The paper (in French) studies Avishai Margalit's concept of decency and its link with John Rawls's principles of justice. Criteria of decency may help to realize effectively justice - when it has to deal with political and social reality - or at least to avoid intolerable injustice.

Political liberalism aspires to be a cosmopolitan and universal system. Yet, in the last decades, it has often been accused of arbitrarily imposing a particular conception of the good. How can we to explain this apparent contradiction? This study aims to determine if the liberal character is necessary to have a just society, even if it is not sufficient, or if it is a contingent feature. It tries to see if it is possible to universalize the principles of political liberalism. Our thesis is that only a justification of liberty via negationis can be universalized. In order to demonstrate this idea, we will highlight the qualitative distinction between the negative justifications that defend the political value of liberty as a tool to restrain power; and the positive justifications that defend its moral value, as a human good. Furthermore, we will defend two arguments: a) a principle of asymmetry of good and evil, which states that avoiding evil has an epistemic and moral priority over promoting good; and b) the idea that the summum malum can be absolute and universal. As defended by Judith Shklar, cruelty is that sovereign evil. Unlike the summum bonum, summum malum is independent from particular moralities. In order to give a normative and universal status to individual liberties, liberalism shall then prove that its political configuration allows to avoid or reduce political evil. That is the argumentative structure of negative liberalism.

The article explores sustainability from a normative perspective to determine the legitimate uses of the concept in general and in business practices in particular. It is evident that when sustainability is used as an instrumental bluff to maximize profits, it is being diverted from its main objective: intergenerational and environmental justice. To avoid that trap, most of the justifications in favor of sustainable business adopt a structure based on the idea that sustainability conceived as a particular policy can bring benefits to society and to businesses. Strategic management based on stakeholder theory appears often as a pertinent solution to this problem: considering future generations as valid stakeholders would allow to integrate sustainability into the calculation. But stakeholder capitalism defends a pragmatist view that erases the borders between strategy and ethics. It considers sustainable goals as normative goods as well as strategic means for cost-effective results. We think that it is insufficient to treat and understand sustainability as a matter of justice and fairness that ought to be addressed by businesses. We defend that in the case of sustainability only moral justifications are logically valid and consistent. Hence, we suggest an argument based on the Rawlsian conception of justice as fairness. Thinking behind the veil of ignorance in the original position allows to defend sustainability as an economic and social model needed not only to secure a fair distribution of basic goods or capabilities between generations, but also to preserve the consistency of any true commitment with the concept of fairness.

Supporting the first Bayreuth Festival, organized by Richard Wagner, in 1876, his friend and ally, Friedrich Nietzsche presents the notion of event as a dialectic in the fourth Untimely Meditation. Precisely, in Richard Wagner in Bayreuth, an event can be described as an historical case which expresses the greatness of both the man who creates it and the people who constitute its audience. Moreover, criticising a traditional approach to the study of culture as a social whole which includes knowledge, belief and art, Nietzsche interprets its underlying values in terms of forces and through the concept of "will to power". As a first statement, and pursuing The Birth of Tragedy from the Spirit of Music, written in 1872, Nietzsche sees the Bayreuth Festival as the rebirth of tragedy which can transcend the nihilism of european culture. Nevertheless, charmed at the beginning by the breadth of the event, the festival becomes afterwards the place of a transvaluation from which Nietzsche, as a human living, emerges afflicted but "greater". Then, if the event of Bayreuth appears "great", it is not so much because of the will of Wagner but also the will of Nietzsche, both of them initially entwined and analogous but finally separate and different. So, when Nietzsche takes distance from Wagner, the event becomes "decadent" and the symptom of a fall which corresponds precisely to the values of his time. Just after the festival, and Human, All Too Human, in 1878, expresses this change, Nietzsche transforms then this event into the "case" of a critical history. This history, as defined in the second Untimely Meditation written in 1874, On the Use and Abuse of History for Life, helps us to understand that, if the task of the historian consists of recounting an event, he must have first experienced it through suffering and deliverance. Life, drowned in an "eternal-return" and the true origin of culture, is ultimately the condition of a reinterpretation which transforms an event into history.

L’Orientation Des Mondes chez Jan Patočka par Pierre Souq.

L’orientation des mondes chez Jan Patočka est l’occasion de penser le rapport du sujet au monde dans sa réserve de l’approche husserlienne, présentée notamment dans La crise des sciences européennes et la philosophie transcendantale (1954), aussi dans son invitation à l’ontologie de Martin Heidegger, celle présentée notamment dans Être et temps (1927), et enfin dans la recherche de son origine chez Platon. Confrontant les deux formulations majeures du concept de « monde » dans la thèse d’habilitation de Jan Patočka, Le Monde naturel comme problème philosophique (1936), nous montrons, non seulement que le philosophe tchèque dépasse l’approche husserlienne du « monde naturel », mais initie aussi une réponse à la crise des sciences européennes beaucoup plus globale que celle de son prédécesseur, appelant en cela l’ontologie heideggérienne, dont le dénouement apparaît après. Si l’humanité traverse une « crise spirituelle » dans les années 1930, se traduisant par la victoire et l’omniprésence du monde technico-scientifique, et ce, au détriment des questions ayant trait à la religion ou à la métaphysique, la phénoménologie transcendantale, bien qu’animée par un projet critique et humaniste, s’est elle-même fourvoyée dans un idéalisme pur, prolongeant le rationalisme dogmatique de la modernité initié par Descartes. Après Husserl donc, Patočka montre que cette crise est finalement celle de la phénoménologie, qui parachève la « conception scientifique du monde » à laquelle il manquait une théorie du sujet connaissant, et où l’illusion de complétude s’efface derrière la toute puissance de l’ego transcendantal. L’orientation positiviste du monde, qui s’exprime alors par la volonté d’expliquer le monde dans sa totalité, tend à mettre de côté d’autres conceptions du monde plus « naïves », ou alors à les expliquer selon des principes et des règles strictement logiques, et ce, sans questionner leur origine et leurs fondements. Ainsi, les lois des sciences naturelles, parce qu’elles se présentent comme les constituants d’un monde dont l’origine et les fondements ne sont pas humains, mais dont l’humain fait partie, font perdre au sujet le sens de la vie, l’ « aliènent » et le forcent à « abdiquer ». Cependant, éprouvé par une conception nihiliste du monde qui influence son « sentiment vital », le monde apparaît dans sa « séparation » dont les deux conceptions du monde sont les symptômes. Alors, nous questionnons l’origine de cette distinction, qui dépasse la pensée moderne, et trouve son fondement dans l’Antiquité grecque avec le concept de chorismos. Croisant l’orientation théorique de son maître, tout en la faisant sortir de son dogmatisme naïf, Patočka extrait la séparation du monde antique de son orientation réaliste à partir de l’existence du sujet. Alors, s’il existe bien un phénomène de « séparation » chez le sujet, c’est justement parce qu’elle fait partie intégrante de l’existence humaine, à condition de la reprendre dans son mouvement primordial et originel.

Résumé : Depuis l’Antiquité, la tradition philosophique occidentale a mis l’esprit au centre de ses préoccupations et le corps plutôt de côté, comme si celui-ci n’était qu’un fardeau ou un frein pour la pensée. Et effectivement, si l’esprit montre la capacité qu’a l’Homme de faire abstraction du réel, et cela, pour produire des théories, le corps, lui, ne peut pas penser. Pourtant, l’esprit est-il si différent du corps ? N’a-t-il pas besoin d’un corps pour penser ? Un esprit sans corps, cela est-il même possible ? Ce que nous vous proposons, c’est un voyage de Platon à nos jours afin de comprendre les relations complexes entre le corps et l’esprit, lesquels ne sont peut-être si différents.

Abstract

The notion of Orientation is almost absent in philosophy. It expresses the subject’s disposition to tend toward something. In others words, the subject’s orientation expresses his concerns (Besorgen) which occupy space in order to reach an object or a destination. Following Martin Heidegger’s Being and Time (1927), we interrogate this meaning related to the subject’s existence which could be transgressive. Indeed, if the subject’s existence is conditioned by time and it necessitates going further to do something, then it implies the risk for the subject to face an uncertain and unknown space which can be lived as transgressive. This transgression, which consists to go beyond a limit, does not target a priori an objectively remarkable physical limit, but a passing into the world where the reaching corresponds to a concern manifesting from the “care” of the Being (Sorge). This care, which belongs to life, can be expressed by the being-towards-death where the feeling of finitude can impel the subject’s orientation, although he doesn’t know the objective space well enough, as well as his “projection” (Entwurf), and even his “falling” (Verfallen). Finally, we think that if the subject orients himself into space, then it must not have a direction a priori, but a set of possibilities which belong to the care of the Being.

Résumé

L’orientation est une notion quasiment absente du champ de la philosophie. Elle exprime la disposition du sujet à tendre vers quelque chose. Dans ce sens, l’orientation exprime les préoccupations (Besorgen) du sujet qui occupe l’espace afin d’atteindre un objet ou une destination. Suivant la pensée de Martin Heidegger dans Être et Temps (1927), nous questionnons cette définition en rapport à l’existence du sujet qui pourrait être transgressive. En effet, si l’existence du sujet est indexée au temps et qu’elle consiste à aller de l’avant afin d’y faire quelque chose, alors il faut pour avancer prendre le risque d’affronter un espace incertain et inconnu, dont l’atteinte peut être vécu comme « transgressive ». Cette transgression, qui consiste à aller au-delà d’une limite, ne vise pas a priori une limite physique objectivement remarquable, mais un passage du monde dont le franchissement répond à une préoccupation manifestant le souci (Sorge) de l’être. Ce souci, qui fait partie intégrante de la vie, peut s’exprimer sous la forme de l’être-vers-la-mort (Sein zum Tode) où le sentiment de finitude peut pousser le sujet à s’orienter en dépit d’une méconnaissance de l’espace objectif, donc à se projeter (Entwerfen), voire même à chuter (Verfallen). En définitive, nous montrons que si le sujet s’oriente dans l’espace, ce dernier ne possède pas a priori de directivité mais constitue un ensemble de possibles qui répond au souci de l’être.
