El texto versa sobre el análisis de la situación que vivieron mujeres del barrio del Poble Sec de Barcelona durante la Guerra Civil y la dictadura franquista, con especial atención a los primeros años de posguerra. Éste barrio, de tradición obrera y reivindicativa, fue uno de los objetivos de los bombardeos de la aviación italiana durante la guerra. Algunas vecinas perdieron sus casas, haciendo de la miseria económica resultante del conflicto una situación especialmente penosa. Además, la legislación laboral franquista, que implantaba el "Nuevo Estado", expulsaba a la mujer casada del mercado de trabajo. Así, los núcleos familiares percibían menos ingresos y la situación de pobreza era mayor. Repasada la legislación laboral franquista aplicable, se explican muchas de las estrategias de supervivencia y gestos de solidaridad relatados por las entrevistadas en la investigación. Solidaridad que, sobre todo entre mujeres, se llevaba a cabo en tres espacios: el privado, conformado por el hogar familiar, el edificio de viviendas, entre las vecinas, y en el espacio público, fuera en la calle o en los comercios de toda la vida, que desarrollaron estrategias para ayudar a sus vecinas y, a la vez, mantener la fidelidad de sus clientas. Networks of solidarity among women of Barcelona's Poble Sec neighbour in public and private spaces during the Franco's dictatorship. Abstract: The communication presented deals with the analysis of the situation that women lived in the Poble Sec neighborhood of Barcelona during the Civil War and the Franco dictatorship, with special attention to the first postwar years. This neighborhood, with a worker and vindication tradition, was one of the objectives of the Italian aviation bombings during the war. It is for this reason that some neighbors lost their homes, making the economic misery resulting from the conflict a particularly painful situation. In addition, the Francoist labor legislation, applied as territories were falling and the "Nuevo Estado" was introduced, expelled married women from the work market. The family units received less income and the situation of poverty was greater. After reviewing the applicable Franco's labor legislation, many of the strategies of survival and solidarity expressions related by the interviewees for the investigation are explained. This solidarity, which was established above all among women, was carried out in three areas: the private one, made up of the family home, the residential building, among the neighbors, and in the public space, outside in the street or in the shops of all of life, who also developed strategies to help their neighbors and, at the same time, maintain the loyalty of her clients.

U ovom radu kratko je pojasnjen pojam pozitivne  diskriminacije prije svega na  trzistu rada ali i opcenito u drustvu.
Takodjer predoceni su znacaj i ciljevi mjera pozitivne  diskriminacije.
Ponudjene  su definicije pojmova  prdrasude, stereotipi i diskriminacija kao i pozitivna  diskriminacija. U zakljucnom djelu prikazan je kroz nekoliko primjera negativan utjecaj primjene  mjera pozitivne  diskriminacije po drustvenu stabilnost.

Theme and Purpose: The centrality of law for the study of political economy was widely recognized at the time of the emergence of the political economy discipline in the 18th century as well as throughout the 19th century. From the outset law was considered an essential component of political economy studies because social phenomena such as capital, labor and power gain their form and basic characteristics from their status as legal institutions. Since then the economic discipline has however increasingly detached itself from neighboring disciplines leaving political economy to economic sociology and political science at the same time as these disciplines increasingly has underplayed the centrality of law in relation to their assessment of political economy institutions. On this background, the conference aims in general terms to reinvigorate the focus on law and reassessing the role of law in political economy contexts. More specifically it aims to increase our theoretical understanding of the function law fulfills between economy and politics and to historically assess the evolution of law and legal thinking in relation to the issue of how law contributes to the stabilization of economic and political processes at the local, national and transnational level of world society.

Résumé

Le droit social, forme juridique prise en France par l'État-providence, est apparu lors de sa fondation comme une alternative globale aux impasses du droit issu de la Révolution. Dans un contexte de développement de la société industrielle, les principes individualistes, égalitaires et consensualistes du modèle civiliste étaient en effet inopérants pour encadrer la situation faite aux travailleurs salariés. Le droit social a entendu substituer une logique distributive à la justice commutative du contrat et de la responsabilité. Aux mécanismes interindividuels, il a préféré un cadre collectif. En lieu et place de la logique formelle et descendante du droit civil, il a imposé une prise en compte concrète et matérielle des rapports sociaux pour en dégager des normes et des institutions praticables. Mais, loin de supplanter intégralement les cadres civilistes du droit, le droit social et ses institutions d'essence solidariste ont en réalité composé avec eux : certaines techniques du droit de la responsabilité ont été maintenues à la périphérie des institutions collectives du droit social. Le droit civil a même reconquis peu à peu une partie du terrain perdu au fur et à mesure qu'il se perfectionnait en liaison avec l'évolution de la société. Cette reconquête permet, en dernière analyse, de mieux saisir la place et la nature exactes du droit social au sein du système juridique français.

Abstract
The welfare state, law and responsibility

The law regulating the French welfare state first appeared as an alternative to post-Revolutionary law. With the development of industrial societies, the situation of salaried workers could not be addressed with the principles of individualism, equality, and consensus underpinning civil law. Legal principles of social law substituted a distributive logic for the responsibilities and justice of contract law. A group logic replaced one of individual relationships. In place of the formal and ordered logic of civil law, there was a concrete and material engagement with social relations in order to identify appropriate norms and institutions. Nonetheless, social law and its institutions of solidarity never completely banished the principles of civil law : certain legal principles of responsibility were retained at the margin. Indeed, civil law has slowly regained lost ground, as it has responded to a changing society. Realising that this lost territory has been retaken provides a better understanding of the ways the law regulates social rights in the French judicial system.

A temática voltada as migrações tem chamado atenção de estudiosos e despertado certo interesse social, em razão da edição da Nova Lei das Migrações nº 13.445/2017 e o número expressivo de mais de 79,5 milhões deslocados pelo mundo (ACNUR, 2020). O trabalho objetiva analisar os mecanismos que viabilizam a validação do diploma escolar estrangeiro no Brasil, a fim de integrar os(as) migrantes a nova sociedade ingressa e propiciar melhores condições laborais. Para desenvolver o estudo foi adotada como metodologia a pesquisa bibliográfica; qualitativa; básica, de cunho exploratório, através da legislação nacional e internacional consultada em sites oficiais como: ONU, UNESCO, Planalto; os marcos teóricos são:  Dalmo de Abreu Dallari, Fábio Konder Comparato, Peter Mittler, Zygmund Bauman. O enfoque é a educação inclusiva escolar para migrantes no estado de Mato Grosso do Sul, através de uma perspectiva analítica entre o Direito, Relações Internacionais e Educação, com recorte temporal entre a promulgação da Constituição Federal de 1988 e a última consulta realizada na plataforma digital da Secretaria de Educação (SEC) do respectivo estado federado. Como premissa geral do estudo realizado foi diagnosticado que embora haja esforços internacionais e normas constitucionais fundamentais, tornar oportuna e acessível a educação inclusiva ainda carece de fronteiras a serem ultrapassadas, mais precisamente a viabilidade de informações quanto aos procedimentos administrativos e judiciais.

The present study analyzes the legal framework, which regulates social entrepreneurship in the European Union and the Republic of Bulgaria. Article 3 TUE states that one of the European Union’s goals is to develop the sustainable progress, based on a balanced economic growth, on the stability of the prices, on a competitive social economy and to an higher level of safeguard and improvement of the natural environment.
Words like “competitive social economy” captured the attention and leads to a consideration: the necessity to balance different values; the European Union pursued a “social market economy” alongside to this an important characteristic to it namely that has to be “highly competitive”.

Ez a jegyzet elsősorban az ELTE Állam- és Jogtudományi Karán a társadalombiztosítási és munkaügyi igazgatási BA szakon főkollégiumként oktatott Társadalombiztosítási jog és Szociális jog alapjai, valamint a jogász osztatlan mesterképzési szakon oktatott Közigazgatási jog – Különös rész, szociális igazgatási alapok című tantárgyak ismeretanyagához kapcsolódik. A jegyzet célja, hogy a két szak hallgatóinak bemutassa a tágabb értelemben vett szociális jog (azaz a szociálpolitikai ellátások és a társadalombiztosítás joga), illetve a szociális igazgatás fogalmi kereteit és legfontosabb elemeit.

Η ανωτέρω ανάλυση επιχειρεί να αναδείξει τις ρευστές και ολοένα αναδιαμορφούμενες δυνάμεις που συνθέτουν τον –μοναδικό- ευρωπαϊκό νομικό πλουραλισμό, καθώς και την ώσμωση των πολλαπλών πηγών δικαίου. Όπως ορθά επισημαίνεται, όσο δεν δημιουργείται ένα ευρωπαϊκό ομοσπονδιακό κράτος πρέπει να ξεκινήσουμε –αλλά εν προκειμένω και να τελειώσουμε- με μια ανοικτή ερώτηση για τις σχέσεις του δικαίου με την πολιτική αλλά και τους κράτους με το δίκαιο1. Το δίκαιο είναι πάντοτε ρευστό (in flux) και εν κινήσει/διαμορφώσει, όπως το μάγμα που ανέρχεται στην επιφάνεια της γης υπό τη μορφή της ηφαιστειογενούς λάβας. Εξού και είναι ανιστόρητα επικίνδυνο να γίνεται λόγος για δικαιική αποκρυστάλλωση ή παγίωση, τουλάχιστον sub specie aeternitatis. Φαίνεται πως το δίκαιο δεν έχει μονότροπη και μονόγραμμη διαμόρφωση, είναι μια σύνθετη, πολυπαραγοντική διαδικασία, προϊόν κοινωνικών, οικονομικών, πολιτικών/ιδεολογικών διεργασιών, κάθε άλλο παρά «ειρηνικών»2. Το δικαιικό προϊόν είναι πάντοτε κοινωνικό προϊόν, αποτέλεσμα που εξαρτάται από την κάθε φορά προσωρινή εξέλιξη μιας αειφόρου διελκυνστίνδας μεταξύ των κοινωνικών δρώντων. Καίτοι εξαρτώμενο από εξωδικαιικές ζυμώσεις, το δίκαιο προσπαθεί πάντοτε να θεμελιωθεί σε αξίες και ιδέες που υπερβαίνουν τον κόσμο του «όντος», ανήκουσες στον κόσμο του «δέοντος». Ενδεχομένως, αυτή η διηνεκώς ιστορικά επιβεβαιούμενη εξάρτηση του δικαίου να μελαγχολεί τους νομικούς, αλλά αυτό πρέπει ταυτόχρονα να τους πεισμώνει για να διαβουλεύονται αναστοχαστικά και βαθύτερα τους λόγους που το δίκαιο ενώ είναι μείζονα κοινωνική κατασκευή, δύναται παραδόξως εν ταυτώ να υπερβαίνει τους εκάστοτε οικονομικο-κοινωνικούς περιορισμούς συνδεόμενο με διιστορικές συνιστώσες, όπως τα ανθρώπινα δικαιώματα ή μια (νεο)καντιανή ηθική και πολιτική φιλοσοφία. The EU labor market, like most labor markets in the industrialized
world, is exposed to economic, social and globalization pressures coming from different sides, with accelerated modernization of the labor process, changes in the concept of employment, as well as social exclusion and aging, and the latest problems with the COVID-19 pandemic and its implications for the employment of millions of workers worldwide. These are all factors that affect the destabilization of the labor market, increasing of the unemployment, a large number of longterm unemployed, impoverishment of the population, ie. social insecurity, social tensions. Employment measures or labor market policies are one of the main
methods for solving labor market problems. In the European Union, within the Eurostat methodology, within the statistics of labor market policies, a classification of types or forms of labor market policies is given, ie. employment measure. The classic division of employment measures has in mind two types of these measures - active and passive. Active employment measures, after their introduction in some countries, are beginning to be emphasized as important policies by various
international organizations, primarily the OECD, and then the European Union, which is exposed through the content and objectives of the European Employment Strategy. In this paper, the author analyzes the importance and goals of active labor market policies in the European Union, and their impact on the labor market.

Príspevok na základe problémov z praxe poukazuje na potrebu zmeny zákona o sociálnych službách, s ktorými sa sociálni pracovníci v zariadeniach núdzového bývania stretávajú. Ide hlavne o problém obmedzenosti cieľovej skupiny a problém s poskytovanou dobou ubytovania.

The authors analyze free movement of workers in the European Union as one of the four fundamental freedoms in the internal market of the European Union. This freedom is important for European Union citizens because it allows them to leave their home country where they don't have adequate employment or income, to go to another Member State where they will be able to work under the same conditions as domestic citizens, and provide for themselves a better living and working conditions. The realization of this freedom is also significant for the Member States of the European Union, in terms of the ability to eliminate labor shortages in a particular profession, so that this deficiency can be removed by the engagement of migrant workers of other Member States. In addition to the legal sources of the primary and secondary law of the European Union governing the freedom of movement of workers, the role of the Court of Justice is particularly important, which by its judgements and extensive interpretation of the provisions governing the freedom of movement of workers made a great contribution to the adequate application of these provisions and the protection of workers' rights. Bosnia and Herzegovina, as a potential candidate for EU membership, has the obligation to harmonize its legislation with the acquis communautaire, which includes this area of law as well. For that reason, in this paper will be also analyzed the legislation of Bosnia and Herzegovina in this area and its harmonization with the law of the European Union, and point out to the obligations that Bosnia and Herzegovina has to fulfill in order to fully accept the standards and principles of the European Union.

Проаналізовано інституційні засади адаптації соціального законодавства України до acquis communautaire. Розкрито зміст основних положень щодо співпраці між Україною та Європейським Союзом у контексті національногосоціального законодавства. Сформовано перелік особливостей щодо адаптації національного соціального законодавства до acquis communautaire на різних етапах розвитку України з моменту здобуття нею незалежності. Установлено, що чинні інституційні засади адаптації соціального законодавства України до acquis communautaire були фактично сформовані станом на 2004 рік.

When Neil MacCormick, in the wake of the launch of the Maastricht Treaty on European Union, went “beyond the Sovereign State” in 1993, he fundamentally challenged the heretofore dominant paradigm of legal ordering in the European context which considered law to be singular, unified and confined within sovereign nation states. The original insight of MacCormick might, however, be pushed even further, as a historical re-construction reveals that legal pluralism is not only a trademark of recent historical times, marked by the European integration process, but has also been at the very core of legal evolution in Europe throughout its modern history. The introduction of modern law in Europe can be traced back to the eleventh and twelfth century Investiture Conflict between the Church and the Emperor, a conflict which solidified the existence of two parallel universes of law, one Church-based and one empire-based, both of which rested, in principle, upon mutually exclusive claims to superiority, but which nonetheless became institutionally stabilized in a manner which allowed for mutual co-existence between them. The existence of such parallel universes of law has throughout, also in the “Westphalian world”, been a central characteristic of European law. It is suggested that the current constellation between the EU and its Member States should be viewed in this light.

Los procesos sociales, económicos, políticos y, en definitiva, culturales que vive Latinoamérica en general y la República Argentina en particular deben llevar a indagar en torno a la necesidad de crear un “mapa del ejercicio de los derechos”. En relación con los derechos económicos, sociales y Culturales deben promoverse instancias colectivas de planificación, diseño y análisis de impacto que habiliten el debido contralor popular. Lo expuesto signado por el principio de “no regresividad” como norte ineludible en materia de promoción y protección de derechos fundamentales.

En dicho contexto, las universidades detentan un rol fundamental en el diseño prospectivo de las estrategias y resortes para la consecución de los fines desarrollados.

Nesta senda, é indubitável ressaltar a evolução do direito a moradia em âmbito internacional, já que estes documentos reconhecem expressamente o status fundamental conferido ao direito à moradia; e principalmente na seara nacional, dando ênfase a preocupação do legislador constituinte em promover o bem-estar aos indivíduos por meio do desenvolvimento de políticas públicas para efetiva material...

Georges Gurvitch (1894-1965), from the 1920s to the end of his life, was solving the problem of combining unity and plurality in the justification of society. He believed that individualism and collectivism represented social processes in a limited way because they were based on the preconception that the binding power of law derives respectively from a private or corporate actor's will. Gurvitch contrasted individual law with the social one, which was intended to overcome the opposition between individualism and collectivism. Social law bases on legal sociology's assumption that social interactions as such are already legal relations. This conclusion allows Gurvitch to consider any social interaction as a source of law and to assert legal pluralism as a way of constructing society. The integrity of the latter is a condition for the mutual correlation of the multiplicity of legal regulations generated by internal social interactions into the unified structure of social law. In a holistic approach to comprehending social interactions, Gurvitch, in his Russian-language works in the émigré period, uses the philosophical-legal interpretation of sobornost to describe society's integrity. In French-and English-language works from the 1930s, Gurvitch uses the term "totality," which he learned from Marcel Mauss, to describe social integrity. This article compares sobornost and totality as variants of denoting social integrity in Gurvitch's social law doctrine. The researcher determines that Gurvitch, using the concepts of sobornost and totality, interpreted society's development differently, 1) as anti-hierarchical sobornost equality, and 2) as a hierarchical inordination of totalities. Having analyzed the peculiarities of the interpretation of sobornost and totality in Gurvitch's works, the author concludes that these concepts should be considered multilingual equivalents in denoting communal unity as sources of law, which reflect changes in the interpretation of society in Gurvitch's social law doctrine.

The Constitution of Ukraine guarantees to every citizen the right to healthy and safe working conditions. The granting of this right was the result of the implementation in the national law of international fundamental acts on human and civil rights. The main provisions on the implementation of this constitutional right of employees are regulated by the law of Ukraine On Labour Protection.
However, despite the sufficiently high worldwide level of guarantees for employee’s rights, the actual level of compliance with labour protection legislation in Ukraine is quite low, which is directly reflected in the state of affairs with an industrial injury.
The paper demonstrates the discrepancies of separate key statistical indicators of industrial injuries: the ratio of fatal accidents to their total. These measures, in contrast to the EU countries, are almost identical. These statistics indicate a high-level of accident concealment from investigation and record.
The changes in the current legislation of Ukraine on investigation and record of accidents, occupational diseases, and accidents that occurred in 2019 are analyzed in the article. A comparative analysis of the current Procedure for investigation of accidents with the previous version of the document is conducted, positive and negative new laws of this regulation are established. Conclusions about significant changes in the procedure of investigation of accidents, establishment of a higher level of legal guarantees for the victims of labour injuries and their families, improvement of mechanisms of interaction of state bodies, the Social Insurance Fund and business entities in the issues of indemnification for health workers, extension of powers and enhancement of the status of the State Labour Service of Ukraine have been made. The work of the author will be useful both in carrying out procedures of investigation of accidents and occupational diseases and development of the measures, on the basis of their results, to improve a state of affairs of labour safety and also useful in the further legislative work.

Resumo
O Direito enquanto construção social torna-se complexo na medida que busca solucionar conflitos de uma sociedade marcada pela diversidade. Cada região e comunidade brasileira possui caraterísticas próprias e suas peculiaridades precisam ser assim estudadas. O objetivo do artigo é trazer o ensino jurídico pautado na emancipação, qualificação e inclusão para a mudança afirmativa da sociedade, vinculando à proposta de criação do Curso de Direito da Terra na UFSCar-SP. Pelo método hipotético-dedutivo e pesquisa bibliográfica, concluiu-se pela necessidade de técnicas em que o Direito identifique-se com a mudança social trazendo aporte teórico-cognitivo assimilando o urbano e o rural na formulação/formação jurídica.

"The paper analyzes the protection of women in the labor legislation of BH, with particular attention to the provisions which regulate the protection of motherhood. In BH, the protection of women and motherhood has been regulated separately at the state level, the entities and Brcko District. The paper gives a comparative overview of these solutions, and shows how they are uneven, thus the unequal position of women in BH, which depends on the part of the state where they reside. At the end of this paper, all the new solutions in the existing labor legislation aimed at harmonizing national legislation with the requests of the European Union and the International Labour Organization have been shown, ensuring the protection of the interests of mother and child and contribute to raising the birth rate. Starting from the fact that protection of families with children is an activity of special social interest, it is necessary to take action aimed to improve the situation in this area, particularly in Federation of BH.

Vor dem Hintergrund eines zu beobachtenden Umbruchs der Erwerbslandschaft in der Bundesrepublik Deutschland befassen sich die Autoren in ihrem empirischen Arbeitsbericht mit den drei (bislang) atypischen Beschaeftigungsformen der Scheinselbstaendigkeit, der Leiharbeit sowie der Telearbeit. Die Gruppe der 'neuen Selbstaendigen' vereint Merkmale der abhaengigen und selbstaendigen Erwerbsarbeit, so dass ihr Erwerbsstatus nicht ohne weiteres eindeutig zu entscheiden ist. Da organisations- und arbeitsmarkttheoretische Konzepte zur Scheinselbstaendigkeit fehlen, wird eine arbeits- und sozialrechtliche Abgrenzung von selbstaendiger und abhaengiger Erwerbsarbeit mittels dreier Modelle vorgenommen: (1) BAG-Modell, (2) Alternativmodell und (3) Verbandsmodell. The author in this paper analyzes development of social rights within the European Union, with special reference to the changes in this area after the entry into force of the Lisbon Treaty. At the beginning of the process of European integration, social policy and thus social rights were marginalized, in such a way that the basic motives for the creation of the European Union were economic and political, while social rights were only slightly covered by the founding treaties, and almost predominantly remained within the competence of Member States. The situation, with the later development of integration processes, gradually changed, in the direction of wider regulation of social rights at the level of the European Union. In the context of social rights, social policy is very important, and it is only in the last two decades of the development of European integration processes that social policy become public policy. Social policy is one of the national public policies under the influence of the European legislator, in a way that the European Union by adopting regulations (hard law and soft law) in the field of social policy influences on the creation of national social policies of Member States, because their policies must be adjusted to the regulations, that is to the standards and principles of the European Union. Social policy is in the shared competence of the European Union and Member States, for the aspects set out in the Treaty on the Functioning of the European Union. Some important areas of social policy are excluded from the competences of the European Union. The Lisbon Treaty has made a great contribution to the development of social policy and social rights at the level of the European Union, by regulating some important aspects of establishment and development of social rights.

In recent years social entrepreneurship has gained increased importance for the development of economic processes. EU and national institutions take different actions for social inclusion of people with disabilities by satisfying their social, cultural and legal needs. These actions are guided by strategies, which have been elaborated by institutions at national level. The implementation of strategies and actions for social inclusion of individuals with disabilities requires legal regulation at EU and national level. On the basis of different method of research (comparative analysis, legal analysis and others) the report investigates EU and Bulgarian legislation in the field of social entrepreneurship. The legal framework has been viewed as an institutional basis and opportunity for satisfying the cultural, social and legal needs of persons with disabilities in Bulgaria, which will contribute to the creation of new value added in economic and social context.

Стаття присвячена дослідженню та аналізу впливу процесу євроінтеграції на збереження трудового потенціалу та проблем адаптації соціального законодавства України до стандартів європейських країн. Визначено мету та завдання європейських соціальних стандартів. Автором наголошено, що досягнення високого рівня життя населення, аналогічного рівню в країнах Європи, є можливим за умови імплементації європейських соціальних стандартів у свою практику, що потребує здійснення суттєвих змін у забезпеченні права на працевлаштування, досягнення європейських стандартів щодо оплати та безпеки праці, гарантій соціального захисту.
