimony. Thus literature unleashes emancipatory forces with regard to a culture’s normative system. The essay tests this hypothesis by analysing E.T.A. Hoffmann’s The Sandman, a narrative that because of its play with the categories of fiction and reality is particularly salient.

Le présent mémoire entend présenter une analyse critique des mutations contemporaines de la subjectivité, qui s’inscrit dans le cadre général de la sociologie dialectique développée par Michel Freitag. En prenant appui sur sa théorie du symbolique comme sur sa typologie des modes de reproduction de la société, nous présentons dans ce travail comment se constitue ontologiquement le sujet, comment il s’exprime dans des structures sociétales historiques (modernes), puis se dissout tendanciellement dans la régulation libérale postmoderne. Cette ligne de fond que nous donne la sociologie dialectique, ouvrant la voie à une compréhension sociale des formes de la psyché, se trouve renforcée dans notre travail par l’apport des analyses contemporaines d’auteurs rattachés à la psychanalyse comme Jean-Pierre Lebrun, Charles Melman, Dany-Robert Dufour, Pierre Legendre et Christopher Lasch. Les travaux de ces auteurs peuvent selon nous effectivement être considérés comme s’inscrivant dans le cadre d’une théorie générale de la médiation, théorie qui comprend l’arrimage socio-institutionnel de la subjectivité, et pour laquelle se marient dialectiquement analyse du sujet et analyse de l’objectivité sociétale. Une fois cette commune conception ontologique de la médiation symbolique dégagée de ces différents courants, nous réalisons une analyse comparative où s’oppose typologiquement sujet moderne et néo-sujet postmoderne, le premier type se trouvant subjectivé à travers les instances politico-institutionnelles de la société, tandis que le second incarne une régression psychique au stade narcissique de la personnalité, généré par un système technocapitaliste autoréférentiel faisant l’impasse sur les médiations sociales agissant comme tiers symbolique.

Cet article analyse les tenants et les aboutissants de l’introduction du Nouveau management public dans les organisations publiques françaises. Il ne s’agit pas d’en considérer les conséquences gestionnaires, économiques et sociales, mais de révéler les logiques civilisationnelles, anthropologiques et théologiques qui sous-tendent la rencontre entre une idéologie et des pratiques américaines d’une part, et la tradition administrative française d’autre part.

Incontestablement, Pierre Legendre appartient à la race de ces rares penseurs contemporains qui ont su bâtir, patiemment, dans l’ombre, dans les marges de l’université et à l’abri des médias, une œuvre aussi profonde que stimulante qui s’étale de 1963, date de la publication de sa thèse soutenue en 1957 et qui portait sur ce qui allait devenir le monument romano-canonique, c’est-à-dire sur la pénétration du droit romain dans la chrétienté, à 2019 avec la récente parution de l’ouvrage Le visage de la main écrit à l’occasion de l’ouverture d’un site Internet dédié à sa pensée : http://arsdogmatica.com.
Ici, donc, point d’ambition d’exhaustivité mais une visée plus limitée, plus circonscrite : inscrivant nos pas dans le chemin frayé par l’anthropologie dogmatique, reconnaissant notre dette envers l’œuvre de Pierre Legendre, devenant au fil des années en quelque sorte familier de sa pensée, nous en sommes venus par la force des choses à observer des frottements récurrents, des tensions souterraines puis résurgentes, ou, mieux formulé certainement, des points limites au-delà desquelles le penseur ne saurait s’aventurer sans remettre en question l’ensemble de son édifice théorique. Pour le dire avec d’autres mots, ces infranchissables seuils, que nous nous proposons d’identifier dans les lignes qui suivent, ne nous paraissent pas liés à une inclination particulière ou à un développement localisé de l’anthropologie dogmatique, mais bien à son agencement interne qui, comme le suggère implicitement le titre du présent article, rend son articulation à l’histoire de l’être, et par conséquent à la Technique et au Nihilisme, sinon intenable du moins problématique…

Für den französischen Juristen und Psychoanalytiker Pierre Legendre („La passion d´être un autre. Étude pour la danse,“ Paris 1978) ist die christlich-abendländische Disziplinierung des Tanzes absolut. In jeder aufrechten Haltung der Tanzenden und in jeder Ordnung der Choreographie perpetuiert sich ein „Gesetz“, eine allgemeine Regulierung der Körperlichkeit, die im Gegenzug das Nicht-Normierte als illegitim ausschließt. Was nicht sein darf – das Sich-Wälzen von Körpern auf dem Boden, der Genuss der Horizontalen, der Kontrollverlust der Ekstase – wird als Symptom von Krankheit und Wahnsinn diffamiert.
Dabei ist das Gesetz auf versteckte Weise der Produzent des Ausgeschlossenen, indem das Verrückte durch den Ausschluss zuallererst hervorgebracht wird. Das gesetzeskonforme Ballett auf der Bühne und die Zuckungen in der Psychiatrie stehen so in einem wechselseitigen Zusammenhang: Nur weil die Körperbilder des Zappelns und Zitterns, der Tics und wilden Ausbrüche in der Psychiatrie konzentriert und weggesperrt werden, ist die Feier des Schönen und vorgeblich Gesunden, Nicht-Wahnsinnigen möglich.
Legendres Ansatz steht so in Beziehung zur Verhältnisbestimmung von Gesetz und Tanz bei Daniel Sibony („Le corps et sa danse,“ Paris 1995). Beide Theoretiker teilen die Nähe zur Psychoanalyse Jacques Lacans und gewinnen von ihr die Denkfigur eines allgemeinen Gesetzes („la loi“). Während aber Legendre das Gesetz vorwiegend negativ als Striktion und Verhinderung wilder Körperlichkeit zu konzipieren scheint, sieht Sibony das Gesetz in einer noch umfassenderen Paradoxalität, die neben der Bindung auch die Ermöglichung von Subjektivität beinhaltet. Der Wahnsinn („la folie“) ist kein Residuum gesetzesfreier Naturalität, sondern ereignet sich wie der Tanz immer „devans la loi“.
Von wenigen kurzen Paraphrasierungen abgesehen (Gerald Siegmund, „Abwesenheit“, Bielefeld 2006) ist Legendres und Sibonys Denken bisher kaum im deutschsprachigen Bereich der Tanzwissenschaft rezipiert worden. Eine genaue relecture dieser Gedanken im Hinblick auf das besondere Verhältnis von Wahnsinn, Tanz und Gesetz steht daher noch aus und wird hier erstmals zusammen mit einer differenzierten Kritik der Grundannahmen und Konsequenzen erarbeitet.
