The dual nature of the community service makes this punishment,
on the one hand, an effective mechanism for reducing the overcrowding
of penitentiaries, while at the same time enabling effective rehabilitation
and reintegration of convicts, through contribution to the local community. Despite the fact that Serbia has been facing the problem of overcrowding of prisons for a long time, and that the punishment of work in
the public interest, although in different modalities, has been recognized for decades as one of the key mechanisms for addressing this problem,
the pioneer attempts to address this problem have started fifteen years
ago. The adequate preconditions to increase a share of the community
service in the total number of the imposed criminal sanctions were created by the amendments to the legal framework in 2014. With this in
mind, in this paper, the authors present the results of the application of
the community service, collected as part of a comprehensive impact
assessment research on the application of alternative sanctions and
measures in the Republic of Serbia in the 2015-2020 period. The basis
for the conclusions presented in this paper are founded on the basis of
the data collected by triangulation of quantitative and qualitative research methods and analysed from the perspective of the efficiency, effectiveness and sustainability of the existing system. The paper also
defines a set of recommendations for improving the normative framework and its application in practice and assesses their compatibility with
the measures envisaged by the Strategy for the Development of the System of Execution of Criminal Sanctions for the 2021-2027 period.

Triggered by the proactive approach of Serbian Penal Administration and its decision to, supported by the German NGO Help e.V, procure the ICT equipment to substitute in-person family visits and ensure regular communication during the lockdown, the authors decided to assess the impact of this pilot project on the right of the children in correctional institutions to communicate with their family members within the scope of the restrictions ordered to fight the COVID-19 pandemic in 2020. The authors also explored the attitudes of children in those correctional institutions and of the professionals working with them to get additional perspectives. The results showed that this measure significantly contributed to preserving contacts and family relations in the changed environment, although it cannot completely replace family visits and direct contact. Furthermore, the results of the research showed that the lack of IT literacy, but also the difficult financial and social context of the families of the origin of the children in correctional institutions, remain a significant obstacle for bridging the gap in family connections caused by COVID-19. Finally, the research showed that there is a need to procure more equipment and to increase the frequency of calls and the time available for communication with the family for all users.

Judicial practice and available official statistics indicate that discovering, proving and sanctioning the crime of animal cruelty, i.e. criminal offence of killing and torture of animals prescribed by Paragraph 269 of Criminal Code of the Republic of Serbia seems to be connected with numerous obstacles and complications. This could be considered as one of the circumstances that contribute to the fact that the number of persons accused of or convicted for this criminal offence in Serbia appears to be rather small in comparison to the actual number of committed and reported cases of animal cruelty. Additional concern is caused by the fact that similar misbalance, showing the presence of so-called “dark figure of crime” follows other criminal offences against environment. In attempt to contribute to more efficient suppression of this type of criminality, the author of this paper discusses fundamental features of criminal offence of killing and torture of animals, draws attention to its most frequent forms (including killing of animals by using firearms or other weapons, animal poisoning, animal neglect, animal hoarding, sexual abuse of animals and causing unnecessary fear and distress to animals) and points out the most acceptable ways to provide valid, relevant and complete evidence against their perpetrators. Moreover, the author highlights the most common practical difficulties that might occur while attempting to provide evidence for each of the aforementioned types of animal cruelty and offers possible solutions that would improve the speed, quality and efficiency of evidentiary proceedings in such cases. Kako na javnim mestima i u privatnim domovima, tako i u ustanovama za izvršenje krivičnih sankcija, video nadzor preti da ugrozi pravo na privatnost i stoga mora biti detaljno regulisan, da bi se uspostavio i održavao balans između privatnosti i bezbednosti. Probation and parole are intended as alternatives to incarceration for eligible offenders. In various European jurisdictions research studies indicated the importance of the offenders’ perspective in supervision; however, the contribution of this factor is still unclear and underexplored. In the present study, we explored the offenders’ experience of the supervision process, based upon the experience of 22 convicts. To understand the offenders’ experience, we used the newly constructed tool, Eurobarometer, which measures eight core domains of offender supervision. The pilot study was conducted in Belgrade and was a part of the European Cooperation in Science and Technology initiative (COST) which was implemented in eight European jurisdictions. Results confirmed that the offenders’ perception of supervision can be significant in various domains of offenders’ life and that Eurobarometer can be significant in capturing that experience.

With their roots set deep in the tradition of many different cultures, carrying the mark of social stigma throughout the early ages of modern prison systems development, and finally, becoming fashion accessories inseparable from modern pop culture, tattoos obtain a rather specific meaning if made behind the prison walls. There are several reasons for that: their symbolism, the roles they have inside the prison community, their relation to criminal behaviour, their impact on offender’s re-socialization and re-offending as well as the health risks they cause. Apart from approved or planned poisoning with agricultural purpose, an increase in the number of cases of intentional animal poisoning (primarily referring to cats and dogs) has been detected in Serbia, and it is suspected that their number is significantly larger than the one shown by the official statistics data. Under the conditions prescribed by the Criminal Code of the Republic of Serbia, such activities may represent the crime of killing and torture of animals, but also the crime of causing a general danger. Rastući broj zavisnika od opojnih droga i razorne posledice ovog zdravstvenog, socijalnog i kriminalnog fenomena nameće potrebu za iznalaženjem najefikasnijih načina za njihovo lečenje i socijalnu rein-tegraciju. U slučajevima kada je zavisniku izrečena kazna zatvora i/ili medicinska mera bezbednosti javljaju se dodatni izazovi i problemi. Do-sadašnja praksa terapije uz pomoć životinja (konja i pasa) kao dodatka lečenju bolesti, psihičkih poremećaja i poremećaja ponašanja ukazu-je da taj inovativni metod može biti delotvoran i u procesu lečenja pre-stupnika zavisnih od opojnih droga. Imajući to u vidu, autor analizira postojeće izazove lečenja zavisnika, sa fokusom na one koji spadaju u zatvorsku populaciju, modalitete državne reakcije na ovaj fenomen, kao i mogućnosti i perspektive uključivanja životinja u njihovu terapiju. Po-sebnu pažnju autor posvećuje italijanskom rešenju koje razmatra kao primer dobre prakse uključivanja životinja u tretman prestupnika zavi-snih od opojnih droga i mogući uzor za domaće zakonodavstvo i praksu.

Having in mind climate change as well as the rising risk of potential environmental crisis caused by pollution and unsustainable exploitation of natural resources, the concept of environmental security, primarily defined as the resilience of countries and individuals to the challenges of environmental degradation, is rapidly obtaining the interest of general public and experts from various scientific disciplines. However, it seems that the gender aspect of security in general and particularly of environmental security has not been given the amount of attention it deserves until recently. Thanks to the ecofeminist movement, based on the idea that women are more closely related to nature than men and more vulnerable and susceptible to the negative impacts of environmental degradation (especially those emerging as the consequences of pollution and climate change), the role of women in the improvement of environmental security through participation in decision-making processes in legislation and public policy making is finally being recognised. The aim of this paper is to analyse the modern concept of environmental security as well as the evolution and contemporary discourses within ecofeminist movements and to explain the link between them, i.e., the contribution of ecofeminism to the shift in the approach to environmental security in the sense of taking into consideration the rights and interests of women as more common victims of negative environmental impacts as well as their potentials as relevant stakeholders in this field.

As a complex and expanding global problem, international child abduction causes many legal consequences. Although the Convention on the Civil Aspects of International Child abduction, adopted in 1980, sets the grounds for cooperation of relevant state authorities in order to provide prompt return of the abducted child to the state of his or her habitual residence and protect his or her best interests, numerous other issues such as criminal liability of parents, protection of child's rights and protection of right to family life, arise therein. The authors of this paper highlight different etiological and legal aspects of international child abduction and discuss the link between this phenomenon and other similar offences such as: abduction, human trafficking, trafficking in minors for adoption and domestic violence with special focus on Serbian legislation. The authors also point out the most disputable issues regarding international child abduction in the practice of European Court of Human Rights and key dilemmas in practical implementation of national and international frameworks for its prevention.

Environmental criminal offences include illegal behaviours against the environment and its integral parts: soil, air, water, flora and fauna. Their consequences are devastating and long-lasting, especially if committed by legal entities, particularly by powerful multinational corporations. This type of crime, referred to as corporate environmental crime or green-collar crime results in criminal liability of corporations. However, its organised and often trans-national character, its link with corruption and other types of crime as well as high costs of expert findings often cause numerous issues and challenges regarding its discovering and proving. Having in mind the important role of the public prosecutor in collecting evidence according to current Criminal Procedure Code of the Republic of Serbia, the author analyses the characteristics of environmental corporate crime and the difficulties related to its discovering and proving. Finally, the author suggests that all subjects involved with criminal proceedings, including the public prosecutor, should be more environmentally conscious and take a more active part in the prosecution of the perpetrators of corporate environmental crime.

Offenders' rehabilitation programs that are based upon the interaction with animals have increasingly been receiving the attention of the media and experts from various fields of science (including psychology, sociology, andragogy, penology, criminology and criminal law) due to a multitude of benefits they are capable of providing for: inmates, prison staff, broader community and animals. Resocialization of offenders, decrease in the rates of recidivism, additional incomes for the prisons' budgets and saving abandoned animals are only some of them. Having this in mind, the author of this paper studies key moments in the historical development of the application of animal assisted therapies and programs, key benefits of these programs, the most remarkable example of modern use of these programs in the world and the implementation of animal-assisted program in Serbia in Correctional Institution in Sremska Mitrovica. In the concluding remarks, the author highlights the most important potentials of these programs in crime suppression, explains the need for additional research in this area, and suggests further directions for their evaluation and improvement.

U ovom radu se primenom normativno-pravnog metoda analiziraju normativni okviri Evropske unije kojima je regulisana oblast odlaganja otpada i razmatraju slučajevi izneti pred Sud pravde EU, primenom metoda analize (studije) slučaja, sa ciljem da se doprinese stvaranju slike o njihovoj primeni. Analizirani su pravni okviri EU bitni za odlaganje otpada sa osvrtom na izmene acquis-a u toj sferi of maja 2018. Objašnjeni su funkcionisanje i uloga Suda pravde EU u sprovođenju komunitarnog prava. Prikazani su slučajevi nezakonitog postupanja u oblasti odlaganja otpada na deponije, uključujući i tretman otpadnih voda u kojima je taj sud odlučivao. U zaključku je ukazano na negativne efekte odlaganja otpada na deponije i na potrebu da se oni redukuju intervenisanjem na normativnom i praktičnom planu. Kao rezultat analize normativnof okvira s jedne i sudske prekse s druge strane, uočene su razlike između postupanja država članica, kao i deiskrepanca između normativnog i stvarnog u toj oblasti.

The European Union is the party of key international documents dealing with the issue of climate changes: the United Nations Framework Convention on Climate Change, the Kyoto Protocol and the Paris Agreement. Moreover, the European Union has designed a rich legislative framework dedicated to the prevention of climate changes and the suppression of their negative consequences, including numerous decisions, directives, thematic strategies and action programmes. Their main purpose is to minimise and control the emissions of greenhouse gases, in order to contribute to the minimisation of pollution, increase of energy efficiency and the mitigation of negative consequences of climate changes. The reports on the implementation of the aforementioned documents confirm that the application of the measures prescribed by various sources of acquis in this field has given positive results in the European Union countries. However, they also show that climate changes still represent a serious challenge for the legislators as well as for all the other entities whose activities can contribute to this environmental phenomenon. Having in mind the fact that the Republic of Serbia is anticipating the opening of the Negotiation Chapter 27, dedicated to environment and climate changes, the author of this paper analyses relevant international documents of universal character signed by the European Union, sources of the European Union law that are significant for facing climate change as well as the reports on achieved results when it comes to combating climate change at the European Union level. At the time of intense rising of environmental awareness and increased environmental risks caused by the impact of negative anthropogenic factors, the protection of human right to healthy environment is given more and more attention. The protection of this right is guaranteed by the Constitution, laws and subordinate legislation and, depending on the gravity of its violation or endangerment, it can be achieved in criminal, misdemeanour, civil or administrative procedure. Special role in this belongs to independent institutions such as: Ombudsperson, Commissioner for Information of Public Importance and Personal Data Protection, as well as to the Environment Protection Agency that functions as legal person within the Ministry of Environment Protection. In this paper, the author highlights the importance of providing an adequate, prompt, efficient and comprehensive protection of the right to healthy environment in Serbia, with special focus on the aforementioned institutions and offers recommendations directed towards the improvement of conditions in this field.

Having in mind current significance of the issue of irregular migration in Europe, the author of the paper analyses international documents relevant to the creation of common minimum standards in the area of the right to asylum in the European Union (hereinafter: EU), as well as to the arrangement of the rights and obligations of the states in the cases of readmission. In that sense, the documents adopted by the United Nations, Council of Europe and EU relevant to the questions of asylum and readmission are presented in the paper with special focus on the Directives of the EU in this field. Since the Republic of Serbia is one of the countries that are facing the issue of migrants, asylum seekers and returnees upon the Readmission Agreement, certain amount of attention is also given to its international obligation regarding this matter. Finally, the author of the paper presents recommendations and suggestions for the improvement of current state in this area with the purpose to ensure the protection of the right to asylum as one of fundamental human rights on the one hand, as well as the fulfilment of international obligations derived from the Readmission Agreement on the other.

Through the past several decades, a growing concern for environmental problems among experts, stake-holders, law and public policy-makers as well as general public has encouraged the development of a large and comprehensive legislative framework on the level of the European Union, regulating various ecological issues in the European Union. The risks of environmental pollution and the awareness of the need to provide for efficient, adequate and universal protection of the environment in all European Union member states has led to the adoption of Directive 2008/99/EC on the protection of the environment through criminal law (Official Journal of the European Union, No. 328, 6.12.2008.).The aim of this paper is to analyse the key provisions of this legal instrument, the means of its implementation in national legislations as well as the mechanisms for its effective application. Moreover, the conditions that have to be met in order to facilitate successful transposition of this Directive's provisions through the alterations of the Criminal Code of the Republic of Serbia are also analysed.

The paper highlights key problems of rural development in the context of economic and environmental crisis, with focus on rural areas in Serbia. It emphasizes the link between sustainable rural development and environmental protection, particularly in the fields of organic agriculture, small organic farming and agro-eco tourism. It analyses legislative and strategic documents regulating this issue on universal, European and national level, making suggestions to improve their application. Obstacles for sustainable rural development include: uncultivated agricultural lands, soil pollution, insufficient irrigation or draining, agricultural lands fragmentation, poor infrastructure, inadequate tax policy, uncompleted restitutions, long probate proceedings and financially uncertain position of land-owners. Some of them have environmental impacts and can be resolved by suitable policy and legislation, strategic planning, environmental education and financial stimuli for green agriculture. The paper suggests legislators and policy makers in the areas of: sustainable development, taxes, agriculture, green economy and environment protection to analyse more profoundly key problems of rural development and their linkage to nature conservation. When it comes to practice, it suggests which legal documents should be applied in order to achieve successful, sustainable and environmentally acceptable development of rural areas. The paper contributes to a better understanding of the relationship between sustainable rural development and environment protection, emphasizing the possibility to preserve nature and increase incomes of rural communities through green agriculture, small farm production and eco-tourism. It also states that current legislative framework provides preconditions for resolving the issues that might appear within, suggesting key steps for its future implementation.

Defined extensively as committing ecological criminal offences with the intention to achieve political goals, environmental terrorism is a global threat to environment, human life, safety and health, as well as to the survival of flora and fauna. Environmental terrorism contains the elements of environmental crime and the elements of terrorism, which makes the position of its victims particularly complex. The subject of this paper includes defining environmental terrorism, analysing its phenomenology. Since this form of crime simultaneously harms and endangers environment, material goods, human life, safety and health, flora and fauna, the subject also comprises the study of the specific position of its victims. It is emphasized that long lasting and extensive consequences of ecological criminal offences make it difficult to determine promptly the victims of this form of crime, as well as that its victims are victimized twice: due to terrorist attack and due to negative consequences of ecological criminal offences (such as severe health damage) often emerging after several years. The subject covers the analysis of current international legal mechanisms for the prevention and protection of environmental terrorism victims’  rights, including those dealing with terrorism in general as well as those relevant to the protection of environment from negative anthropogenic factors. Finally, the subject contains a critical analysis of legislative framework of the Republic of Serbia pertinent to the prevention and sanctioning of environmental terrorism, with focus on the provisions of current Criminal Code prescribing ecological criminal offences and terrorism. In order to achieve more precise tracking of the scope and dynamics of environmental terrorism and more adequate sanctioning compatible with its social hazard, the authors propose its incrimination as an independent criminal offence against humanity and other values protected by the international law. The purpose of this paper is to define environmental terrorism, analyse its forms and to examine current mechanisms for the prevention of victimization from environmental terrorism and the protection of its victims’ rights on international and national level. Moreover, the authors seek to contribute to the improvement of the quality of tracking and to the efficiency of prevention of victimization from environmental terrorism in Serbia by suggesting its incrimination as an independent criminal offence.

Ovaj rad govori o složenosti problema i pitanjima pravne zaštite prirodnih i radom stvorenih vrednosti životne sredine − resursa (u funkciji turizma), iskazanoj kroz: 1. uočavanje i definisanje svega što spada pod dotični (grupni) objekt pravnog tretmana, 2. teškoće definisanja minimuma osnovnih elemenata poželjnog ponašanja prema njima, 3. složenost uspostavljanja režima zaštite koju im treba pružiti i 4. otvoreno pitanje na kojim je sve nivoima uputno da se zaštita ostvari: međunarodno-pravnom, državnom, te unutardržavnom iskazanom na regionalnom i lokalnom nivou. Kako bi se postavljeni zadaci ostvarili, neophodno je izabrati i državu koja je adekvatan primer, tj. ostvarive analize u cilju realizacije zadatka našeg istraživanja koje plasiramo kao deo rezultata Projekta 47011 kojim rukovodimo. Takođe, potrebno je i formirati adekvatan metodološki aparat prikupljanja činjenica, induktivnog analiziranja, potonje dedukcije, ali i, sasvim razumljivo, u svetlu primene ekološko-pravnih metoda, pre svega: formalno-normativnog, materijalno-normativnog, te normativno-hijerarhijskog.

Waste disposal is a global challenge, particularly in the context of
environmental pollution prevention and human health protection. That is
the reason why the European Union has been adopting and applying a
series of documents pertinent to this issue. The most relevant are: Directive
2008/98/EC of the European Parliament and of the Council of 19 November
2008 on Waste and Council Directive 1999/31/EC of 26 April 1999 on
the Landfill of Waste. However, the reports of the European Commission
and the practice of the Court of Justice of the European Union confirm
that there are numerous disparities between the Member States regarding
the implementation of standards of waste management in general and in
particular, waste disposal. The Republic of Serbia has to make substantial
improvements in the area of waste disposal, especially in the context of
the upcoming opening of the Negotiation Chapter 27, dedicated to the
environment and climate change. Therefore, the authors analyse legal
sources of the European Union related to waste disposal, reports on their
application and relevant practice of the Court of Justice of the European
Union as potential directions and guidelines.

Konstantno povećavanje količine otpada različitog porekla predstavlja globalni ekološki problem. Razvijenije zemlje, posebno članice Evropske unije, decenijama nastoje da unaprede sisteme upravljanja otpadom kako bi, primenom odgovarajućih postupaka I mera, omogućile iskorišćavanje otpada kao korisnog resursa I osigurale njegovo bezbedno i održivo odlaganje. Zemlje koje prolaze kroz fazu tranzicije u oblasti zaštite životne sredine suočavaju se sa problemom nepropisnog odlaganja otpada, što se negativno odražava i na životnu sredinu i na zdravlje ljudi nastanjenih u blizini divljih deponija. Imajući u vidu nastojanje Srbije da svoje zakonodavstvo i praksu u oblasti zaštite životne sredine uskladi sa evropskim standardima kao I da ispuni međunarodne obaveze u skladu sa Bazelskom konvencijom, autor analizira postojeće stanje u oblasti nepropisnog odlaganja otpada u Srbiji, sa fokusom na divlje deponije, i pravne mehanizme za sankcionisanje te pojave. Nakon ukazivanja na probleme i prepreke ali i pozitivne iskorake u vezi sa tretmanom i odlaganjem otpada u Srbiji, autor iznosi sugestije za njegovo poboljšanje u skladu sa standardima postavljenim u međunarodnim izvorima prava.

Mizogino i seksistički motivisano nasilje prema ženama, koje neretko ima smrtni ishod, predstavlja problem globalnih razmera. Mnogi međunarodni i nacionalni pravni izvori posvećeni su prevenciji i sankcionisanju nasilja prema ženama. Ipak, realnost zahteva preispitivanje postojećih mehanizama kaznenopravne reakcije na njegov najekstremniji i najbrutalniji oblik: femicid. Imajući u vidu učestalost i dalekosežne posledice ovog krivičnog dela i diskriminatorski karakter poruke koju država šalje njegovim tolerisanjem i neadekvatnim kažnjavanjem, autorka nastoji da definiše pojam femicida, predstavi osnovne oblike državne reakcije na femicid u uporednom pravu i analizira odlike femicida kao samostalnog krivičnog dela. Zalažući se za inkriminisanje femicida kao samostalnog krivičnog dela u krivičnom pravu Republike Srbije, autorka ističe da takvo rešenje može doprineti preciznijem praćenju ovog oblika kriminaliteta, boljoj proceni kvaliteta državne reakcije na njega i njegovom efikasnijem suzbijanju.

Zemljište predstavlja jedan od najvažnijih obnovljivih resursa, a njegov dobar kvalitet i održivo korišćenje preduslovi su opstanka brojnih ekosistema na globalnom nivou. Neumerena eksploatacija prirodnih resursa, industrijalizacija i povećanje populacije u gradovima, doprinose porastu zagađenja zemljišta, posebno u urbanim zonama, što se negativno odražava na zdravlje ljudi i životnu sredinu. Zbog toga autor ovog rada sumarno predstavlja trenutno stanje kvaliteta zemljišta u većim gradovima u Srbiji, posebno se fokusirajući na prisustvo zagađujućih materija, i analizira postojeće nacionalne pravne okvire za zaštitu zemljišta od negativnih antropogenih uticaja, uključujući preventivne odredbe, ali i norme kaznenog, odnosno krivičnog i prekršajnog prava. Nastojeći da doprinese unapređenju stanja u ovoj oblasti, autor ukazuje na najvažnija načela u skladu sa kojima bi pravna zaštita zemljišta u Srbiji trebalo da se razvija, predlažući pri tome i određena inovativna rešenja u pogledu inkriminisanja nedozvoljenih ljudskih radnji čije posledice povređuju ili ugrožavaju ovaj eko-medijum.

Kulturna dobra spadaju u takozvane veštačke ili radom stvorene vrednosti životne sredine i izuzetno su podložna destruktivnim uticajima negativnih antropogenih faktora usmerenih ka različitim ekomedijumima poput vazduha, vode i zemljišta. Pravna zaštita kulturnih dobara od zagađenja tesno je povezana sa zaštitom životne sredine uopšte i ostvaruje se na nekoliko nivoa: međunarodnom I nacionalnom, krivičnopravnom i prekršajnopravnom, zakonskom I podzakonskom, u okviru ekološkog zakonodavstva i u okviru drugih grana prava. U skladu sa tim, kao predmet ovog rada razmotreni su pravni okviri od neposrednog i posrednog značaja za zaštitu kulturnih dobara od zagađenja kako na globalnom nivou tako i u okviru granica Republike Srbije. Takođe, ukazano je na određene nedostatke postojećih domaćih rešenja sa ciljem iniciranja njihovih eventualnih izmena i poboljšanja u skladu sa svetskim trendovima u oblasti zaštite životne sredine i kulturnog nasleđa, kao i sa obavezama proisteklim iz ratifikovanih međunarodnih dokumenata i procesa evropskih integracija.

Nagorno-Karabakh represents a disputable issue in politics and international public law. Like other entities floating between autonomy within a sovereign state and fully confirmed independence, it triggers numerous questions regarding sovereignty, territorial integrity, right to self-determination, secessionism and separatism. Current position of Nagorno-Karabakh cannot be fully comprehended without a detailed insight into historical and political courses that shaped its evolution. Therefore, the authors attempt to highlight the most important and influential historical events and circumstances that had been affecting the South Caucasus region, to explain their repercussions on today’s tatus of Nagorno-Karabakh and, based upon them, estimate future development of this entity’s position in international relations.

Appropriate health care and adequate medical treatment of prisoners with health issues and intensive rehabilitation of drug and alcohol addicts during the execution of prison sentence may be considered one of the factors that contribute to their successful re-socialisation. Social reintegration of former prisoners, particularly through their reintroduction to the labour market is perceived as a powerful means to reduce recidivism and, hence, protect the society from crime. However, that goal cannot be achieved if their physical or mental health is harmed. Managing to preserve physical and mental health in spite of being exposed to numerous prison deprivations, represents a precondition got re-entering regular life courses in post release period, such as: initiating or proceeding education or professional training, entering or returning to the labour market, finding and keeping a job as a legal source of income and becoming a useful member of the community. Apart from being one of fundamental human rights, the fact that it represents a precondition for successful social reintegration is also the reason why prisoners’ health and minimal standards regarding their medical care are prescribed by various legal documents of national and international character and monitored by competent entities including independent bodies such as ombudsperson and non-governmental organisations. Being aware of the importance of the implementation of national and international prisoner’s health care standards for both - human rights protection and crime prevention, the authors briefly analyse legal documents regulating this issue and critically examine current conditions in Serbian prisons pertinent to the fulfilment of minimal health care requirements, treatments available for prisoners with HIV or hepatitis and rehabilitation programs for drug and alcohol abusers and, finally, give suggestions for the improvement of the existing situation.
