Eurasia (Cáucaso, Mar Caspio y Asia Central) es un vínculo natural conectando Europa y China en temas comerciales, logísticos, energéticos y de transporte, evitando Rusia, Irán y sanciones. Por más de 25 años, el estatuto legal del Mar Caspio permaneció irresoluto. En 2018, los cinco países ribereños del Mar Caspio adoptaron la Convención sobre el Estatuto Jurídico del Mar Caspio. La Convención se apoya fuertemente en derecho marítimo, evita definir si el Mar Caspio es un lago o un mar, y estipula que, es una cuenca endorreica establecida en mapas específicos. La Convención es pragmática, para conjuntamente explotar recursos submarinos [de hidrocarburos] y colocar ductos sin demarcación fronteriza, permitiendo restricciones ambientales.

The Caspian Sea is an important source of oil for the world, particularly Europe. However, the landlocked area was surrounded by neighbors who were commercial rivals and possessed major regional access routes. Examination of Eurasian oil pipelines evidences two large regions: Northern European and Mediterranean European systems involved in competition and collaboration in close quarters with competition and confrontation to reach the European markets from the Caspian Sea sources. With the demise of the Soviet Union, and driven by EU and US interests, as well as counting on their support, the Caspian region broke the Russian oil monopoly in less than a decade.

One result is unblemished: Azerbaijan is now a key player in the Silk Road region—a keystone state in a part of the world that is critical to the advancement of the connectivity ambitions of most if not all of the world’s major powers. The North-South Transport Corridor (NSTC) is regional interest not only for Russia and Iran, but for all involved in East (China)-West (Europe) trade. This 7,200 km. long railroad has long been on the drawing board. As with any grand connectivity project, it started as a far-fetched dream to connect Northern Europe with India via a land corridor crossing Russia, Azerbaijan, and Iran—and eventually as a counterbalance to the East-West transport corridor (generally referred to as the Middle Corridor).
In logistics terms, some could say NSTC is linking the extremes of the Silk Road region with one railroad, bypassing large swaths of oceans with a cheaper and faster route.

In today's geopolitical world, full of images, symbolisms, and displays of effecting power, one meeting, with coffee, on the sidelines of the most recent General Debate of the UN General Assembly adumbrates what could be seen as auguring a new era—not only for the Silk Road region but for the world, with very important adaptations to come. The C5+1 Upgrade seems to signal, after 30 years, a renewed U.S. interest in Central Asia and the Caucasus. One would expect, if there is a veritable commitment, to have further meetings at the Presidential level, and even a visit to the region.

The Silk Road region serves as a land conduit between East (China) and West (Europe). This is evidence with oil and gas pipelines from the Caspian to Europe, and recently with transport corridors, including the Trans-Caspian International Transport Rout (TITR) also called the Middle Corridor. The Caspian Sea and the Black Sea are two choke points in the land route but they also work in tandem. This is the first of a series dealing with such possibilities.

Analysis of oil pipelines laid in Eurasia evidence Caspian Sea states broke Russia’s oil monopoly in the Caspian Sea in a span of less than a decade —namely Azerbaijan and Kazakhstan. While Baku-Novorossiysk Pipeline maintained Russia’s position while transporting Azerbaijani Caspian oil, the first fissure occurred in 1998 with Baku-Supsa Pipeline and the opening up of rail routes from Baku to Batumi and Supsa. A second took place when Caspian Pipeline Consortium opened in 2001, carrying Kazakhstani oil to the Black Sea via Russia. The third came about in 2006, with Baku-Tbilisi-Ceyhan finally breaking Russia’s monopoly and bypassing the Bosporus-Dardanelles bottleneck. Kazakhstan and Azerbaijan are developing trans-Caspian oil shipping from Aktau to BTC, that in 2016 was 80% fulfilled—and committed to building a trans-Caspian pipeline. These routes provide the Silk Road region with competitive and diverse routes that undermine Russia’s position. ========

Eurasia (Caucasus, Caspian Sea and Central Asia) is a natural link connecting Europe and China, in commercial, logistics, transport and energetic issues, while avoiding Russia, Iran and sanctions. For over twenty-five years, the legal definition of the Caspian Sea remained unresolved. In 2018, the five riparian Caspian Sea states adopted the Convention on the Legal Status of the Caspian Sea.The Convention draws heavily from maritime law, yet avoids defining the Caspian Sea as a sea or a lake and stipulates it as an endorheic basin in specific charts. The Convention is pragmatic, to jointly exploit subsoil [hydrocarbon] resources and lay pipelines without demarcation mechanisms, yet enabling possible restrictions on account of environmental issues.

Repetidas veces –y muchas veces en forma irreflexiva– se ha dicho que la constitución es suprema y que de ella deriva todo el aparato jurídico de la nación. Pero, ¿qué ocurriría si no contuviera todos los derechos humanos? En otras palabras, ¿pueden existir vacíos jurídicos en la constitución? ¿Podrían lesionar a la persona? La normatividad internacional, en particular los tratados de derechos humanos, reconocen derechos como los recogidos en la constitución –y otros diversos.
La obra destaca acuciantes vacíos constitucionales, incluyendo el derecho a la vida –que la constitución mexicana incluso previó suspender. Plantea que constitución y tratados –junto con las leyes generales del Congreso de la Unión (conforme al artículo 133 constitucional)– integran un corpus iuris que sin jerarquías preestablecidas permite mutua y recíprocamente subsanar vacíos jurídicos; todo en beneficio de la persona.
Asumir que las normas existen para el mayor beneficio de la persona, avizora riesgosas sendas para proteger a la persona y que concluirán en desdeificar a la constitución.

RESUMEN: El moderno sistema jurídico mexicano nació el 11 de junio de 2011, fecha en que entró en vigor la reforma constitucional en materia de derechos humanos. Nuestro sistema jurídico tiene ahora que enfrentar un nuevo paradigma jurídico nacional integrado por la constitución política y los derechos humanos. Toca al foro mexicano —sociedad y gobierno, es decir, la totalidad del Estado— hacer realidad dicho paradigma enmedio de las múltiples avenidas que ofrece. No basta que el texto constitucional exprese estos derechos. Es menester hacerlos realidad.

El autor propone la reforma constitucional "mínima" para lograr la efectiva aplicación de los derechos hu-manos en México. Señala que si bien, conforme al artículo 133 constitucional, los tratados son parte de la "Ley Supre-ma de toda la Unión" y no habría necesidad de incorporar los derechos humanos reconocidos en los tratados ratificados por México, propone incluir una breve frase en dos artículos constitucionales para expresamente reconocer a nivel constitucional la vigencia de dichos derechos humanos y otorgar competencia a los tribunales mexicanos. Al efecto, y para estudiar la práctica internacional, el autor recurre a la legislación de diversos Estados, así como a lo dispuesto en tratados bilaterales y multilaterales de extradición. Esto hace patente las tensiones, en materia de extradición, que llegan a existir entre Estados que contemplan la prisión vitalicia y aquéllos que la prohíben expresamente o que en los hechos no la aplican por fijar términos máximos de prisión.

Los argumentos en contra de la extradición defienden la visión de que los nacionales estarán en desventaja en tribunales extranjeros o que otros sistemas jurídicos no aseguran que exista un juicio justo. Los países del common law están más dispuestos a extraditar a sus nacionales, mientras que los países del civil law sólo admitirán la extradición de sus nacionales en circunstancias excepcionales. Desde 1995 la política mexicana ha sido profundamente revisada, y el principio de aut dedere aut judicare en el tratado en vigor ha favorecido el castigo de presuntos criminales aunque no sean extraditados. La Suprema Corte de Justicia de México ha fallado para resolver una contradicción entre tribunales de menor jerarquía respecto de la facultad del Ejecutivo de extraditar a nacionales mexicanos. La solución, que el autor explica, es que el Código Penal mexicano no impide al Ejecutivo extraditar nacionales, sino que se aplica el artículo 9.1 del tratado en vigor.

RESUMEN: El autor analiza, a través de la práctica internacional, la situación de la prisión vitalicia en el mundo y muestra que no existe un concepto uniforme de dicha pena ni un tratamiento homogéneo sobre el tema. Al efecto, y para estudiar la práctica internacional, el autor recurre a la legislación de diversos Estados, así como a lo dispuesto en tratados bilaterales y multilaterales de extradición. Esto hace patente las tensiones, en materia de extradición, que llegan a existir entre Estados que contemplan la prisión vitalicia y aqué-llos que la prohíben expresamente o que en los hechos no la aplican por fijar términos máximos de prisión. ABSTRACT: The author analyzes the current situation of life imprisonment in the world through international practice and shows that no uniform concept exists on this sanction nor is there a homogeneous practice on the issue. For these purposes, the author refers to international practice as evidenced through national legislation of several States as well as the provisions in bilateral and multilateral extradition treaties. This evidences the tensions that may exist on extradition issues between States that allow life imprisonment and those who expressly prohibit it or that in fact do not apply it by setting maximum prison terms. RÉSUMÉ: L'auteur analyse au travers de la pratique international, la situation de la prison viagère dans le monde et montre qui n'existe pas un concept uniforme de cette peine, même pas un traitement homogène international. Pour ces buts et pour étudier la pratique international, l'auteur recours á la législation des différent États et aussi aux dispositions dans les traités bilatéraux et multilatéraux d'extradition. Ca montre, en matière d'extradition, les tensions qui peuvent exister entre les États qui considère la prison viagère et ceux-là qui la prohibent expressément ou que dans les actes ne la ap-plique pas pour déterminer des termes maximes de prison.
