Conciliation

In this article, the authors compare alternative conflict resolution mechanisms in Colombia and Russia. In the former, conciliation is the most developed alternative dispute resolution mechanism, while in the latter, mediation is the most developed. In order to deepen this comparison, a qualitative research of interpretative nature has been developed with the support of bibliographic-documentary material. The main conclusion is that access to justice is a human right that has been positivized as a fundamental right in the constitutions of both Colombia and Russia. However, the Colombian Constitution allows individuals to exercise their jurisdictional functions on a temporary basis, unlike the Russian Constitution, which only authorizes judges from the Federation to exercise their jurisdictional functions. While conciliation in Colombia is developed and implemented through State-supervised Conciliation and Arbitration Centers, mediation in Russia is in its initial phase and has gradually gained acceptance in society. In both states, the implementation of alternative dispute resolution mechanisms has been driven by the need to decongest the courts and tribunals of ordinary justice. Therefore, it is useful to insist on the massive use of these instruments to make possible a justice that comes from the parties in conflict, that can repair the relations of the subjects in dispute and that tends towards the construction of more peaceful societies.

La tension qui se joue dans l’articulation travail famille, vie privée et
vie professionnelle, n’est pas nouvelle. Les changements observés ces
dernières décennies témoignent de la reproduction, encore présente à
des intensités diverses au sein des foyers des pays industrialisés, des
modèles de partage inégal des tâches parentales, de l’enracinement
des représentations des rôles masculins et féminins reportées au sein
des modes de pensée et d’agir en ce qui a trait à l’articulation des
temps sociaux relatifs au travail et à la famille. Fortement investie dès
le début des années 1990, la conciliation travail et famille cristallise
une pluralité d’enjeux : celui de la croissance économique, de l’emploi,
du renouvellement des générations, mais aussi de l’égalité entre
hommes et femmes sur le marché du travail et dans la sphère privée.
Nous proposons d’identifier quelques-uns de ces enjeux importants.
Puis, nous analysons ce que les articulations entre temps productifs
et reproductifs produisent en termes d’inégalités entre les femmes et
les hommes.

La consulenza tecnica ha avuto inizialmente una funzione ancillare nell’ambito della procedura di mediazione, ma è via via cresciuta di importanza soprattutto nelle controversie relative a liquidazione di danno causato da incidente stradale o cattiva sanità, dispute bancarie e finanziarie, esecuzione di lavori edili. E, col tempo, si è posto anche il quesito su di un possibile utilizzo della perizia (ottenuta in mediazione) nel successivo eventuale giudizio, per risparmiare tempo e denaro. Fino a giungere alla disposizione di una CTU consulenza tecnica d’ufficio nell’ambito del giudizio, non soddisfacente, ed il rinvio delle parti in mediazione delegata, con l’indicazione da parte del giudice di “paletti” entro cui gestire quest’ ultima, ricorrendo eventualmente ad una CTM, consulenza tecnica in mediazione. Una “conversione ad U” fino a pochi anni prima inimmaginabile.
Il tutto, tenendo conto che una delle caratteristiche cardine della mediazione è la riservatezza e che una perizia, ottenuta al di fuori del processo, non può essere considerata prova in senso tecnico.

There are constitutional and statutory provisions for industrial conflict mediation in Nigeria. These include the Trade Dispute Act; the Arbitration and Conciliation Act; and the Constitution of the Federal Republic of Nigeria. The Trade Dispute Act specifically set out in Sections 4, 5, 6, 7 and 8 the various amicable processes that should be taken when industrial disputes arise. These processes range from non-governmental amicable dispute resolution processes, to government facilitated mediation and conciliation. Recourse to adversarial industrial dispute resolution is therefore a last resort, legally, that is, only when all avenues to negotiate, mediate and conciliate have failed. Very importantly, the Constitution of Nigeria mandates the National Industrial Court of Nigeria (NICN) to set up alternative dispute resolution (ADR) centers for the purposed of administering amicable dispute resolution process to industrial disputes. The Arbitration and Conciliation Act provides that parties' arbitration clauses do not prevent them from agreeing to use conciliation in the resolution of their disputes. This paper highlights these statutory mandates for industrial dispute mediation and conciliation. It also introduces the author's 10-Step-Mediation model of amicable industrial dispute resolution. Topics covered under the10-Step-Mediation description include: understanding of disputants' emotional situation; dealing with disputants' emotions; understanding disputants' problems; understanding disputants' unmet needs that fuel conflict; setting out issues for determination in dispute resolution; strategizing (brainstorming) for options for dispute resolution; sensitizing options; doing reality-testing; making offers for settlement; and, accepting offers for settlement. The 10-Step-Mediation model provide a step-by-step approach to dispute resolution that ensures that all issues in contention in a dispute are adequately examined and resolved.

The paper discusses about the alternative method to litigation. When medical malpractice claim is filled against the provider, litigation takes years to come to a solution, which is beneficial to neither party to the dispute. So this paper discusses the nature and origin of medical malpractice claim and how they can be resolved through negotiation, mediation, arbitration and Hybrid Process (Med-Arb). Further the author makes comparison of three different countries: How alternative dispute resolution is working in those countries and concludes by saying why India needs Alternative dispute resolution in the field of Medical Malpractice.

This article looks outside the box of adversarial litigation of matters through the Courts of law. It explores a new trend in Uganda encompassing different forms of Alternative Dispute Resolution mechanisms. These include Arbitration, Conciliation, mediation and a brief look into Collaborative legal practice. The author explores the advantages and disadvantages of each of these mechanisms as he attempts to provoke the reader into determining whether ADR is a more viable means of administering justice in Uganda.

La présente étude a pour objet la réflexion sur le rôle des autorités coutumières en matière de régulation des conflits en Afrique de l’Ouest francophone. L’objectif visé est de mesurer la portée de la contribution des autorités traditionnelles et religieuses en matière d’administration de la justice dans la zone de référence.
La démarche mise en œuvre à travers l’étude a consisté à analyser le rôle des autorités coutumières en matière de justice, dans les pays de l’Afrique de l’Ouest francophone, en adoptant une approche comparative. La méthode est à la fois analytique et prospective, en partant des constatations factuelles
pour déboucher sur des propositions de réforme.
L’analyse effectuée montre que, dans les pays d’Afrique de l’Ouest francophone, les autorités coutumières jouent effectivement un rôle dans la régulation de conflits et cela dans plusieurs domaines, notamment les conflits familiaux et de voisinage, les conflits fonciers, les atteintes aux personnes et aux biens, les conflits politiques. Leurs modes d’intervention couvrent la prévention, la médiation/conciliation et le règlement/résolution des conflits. Cependant, il apparaît que l’appréhension
du rôle des autorités coutumières, à l’aune du cadre juridique et institutionnel dans lequel ils évoluent, pose la problématique de la formalisation de leur intervention. Certains pays, à l’exemple du Togo et du Niger, reconnaissent formellement la chefferie traditionnelle, à la différence des autres pays de la zone de référence où elle reste une institution informelle, qui existe en fait, sans reconnaissance officielle.
Toutefois, la chefferie traditionnelle n’a pas d’attributions expresses en matière de justice au Togo, alors qu’au Niger, elle se voit reconnaître, par la voie législative, un rôle en matière de conciliation en matière civile et commerciale. Le constat général, dans les pays faisant partie de la zone de référence, est que de facto les autorités traditionnelles et religieuses vont au-delà du rôle qui leur est assigné par la loi en exerçant un réel pouvoir de juridiction en certaines matières. Cet état de fait a pour implications la concurrence et le conflit éventuel de compétence avec les institutions judiciaires formelles. Cette situation porte les marques du pluralisme institutionnel, avec une opposition entre les institutions informelles et les institutions formelles de justice. Des conséquences en découlent sur le plan de l’administration de la justice. En définitive, l’étude est conclue par un appel à la formalisation du rôle des
autorités coutumières en matière de régulation des conflits, en dégageant des orientations générales sur les modalités de cette formalisation.

Essa pesquisa teve como objetivo analisar como uma política judicial que prometeu criar um “novo acesso à justiça” - a política nacional de conciliação - tem afetado as práticas e o atendimento aos cidadãos dentro dos tribunais. Partindo de uma abordagem etnográfica, acompanhei as atividades de um Centro Judiciário de Solução de Conflitos e Cidadania localizado na cidade de Campinas-SP para entender como as diretrizes da política constroem e ganham significados nas práticas locais. A primeira hipótese, de que a conciliação judicial tem sido utilizada no Brasil como forma de reagir a problemas de gestão estatal de recursos, encontrou fortes indícios que confirmaram sua eloquência. As diretrizes da política valorizam o encerramento de processos por meio de acordos e o controle de estatísticas, além de organizar premiações para incentivar os tribunais a serem mais “eficientes”. A segunda hipótese, de que a política estaria criando lógicas coercivas que forçam o acordo em nome do “bem comum”, também demonstrou ser convincente. Tal como observado nas primeiras iniciativas de tornar a conciliação uma prática judicial nos Estados Unidos, o Judiciário brasileiro estaria transformando o “acordo” em um ideal a ser alcançado, convertendo a audiência de conciliação num ritual judicial propício para práticas de harmonia coerciva. Enquanto a “pacificação” dos burocratas do Judiciário se resume a “acordos forçados”, a “pacificação” dos métodos que buscam o diálogo ou, nos casos em que o diálogo não é possível, encaminham para a “porta” do processo judicial, é desvirtuada. Este deslocamento de sentidos retrata um Judiciário que se apropria de “boas ideias” para convencer a todos sobre as vantagens da sua autorreforma, sem garantir condições para que assimetrias, desigualdades e relações de poder inerentes ao sistema de justiça sejam eliminados. Evitando o conflito e aceitando que assinar um acordo é pacificar, o Judiciário negligencia seu papel de garantidor de direitos e adota critérios de um modelo de justiça neoliberal.

Political parties provide the platform for the actualization of the objective of capturing and controlling the machinery of government. The process of achieving this objective is often fraught with conflict exacerbating elements. Congresses, party primaries, elections, and appointments constitute the most visible processes that have generated disputes and threaten party cohesion and the general governance processes. The thesis sponsored by this paper is that whereas the formal judicial process of litigation has shown some strength in resolving party disputes, yet there is a budding consensus of the system’s limits and failures in delivering justice, facilitating voluntariness and reconciliation, healing wounds, ensuring direct participation of disputants in resolving their disputes, reducing time and cost of resolving dispute and fostering internal party cohesion. The paper identifies lack of ideology and absence of internal democracy as factors that predispose political parties to disputes. It argues that party disputes can be effectively resolved through the deployment of Alternative, Appropriate and Amicable Dispute Resolution (ADR) options.

Secondo il Parlamento europeo (9.12.2017) "L'Italia utilizza la mediazione sei volte più del resto d'Europa". La mediazione obbligatoria è stata normata in Italia nel 2010 ed è entrata in vigore nel 2011. Opposizione serrata da parte degli avvocati, disinteresse apparentemente benevolo da parte dei giudici. A fine 2012 ne segna una battuta d’arresto la dichiarazione di incostituzionalità, per riprendere poi quota con la reintroduzione nel 2013, con la possibilità di "Opt-Out" dal procedimento.
Risultati:
. 2011 -  60.810 mediazioni,  9.912 accordi, tasso di successo 16%;
. 2018 – 151.923 mediazioni, 20.965 accordi, tasso di successo 14%.
20.965 è il più alto numero di accordi di mediazione mai raggiunto in Italia. Nelle procedure svoltesi con tutte le parti presenti e proseguite oltre il primo incontro, la percentuale di successo nel 2018 è stata del 45%. Tuttavia, la mediazione è cresciuta ben al di sotto delle sue potenzialità: i nuovi giudizi iniziati nei tribunali italiani nel 2018, infatti, sono stati 3.220.928.
In Italia la mediazione, intesa quale condizione obbligatoria di procedibilità, è limitata a materie che corrispondono all’ 8% circa di tutte quelle oggetto di contenzioso giudiziale. In TUTTE le questioni relative ai diritti civili disponibili, invece, i giudici possono ordinare alle parti di attivare la mediazione (mediazione demandata, ex art. 5, c.2, D.Lgs. 28/2010) e/o possono proporre una soluzione della controversia basata sull'equità (proposta di conciliazione del giudice, ex art. 185-bis c.p.c.), proposta che le parti possono accettare o rifiutare (arbitrato non obbligatorio). Quando la mediazione obbligatoria fu introdotta, i magistrati la guardarono con apparente benevolo distacco, ma a partire dal 2015 è grazie ai giudici che la mediazione italiana è cresciuta; le mediazioni demandate sono ammontate al 2% (di tutte le procedure avviate presso gli organismi di mediazione) nel 2011, 10% nel 2015, 11% nel 2016, 13% nel 2017, 15% nel 2018.

O presente artigo aborda a solução de conflitos trabalhistas e a efetividade dos direitos social e processual do trabalho, em uma perspectiva de se pensar o tratamento de tais conflitos de forma adequada para se alcançar efetividade e, via de consequência, acesso à Justiça em sua compreensão ampliada. Acesso à ordem jurídica justa que implica em se garantir acesso a direitos sociais constitucionalmente garantidos. Assim, amplia-se o olhar sobre o tema para abordar formas que não são usualmente tratadas na temática, como por exemplo, a prevenção dos conflitos. Trabalha-se com as possibilidades de solução e tratamento dos conflitos de interesses, levando em consideração a atuação institucional do Justiça do Trabalho e dos atores institucionais e sociais imprescindíveis a tal atuação, a saber, Ministério Público do Trabalho e Advogados, firme na compreensão de que solucionar conflitos trabalhistas há de se garantir o respeito e cumprimento dos direitos sociais e processual do trabalho.

Versa sobre os meios consensuais de resolução de conflitos, especificamente a conciliação e a mediação. Investiga-se, de início, se tais meios alternativos à jurisdição tradicional se compatibilizam com os valores democráticos, de tal sorte a viabilizar a participação popular dos litigantes na interpretação e aplicação do Direito. Discute-se, depois, acerca da fisionomia normativa da conciliação e da mediação no sistema jurídico brasileiro, destacando as principais inovações trazidas pelo novo Código de Processo Civil (NCPC), com relação à introdução da audiência de conciliação e de mediação.    Perquire-se, empós, se as alterações normativas procedidas nos institutos sobreditos representam avanço ou retrocesso no ideal de acesso à justiça. Conclui-se que a conciliação e a mediação constituem instrumentos que podem proporcionar a participação direta dos cidadãos na administração da justiça e que a reformulação implementada pelo NCPC nesses procedimentos judiciais aproxima o sistema processual civil pátrio dos conceitos contemporâneos de jurisdição democrática e acesso à justiça.

By thе late 16th century the laws of the Polish-Lithunian Commonwealth evince a shift in the perception of law infringements: they are no longer viewed as a private matter of the victim, but rather as a transgression against society at large. Punishments grow sterner, as can be seen from the treatment of incarceration: more acts stipulate for «confinement in a tower» (even for days), the first prohibitions against avoiding punishments through striking peace deals between the confl icting sides are put in place, and the places of incarceration are being set up in
a more unified manner. Concomitantly, incarceration gains prominence as part of the verdicts of the familial courts as a sign of the accused submission and as a precondition for reconciling the opponents, particularly in cases when blood was shed. Alongside lengthier incarcerations, purely symbolic confi nement of several hours or days оссured. There are fixed rituals of such voluntary confinement. Therefore, incarceration marks certain early modern changes in the
gentry legal culture of the Polish-Lithuanian Commonwealth.

2001. aastal võttis Euroopa Liidu Nõukogu vastu raamotsuse  ohvrite seisundi kohta kriminaalmenetluses, mis kohustas liikmesriike soodustama lepitusmenetluse kasutamist kriminaalasjades.  Eestis on võimalik leppimise tõttu kriminaalmenetluse lõpetada alates 2007 aastast, mil jõustus uus kriminaalmenetluse seadustik (edaspidi KrMS) .

Kriminaalmenetluse lõpetamine leppimise tõttu on üks kriminaalmenetluse otstarbekusest lõpetamise võimalustest. Lepitusmenetlus tugineb laiemalt restoratiivõiguse (restorative justice) põhimõtetele, mille lähtekohaks on kuriteo sotsiaalne taust. Lepitusmenetluse raames tegeletakse kuriteoni viinud konflikti põhjustega ja konflikti lahendamisele kaasatakse nii kuriteo toimepanija kui ka ohver. Ohvri aktiivse kaasamise läbi soovitakse suurendada ohvri turvatunnet ning vähendada kuriteoga kaasnenud pingeid, hirmu jms tundeid. KrMS-i kohaselt on lepitusmenetluse eesmärgiks saavutada kokkulepe kannatanu, kahtlustatava või süüdistatava leppimiseks ning kuriteoga tekitatud kahju heastamiseks.

Teoorias saab välja tuua kaks lepitamise kontseptsiooni alust, mida lepitamise tulemusena tahetakse kriminaalmenetluses saavutada: lepitamine kui abinõu ressursside kokkuhoidmiseks ja lepitamine kui iseseisev konflikti lahendamise viis. .
Käesoleva uurimistöö raames keskendub autor just viimase nimetatud viisi uurimisele. Autor kasutab uurimistöös süsteemset-induktiivset uurimismeetodit. Lisaks on uurimistöös ositi kasutatud ka võrdlevat meetodit Euroopa õiguse valguses.

Esimeses peatükis uurib autor, millised on lepitusmenetlusse suunatavad kuriteod seaduse ja praktika alusel. Samuti annab autor ülevaate, millised on lepitusmenetluse põhimõtted, kes on lepitusmenetluse osapoolteks Eestis ning milline on lepitusmenetluse üldine korraldus.


Teises peatükis analüüsib autor lepitusmenetluse rakendumist ja lepitusmenetluse eesmärkide saavutamist praktikas. Autor otsib vastust küsimusele, mis põhjustel on või ei ole lepitusmenetluse eesmärgid saavutatud. Samuti uurib autor lepituskokkuleppes sisalduvaid kohustusi ja nende täitmist praktikas. Kuna Eestis on lepitusmenetluse üheks osapooleks riiklik lepitaja , siis uurib autor, kas lepitajat saab ja võib pidada Eesti tingimustes alati objektiivseks?

Kolmandas peatükis uurib autor võimalusi lepitusmenetluse laiendamiseks Eestis, sh restoratiivõiguse põhimõtete laiendamise võimalusi Euroopa õiguse valguses. Peamiseks uurimisküsimuseks on, kas lepitusmenetlust on võimalik laiendada väljaspoole seaduses toodud piire.

Neljandas peatükis käsitleb autor lepitusmenetlust ja konflikti. Esmalt tuleb anda vastus küsimusele, mis on üldse iseseisev konflikt ning millele on see konflikti lahendamine suunatud. Samuti uurib autor, millised on lepituse aluseks olevad printsiibid osalpoolte nõusoleku osas.

Il Dr. Massimo Moriconi è un giudice del Tribunale di Roma e dal 2012 ha applicato l’istituto della mediazione in più di 300 cause presenti nel suo ruolo, ottenendo una riduzione del loro numero di circa il 10%. Ha fatto conoscere la sua esperienza partecipando a seminari e conferenze, tramite la pagina Face Book “Non solo sentenze” ed ora con un libro, dallo stesso titolo, scritto per “rendere una testimonianza ed un servizio” a magistrati, avvocati e mediatori.

Taglio del libro assolutamente operativo, sorretto da dottrina e tanta esperienza. La sensazione principale che si prova nel leggerlo è il richiamo costante nella mente del lettore a mediazioni gestite, alle difficoltà incontrate ed alle soluzioni adottate in passato; è lo spunto che il lettore trae per cercare di risolvere un problema, in cui si è appena imbattuto. Un testo che diventerà punto di riferimento per la formazione alla mediazione e la gestione di problemi operativi.

Currently, there are a few law schools in Bangladesh which has ADR as a course module. The subject is mostly taught in the first semester of a 4 year Honors programme. By the time a student graduates, he would forget what he studied on his first days as a law student. What needs to be introduced is a standalone course which is longer in duration.

Diplomacy is an extremely wide concept, therefore to specify its special relationship with the category of security, individual appointments were taken into account. Methodology was based on the analysis of literature. The following concept were characterized: preven-tive diplomacy, diplomatic asylum, extraterritoriality, security letter, conciliation, mediation, notification, diplomatic negotiations, peaceful coexistence, ultimatum, sanctions.  Their theoretical aspect and practical application in international politics were shown, both as "status quo" and "status quo ante".

Evaluation of Article 35/A Concerning Conciliation of the Draft Attorneyship Act Working Text

ABSTRACT
Turkish Union of Bar Associations prepared a draft amendment in the name of the 1136 numbered Code of Lawyers’. The discussions related to this topic was opened on March 21, 2012. The sudy focuses on analysing the 35/A Article as well as the
two new draft paragraphs of the same article of the aforementioned code."

This article presents six cases of conciliation (ṣulḥ) that took place in Baghdad between 460/1068 and 537/1142, in the context of the political domination of the Seljuq sultans over the Abbasid caliphate. These are the only cases for which detailed documentation is available among Arabic sources. While conciliation can be understood as a method for settling precedence disputes between individuals, the study shows that it also enabled the caliph to intervene in controversial and sensitive ideological issues that threatened Baghdadi public order. In some cases, conciliation was the inal phase of a maẓālim procedure. Should conciliation fail, the caliph would take the inal decision. Through a conclusive synthesis we examined some similarities in these cases in terms of procedure, aims, results, and political and social issues.

Öz ICSID Sözleşmesi ile oluşturulan Merkezin amacı, Sözleşmenin 1. Maddesi kapsamında yatırım uyuşmazlıklarının arabuluculuk ve tahkim yollarıyla çözümünü kolaylaştırmaktır. Bu çalışmada, Merkezin söz konusu amacı doğrultusunda Devletler ve Diğer Devletlerin Vatandaşları Arasındaki Yatırım Uyuşmazlıklarının Çözümlenmesi Hakkında Sözleşme (ICSID) uyarınca, yatırım uyuşmazlıklarının "ICSID Arabuluculuk Kuralları" ışığında çözümü ayrıntılı olarak ele alınmıştır. ICSID Arabuluculuk Kurallarında öngörülen arabuluculuk prosedürü de dahil olmak üzere, yatırım uyuşmazlıklarının dostane bir yöntem olarak arabuluculuk yoluyla çözümü bu çalışmanın esasını oluşturmaktadır. Arabuluculuk, bir yatırım uyuşmazlığının söz konusu olduğu hallerde, çoğunlukla tercih edilen tahkim yargılamasına alternatif bir çözüm yöntemi olarak karşımıza çıkar. Arabuluculuk, uzlaşı sağlanması adına birçok yönü itibariyle tahkim yargılamasının dezavantajlı özelliklerini daha esnek bir sürecin takip edilmesiyle giderebilen aynı zamanda, uzlaşı sağlanmasında tahkim yargılaması kadar etkili olabilecek bir yöntemdir. Arabuluculuk süreci sonunda verilen "arabuluculuk raporunun" bağlayıcılığı, yöntemin tercihinde rol oynayan en önemli faktörlerden biridir. Arabuluculuk, salt olarak sonucunda tavsiye niteliğinde bir karar ile herhangi bir bağlayıcılıktan söz edilmeksizin uzlaşı sağlanan bir süreç olarak görülmemelidir. Çalışmamızda, arabuluculuk sürecinin niteliği, tahkim yargılaması sonucunda verilen kararların aksine arabulucu raporlarının bağlayıcı etkisi bulunmadığını ve yatırım uyuşmazlıklarına konu olan büyük çaplı projelerde zaman kaybı olmaktan ileriye gidemeyeceğini savunan görüşler de dikkate alınarak incelenmiştir. Related with the mentioned purpose, in this article, the resolution of investment disputes has been analyzed in the light of "ICSID Conciliation Rules" of the Convention on the Settlement of Investment Disputes between States and Nationals of Other States (ICSID). Including the conciliation procedure prescribed in ICSID Conciliation Rules, the corner stone of this article constituted under the conciliation process as an amicable settlement method. Conciliation, where an investment dispute is involved, is often an alternative solution to the arbitral proceedings. As of many aspects, conciliation can be as effective as an arbitration in order to achieve a consensus via eliminating the disadvantageous features of arbitral proceedings thanks to its more flexible structure. Whether the binding feature of the "conciliator report" at the end of the process is one of the most important factors in the choice of this method. Conciliation should not be seen as an advisory process merely. Within the framework of this article, the characteristics of conciliation process has been examined considering the opposite opinions that advocate the a nonfunctionality and nonbinding effect of conciliation.

O presente artigo possui como objetivo averiguar a eficácia dos três principais ramos do Poder Judiciário brasileiro (Justiça Estadual, Justiça Federal e Justiça do Trabalho) no cumprimento das metas de conciliação estipuladas pelo Conselho Nacional de Justiça (CNJ) para o quinquênio 2015-2019. Na seara das políticas públicas, o CNJ instituiu, por meio da Resolução nº 125/2010, a Política Judiciária Nacional de tratamento adequado dos conflitos de interesses no âmbito do Poder Judiciário, com o objetivo – dentre outros – de fomentar a conciliação entre as partes. O problema de pesquisa deste artigo é: considerando as metas de conciliação estabelecidas pelo CNJ entre 2015 e 2019, é possível afirmar que a Política Judiciária Nacional de tratamento adequado dos conflitos de interesses no âmbito do Poder Judiciário foi exitosa durante esse período? O método de abordagem adotado é o dedutivo, e os métodos de procedimento utilizados são o estatístico e o comparativo. A conclusão é a de que as metas de conciliação foram alcançadas em apenas um terço dos casos pelos três principais ramos do Poder Judiciário.

Reconciliation is the possibility of harmonising work, personal, family and com- munity life to this e ect, it is essential to promote social, economic and time policies, as well as strategies that can enable the right of presence and the balance among the mentioned spheres. This approach compels to rethink the issue of co-responsibility, since it cannot be considered as a mere review of gender roles and as a balanced distribution of family tasks and household chores. We must achieve a social pact involving work, school and family life in order to respect childhood rights and family welfare. In the studied period (2009-2015), concurrent with the  nancial crisis and the loss of purchasing power, families with school-age children  nd more di cult to manage their times; besides, an increase of inequalities regarding the distribution of daily times is observed, with a clear polarization referred to reconciliation in the seven analyzed cities in Galicia. We have worked with N=1267 in 2009 and N=2037 in 2015.

La conciliación como método alternativo de solución de conflictos fue concebida como una oportunidad cierta y adecuada para que los sujetos de derecho solucionaran sus conflictos de manera pacífica y concertada con la presencia de un tercero imparcial sin poder de decisión, pero con atribuciones que encausan y procuran de manera asertiva la negociación. Desde su implementación como requisito de procedibilidad, se plantea el objetivo de discutir si se puede comprender la conciliación como una oportunidad de amparo de la tutela judicial efectiva o como una simple exigencia de ley. En ese sentido, y a partir de las estadísticas del SICAAC en la Costa Atlántica, se concluye que aún la sociedad no interioriza de manera suficiente los beneficios de este medio de solución de conflictos autocompositivo. La metodología utilizada es la revisión documental, bibliográfica y el análisis crítico al consultar, revisar y analizar la doctrina,jurisprudencia e información documental originada por el Ministerio de Justicia. -/- The conciliation as an alternative conflict resolution method was conceived as a positive opportunity for parties to settle their conflicts in a peaceful and concerted manner with the presence of an impartial third party without decision-making power, but with attributions to address and assertively seek an agreement which will be stated in a conciliation act. However, since the implementation as a procedural requirement, the objective is to discuss if conciliation can be understood as a certain opportunity to protect effective judicial protection or as a simple procedure derived from the law. Based on the statistics of SICAAC on the Atlantic Coast, we can conclude that the benefits of conciliation as an alternative dispute resolution method have not yet been sufficiently internalized by society. The methodology used is the documentary, bibliographic and critical analysis review, when consulting, reviewing and analyzing doctrine, jurisprudence and documentary information originated by the Ministry of Justice.

A massive decrease in successful mediation procedures at the Alternative Dispute Resolution Department at the District Court in Ljubljana raises the question of what its causes are. To recognize factors that contribute to a successful mediation we did qualitative research on a sample of nine mediators. It was determined in the research that the mediators believe that the factors which greatly influence the decrease in successfulness in mediation procedures are: the manner of realization of mediation procedure, phase in which the dispute should be solved with mediations, role of the judge in the phase of starting mediation, suitability of dispute for mediation, possibility to choose a mediator, mediator himself, use of method for dispute resolution, separate and joint sessions and payability of mediation procedure. In conclusion, we present guidelines and proposals according to research findings.
