Already in late Christian antiquity, the right of asylum was presented with a characteristic common to the institution throughout its legal history and which is also present in the current law, that is, the fact of being a law that is constantly “evolving”, as can be inferred from the case we are going to study, on the one hand, because of the juridical answer that the Roman and Byzantine political authorities were able to articulate on the basis of the economic, social and political problems of each time, and, on the other hand, because of the fact that the subsequent regulation should not necessarily be considered as positive, if we understand as such the fact that it improves the previous one; unfortunately, we will see that this law with its permanently mutable character, its evolution according to the conjunctures, can also include elements that are a step backwards in the recognition and the exercise of it.

Following a brief introduction, this paper will then focus on Cyprian’s comments regarding the behaviour of Virgins in De Habitu Virginum. Cyprian of Carthage argues with the adulterium, a category of Roman criminal law which was particularly important in contemporary society, in order to justify the requirement for Virgins to adopt a way of life and behaviour that would be described today as ‘well-behaved and discreet’. The paper aims to make a comment of the Ordinances of the Consulate of Bilbao of 1737. Bilbao's Ordinances were supplementary law for the resolution of disputes of the Consulates that were established in some Latin American Cities by the end of the 18 th century. This made it posible that legal customs, initially rhodian-romans, received in the spanish maritie practiced law during all the Middle Ages in the Atlantic área, were applied in Latin American's Consulates.

Abstract: Already in late Christian antiquity, the right of asylum was presented with a characteristic common to the institution throughout its legal history and which is also present in the current law, that is, the fact of being a law that is constantly "evolving", as can be inferred from the case we are going to study, on the one hand, because of the juridical answer that the Roman and Byzantine political authorities were able to articulate on the basis of the economic, social and political problems of each time, and, on the other hand, because of the fact that the subsequent regulation should not necessarily be considered as positive, if we understand as such the fact that it improves the previous one; unfortunately, we will see that this law with its permanently mutable character, its evolution according to the conjunctures, can also include elements that are a step backwards in the recognition and the exercise of it.
