RE: EMPLOYMENT WITH YATHRIB HAYAT PTY LTD T/A ERINDALE CHEESE CAKE
SHOP

I have pleasure in confirming and extending to you the opportunity to the full time position of Shop
Manager available for a period of two years after the visa grant.

Position: Shop Manager

Responsible to: Owner

Date of Commencement: Subject to visa approval


Hours of Work: Working hours 38 hours per week, from 9am to5pm. There would be 2
days off every week depending on the work roster.


Salary Package: Salary: $ 50,000
Superannuation: $ 4,625

Total Package: $54,625



Position Description: see Annexure 1-Position Description attached.



Payment: Your pay will be deposited into your nominated account every fortnightly
from the day of work commencement.

Superannuation: At present this rate is 9.25%. You may also top up
your superannuation contributions via salary sacrifice.









In accordance with superannuation legislation, your employer superannuation contributions will be paid
to either your preferred complying superannuation fund or where you do not have a preferred complying
superannuation fund, the employers default superannuation fund.

Annual Leave: You are entitled to four (4) weeks pro-rata annual leave in accordance
with the Fair Work Act, 2009.

Sick/Carers Leave: You will be granted ten (10) days pro-rata sick leave per annum,
cumulative for bona fide illness in accordance with the Fair Work Act,
2009. This accumulates from your employment commencement date.

If you have an accrual of sick leave, you may access up to five (5) days of that leave in each year to care for and
support members of your family when they are sick.

There shall be no payment of portions of sick leave not taken on retirement or termination.

The employer may request you to provide proof of illness, being either a medical certificate or other
appropriate documentation acceptable to your employer, with respect to any period of sick leave taken by
you.

If you require more than two days leave, you are required to provide a medical certificate for the full
amount of sick days taken.

Bereavement Leave: You will be granted up to two (2) days of bereavement leave in
the event of the death of a family member in accordance with the Fair Work Act, 2009.

Public Holidays: You are entitled to take any public holidays proclaimed in ACT, where that public
holiday falls on a day which you are usually required to work under this agreement.


Termination: The employer has the right of immediate dismissal without payment in
case of misconduct and may terminate your
employment at any time without prior notice if you:

are guilty of serious misconduct including, but not limited to, theft,
fraud or assault;
are grossly negligent or otherwise incompetent in the performance of
the duties of the position.
commit a serious or persistent breach of the terms of this agreement.
are guilty of conduct that causes serious risk to the health and safety
of a person.
Commit a crime or other civil wrong, which, in the reasonable
opinion of the employer, may seriously impact on your ability to





perform the duties of the position, or are likely to significantly
damage the reputation or business of the employer.

Upon termination of this agreement, for whatever reason, you will immediately deliver to the employer or
to the employers authorised representative all documents, products, files, materials, company
information, property, computer programmes, computer discs and any other records whatsoever in your
possession or control, relating in any way to the business or affairs of the employer.


You must provide appropriate written documentation before any payments for business-related expenses
will be made.

Inducements: You shall not accept any payment or other benefit in money or in kind
from any person as an inducement or reward for any act or forbearance
in connection with any matter or business transacted by or on behalf of
the employer or its agencies.

Non-disclosure: Unless required to be revealed by law, you shall not disclose to
unauthorized third parties, without the written consent YATHRIB
HAYAT PTY LTD T/A ERINDALE CHEESE CAKE SHOP on any
trade secrets, software programs, confidential operations, processes,
dealings, information or other matters concerning the organization,
business finances and affairs of YATHRIB HAYAT PTY LTD T/A
ERINDALE CHEESE CAKE SHOP or its affiliate companies. This
obligation also extends for an unlimited period beyond the termination of
employment.

Waiver and Except where the contrary intention appears from this
Variation: agreement, a provision of this agreement may only be
amended by agreement in writing, signed by both parties.





















Please sign both copies of this letter, indicating your acceptance of the above terms, and retain a copy for
your personal record.
